    INEC shifts Enugu East senatorial poll to Mar 11

    The Independent National Electoral Commission (INEC) has rescheduled the Enugu East senatorial elecrion in accordance with the provisions of the Electoral Act 2022.

    The election was shifted following the death of the candidate of the Labour Party(LP) who was allegedly murdered by gunmen.

    Speaking at a daily media briefing by the commission ahead of Saturday’s election, INEC Chairman, Prof. Mahmood Yakubu said the exercise will hold with the Governorship and Assembly elections on March 11.

    He said: “I can confirm that we have now received a formal communication from the party informing the Commission of the death of its candidate for Enugu East Senatorial District. The party also conveyed its intention to participate in the election for that constituency by replacing its deceased candidate. This request is in line with the provision of the law.

    “For clarity, I wish to quote verbatim the provision of Section 34(1) of the Electoral Act 2022 as follows: If, after the time for the delivery of nomination paper and before the commencement of the poll, a nominated candidate dies, the Chief National Electoral Commissioner shall, being satisfied of the fact of the death, countermand the poll in which the deceased candidate was to participate and the Commission shall appoint some other convenient date for the election within 14 days.

    “The Labour Party has provided satisfactory evidence of the death of its candidate. Consequently, the Commission has suspended the election in the senatorial district as provided by Law.

    “We have already communicated this decision to our Enugu State office. Therefore, there will be no senatorial election in Enugu East Senatorial District made up of six Local Government Areas, 77 Wards and 1,630 Polling Units.

    “The election will now be combined with the Governorship and State Assembly elections holding in the next two weeks on 11th March 2023. Materials already delivered for the senatorial election will remain in the custody of the Central Bank in the State until the new date for election”.

    He explained that as a result of the postponement of the election, all parties taking part in the Senatorial election can resume their campaigns which must close 24 hours to election day.

    He also said that the Labour Party is expected to conduct its primary for the senatorial district within the next seven days and submit the name of candidate to the commission.

    The Troops of 1 Division Nigerian Army and Air Component of Operation Whirl Punch have neutralised five bandits and recovered 10 motorcycles in Kaduna State.

    The Deputy Director Army Public Relations, 1 Division Nigerian Army, Lieutenant Colonel Musa Yahaya, confirmed the development.

    Yahya, in a statement on Friday in Kaduna, said the operation was conducted to create a conducive environment for peaceful and successful general election and deny bandits freedom of action in 1 Division Area of Responsibility.

    He said: “The highly motivated troops of 1 Division Nigerian Army and Air Component of Operation Whirl Punch dealt heavy blow on bandits and other criminal elements in Kaduna state.

    “In the very aggressive fighting patrol that lasted over 48 hours, the troops successfully cleared Mando-Sabon Birni-Maidaro -Dogon Dawa, Galadimawa, Saulawa, Farin Ruwa and Polewire villages in Birnin Gawri and Chikun Local Government Areas in the state.

    “During the patrol, troops neutralized five bandits and recovered 10 motorcycles from the bandits while several other motorcycles were burnt and destroyed.

    “Other items recovered by the troops included two AK 47 rifles, five Improvised Explosive Devices, two mobile phones, bandits uniforms and magazines.”

    Yahaya said the General Officer Commanding 1 Division Nigerian Army, Major General Taoreed Lagbaja, expressed satisfaction with the conduct of the troops during the operation and commended them for their gallantry and resilience.

    “The GOC charged the troops not to relent until banditry, kidnapping, terrorism and all other crimes are brought to an end,” Yahaya said.

    Popular content creator Amarachi Amusi aka Ashmusy has claimed that she declined an offer of N20 million to endorse a particular politician for Saturday’s presidential election.

    The skit maker, who was recently accused with her colleague, Nonraj of having an affair with Dino Melaye, said this in an Instagram post.

    She said she was approached to make a political post in support of a candidate she and many others don’t want.

    Ashmusy confessed the offer was tempting albeit she rejected it because it would mean selling her soul to the devil.

    A federal judge in Chicago, the United States of America has sentenced American singer, R. Kelly, to 20 years in prison for child s3x crimes.

    The latest judgment was handed to him after a jury found that he had produced three videos of himself s3xually molesting his 14-year-old goddaughter.

    The judge ruled that all but one year of the prison sentence would be served at the same time alongside a previous 30-year sentence that the embattled received after a jury in Brooklyn convicted him of racketeering and s3x trafficking charges in 2022.

    The jury in Chicago convicted him of six of the 13 charges brought against him in line with s3xual exploitation during the 1990s, including counts of forcing three minors into s3xual activity and producing s3x tapes involving a minor.

    However, R. Kelly was acquitted of a charge that he had attempted to impede an earlier investigation into his abuse of the goddaughter, and two other counts of enticing minors to have sex.

    Federal prosecutors had argued that the 56-year-old ‘Ignition’ singer deserved 25 years imprisonment in addition to his earlier sentence, citing the singer’s “lack of remorse” as a reason he would pose a danger to society if released.

    EFCC intercepts N32.4m for vote buying

    The Economic and Financial Crimes Commission (EFCC) has intercepted N32. 4million allegedly meant for vote buying.

    It said the suspect was already undergoing interrogation.

    It urged all staff deployed in for election monitoring duties to show courage and not bow to unscrupulous elements.

    A statement by the Head of Media and Publicity of the commission, Wilson Uwujaren, said tactical teams have been sent to the 36 states and the Federal Capital Territory.

    The statement reads “The massive operation by the Economic and Financial Crimes Commission (EFCC) to deter vote trading and other financial malfeasance ahead of tomorrow’s presidential and National Assembly elections may have begun paying dividends with the interception in Lagos of N32, 400,000 allegedly suspected to be used for vote buying in Lagos.
    “The recovery was made by operatives of the Lagos Zonal Command of the commission. The suspect involved has been taken into custody for further questioning.

    ” The Chairman of the commission, Abdulrasheed Bawa has implored all personnel deployed for election monitoring duties to show courage and not give room for unscrupulous persons to undermine the integrity of the elections through financial inducement.

    ” Tactical teams of operatives are currently on ground in all the states of the federation and the FCT.

    ” Telephone hotlines have already been circulated through social media for members of the public to share information regarding financial malpractices with agents of the Commission. Details of the number are available on EFCC social media platforms.

    ” Members of the public are encouraged to report anyone trying to buy or sell votes by making use of the EFCC financial crimes reporting App, Eagle Eye, which is available for download on the Google Play or Apple store.

    ” They can also reach the Commission through our social media handle, @officialefcc or by email, info@efcc.gov.ng.”

    JUST IN: Appeal Court rejects Abba Kyari’s request for bail

    The Court of Appeal in Abuja has dismissed an appeal by suspended DCP Abba Kyari in which he sought the reversal of an earlier ruling of a Federal High Court in Abuja refusing his request for bail.

    In a judgment a moment ago, Justice Stephen Adah, who read the unanimous judgment of a three-member panel, held that Kyari’s appeal was without merit.

    Justice Adah held that in view of the nature of the charges pending against Kyari and others before the trial court, such request for bail needed to be handled with caution.

    He held that Justice Emeka Nwite of the Federal High Court, Abuja, who earlier rejected bail to Kyari, appropriately exercised his discretion in refusing to grant Kyari bail.

    The National Drug Law Enforcement Agency (NDLEA) is prosecuting Kyari, a former head of the Intelligence Response Team (IRT) of the Nigeria Police Force, and four members of the IRT – ACP Sunday J. Ubua, ASP Bawa James, Inspector Simon Agirgba and Inspector John Nuhu – before a Federal High Court in Abuja.

    Kyari and others are charged with with conspiracy to deal in 17.55kg of cocaine; dealing in cocaine without lawful authority; conspiracy to tamper with cocaine and unlawfully tampering with the 21.35kg of cocaine seized from two convicted drug dealers.

    Kyari also charged alone with attempting to obstruct officials of the NDLEA in the conduct of their activities by offering them bribe.

    The Labour Party has called for the postponement of Saturday’s general elections in Ondo State over absence of its logo in the ballot papers.

    It said its logo was missing in the ballot papers to be used for elections into Ondo Central Senatorial District and five House of Representative seats.

    The House of Representatives seat where its logo were missing were Akoko Southwest/Akoko Southeast, Ondo East/Ondo West, Akure North/Akure South,
    Okitipupa/Irele and Ese-Odo/ Ilaje.

    Ondo LP Secretary, Abiodun Agbaje, said names of the party’s candidates were sent to INEC but were surprised that the party’s logo was missing from the ballot papers.

    “Our representative went to INEC for sorting out for electoral materials to be sent to various wards. LP logo was missing for the Senatorial and House of Representatives where we have candidates. INEC should give us opportunity to participate or postpone the election.

    “Our candidates should be given opportunity to exercise their rights. We are here to express our displeasure. We expect INEC to do the needful. It was a deliberate act. I do not think if any agency of government supercede the judiciary that gave us judgment.

    Logo of the party appeared in Ondo North. Our candidates wer3 not initially uploaded on the portal on the fault of INEC and not the party. Names of all the candidates were forwarded to INEC.”

    Supreme Court asked to reverse Abacha’s sack as Kano PDP Gov candidate

    The Supreme Court has been urged to reverse the February 10 judgments by the Court of Appeal in Kano voiding the nomination of Mohammed Sani Abacha as the governorship candidate of the Peoples Democratic Party (PDP) in Kano State.

    The apex court is also urged to order the Independent National Electoral Commission (INEC) to reinstate Abacha as the actual candidate of the PDP in Kano for the next governorship election.

    These requests form part of the reliefs being sought in two notices of appeal filed before the Supreme Court by Mohammed Abacha, the eldest surviving son of the late Head of State, General Sani Abacha.

    In two notices of appeal filed by his lawyer, Dr. Reuben Atabo (SAN), Abacha argued that the Court of Appeal, Kano erred in law when it set aside an earlier judgment of the Federal High Court, Kano which recognised him as the actual candidate of the PDP in the state.

    Abacha had claimed, in his suit at the Federal High Court,Kano, marked: FHC/KN/CS/01/2022 that he won the only validly conducted PDP governorship primary in Kano State, but had his name wrongly substituted with that of Sadiq Aminu Wali by some party leaders.

    In a judgment on December 22, 2023, Justice Abdullahi Liman of the Federal High Court, Kano held in Abacha’s favour and ordered INEC to recognise him as the PDP governorship candidate in Kano State, a decision Wali and the PDP challenged in separate appeals before the Court of Appeal, Kano.

    In its judgments on both appeals on February 10 this year, the Court of Appeal set aside the Federal High Court judgment and held among others that Wali was the valid candidate, a decision Abacha has now appealed to the Supreme Court.

    In his two notices of appeal, containing 31 grounds, Abacha equally wants the Supreme Court to set aside the Court of Appeal’s judgment and affirm that of the Federal High Court.

    In the 17-ground notice of appeal relating to the Appeal Court judgment in the appeal by the PDP, Abacha argued that the appellate court erred when it held that the trial court lacked jurisdiction to have entertained this suit and that he lacked locus standi to have instituted the case for not being an aspirant.

    Abacha argued that, as against the wrong position held by the Court of Appeal, he was an aspirant in the primary election conducted by the PDP and monitored by INEC in accordance with the proviison of Section 84(1) of the Electoral Act; Paragraph 15(c) , Part 1 of the 3rd Schedule to the Constitution, as well as the Supreme Court’s decision in the case of Sylva v. PDP.

    He added that he emerged ” as the candidate that scored the highest number of votes during the primary election organised by the 1st respondent (PDP) and supervised and monitored by by the 2nd respondent (INEC).

    “The name of the appellant (Abacha), who emerged as the winner during the primary election, was wrongly substituted with that of the 3rd respondent (Wali) who scored zero vote during the primary election.”

    The appellant also faulted the Court of Appeal for holding that Wali did not participate in the primary election held on May 25, 2022 at No: 5A Lugard Avenue, Kano, which primary he (Abacha) won.

    Abacha argued that contrary to the position held by the Court of Appeal, there are documentary evidence presented before the trial court that Wali actually participated in the primary.

    “The findings of fact made by the trial court in respect of the participation of the 3rd respondent in the 1st respondent’s primary conducted on May 25, 2022 at No: 5A Lugard Avenue, Kano was not challenged by the 1st respondent at the lower court,” he said

    Abacha argued that the Justices of the Court of Appeal erred in law when the held that he was not an aspirant in the primary that produced Wali.

    He contended that as against the position held by the appellate court, the primary which produced Wali and was held at the Sani Abacha Youth Centre, Kano, was an illegal one, having not been conducted in accordance with relevant laws.

    Abacha added that there was documentary evidence at the trial court that the National Working Committee of the PDP sanctioned and organised the primary held at Lugard Avenue and which he won.

    The 14-gound notice of appeal relating to the Appeal Court’s judgment in the appeal by Wali, faulted the appellate court for holding that the primary held on Lugard Avenue was conducted by the Kano PDP’s State Executive Committee.

    He noted that, contrary to the appellate court’s position, the trial court specifically found that the primary held on Lugard Avenue was “sanctioned and organised by the National Working Committee” of the PDP.

    Abacha also faulted the Justices of the Court of Appeal for holding that the primary election held on Lugard Avenue was a void primary election.

    This position, he argued, is contrary to the specific finding of the trial court that the primary election conducted on Lugard Avenue was sanctioned and organised by the NWC of the PDP as required by law.
