Kogi governorship poll: INEC, APC, Ododo ask tribunal to dismiss SDP’s petition

The Independent National Electoral Commission (INEC), Kogi State Governor Usman Ododo, and his party, the All Progressives Congress (APC), have urged the State Governorship Election Petition Tribunal sitting in Abuja to dismiss the petition filed by the Social Democratic Party (SDP) against the result of last year’s election.

The tribunal yesterday reserved judgment till a date to be communicated to the parties in the dispute over the November 11, 2023 poll.

The SDP and its candidate in the election, Murtala Ajaka, are, by their petition, challenging the victory of Ododo in the November 11 poll.

Lawyers to the parties in the petition yesterday made their final submissions and adopted their written addresses.

The INEC, the APC, and Ododo urged the three-member panel tribunal, led by Justice Ado Birnin-Kudu, to dismiss the petition for being unmeritorious.

INEC’s lawyer, Kanu Agabi (SAN), argued that the petition lacked merit and was incompetent.

He said: “It is our humble submission that your work in the determination of this petition is simplified in recent judgments by the Court of Appeal and Supreme Court.”

The former Justice minister averred that the Court of Appeal had decided that if the grounds of a petition are inconsistent with one another and also inconsistent with the reliefs sought, it should be struck out.

He added that the evidence led by the petitioners were grossly insufficient, citing a Supreme Court decision in the case of Tonye Cole against the INEC.

Agabi said the Supreme Court’s decision in that case “is to the effect that once the evidence called is grossly insufficient, there is no evidence”.

He added: “In that case, the petitioner filed 305 witness depositions but only adopted 40 of them. The petitioner only adopted about 13.1 per cent of the witnesses’ depositions.

“In this case (the petition by the SDP and Ajaka), the depositions adopted represent just about 3.6 per cent of their witnesses’ depositions.”

The eminent lawyer said the petitioners only called 25 witnesses, stressing that in mathematical calculation of evidence, 3.6 per cent of Ajaka’s witness deposition adopted in the petition amounted to a failure and, therefore, ought to be dismissed.

Agabi argued that the petitioners’ witness, who testified about the Bimodal Voter Accreditation System (BVAS) machines, clearly stated that he could not guarantee whether those were the BVAS used.

He said the witness was not the maker of the inputs in the BVAS machines, adding that the evidence contained in the BVAS machines fell short of what was required under the law.

He argued that of the 25 witnesses the petitioners called, there was no polling unit agent among them.

“In other words, not a single person who observed the election was called. Besides, the star witness could not distinguish between what he heard and what he saw when questions were put to him,” Agabi said.

Ododo’s counsel, Joseph Daudu (SAN), argued similarly, faulting the competence of the petition, which he said was statute barred, having allegedly been filed out of time.

Daudu prayed the tribunal to dismiss the allegation of forgery the petitioners made against his client.

The lawyer argued that such an issue bordered on pre-election matter, which could not be raised at the state of post-election litigation.

He also argued that Section 137 of the Electoral Act, which the petitioners cited on allegations of over-voting, was inapplicable.

Lawyer to the APC, Emmanuel Ukala (SAN), also urged the tribunal to dismiss the petition for lacking in merit.

He said President Bola Tinubu’s administration’s Renewed Hope Agenda was anchored on delivering digital services through technological solutions, especially Artificial Intelligence (AI), Internet of Things (IoT), and drones, amongst others, to solve Nigeria’s critical problems.

According to him, NITDA is partnering Cisco to boost agricultural productivity and food security with the adoption of technologies to be extended to unserved and underserved areas of the country.

Abdullahi, who took the Cisco team round some designated farms in Abuja, said the digital company would work with a firm in Maiduguri, the Borno State capital, to develop a learning centre on the use of AI, IoT, and other technology solutions to improve businesses.

“The MoU we signed today is aimed at accelerating the adoption of technology solutions as well as digital services to enhance agricultural productivity and improve health care services, security, among others.

“This is the vision of Mr. President, as encapsulated in the Renewed Hope Agenda. Our Minister (of Communications, Innovation, and the Digital Economy), Dr. Bosun Tijani, has developed five pillars for the realisation of the vision.

“Here at NITDA, we have seven pillars for our strategic plans. All these are geared towards economic transformation and accelerated development,” Abdullahi said.

Cisco’s Country Director Naidoo said Nigeria would benefit from the MoU through improved agricultural production, creation of jobs and empowerment of the citizens financially.

He said Cisco had been working with various governments in Africa and America to create innovation hubs.

The country director announced that technology experience centres would be created across Nigeria to boost security services and business units.

Naidoo said his organisation would create inclusive modules that would empower local communities and make them benefit from various jobs in the digital services sector and other related sectors.

Buratai backs Fed Govt’s rejection of foreign military bases

Former Chief of Army Staff, Lt. General Tukur Buratai, has voted for autonomy, saying Federal Government must not allow foreign forces in its territory.

Buratai’s position came after allegations by some n orthern leaders that United States and France were lobbying for new defence pacts to pave the way to redeploy their expelled military forces from the Sahel.

“I commend Federal Government for its stand against the reported planned redeployment of U.S forces being withdrawn from Niger Republic to Nigeria,” he soldier-diplomat, who was said.

He added: “The minister of Information and National Orientation made it clear Nigeria had no plan to harbour the troops on our soil.”

In a letter to the President, some northern leaders warned that the presence of fo reign military bases would worsen relations between Nigeria and Niger as well as Francophone countries…”

In an interview, David Greene, U.S chargé d’affaires in Nigeria, refuted the reports.

“I am not aware of any such conversation, and I am not sure whose purpose it serves to agitate on this point,” he said.

But Buratai noted given Nigeria’s continental and regional clout, strategic autonomy is  the best doctrine from which to manage disruptive international geopolitical theatre.

He said in 2014 and 2015, Nigeria had declined deployment of UN or AU international force to fight Boko Haram.

‘‘Nigeria rejected a UN or AU international peacekeeping force to fight Boko Haram in 2014 and 2015.

“Birth of the new MNJTF with headquarters in Ndjamena was the solution to a foreign force deployment that could have placed these foreign forces as an inter-position force between Boko Haram territory and Nigerian territory.

“Implication of this is that it could have given territorial legitimacy to the insurgents.

“Similarly, as Army chief, I had to recover Gamboru-Ngala from the insurgents to prevent deployment of Chadian Forces on Nigerian soil. The MNJTF Concept of Operation was to have three sectors.

“Sector 1 in Cameroon’s Far North, with Cameroonian troops. Sector 2 in Ngamboru-Ngala on our territory, with Chadian troops. Sector 3 in Baga in northern Borno State, with Nigerian troops.
