A firm, Star Properties Limited, has urged the Lagos State High Court to interpret a 1958 lease agreement on a five-storey property on 3, Ganiyu Smith Road, Lagos Island.
It wants the court to interpret the agreement between Regina Omoloto and Marooun Daakour, as well as declarations on notice to quit and letters served on the applicant by the first interested party, Adediran Thomas.
The late Olabisi Thomas and the Adeyemi Wright are the respondents in the suit numbered LD/1989GCM/17.
The applicant served the originating summons on the counsel to the interested parties who had been sending correspondence to the firm before the suit was instituted.
Adediran Thomas and Mrs. Oyinkansola Obasi (nee Thomas), who have been administering the Estate of Regina Omoloto Wright since May 2015, are the interested parties.
Star Properties said it possessed the property in 1967. It is a five-storey building (excluding basement/car park) refurbished with a glass front exterior used for commercial/business purposes.
It is located directly opposite St Nicholas Hospital and a short walk to King’s College, the High Court and Holy Cross Catholic Cathedral.
The interested parties, by a preliminary objection, are urging the court to strike out the suit because the respondents on record died eight and 26 years ago.
They contended that those sued were, therefore, not competent respondents.
The case will come up on May 27.
