Fresh applications stall Abia APC’s legal tussle

The legal battle for the soul of All Progressives Congress (APC) in Abia State has been adjourned till May 3 for pre-hearing by Justice C. U. Okoroafor.

Speaking with reporters at Umuoba, the Abia APC Legal adviser, Somadila Uzodinma, said an application was brought by counsel to Donatus Nwankpa asking the court to set aside the case.

Uzodinma said another application was brought by counsel to Sunday Ogbonnaya and two others asking to be joined.

However, counsel to Fabian Nwankwo and two others, who brought the case before the court, G. I. Chionye refused the applications.

Abia APC legal adviser said the judge gave counsel seven days for parties to be served all applications.

Uzodinma noted that the authentic Abia APC chairman remains Dr Emmanuel Aguzie Ndukwe till the substantive suit is determined.

On March 8, the court ruled that Donatus Nwankpa and his executive should stop parading as leaders of the party.

The order was brought before the court by Fabian Okonkwo, Chris Okpechi and Onyebuchi Igodo against APC, Chief John Odigie-Oyegun, Donatus Nwankpa and three others.

The order asked APC, Odigie-Oyegun, Alh. Mai Mala Bunu and Dr Muz Banire to stop dealing with the Nwankpa and Menyechi Onuoha and other members pending the hearing and determination of the substantive suit.

The order said: “The first to fourth respondents are restrained from dealing with the factional list of state, LGA and ward delegates sent to the national secretariat of the APC in Abuja by Nwankpa led state Exco in any manner until the substantive suit is determined.”
