A Federal High Court, Abuja, has dismissed a dual citizenship suit by some Accord chieftains against Senator Monsurat Sunmonu.
Justice Nnamdi Dimgba upheld the preliminary objection by Sunmonu’s lawyers that the issue had been trashed at the Election Petition Tribunal and the Court of Appeal.
He held that because both the tribunal and Appeal Court definitively decided the issue, it amounted to Res Judicata and the issues could not be re-litigated.
Justice Dimgba quoted the portions of the tribunal judgments where pronouncements were made, adding that his court would not be used as a conduit for vexatious, frivolous and baseless matters.
The judge said although the preliminary objection succeeded, even if he was to determine the case he would have dismissed the matter.
