Expert to ECOWAS: resolve Niger crisis with diplomatic engagement

A security expert, Amb. Abayomi Mumuni, has urged the Economic Community of West African States (ECOWAS) to use diplomatic engagement and communications to resolve the ongoing crisis rocking the Republic of Niger.

He said ECOWAS must intensify efforts to secure release of ousted President Mohamed Bazoum rather than military intervention.

Bazoum has been held hostage following military takeover of Niger Republic on July 26.

ECOWAS, chaired by President Bola Ahmed Tinubu, described the coup as unacceptable, giving the junta a deadline to restore democratic rule.

A statement by Mumuni’s media aide, Rasheed Abubakar, maintained war is not solution to the problem, saying Tinubu should not be provoked to settle for military intervention which it’s outcome may be brutal.

The counter-terrorism expert from the Certified Counter-Terrorism Practitioner Network, UK said: “The first thing that should have been on the priority list of ECOWAS when the coup was announced is securing the release of President Mohamed Bazoum. And this should be done through robust diplomatic engagements and persuasive communications.”

“War or military intervention is not the answer. I think ECOWAS can do better to manage the crisis rather than setting for war whose consequence would be untold and brutal.

“Therefore, the ECOWAS chieftains should intensify diplomatic engagements and persuasive communications with the junta. They should not be deterred by the fact that the last diplomatic engagement failed.

“In all of these crises, the life of the ousted president is most precious. He should come out alive first. Any declaration of war may see him killed, which would defeat the essence of the whole thing. Bazoum’s release should top the priorities of ECOWAS. They should do more and continue to press for his release by the junta.”

The counter-terrorism and intelligence specialist further said that younger military chiefs and generals should be made to lead the ECOWAS mission.

According to him: “These officers, especially from Francophone countries, would be able to speak to the junta in the language they understand and hopefully broker peace and the release of the ousted president. The junta are of the younger generation and they would get along with people of their generation.

“President Tinubu should resist temptations to deploy ECOWAS troops to Niger. He should not be surprised if other Francophone nations in the association later pitch their tents with Niger if War were to break out. We have quite different orientations. They were colonised by France and Nigeria was a British colony.

“Though our military establishment is fierce and strong in the African community, it has been overstretched by internal terrorism. We shouldn’t add more burden with the Niger crisis that effective diplomatic engagements and strategies can solve.”

“Right now, the Western gladiators are seeing this as another opportunity to see Africa go into war against itself. We must never allow that happen.”

    BBNaija’s Tacha threatens ‘war’ if..

Reality TV star Tacha has cried foul while threatening war if organisers of the BBNaija show fail to apologise to her in the next couple of hours.

The former “Pepper Dem” housemate ranted after Ilebaye got issued two strikes instead of an outright disqualification like many anticipated following her violent behaviour towards colleagues, CeeC and Doyin.

Ilebaye, after their Saturday night party, pulled CeeC prompting them to almost get physical after the latter interfered in her dispute with Doyin.

Ilebaye didn’t stop there, she also exchanged words with the now-evicted Princess, who teased her, and Doyin, who she grabbed by the neck when Biggie summoned her into the diary room.

Many expected she would be disqualified from the show but that wasn’t the case, causing an uproar on social media with previous season’s participant like Tacha who was disqualified over her altercation with Mercy Eke, threatening fire and brimstone for the supposed bias shown by Biggie.

Tacha insinuating favouritism on the part of Biggie towards Ilebaye swore to begin a war if she wasn’t offered an apology before the next day.

The ‘Titans’ queen also opined the show’s organisers were a “bunch of jokers”.

  • Appeal Court restores Federal Govt’s power to register marriages

Appeal Court restores Federal Govt’s power to register marriages

The Court of Appeal sitting in Lagos has held that the Federal Government and Local Government Councils have the legal authority to celebrate, contract, and register marriages between prospective couples.

The appellate court, in two decisions, overturned the December 8, 2021 judgment of the Federal High Court in Lagos which barred the Federal Government from further registering marriages contracted or celebrated under the Marriage Act, 2004 in some local Government Council Areas in the country.

A three-man panel of the court comprising Justice Jimi Olukayode Bada (presiding), Justice Abubakar Sadiq Umar and Justice Fredrick Eziakpono Oho unanimously held that no single organ of government has the exclusive authority to contract and celebrate marriages between a prospective couple.

The Federal High Court had, in the 2021 judgment by Justice Daniel Osiagor, restrained the Minister of Interior and/or either by his privies, agents or delegates from further registering marriages contracted or celebrated under the Marriage Act, 2004 within the Plaintiffs’ Local Government Councils Area.

The judge made the decision in a suit jointly filed by Eti-Osa Local Government, Lagos State; Egbor Local Government, Edo State; Owerri Municipal Local Government, Imo State; and Port-Harcourt City Local Government; against the Minister of Interior, the Attorney General of the Federation (AGF), and Anchor Dataware Solution Limited.

The lower court granted reliefs 1, 2, 3 and 4 as endorsed on the amended originating summons while it refused reliefs 5 and 6. Relief 7 was granted in part.

Dissatisfied, the Appellant (Minster of Interior) in a Notice of Appeal marked CA/LAG/CV/566/2022 prayed the Appeal Court to determine two issues:

“Whether the lower court was right when it held that the plea of the doctrine of res judicata is inapplicable to the 1st to 4th Respondents’ action.

“Whether the learned trial Judge was right when it granted the reliefs sought by the 1st to 4th Respondent and found that the Judgment in Suit No: FHC/870/2002 granted exclusive rights to the 1st – 4th Respondents and other Local Governments in Nigeria to conduct, celebrate and register marriages within their local government’’.

The AGF also filed another appeal challenging the lower court’s decision. This appeal was marked CA/LAG/CV/968/2022.

Resolving the issues, the appellate court in two judgments delivered on Wednesday, August 2, 2023, held that the lower court was wrong in granting reliefs 1 – 4 of the reliefs sought by the 1st to 4th Respondents and granting reliefs 7 as endorsed on the amended originating summons in part.

Justice Abubakar Umar, who read the lead judgment in the first appeal by the Minister of Interior, held that both the Appellant and the Respondents had the vires to celebrate, contract, and register marriages between

However, Justice Umar stated that the lower court was correct in refusing reliefs 5 and 6 as endorsed on the Respondents’ amended originating summons.

On why the lower court was wrong when it restrained the federal government from further registering marriages, the appellate court held: “I have found supra in this Judgment that the decision in Suit No: FHC/L/870/2002 which the Cross-Appellants have predicated their action on, does not in any manner whatsoever grant exclusive rights to the Cross-Appellants to conduct or celebrate marriages within the local government council.

“On the contrary, the court in Suit No: FHC/L/870/2002 highlighted the various fora for the conduct and celebration of marriages.

“The court identified the lawful bodies or authorities vested with the powers to celebrate and contract marriages for intending persons and recognized the marriage districts/local government council, and marriages conducted under the license granted by the Director-General Ministry of Internal Affairs, Director-General of a State Government in charge of marriages and the Minister of Internal Affairs.

‘’The simple implication of the decision in Suit No: FHC/L/870/2002 is that no one organ of government has the exclusive preserve of contracting and celebrating marriages between a prospective couple.

“I am therefore of the considered view that the restriction imposed by the lower court directing the 1st Cross Respondent to only conduct, celebrate and contract marriages in the marriage registries situate at Ikoyi, Lagos and Federal Capital Territory Abuja is wrong and erroneous…

“Having found that the reliefs 1-4 ought not to have been granted by the lower court, it follows therefore that reliefs 5 and 6 being ancillary must fail as a matter of course.

“It is the law that where a principal relief fails, all reliefs ancillary or depend thereto will fail.

“Accordingly, the Judgment of the lower Court delivered on the 8th day of December 2021 in Suit No: FHC/L/CS/816/2018 succeeds and fails in part. Parties should bear their respective cost’’.

  • Why Maryam Shetty was withdrawn as ministerial nominee – Ganduje

Why Maryam Shetty was withdrawn as ministerial nominee – Ganduje

The National Chairman of the All Progressives Congress (APC) Abdullahi Ganduje has explained what led to the withdrawal of Maryam Shetty as a ministerial nominee.

Shetty’s nomination was withdrawn while awaiting her screening by the Senate last week.

The Nation reports she was replaced with Dr. Mariya Mahmoud.

Speaking in an interview on Freedom Radio monitored by The Nation, Ganduje alleged that Maryam Shetty’s name was “smuggled” into the ministerial list.

Ganduje however assured that she would be considered for another appointment.

He said: “In the process of appointing ministers, the president has people who will advise him from different states. Also, it is the prerogative of the president to appoint whoever he deems fit as minister.

“He also has the right to consult people from the state, because they are the ones who know the people who are fit to occupy such office.

“But what happened in this case is that we were not consulted. So we just heard her name on air. Initially, we didn’t complain, taking into consideration that Mr President has the right to appoint anyone. And as loyalists of the president who understand democracy, we accepted his choice.

“But again, we don’t know her, and since we don’t know her, we can’t vouch for her competency for the job.

“Also, the President’s attention was drawn to the social media reactions that followed her nomination. Sometimes people take actions, thinking they won’t be caught. But you will be surprised that all your actions are in the public domain. That’s what happened in this case.

“The reactions became so intense, and people were questioning her competency, and worthiness to represent Kano State.

Read Also: Ganduje will take APC to next level, says Akpabio

“These concerns were not raised by Ganduje, but the masses. The president was also shown the social media reactions, and he sought my opinion.

“Clearly, I told him, I don’t know who she is. He asked if there was a need to replace her, and I answered in the affirmative.

“Because these kinds of positions need someone with integrity, the person must also understand the job, and thirdly, what role did the person play in the formation of the government.

“So if you look at these qualities, we were the ones that needed to be consulted for any appointments coming from Kano State.

“Even though I don’t know all the competent people from Kano, at least our advice needs to be sought when people make recommendations, but that didn’t happen in this case.

“So the president gave us the opportunity to make a replacement with the emphasis that it must be a woman. After consultation with critical stakeholders, we settled for the new nominee, Dr. Mariya Mahmoud Bunkure. From hearing the name, Bunkure, You know where she hailed from.”
