    Concert of losers – and plotters

    The political circuit is agog with the Concert of Losers and Plotters de-marketing the ruling order, no matter how ridiculous they sound; always hoping the people are gullible and always available to be scammed.

    That’s the impression you get from the latest tours of the eternally restless and excitable Peter Obi, self-condemned to a torrent of talks, sensible or senseless, just to keep up the fob for his doting Obidients.

    Still, Obi’s latest tours should really intrigue you.  First, former Vice President Atiku Abubakar.  At the 2023 presidential election, Obi and Atiku viciously neutralized each other, while President Bola Tinubu galloped into town with the presidential diadem.

    Atiku, hitherto self-projected Mr. Pan Nigeria, declared himself the autochthonous northerner, who every genuine northerner must vote.  It was practical but fatal political Freudian slip, exposing Atiku for what he really is — a closet northern irredentist.

    Obi, on the other hand, pushed for naked Igbo and Christian votes, deluding himself such raw appeal to tribe and faith would push him through.  He collapsed, though given his tally as third best, he was able to game many sorry souls.

    Both pounced on each other, claiming victory from a clear and meritorious loss. Both oozed mutual contempt at each other, while claiming they would triumph at the courts.  When both crashed after the Supreme Court’s final verdict, both danced naked with intemperate howls that saw nothing but gloom and doom.

    But now, both — breaking news! — are back under the same sheets, plotting where delusional hope always springs eternal!  By the way, both had bad-mouthed the Lagos-Calabar coastal road, thus alienating not quite a few in that belt, in their early poaching and pitching for 2027.

    But beyond Atiku, Obi’s new taste appears some sweet but strange cuisine: he savours the politically living dead.  Sule Lamido of Jigawa was the glorious Obasanjo era poster boy.  But Lamido, always a damp squib, is politically displaced from his Jigawa lair.

    He also serenaded Bukola Saraki — the one who inherited his father, the goodly Baba Oloye, Dr. Olusola Saraki’s lifelong Kwara political empire, but crashed it in less than 12 years, instead becoming a political living dead!

    O, if Obi doesn’t go to this one, this one would go to Obi: Pat Utomi, the Don Quixote of Nigerian politics, always tilting at the windmills of “mega party”, every pre-election season!  He was also with Obi during his Labour Party misadventure!

    No — it’s no crime to plot for legitimate power in a democracy.  But this Concert of Losers and Plotters must know: had they implemented critical, life-changing policies during the Olusegun Obasanjo PDP era, they won’t all be in political Siberia now. 

    Eternal plotting won’t get them out of that hole.  Only quality thinking will.  But the snag: the lost PDP boys and quality thinking are two parallel lines that will never meet.  Too bad!

    Efcc is building critical momentum under Olukoyede (1)

    As a certified strategist, an apostle of the Transnational Alliance to Combat Illicit Trade TRACIT (TRACIT is a global private sector initiative to mitigate the economic and social damages of illicit trade), an advocate for good governance and policy coherence in governments amongst other skill and experiences; I am able not just to appreciate the importance of a sincere and objective fight against economic and financial crimes in societies and Countries; I am also able to dimension the depth of the issues that the Economic and  Financial Crimes Commission (EFCC) of Nigeria is facing, the trajectory so far achieved, and proffer some ways forward for an efficient, effective and impactful EFCC.

     Barely seven months after his appointment as the 5th Executive Chairman of the (EFCC) since the commencement of her operations in April 2003, Mr. Olanipekun Olukoyode had hit the ground running and has so far, built critical momentum in the right direction in the fight against economic and financial crimes which is the fulcrum of the bane of our progress as a nation.

     Momentum of high-profile cases

    Within the last 7 months, the status of ongoing high-profile graft and other corruption cases at various stages of investigation and prosecutions – with a scope and scale of cash and assets amounting to whopping Billions of US Dollars (Trillions of Naira); are indicators of the critical momentum that the EFCC has built in such a short time under the leadership of Mr. Olukoyede, especially with the seriousness and fearlessness, the EFCC is currently executing her mandates.

     Such high-profile cases include:  those of the former Governor of the Central Bank of Nigeria (CBN), Mr. Godwin Emefiele and his co-suspects, the former Governor of Kogi State, Alhaji Yahaya Bello and his co-suspects, former Minister of Aviation and Aerospace Development, Senator Hadi Sirika and his co-suspects,  suspended Minister of Humanitarian Affairs and Poverty Alleviation, Dr. Betta Edu, her predecessor and other co-suspects, suspended Managing Director of the Rural Electrification Board (REA) Mr. Ahmad Salihijo, the suspended Executive Directors of the REA, and their co-suspects, etc.

    Economic and financial crimes are major crimes against humanity and sabotage to nation-building; which is part of the reason why some countries around the world legislate capital punishments as stringent as the death penalty or life imprisonment for such heinous crimes.

     Love him or hate him, The EFCC under the leadership of Mr. Olukoyede is building critical momentum for success. Are there rooms for improvement with regard to the operations of the EFCC? The answer is YES. But what we cannot take away from the current leadership of the EFCC is that they are improving and are certainly moving in the right direction and already making impacts. Therefore, Kudos to Mr. Olukoyede and his team.

    In this series of episodes, I also will advise the EFCC on some important points to note in order to sustain the momentum and make significant impacts not just in prosecutions and convictions but more importantly in curtailing and preventing economic and financial crimes in Nigeria.

     The level of pushback that is deployed anytime are attempts to stand up against vested interests or fights against corruption, tells any right-thinking person that indeed we are in trouble in Nigeria. I therefore do not envy the situation that Mr. Olukoyode has found himself in. Indeed, the task is enormous, the enemies are formidable and the risks are high.

      Accordingly, I wish to encourage Mr. Ola Olukoyode and the EFCC that the first casualty in the fight against Corruption is the truth and therefore he should expect a bigger campaign of calumny against him and the EFCC. Some of the Critical Success Factors focus on Process and tenacity of purpose which Mr. Olukoyede should imbibe not just in himself but across the EFCC as an institution because indeed, “no tree can make a forest”.

    The political will of mr. president has been a critical success factor

    Indeed, it is worthy of note and commendation, that the momentum so far achieved by the EFCC in the last 8 months is due to the unalloyed support by President Bola Tinubu, who first of all made a “round peg, in round hole” appointment of Mr. Olukoyede and Mr. Muhammad Hassan Hammajoda as Executive Chair and Secretary of the Commission respectively.

     Furthermore, from all indications, Mr. President has not been interfering with the works of the EFCC in this administration. This is based on the fact that the aforementioned high-profile cases under investigation or undergoing prosecution are all of the members of the ruling political party the All Progressives Congress (APC) who held public offices during the immediate past administration of President Buhari (who is of the APC), and also officials at the highest level of the current administration of President Tinubu. Hence, so far, President Tinubu has shown the political will to fight corruption with the way he has been allowing the anti-corruption institutions to perform their duties. Accordingly, if the dragnets of the anticorruption war go beyond APC members, the President should not be accused of witch-hunting!

      Strategic considerations and ways forward

    While I agree that we should critique the operations and performance of the EFCC, it will only be objective if we, as citizens, civil society organizations, arms of government, etc; also take note of the key strategic and operational impediments and challenges that the EFCC and other anti-graft agencies face in the discharge of their mandates, and support the removal of those impediments. Only then could we effectively support critical institutions like the EFCC to succeed for the betterment of Nigeria. Otherwise, our actions/ inactions as citizens, civil society organizations, arms, and institutions of government will amount to asking the EFCC to chase criminals with her hands bound behind her back, which in my opinion is sheer hypocrisy. Let me share some classic examples of such impediments:

     •Judicial Impediments: Plethora of Exparte Orders and conflicting judgments

    As I have elucidated in my two past episodes where I added my voice to the need for reforms in the judiciary in Nigeria. It is relevant to regurgitate this point which I made in those episodes about how the judiciary in some cases deliberately or inadvertently constitutes impediments to the effective administration of criminal justice in Nigeria. One of the classing examples of how the judiciary enables wanton corruption in Nigeria is the ugly trend of how persons and organizations lean/ hide under section 46 of the 1999 Constitution as amended, to secure injunctions/ judgments to stop investigations, especially on matters of corruption, other forms of criminality, and even terrorism; to the extent that judges grant orders to stop statutory bodies from performing their constitutional responsibilities, which leave much to be desired. This is a serious issue that is becoming an anathema to the progress of Nigeria. In most of the cases where such injunctions or judgments are given, it is very clear that the prayers of the applicants are out of place at no moment. Additionally, some of the injunctions are granted in clear violation of the constitutional provisions given those Arms or agencies of Government, for example; the National Assembly in line with Sections 88 and 89 of the 1999 Constitution, or the provisions of the Acts of the EFCC, ICPC, Nigeria Police, DSS, etc. In any case, it is elementary to note that anyone trying to stop an investigation into criminal allegations is actually indicating that he/ she is trying to avoid investigation and possible prosecution, and therefore, such applications should not be granted by the honorable justices. This is because innocent parties will set the records straight and clear their names when they face an investigation. Unfortunately, we are all witnesses to this ugly trend which if not stopped, will certainly legitimize corrupt practices, and all forms of criminality including terrorism and acts that could threaten our territorial integrity. These are serious issues with potentially serious consequences on our polity, and should not be entertained by any well-meaning judges or citizens of Nigeria.

     Accordingly, on the basis of legal reasoning, the judiciary should allow and support statutory institutions to perform their duties, rather than prevent valid investigation or obstruct the principles of separation of powers that they- the judiciary should protect! Legislative, regulatory investigative, and prosecutorial institutions should be allowed to undertake their mandates as enshrined in the Constitution. If some judges continue the habit of forestalling investigations under the guise of fundamental human rights, as long as the investigation (civil or criminal) does not violate any constitutional provision; then that Judge, in my opinion, is supporting the obstruction of justice.

    • At last, the Malabu case against former attorney general and oil majors was a waste of time and resources

    The war on corruption has been intriguing, but it has been more when the apex corruption fighter creates its own drama of self-indictment. One, it was argued that the quality of prosecution sometimes undermines the integrity and fortitude of its battles. Hence former president, who also set it up, Chief Olusegun Obasanjo, invoked a Yoruba word to demonstrate its weakness. He asked the organisation to employ ‘ogbologbo’ lawyers; that is lawyers of high stature and great acumen.

    It appears that nearly 26 years after the award of Oil Prospecting Licence (OPL) 245 to Malabu Oil Ltd, the recent ruling of Justice Abubakar Idris Kutigi of the FCT High Court has put an end to the crises, controversies and legal tussles surrounding it. Justice Kutigi ruled that the Economic and Financial Crimes Commission (EFCC) did not provide evidence to prove its charges of corruption, fraud and conspiracy against the defendants. Similar cases suffered defeats in Italian and British courts where the judges ruled that they could not see any conclusive proof of fraud and corruption in the OPL 245 agreements signed by Nigeria, Malabu, Shell and NAE in 2011. The United States Department of Justice (DoJ), the US Securities and Exchange Commission (SEC) and Dutch authorities all brought the matter to a close after investigating petitions filed by Nigerian, Italian and British anti-corruption campaigners who had alleged corruption and fraud in the deal.

    The controversy started in 2001 when the Olusegun Obasanjo Administration revoked the oil block from Malabu without explanation. Malabu immediately instituted legal proceedings against the Federal Government. In 2006, the Obasanjo Administration decided to settle out of court with Malabu by agreeing to restore OPL 245 to them, a decision that also irked Shell, the new allottee, which then filed arbitration claims against Nigeria. The crises appeared to have ended with the settlement agreements signed by all parties in 2011 under then President Goodluck Jonathan. But when former President Muhammadu Buhari came to office in 2015, he decided to revive the corruption allegations.

    With the controversies now seemingly over, there are a number of issues that should not be swept under the carpet. One, the Obasanjo Administration plunged Nigeria into a prolonged legal tussle when it revoked the oil block without justification. This sparked off the crises and controversies that stalled the development of the highly endowed oil block. Sadly, the Nigerian government is notorious for taking unilateral actions on contracts. This unsavoury reputation affects the country’s ability to attract serious investments. Investors are always sceptical about the sanctity of contracts and rule of law in Nigeria. It is hoped that government will henceforth take its contractual responsibilities more seriously.

    Two, it should be considered worrisome that EFCC’s key witness was Mohammed Abacha, son of General Sani Abacha, Nigeria’s former Head of State. He claimed he owned Malabu Oil and that his name was illegally expunged from the company’s Form C.02 at the Corporate Affairs Commission (CAC) while he was in detention in 2001. As a result, he missed out on the $1.1bn paid to Malabu by Shell and NAE. Although the EFCC charged seven defendants to court, most of the counts bordered on the alleged forgery which would suggest that the EFCC was indeed fighting for the Abacha family. By Decree No. 53 of 1999 (now an Act of Parliament), the Abachas are to forfeit all public assets traced to them. Was the EFCC not aware of this?

    Three, on the N300 million allegedly paid to Adoke as a bribe for his role in the settlement agreements, Justice Kutigi noted that the same sum was presented to another court by the EFCC as evidence of a mortgage the former minister collected from a bank. The contradiction was fatal to EFCC’s case. This raises questions about the way the EFCC builds its cases. The commission is regularly accused of being used as a political tool. Failings of this nature do not help its case. Adoke repeatedly said he was being persecuted because he did not help the Abachas get a cut from the Malabu windfall. EFCC’s conduct tends to support his claim.

    Four, it should not have taken 23 years to resolve legal tussles around this rich oil block. The Nigerian economy has lost billions of dollars in revenue as a result, plus the thousands of jobs that could have been created and the forex that could have accrued to the country from oil exports, among several other benefits. In the final analysis, the OPL 245 case may have ended, but the issues that the entire saga raised need to be addressed. Lessons have to be learned to improve public policies and litigation.

    It is amazing that the president who called for ‘ogbologbo’ lawyers set the stage for the drama that would expose his own shenanigan in office and the EFCC could not get a lawyer worth his salt to prosecute. Rather, the EFCC put up a slipshod job and turned an innocent man and a slew of oil companies into an international rigmarole of fruitless legal jousts.

    Victor Boniface’s fairytale debut season with German Champions Leverkusen has  yet been richly rewarded after  the Super Eagles  striker was announced yesterday as Bundesliga ‘s Rookie of the Season.

     Following his imperious performance that saw him  winning  four  Rookie of the Month Awards  between August and November, the  choice of Nigerian  did not come as a surprise to many as he was voted for the coveted award  ahead of the trio of  Leipzig’s Xavi Simons, Dortmund’s Ian Maatsen and Hoffenheim‘s Beier.

    Transferred   to Leverkusen from Belgian side Union Saint-Gilloise last summer, the 23-year-old Boniface  was on fire almost throughout the season  scoring as if goals out of fashion  during  his four monthly reign  as the rookie of the month  in August,  September, October  and November of 2023 as he scored seven goals and provided five assists in 12 Bundesliga appearances. He also added three further goals and two more assists in four league outings before the winter break.

     He made his international  debut for Nigeria last September  but  injury forced him out of the  2023 Africa  Cup of Nations where the Super Eagles  were undone in the final match by hosts, Cote d’Ivoire  to finish in second position.

    But he  bounced back   in spectacular fashion in February and regarded as one of the class acts  that helped  Leverkusen  won their  first  Bundesliga  title as they  push  for a treble with the addition of the DFB Cup and UEFA Europa League.

    Even with  three  more matches  to go in the Bundesliga, Boniface  already  has 13 goals and eight assists in 22 games and it goes without saying that more accolades  is in the offing for him.

    Tinubu hails Quadri  for reclaiming ITTF Africa Cup title

    President Bola Tinubu has congratulated Nigeria’s table tennis champion,  Aruna Quadri, on  is impressive victory at the 2024 International Table Tennis Federation (ITTF) Africa Cup in Rwanda.

    Quadri reclaimed his title as Africa’s table tennis champion after defeating Egypt’s Mohamed El-Beiali 4-0 in the final match.

    This achievement has earned him recognition from the President, who commended his determination and resilience in the face of obstacles.

    In a statement issued on Wednesday by his Special Adviser on Media and Publicity, Ajuri Ngelale, President Tinubu praised Quadri’s exceptional qualities, including his zeal for distinction, hardiness to succeed, and inventiveness to solve complex problems, which he said define Nigerians.

    “President Bola Tinubu congratulates Nigeria’s table tennis pacesetter, Mr. Aruna Quadri, on winning the International Table Tennis Federation (ITTF) Africa Cup title.

    The newly appointed Super Eagles head coach Finidi George has asserted that players who ply their trade in the domestic league- Nigeria Premier Football League (NPFL) who are good enough for the senior national team would get their chance.

    Enyimba goalkeeper Ojo Olorunleke was the only domestic  league player that was in the 2023 African Cup of Nations squad in Cote d’Ivoire and this has made football purists to voice their indignation at the lack of interest in players in the NPFL.

    Speaking with journalists, Finidi confirmed that he would continually visit domestic league match venues with the aim of getting quality players from the league for the Super Eagles.

    ” Definitely I will still come back to Aba to watch Enyimba play because my duty now is to mix the Super Eagles team up with the home-based players,” Finidi told journalists. ”Aba definitely will be my first destination when I come to watch Enyimba play.

    “Most likely I will see one or two players that I can take with me to the Super Eagles.”

    Super Eagles will face the Bafana Bafana of South Africa and Cheetahs of Benin Republic next month in key 2026 FIFA World Cup qualifiers and the country’s senior national team is in a must-win situation to relaunch their qualification chances.

    Minister of Sports Development, Senator John Owan Enoh  has extended his congratulations to  Wilfred  Ndidi  for  helping Leicester City secure  promotion to the English Premier League.

    Senator Enoh said  as such  when the 27-year-old midfielder paid a courtesy visit to this office  yesterday accompanied by his manager, Yahaya Atom, and Mr. Yemi Idowu.

     Ndidi engaged in discussions with the Sports Minister on various matters pertaining to Nigerian football.

    Acknowledging   the  contributions of the Super Eagles midfielder  to the success of the Leicester City in the Championship , Senator Enoh  took the opportunity to discuss the upcoming World Cup qualifying matches, scheduled to commence early next month.

    The minister emphasized the importance of preparation and urged Ndidi to play a pivotal role in the Super Eagles’ quest to secure their place in the World Cup. He encouraged Ndidi to continue to exhibit the same level of dedication and skill that has made him a valuable asset to both club and country.

    Also, Ndidi conveyed his appreciation to Senator Enoh, expressing gratitude for the minister’s undiluted support and commitment to the well-being of the Super Eagles team, particularly during the recent Africa Cup of Nations (AFCON) tournament.

     He commended Senator Enoh for the excellent care and assistance provided to the team throughout their campaign.

    The meeting concluded on a positive note, with both Ndidi and Senator Enoh expressing optimism for the future of Nigerian football and pledging their continued support to the advancement of the sport in the country.

    Napoli are likely to  be without their talismanic striker Victor Osimhen for  Friday’s Italian Serie A clash with Fiorentina .

    The Nigerian International  who suffered a muscle strain earlier in the week , has reportedly  been training separately from the rest of the  team.

    “On Monday and Tuesday Osimhen underwent therapy and personalised training in the gym.Jesper Lindstrom and Piotr Zielinski followed custom programmes outside while Mario Rui had a gym session and Victor Osimhen had physiotherapy,” the club posted on their  website.

    According to football Italia, The Partenopei fell behind the Viola in the Serie A standings last week and need to win this game to have any chance of getting eighth place.

    The  news outlet stated further that  coach Francesco Calzona’s squad is significantly weakened without Osimhen who last year won the Italian Capocannoniere (top scorer award).

    Osimhen scored 15 goals in Serie A this season, but has been affected by numerous injuries and his absence due to the Africa Cup of Nations in January and February.

    If he doesn’t make it for Friday, then it is likely that Giacomo Raspadori or Giovanni Simeone will step in as the centre-forward.

    Yet Osimhen is however expected to recover in time to be part of the Super Eagles team for the upcoming 2026 FIFA World Cup qualifier against South Africa and Republic of Benin next month.

    Injured Ebenyo laments over Okpekpe dashed  dreams

    Daniel Ebenyo’s dream of becoming the first man to successfully defend the  Okpekpe 10km race title has been derailed by injury.

    The 28-year-old  who won the men’s title last year had promised to return this year to his adopted  second country, Nigeria, but an injury he sustained in training means he will not be in Okpekpe to defend his title.

    The Kenyan  has equally  lamented his inability to be the first man to break 28 minutes at the race after setting a 28:28 course record in 2023.

     “I had a dream to be the first man to defend my title and  run another course record but definitely I can’t again,” the Kenyan  reportedly said  in  a message to the Okpekpe race media.

    While  wishing the athletes who will compete for honours this year all the best, Ebenyo also has nice words for the organizers of the world class, gold label 10km road race.

     “ I am  hereby wishing all the runners all the best and may the best athlete win,” he  said. “Okpekpe is always a bridge and a mother to all races in Africa.

    “God bless Okpekpe and God bless the organisers of the race. See you next year,”  added  Ebenyo who made the podium at both the World Athletics Championships in Budapest and World Athletics Road Running championships in Riga after emerging Okpekpe race champion last year.

    This year’s race is the 10th  in the series and organisers have assured of another world class event come May 25 in Okpekpe in Edo state of Nigeria.

    The race is the first road race in Nigeria to have its course measured by a World Athletics’ certified measurer  and the first be in West Africa to be  granted label status to depicts its world class status.

    World Cup 26: Chadian referee to decide Nigeria, South Africa fate  

    Chadian official, Alhadi Allaou Mahamat will be in the centre when the Super Eagles host South Africa’s Bafana Bafana in a 2026 FIFA World Cup qualifying match at the Godswill Akpabio Stadium, Uyo next month.

    Mahamat, 38, became an international referee 12 years ago and has officiated in the CAF Champions League and CAF Confederation Cup competitions. He was also a referee at the 34th Africa Cup of Nations held in Cote d’Ivoire earlier this year.

    Mahamat will work with Sudanese official Mohammed Ibrahim Abdallah (assistant referee 1), Abelmiro Dos Reis Monte Negro from Sao Tome & Principe (assistant referee 2) and compatriot Pousri Armi Alfred (fourth official) at the encounter that will commence at 8pm Nigeria time on Friday, 7th  June.

    Ahmed Sayed Abou Elela from Egypt will serve as the referee assessor while Ghanaian Munkaila Nassam Adam will be the commissioner for the Day 3 clash.

    CAF has also appointed Ethiopian official Bamlak Tessema Weyesa, 43, as the referee for the Day 4 encounter between the Super Eagles and the Cheetahs of Benin Republic at the Stade Felix Houphouet-Boigny, Abidjan. That match will kick off at 4pm CIV time (5pm Nigeria) on Monday, 10th June.

    An icon of refereeing on the African continent, Bamlak Weyesa will work with compatriots Temesgin Samuel Atango (assistant referee 1), Tigle Gizaw Belachew (assistant referee 2) and Tewodros Mitiku (fourth official). Djamel Haimoudi from Algeria will be the referee assessor while David Yameogo from Burkina Faso will serve as the commissioner, and Ivorian Claude Elloh will work as security officer.
