    Court frees ex-Gov Okorocha, others for alleged N3b fraud

    A Federal High Court in Abuja has discharged former Governor of Imo State, Rochas Okorocha, and six others from an N3 billion fraud charge brought against them by the Economic and Financial Crimes Commission (EFCC).

    In a ruling on Monday, Justice Inyang Ekwo upheld the objection raised by the defendants against the propriety of the charge.

    Justice Ekwo held that the EFCC acted unlawfully when it ignored the directive by the Attorney General of the Federation (AGF) and proceeded to initiate the criminal proceeding against Okorocha and others.

    The judge held that the EFCC, like every other law enforcement/prosecuting agency, was under the obligation to defer to the directive of the AGF in deciding whether or not to prosecute an alleged offender.

    Justice Ekwo held that the failure of the EFCC to comply with the directive by the AGF that it submits the case file in the case involving Okorocha and others for review rendered the criminal proceeding it initiated against them nullity.

    The judge voided the proceeding and discharged the defendants – Okorocha, Nyerere Chinyere, Naphtali International Ltd, Perfect Finish Multi Projects Ltd, Consolid Projects Consulting Ltd, Pramif International Ltd and Legend World Concepts Ltd.

    Justice Ekwo said that the directive of the AGF in a letter dated September 12, 2022, to the EFCC to forward the case file as well as the EFCC’s comments on the issues for consideration and review was binding on the commission.

    “All that the law required of the respondent (EFCC) was for the respondent when directed by the HAGF, pursuant to any enactment, is to comply and not act as if it is not under the law or is exempted thereby.

    “For the avoidance of doubt, the office of the HAGF is founded on the provisions of the constitution and is thereby preserved.

    “The controversies and drama surrounding this tral proceeding is needless and it is time to stop it,” he said.

    Justice Ekwo held that from the moment the AGF gave the directive to the EFCC, the commission ceased to have the legal authority to prosecute or continue the prosecution of the case.

    “In other words, the intervention of the HAGF in any criminal proceedings ends the authority of the prosecuting agency in the matter unless otherwise directed by the HAGF.

    “In the end, I find that non-compliance by the respondent with the directive of the HAGF as stated in Exhibit Okorocha 7 is fatal to this proceeding and has rendered it a nullity.

    “The respondent is not empowered by any law to continue with this proceeding after the HAGF issued the directive in Exhibit Okorocha 7.

    “With Exhibit Okorocha 7, it is only the HAGF that can decide whether or not to charge the defendants upon the case file being remitted to his office as directed,” he added.

    The judge upheld the defendants’ contention that the earlier judgment of a court of coordinate jurisdiction sitting in Port Harcourt, in a suit marked: FHC/PH/FHR/165, between Okorocha and EFCC, retraining the commission from further proceeding on the alleged offence, had not been set aside.

    Justice Ekwo, who held the order is binding until it is set aside, said: “The fact that a person refuses to comply with the law does not change the law, neither does the law change to accommodate the act of non-compliance by any person.

    “What happens when a person elects not to comply with the law is that the law turns its back on the person.

    “When that happens, every action or decision taken by such person in the process of non-compliance becomes illegal and the court will set aside the such act of non-compliance ex debito justitiae.

    “This is so because there is no machination that can be used to salvage an illegal act.

    “I, therefore, make an order striking out the charge which found this proceeding. The consequence is that the defendants are discharged,” Ekwo said.

    N120B loan: Protesting Deltans warn banks, barricade East-West Road

    Concerned stakeholders of Delta State drawn from several Civil Society Organizations (CSOs) have cautioned commercial banks against giving out more loans to the Delta State Government.

    The scores of stakeholders gave the warning on Monday morning when they blocked the Federal Junction section of the East-West Road in protest of the recent N120 billion loan request by the State Government.

    The protesters accused the Governor Ifeanyi Okowa-led government of mortgaging the future Deltans yet-unborn, considering the high debt profile of the state.

    Bearing placards with inscriptions such as: “don’t mortgage Delta,”; “We say no to N120B loan,” they insisted that the concerned banks would be giving out the loan at their own peril, as the state will not pay back.

    Addressing newsmen, one of the protesters, Urhobo Progress Union (UPU) Youth wing President, Comrade Kelly Umukoro, said: “We have seen that the present state government wants to sell us for the future of their children and themselves. You have few months to leave government, and you are borrowing another N120 billion.

    “Is it that we are sponsoring Okowa’s ambition to be vice president of Niger with Delta state money? Did we have any meeting as Deltans to say we want to use our treasury to sponsor Gov. Okowa who has not been able to improve the lives of Deltans?

    “No infrastructure, for eight years you have been able to do one flyover and you are celebrating it. What does he need this money for? The answer is simple, he needs it to oil his vice presidential ambition.

    “As critical stakeholders, we are saying no, never. We are saying our children cannot pay debt that was not used by their fathers. Okowa should have pity on us. Delta owns a State University in Abraka, school fee was increased. Delta state university is like a private university where students pay N250,000.

    “With all the ways of getting money, the governor is still interested in taking more loan. As Deltans we are saying any bank that gives loan to Okowa is doing that on their detriment. If they are doing giveaway, they should make it clear.

    “We are not going to pay.
    We are demanding that banks should not give Okowa anymore loan because the money in his coffers, he has not been able to use it judiciously”.

    Another protester, Onoriode Emmanuel, expressed dissatisfaction with the level of development in the state, noting that despite the huge loans collected, there are no tangible projects to show.

    He described the Delta Assembly of being rubber stamp as they easily approve every loan sought by the state executive.

    On his part, President of the Committee for the Defense of Human Rights (CDHR), Prince Kehinde Taiga, noted that despite huge allocations to the state, as well as internally generated revenues, the state us still underdeveloped.

    She noted if it would require them to save for a long or even borrow for the test, they should by all means do so.

    According to her, with the increasing rate of dishonesty-cum-paternity fraud in recent times, it was only right for every man to certify himself as the biological father of his children.

    “Dear men, in everything you do, please do DNA. No matter how broke you are, please save money for DNA or borrow money”, she said.

    Bakare also addressed mothers, urging them not to find it offensive when their partners demand for a paternity test for their children.

    As a woman, you shouldn’t find it offensive when your man asks for DNA at birth. With the level of dishonesty/paternity fraud, we see on daily basis.

    DNA paternity testing is the use of DNA (or deoxyribonucleic acid which is the hereditary material in humans and almost all other organisms) profiles to determine whether an individual is the biological parent of another individual.

    Paternity testing can be especially important when the rights and duties of the father are in issue and a child’s paternity is in doubt.

    Court remands Lagos lecturer for alleged incest

    A Lagos Magistrates’ Court in Ogba has remanded a lecturer at the Lagos State University of Technology formerly (LASPOTECH) (names withheld) in the custody of Kirikiri Correctional Centre for allegedly defiling his 10-year-old daughter.

    He was also alleged to have been having carnal knowledge of the minor since 2018.

    The lecturer was arraigned on a two- count charge last Friday bordering on defilement and sexual assault by penetration before Magistrate Bola Osunsanmi.

    When the charges were read, Magistrate Osunsanmi did not take his plea.

    She ordered his remand at the Kirikiri Correctional Centre pending the Directorate of Public Prosecution’s legal advice.

    The case was adjourned till March 6, 2023.

    A statement by Joke Ladenegan-Oginni for the Lagos State Domestic and Sexual Violence Agency (DSVA) said the lecturer was arrested following a tip off from a Mandated Reporter on the allegation that he was having unlawful sexual intercourse with his biological daughter.

    The mother of the survivor reported that her husband stopped being intimate with her in 2018 and anytime she tries to address it, it always resulted in him physically assaulting her.

    According to the information the DSVA gathered, the last abuse happened on the 30th of December, 2022.

    Executive Secretary, DSVA, Mrs Titilola Vivour-Adeniyi decried the rise in cases bordering on Domestic and Sexual violence, particularly, allegations of incest.

    Mrs Vivour-Adeniyi urged residents to continue to break the Culture of Silence by reporting cases of abuse.

    She gave assurance that all forms of abuse are crimes against the state and that holistic support would be made available to survivors as perpetrators will be made to face the full wrath of the law.

    “We use this medium to reiterate the State Government’s Zero tolerance to all forms of child abuse whilst reassuring all Lagos State residents of the commitment of Governor Babajide Sanwo-Olu in ensuring a Lagos State that is free from all forms of Domestic and Sexual Violence,” Mrs Vivour- Adeniyi said.

    The All Progressive Congress (APC) in Diaspora (North America) has knocked the presidential candidate of People’s Democratic Party (PDP) Atiku Abubakar and his counterpart in Labour Party, Peter Obi, saying none of them is competent to win the contest.

    APC said Atiku and Obi lack capability to take Nigeria to the Promised land, saying its presidential candidate, Asiwaju Bola Ahmed Tinubu, is the the leader Nigerians need to solve their problem.

    Speaking during a live radio program “Gbengba Lasa N Ta”, in Ibadan, the Oyo State capital, the chairman of APC in Diaspora North America, Olalekan Sani, said considering Tinubu’s pedigrees and antecedents, he remains the best candidate that can do the job.

    According to him, Tinubu’s exposure and knowledge are unbeatable.

    He said: “Tinubu loves Nigeria and he has paid his dues for the nation, his achievements in Lagos state which is the economic hub of Africa speak volume.

    “Tinubu was the brain behind Lagos economy which everybody is now reckoning with. Tinubu is the only politician in Nigeria that nurtured young politicians who are now leaders in their various domains. He always turns impossibility to possibility. He is also a philanthropist who has impacted on many Nigerians.”

    Sani urged Nigerians not to vote based on ethnic or religious sentiments but choose competence and capability.

    He maintained that same-faith ticket should not be an issue at the polls but Nigerians should vote for whoever they believe can deliver.

    He said: “Some Governors and their Deputies belong to the same religion and there is peace and development in their States

    “Government is about critical thinking, capacity and experience. Religious sentiments cannot hinder the chance of our candidates because our candidates are capable and competent. They are people whose pedigree and antecedents speak volumes.

    Nigeria Air to launch Q1 2023 – Minister

    Despite litigation seeking to stop Nigeria Air, the Federal Government has assured that the airline will commence operations before the end of the first quarter (Q1) this year.

    The government said contrary to claims that the airline was taken to court by Airline Operators of Nigeria (AON), it said only five airlines took it to court.

    The airlines according to it, are Air Peace, Max Air, United Nigeria Airlines, Topbrass Aviation, and Azman Air.

    Minister of Aviation, Hadi Sirika disclosed this in an interview posted on YouTube on February 2, by AeroTime.

    On the fate of the proposed national carrier; Nigeria Air, the minister said: “Nigeria Air will launch shortly. There is a process to having an airline and that process is driven by Nigeria Civil Aviation Authority (NCAA) the process comes in different phases for those processes to happen.

    “Being a PPP, it has to go through Infrastructure Concession Regulatory Commission (ICRC) by establishing a consulting firm, and transaction advisers to make a business case and to know if it is a viable project and that has been done. It took two years and the Outline Business Case was produced and approved by ICRC and then taken to the Federal Executive Council which was also approved.

    “Before now, we went to the public to invite bidders which is a procurement process. The process ended up having Ethiopian Airline as the partner with 49 per cent, 5 per cent for the government of Nigeria, and 46 per cent for Nigerian entrepreneurs and companies coming together to own the rest.

    “They have applied for Air Transport Licence (ATL) which is being issued and now they are applying for AOC and the process has gone very far.

    “I believe in the next one or two weeks from today, they should be able to get the AOC issued and that will signal the beginning of the carrier itself being flying but we have been working for the past six years to establish it and we took this long because we wanted to be very diligent.

    “So, I think the airline is on its way coming and it will be soon. It will be launched within this quarter and it will be flying within this quarter and it will give Nigerians the service that has been eluding it.”

    On the litigation, he said: “It is not the Airline Operators of Nigeria that went to court, it is Air Peace, Max Air, Azman, Topbrass, and United Nigeria. Interestingly, United Nigeria started business during my tenure as a minister and I was in charge of them becoming an airline and we did not stop them from coming.

    “During my time as minister, almost a dozen of airlines started and nobody stopped them. All of them; United Nigeria, Topbrass who doesn’t have an airplane, Max Air, and Azman can go outside and get investors.”

    Sirika continued: “The problem of airlines in Nigeria includes governance where you have a one-man show running an airline; there may be nothing wrong if it is done very well, lack of capital and the know-how.

    “So, I think Nigerian airlines should try to copy what Nigeria Air is trying to do by bringing in an investor. It is all about the service.

    “I think those that are in court which is not a big deal to deal with should know that they have the same opportunity to bring in investors into their airline.

    “So, I wish by next month, Airpeace, United, and Topbrass should go somewhere else and bring in another airline to come and partner with them.”

    On the markets that the airline hopes to explore, he said: “With the OBC, the airline should break even within the next three years and then start doing domestic and international flights.

    “The UAE, Abu Dhabi, the London market; Heathrow, JFK, and the rest of USA. Nigeria has a partnership with the USA which means you can land many times and as many times, China, Singapore; all these are routes Nigeria Air is looking at and it will happen so quickly.”

    Buhari commissions, names Federal Secretariat Lafia after Justice Bage

    President Muhammadu Buhari, on Saturday, commissioned a number of projects in Nasarawa State, one of which is the Federal Secretariat, Lafia, which he named after the Emir of Lafia, Justice Sidi Dauda Bage, a retired Justice of the Supreme Court.

    The President also named the Conference Room at the Secretariat, which sits on 10.9 hectares of land, after Maimuna Joyce Katai, another citizen of the Nasarawa State.

    According to a statement issued by his Senior Special Assistant on Media and Publicity, Mallam Garba Shehu, the President noted that the honour to the two Nasarawa State indigenes; Justice Bage and the Late Katai, was in recognition of their contribution to national development.

    Before attending the APC Party Presidential Campaign rally at Lafia Square, the President also commissioned the Agricultural Machinery and Equipment Development Institute of the National Agency for Science and Engineering Infrastructure (NASENI) and the Sadami Street road, executed by the Nasarawa State Government.

    Paying homage to the Emir of Lafia, President Buhari thanked the first-class traditional ruler for always welcoming him to his palace, noting that in the last eight years, he had lost count on the number of visits.

    The President was accompanied by the party’s presidential candidate, Asiwaju Bola Ahmed Tinubu, his running mate, Senator Kashim Shettima, the Senate President, Ahmed Lawan, APC National Chairman, Abdullahi Adamu, APC Governors and party stalwarts.

    ‘‘Thank you very much Your Highness for the affection Lafia and the entire people of Nasarawa State have shown to me always.

    ‘‘I congratulate you on the rapid transformation of the city. Once more, I wish to express my gratitude and appreciation for the hospitality I have always enjoyed during my visits,’’ President Buhari wrote in the visitors’ book.

    Governor Abdullahi Sule, who thanked the President for inaugurating Federal and State projects, noted that the NASENI Institute would transform agricultural production in the country.

    He also lauded the President’s support towards education, health delivery and increased security in the state, saying that the remaining four primary school pupils kidnapped recently at Alwaza, a community in Doma Local Government Area, in the State have been rescued.

    ‘‘We didn’t pay any ransom for their safe return,’’ the governor said.

    Governor Sule declared that the 2.2km Loko-Oweto Bridge and link roads between Benue and Nasarawa States would be formally inaugurated by the President in March.

    Commending the Federal Government’s commitment to infrastructure, the governor described Oweto bridge and the second Nigeria Bridge as signature projects of this administration that will impact positively on Nigeria’s economic development.

    The Emir of Lafia thanked the President for naming the Federal Secretariat after him and his unflinching support toward the development of the State.

    On Tinubu, the retired Justice of the Supreme Court said ‘‘I have known him for many years since my days in Lagos State at the Court of Appeal, we saw what he did, his transformational agenda in the State. We are waiting for that for our nation. We know you can do it; you have the capacity to transform this nation.’’

    Earlier at the Agricultural Institute, the Executive Vice Chairman/Chief Executive of NASENI, Professor Mohammed Sani Haruna, told the President that the newly inaugurated edifice was built in six months.

    He toured the Lafia Institute, equipped with modern laboratories and machines for mechanized farming and agricultural development.

    The President had approved the establishment of six Agricultural Machinery and Equipment Development Institutes, one per geopolitical zone of the country.

    At the Federal Secretariat, the Minister of Works and Housing, Babatunde Fashola, acknowledged the support of the President, the State government, and the National Assembly in making the project a reality.

    According to official figures from the Ministry of Works and Housing, the contract for the project was awarded to M/S Falpins Nigeria Limited on December 9, 2011 at the original sum of N2.3 billion.

    It was revised to N3.1 billion in August 2020 and ‘practically completed’ and taken over by the Ministry on September 8, 2022.

    The Secretariat will accommodate over 2000 staff from several Ministries, Departments and Agencies, who have already indicated interest in moving into the facility when commissioned.
