A Makurdi High Court presided over by Justice Elizabeth Kpojime yesterday said it would halt proceedings in the suit by suspended lawmaker Kester Kyenge pending determination of an appeal by counsel to the defendants, Fidelis Mnyim.
Mnyim approached the Appeal Court to challenge the decision of the High Court, which granted a motion to amend the originating summons by counsel to the plaintiff, Da’Agba, which he argued was defective and could not be amended through a motion.
Following this development, Mnyim filed a motion to halt proceedings to allow the determination of the appeal pending at the Makurdi Division of the Court of Appeal.
When the case came up yesterday for ruling, Justice Kpojime, upheld the motion, saying the court would halt proceedings pending outcome of the appeal.
The ruling is viewed as a major setback for Kyenge, who has been on a five-month suspension since July, and trying to upturn the suspension through judicial process.
