    Makinde seeks clearance for seven as commissioners

    Oyo State Governor Seyi Makinde yesterday sent seven names as commissioner-nominees to the House of Assembly for clearance.

    A source close to the House of Assembly said the list was delivered yesterday evening after plenary.

    Six of the nominees are returning. They are Seun Ashamu (son of the former House Speaker); Akinola Ojo, Prof. Musibau Babatunde; Faosat Sanni; Prof. Daud Sangodoyin and Adeniyi Adebisi.

    Mrs. Toyin Balogun, who was women coordinator of the Omi Titun 2.0 campaign organisaitn, is the only new comer among the lot.

    It could not be confirmed if the list contained their proposed ministry. The governor is also expected to announce Secretary to the State Government soon.

    NMDPRA tightens oil sector’s regulatory framework

    The Nigerian Midstream and Downstream Petroleum Regulatory Authority (NMDPRA) will in the next few weeks gazette and publish additional four regulations on its website.

    General Counsel and Legal Adviser, Nigerian Midstream and Downstream Petroleum Regulatory Authority (NMDPRA), Dr. Joseph Tolorunse, made this known at the meeting with the General Counsel and Legal Advisers’ Forum of midstream operators in Abuja.

    He said: “It is also our pleasure to announce that in the coming week, the Authority will gazette four more regulations for the midstream and downstream sector and the same will be published on its website.”

    He described the forum as the first of many engagements that the Authority will host with general counsels and legal advisers to engender and enhance the collaboration between the Authority as the regulator and the legal practitioners of the oil and gas industry.

    He urged the stakeholders to be confident that the Authority is enthused to receive their feedback and contributions.

    He noted that he looked forward to conversations and discussions to enable the Authority to create and enhance value for both industry players and Nigerians alike.

    Tolorunse said this is one of many of such parleys organised by the NMDPRA to enlighten our stakeholders to enable the smooth implementation of the Petroleum Industry Act.

    Meanwhile, the Chief Executive Officer, Mr. Farouk Ahmed said the Petroleum Industry Authority (PIA) is designed among other key objectives to create two distinct but complementary regulatory entities, and promote gas utilisation through deepening of midstream operations.

    According to him, it will also unbundle the composite licensing regimes to encourage more participation across the upstream, midstream and downstream value chain.

    He added it is to “attract local and foreign investment and sustainably grow our industry for our host communities and Nigerians.”

    Ahmed noted that is, therefore, imperative that as co-implementers of this Act NMDPRA does not lose sight of the key objectives and deliverables of the PIA which took over 20 years to develop.

    Executive Director, Mr. Ogbugo Ukoha, who represented him, said the essence of this engagement is to deliberate on the legal framework for the oil and gas industry as intended by the PIA 2021, present clarity and insights to the sections of the law with diverse/different interpretations.

     He said the forum was aimed at clarifying the sections of the law with diverse/different

    interpretations.

    He added that it is also to discuss value chain propositions in a deregulated market and propose a way forward for a seamless operationalisation of the objectives of the PIA.

    Continuing, the CEO noted that stakeholders and potential investors require regulatory

    clarity to drive investment decisions and guide operations to ensure compliance with legal provisions and prevent reputational damage.

    The NMDPRA boss said providing regulatory clarity is also beneficial to the regulators as it will allow both entities to focus on their mandate as intended by the law for the benefits of the industry and Nigerians.

    Rate convergence: naira narrows down to N763/$

    The naira yesterday lost N7 to close at N763/$ at the Investors’ and Exporters’ (I&E) window.

     The naira exchanged at N765/$ at the parallel market, an indication of rate convergence between the official and black market rates.

    The local currency, which closed at N756/$ on Tuesday, was unable to sustain the appreciation tempo as demand for dollars surpassed supply from domestic and foreign investors.

     The  Central Bank of Nigeria (CBN) had abolished multiple exchange rates and adopted a market-driven model under the I & E Window.

     The apex bank is implementing foreign exchange reforms meant to improve transparency and accountability into the market and boost foreign capital inflows to the economy.

     The unification of multiple exchange rates into the I&E window has been described by stakeholders as a game changer in the apex bank’s plan to achieve exchange rate stability. 

     The policy, which allowed forex dealers and investors to buy and sell dollars at the exchange rate of their choice, provided they could find buyers. This move aims to ensure that the naira is allowed to trade at the market-clearing rate in the forex market.

     Managing Director, Economic Associates, Dr. Ayo Teriba, said the Bureau De Change (BDC)/ parallel market rate is a reliable indication of market realities, and it is stable.

     “The volatile price correction in the I&E rate should trigger equally strong reduction in demand plus an increase in supply in that window. That  would make the market settle back towards equilibrium in the next few days. I expect the rates to strengthen across all windows before the end of this week. I expect the unified rate to move towards N600/$ or stronger in the next week or so.”

     He said the unified exchange rate would also boost government revenue from the sale of forex at an attractive rate.

    He said aside from saving money that the government is losing by giving access to forex to some people below market rate, it will also end the forex subsidy regime that has created frivolous demand in the market. He added that with a single rate market, the government will get more revenue, since all the forex at its disposal will be sold at the market rate.

    Teriba said: “The ‘privileged persons’ who access the cheap dollar and sell to the Bureau de Change operators will no longer see it as attractive. The presence of the special rate for special people means that some of the special people who don’t need the forex will demand it just because of the profit they make from it.”

    Managing Director, Financial Derivatives Company Limited, Bismarck Rewane, explained that in continuation of the fundamental reforms in the forex market, the CBN announced the relaxation of the domiciliary account restrictions. Hitherto, cash deposits and withdrawals were limited.

    He said the market’s reaction to this was the instant appreciation of the naira at the parallel market.

    “This is good news for traders who source dollars mainly at the parallel market. With this development, it is likely that imported inflation, which is a function of the exchange rate, begins to taper,” he said.

    Continuing, Rewane said the adoption of a single exchange rate and the “willing buyer-willing seller model” by the CBN is, no doubt, cheery news for the market.

    He said the new exchange rate framework is expected to increase transparency in the forex market, reduce exchange rate misalignment and transaction costs, and buoy investor confidence.

    “However, exchange rate management goes beyond exchange rate unification. It must address issues surrounding market structure, easy access and adequate supply. This means effectively dismantling forex rationing, administrative controls, and reviewing import restrictions. As Barack Obama declared, “Africa doesn’t need strongmen, it needs strong institutions,” Rewane said.

    Cristiano Ronaldo has always relished a sense of occasion and struck in typical fashion, bagging a winner on the same night he was honoured with a plaque for his 200th international appearance.

    Al-Nassr forward Ronaldo received a Guinness World Records certificate for having the most international caps for a male player.

    The closest to Ronaldo’s tally is Bader Al-Mutawa, who was capped by Kuwait on 196 occasions.
    Fittingly, Ronaldo marked the occasion by scoring the winner in the 89th minute as Portugal won 1-0 against Iceland, who had been reduced to ten men following the dismissal of Willum Thor Willumson.

    The 38-year-old turned home Goncalo Inacio’s header with a poacher’s finish and celebrated wildly.
    There was a pause before VAR allowed the goal to stand having originally been called offside in the build-up.

    20 killed in night attacks on Plateau communities

    Over 20 persons have been killed in  fresh attacks on Bwai and Chisu in  Mangu Local Government Area of Plateau State.

    It was gathered that the   incident occurred late night on Tuesday after residents had gone to bed.

    The attackers stormed the  communities and set houses ablaze .

     A resident, Bamshak Ishaya, said: “Some people were killed by militias at a community leader’s house at Chisu village around 11pm on Tuesday.

    “The COCIN RCC Church in Bwai which is along the Mangu-Bokkos road was also burned to ashes along with houses, vehicles and tricycles. People in Chisu community heard sporadic gunshots and ran to the residence of their community Leader, unfortunately, the house was set ablaze and 11 burnt bodies have been picked up this morning while the search is still ongoing.

    “At Bwai, apart from the church, houses around the market were also burnt and a woman who sleeps in her shop was burnt too. We are not sure if there are others that are yet to be discovered.”

    The Interim Management Committee Chairman of Mangu LGA, Markus Artu, confirmed the incident to reporters through telephone but had no details yet.

    His words:  “I am gathering the pieces. I am going on an on-the-spot assessment of the situation. We have conflicting reports. The security agencies said there was an attempt to attack but it was repelled but again, some other people are telling other stories.

    “I heard that they attempted to burn the church but it was repelled. I don’t have the facts, whatever I heard is speculative. As soon as I have them, I will let you know.”

    The Member representing Mangu South Constituency in the State House of Assembly,  Bala Fwangje, also confirmed the incident. He said: “Around 11pm, we had a call that  herdsmen came into Chisu and Bwai. This morning we heard that about 20 people were killed, houses destroyed, properties burnt. I am yet to get the full details.”

    Despite the 24-hour curfew that was imposed in the local government on Monday by the interim management committee chairman, the unrepentant herders stormed the two communities to carryout their attacks.

    The state Police Command did not confirm the incident as the  spokesman, DSP Alfred Alabo did answer calls to his telephone at the time of this report.

    Governor Caleb Mutfwang yesterday restated commitment to ending insecurity in the state.

    Swearing-in four new Permanent Secretaries into the State Civil Service, at the Government House, Jos, Mutfwang said steps had been taken and measures put in place to arrest the situation.

    The governor said that he also had some interactions with President Bola Tinubu, who assured him of assisting with the necessary support to find lasting solutions to insecurity in Plateau.

    He said he would also deliberate with the newly appointed security chiefs, as part of the efforts towards tackling the challenge.

    The governor explained that in furtherance of his commitment to urgently address the issue of security, he had appointed a Special Adviser on Security Matters, Brig.-Gen. Gakji Shipi (rtd), based on his professional competence and passion for Plateau.

    He said that Shipi was sworn in with the new permanent secretaries, to enable him immediately swing into action of organising the state security assets and deploying them to address the problem.

    “Even last night, I regret to say that we have lost 14 people. Before I was sworn in, Mangu and parts of Riyom local government areas have been coming under severe attacks.

    “In Mangu alone, we have buried over 150 people, and as I am talking to you, probably about 16 to 20 villages have almost been pulled down.

    “We are not fighting for any tribe or religion. Every inch of Plateau is dear to us and we will fight to protect it,’’ he said.

    Cobbler, cleric jailed for defiling girl

    An Ikeja Domestic Violence and Sexual Offences Court  yesterday sentenced a cobbler, Alex Michael, and an Islamic cleric, Alfa Yakubu Isiaka, to life imprisonment for defiling an underaged girl .

    Justice Raman Oshodi sentenced the convicts having found them guilty of a two count charge of defilement brought against them by the state.

    The convicts  were alleged to have had sexual intercourse with a 13-year-old girl and were arraigned before the court on May 27, 2020. They were first arraigned before Justice Sybil Nwaka before her elevation to the Appeal Court. They had pleaded not guilty to the two counts.

    The defendants were re-arraigned before Justice Oshodi on August 3, 2021. They pleaded not guilty to charge read to them.

    They were said to have had sexual intercourse with the underage girl three times between October and November 2019 at Fatai Olukoga Street, Igbo Olomu Estate, Ikorodu.

    Michael was said to have had canal knowledge of the girl three times while Isiaka was said to have also had unlawful sexual intercourse with her two times. The prosecution team, Babajide Boye, O. Aluko and I. D. Solarin, commenced trial and called witnesses including the  Investigation Police Office (IPO) and the survivor, to testify against the defendants.

    The prosecution also tendered documents as exhibits to support the charge of rape against the defendants.

    Michael had in his statement  said the young girl normally came to their house and a woman called mummy Ada always sent her away.   He stated that on the day of the incident, “she came to my house again when she entered she sat on the floor and she took my phone and started watching video on it.

     “When I looked at her she laughed and I asked her the reason she was laughing and I found out she was watching blue film on it. I collected the phone from her. She went out and later came back and took the phone again.

    “While I was lying down on my bed in our parlour, she said I want you to see what I’m watching. That was when she started kissing me and we had sexual intercourse together.”

     He claimed that the survivor came the next day and that they had sex again.

    Led by defence counsel, O. Fatoyebo, on October 11, 2022,  Isiaka told the court that the girl was his neighbour but insisted that he did not have any relationship with her and did not know why he was in court.

    He said that the allegation of defilement was trumped up charge against him because he slapped the survivor’s sister, a situation he said led to a scuffle between him and the survivor’s father.

    He said that at the police station, he was beaten and threatened before he wrote Exhibit P2. (his confessional statement).

    Delivering judgement, Justice Oshodi held that the prosecution proved the case of defilement against the defendants and therefore sentenced both to life imprisonment.

    The court also held that the statement he said he wrote denying the allegation was not tendered.

    “But no such statement has been produced by the parties. None was contained in the proof of evidence. The only statement before the court is Exhibit P2. I have looked at Exhibit C. I see that Exhibit P2 was signed in five places by the first defendant at the top and bottom of the front page and the top and bottom of the second page.

    “The confession in Exhibit P2 was corroborated by the IPO who testified that the first defendant admitted that he had sexual intercourse with the  prosecutrix three times. I also believe that the first defendant had the opportunity to commit the crime.

    “He was the survivor’s neighbour and knew her well. I believe that the confession in Exhibit P2 is possible and is consistent with other facts which have been ascertained as articulated in this judgment.

    “Consequently, I believe that Exhibit P2 is a direct, positive, and unequivocal admission of guilt by the first defendant…”

    After citing plethora of decided cases, he held that, “you had sexual intercourse with the victim who, to your knowledge, was a child. You both admitted this crime to police officers at the Owutu Police Division, Ikorodu.

    The judge ordered that their name be registered as sex offenders in the Lagos State Sexual Offenders’ Register.

    “You, Alex Michael, said that you had sexual intercourse with the victim three times because she was flirting around you. You also shared phonographic materials on your mobile phone with the victim.

    “As for you, Yakub Isiaka (a.k.a. Alfa), the evidence shows that you had sexual intercourse with the victim twice. The first time, you gave her N500. The second time, you gave her N200.

    “Our laws in Lagos State have zero tolerance for sexual crimes.

    “The charge of defilement, for which you have both been convicted, carries a mandatory sentence of life imprisonment, which sends a signal that it is unacceptable.

    “I consider the seriousness of the offence to justify a life sentence, and that is the sentence I must, therefore, impose upon you.”

    He therefore sentenced each of the defendants  to life imprisonment.

    TRCN, JAMB strengthen partnership to boost service delivery

    The Teachers Registration Council of Nigeria (TRCN) and the Joint Admissions and Matriculation Board (JAMB) have said they are exploring means to strengthen collaborations to boost service delivery to Nigerians.

    TRCN’s Registrar, Prof. Josiah Ajiboye, said in a statement that the move was in tandem with inter-agency partnership in the Ministry of Education.

    On Monday, Ajiboye joined the Registrar of JAMB, Prof. Is-haq Oloyede, in inspecting the new Computer Based Test (CBT) facilities built by the board in Kaduna.

    According to Ajiboye, the new 1,000-seater CBT centre was recently inaugurated by former Kaduna State Governor Nasir El-Rufai.

    The TRCN boss said the visit, which was at the instance of the JAMB registrar, was aimed at forging stronger partnership between TRCN and JAMB with the former using the new facilities for professional qualifying examinations and digital training programmes.

    “Each of the CBT halls has a withholding room that can seat 250 candidates at a time and the centre has a big parking lot that can accommodate hundreds of cars,” he said.

    7.5 per cent diesel VAT may spike telecom tariff hike

    Telecom operators may be compelled to hike end user tariff in response to the implementation of the Federal Government’s economic policies, especially the implementation of the 7.5 per cent Value Added Tax (VAT) on automotive gas oil (AGO) or diesel.

    This will translate to an increase in the cost of making voice calls, payment for data services and using the short message service (SMS) or text message platform too.

    In the face of dearth of regular electricity supply from the national grid, mobile network operators (MNOs) and other service providers in the information communication technology (ICT) sector of the country are compelled to run their base transceiver stations (BTS) effectively on diesel.

    GlobalPetrolPrices.com puts the price of diesel at N842.25 per litre, stressing that ‘for comparison, the average price of diesel in the world for this period is N905.66’.

    Recall that the Federal Government had earlier in the week confirmed the commencement of the implementation of the payment of 7.5 per cent VAT on diesel.

    An industry source who chose to speak on condition of anonymity said diesel constitutes a significant percentage of the industry’s operating expenditure, stressing that proposals will be forwarded to the regulator, the Nigerian Communications Commission (NCC) for consideration of end user tariff hike.

    “We are all in it. The implementation of the 7.5 per cent VAT on diesel will definitely affect our operational cost on diesel. Remember it is the fuel for running our BTS across the country. When you add this new VAT to other official and unofficial tax and levies in the industry, you will appreciate the burden and the need for us to break even because we are in business. Remember that we have shareholders too,” the source said.

    Officials of the Nigeria Customs Service (NCS) and Federal Inland Revenue Service (FIRS) had the implementation. They insisted that AGO was not exempted from the payment of VAT based on the VAT Modification Order 2021.

    Diesel currently accounts for about 35 per cent of the operating costs of the mobile network operators (MNOs) .

    According to the National Bureau of Statistics (NBS) report, the cost of diesel had risen to N836.81 per litre in March 2023 from N539.32 per litre in the corresponding period of last year. This increase had inevitably pushed the monthly cost of BTS to N33.47billion in March 2023 from N21.57billion as at March last year pushing the cost to  N33.47billion per month following a 55.16 per cent year-on-year increase in the cost of diesel.

    According to the report, the cost of operating BTS is expected to exceed N401.67billion by year’s end. When the 7.5per cent VAT is added, this will mark a significant impact.

    Industry statistics estimate that mobile telecommunication operators use at least 40 million litres of diesel per month to power telecom sites. As of the end of 2021, the NCC revealed that there were 38,288 base stations in the country. This figure may have gone up.

    NCC CEO, Prof Danbatta Danbatt said the Commission had worked tirelessly to ensure telecom services were brought to people living in rural, unserved, and underserved areas of this country, totalling 37 million people courtesy of the consultancy that was conducted in 2013.

    “By 2019, we had succeeded in reducing the clusters of access gaps to 114 through the deployment of the necessary infrastructure needed to bring services to people living in rural, unserved and underserved areas of the country. The deployment of infrastructure is in terms of base transceiver stations, which resulted in the reduction of Nigerians in those clusters from 37 million to 31 million in 2019.

    “By 2022, we have reduced the clusters of access gaps to 97 from 207 in 2013. The number of  Nigerians again have come down from 37 million in 2013 to 27 million as we speak. We achieved this by deploying, from 2009 to 2011, a total of 79 new base transceiver stations,” he said

    Danbatta stated that in 2013 to 2018, the telecom sector also witnessed the deployment of additional 124 base transceiver stations while from 2019 to 2022, a total of 364 base transceiver stations were deployed.

    “So far, the total numbers of BTS we have deployed to date between the time the access gaps were identified till the end of 2022 are 567,” he said.

    For efficiency and backup purposes, each BTS must have a minimum of two diesel-powered generators.

    Efforts to get the reaction of the Association of Licensed Telecoms Operators of Nigeria (ALTON) proved futile as calls made to the telephone number of the group’s chairman, Engr Gbenga Adebayo rang through unpicked while that of the group’s Head of Operations, Gbolahan Awonuga, was also not picked.

    Awonuga had earlier said the telecoms industry is the highest user of diesel in the country while the average revenue per user (ARPU) has continued to decline.

    He estimated that the industry consumes over 40 million litres of diesel per month. Awonuga argued, “The report that we are consuming about 40 million litres of diesel per month is correct and should be more than that presently. The quantity has not decreased.”

    But last year, ALTON, via a letter to the NCC, said:  “The telecommunication industry has been heavily financially impacted following Nigeria’s economic recession in 2020 and the effect of the ongoing Ukraine/Russia crisis.

    “This has resulted in an increase in energy costs (which constitutes an appreciable 35 per cent of ALTON’s members’ operating expenses).”

    In view of these circumstances, the MNOs had proposed a 40 per cent hike in the cost of telecom services due to the hike in diesel prices.

    Relocate tribunal to Abuja, Akwa Ibom YPP candidate pleads

    The Young Progressives Party (YPP) governorship candidate in Akwa Ibom State, Senator Bassey Albert, has urged the Court of Appeal president to relocate the Election Petition Tribunal from Uyo to Abuja for safety reasons.

    In a June 21 petition by his lawyer Ahmed Raji (SAN), Albert claimed that the tribunal venue was no longer safe for him and witnesses.

    He copied the Chief Justice of Nigeria (CJN) Olukayode Ariwoola and the tribunal chairman.

    Albert is contending that he ought to have been returned winner of the March 18 governorship election in the state.

    Raji said a staff of the University of Uyo, Daniel Akpan, declined to give evidence for the petitioners on the basis that his life was being threatened, to the extent he had to remove his family from Uyo.

    He said Akpan was compelled to testify on whether he is a staff of the University of Uyo, who certified the academic records of Governor Umo Eno as to his qualifications.

    Raji said an incident on June 20 compelled his client to seek a relocation of the tribunal.

    “The aggregation of events…has irresistibly prompted me to write this letter, not only for the safety of our lawyers but for justice, equity and fairness, which can no longer be realised in Uyo.

    “To this end, I hereby apply with humility, on behalf of myself, my team of lawyers and the good people of Akwa Ibom State, that the Governorship Election Tribunal sitting in Uyo, Akwa Ibom State, be relocated to Abuja.”

    The SAN said during the proceeding of June 20, Akpan, was prevented from testifying.

    “As a proactive measure, the petitioners had to apply for additional reinforcement and security personnel…,” he wrote.

    Raji stated that Akpan complained that his life was in danger. “Unfortunately, the tribunal rebuffed this complaint, perhaps because he was perceived to be a helpless common man,” Raji wrote.

    He said he applied for an order that nobody should arrest or whisk the witness away, but “the tribunal appeared to downplay the importance of the life of Ekpan,” adding that it was described as “administrative issue”.

    “Whilst the Tribunal adjourned further hearing to June 21, unknown men, military men and officers of the police in different squads, invaded the court and blocked my team and me from going home.

    “We were all ordered to alight from our vehicles, wielding heavy armament, weapons, shooting into the air, bullets, and tear gas.

    “The whole environment was engulfed in commotion, with our team of lawyers escaping on foot and hiding in bushes, scampering for safety.”

    The SAN said without the armoured car that conveyed him, he would have been harmed after being held hostage for over two hours.

    Activists caution Dokubo over oil theft allegation

    Some activists, under the aegis of the National Probity and Values for Nation-Building Organisation (NPVNBO), have cautioned former Niger Delta militant leader, Alhaji Asari Dokubo, over his oil theft allegations against the military.

    They urged Dokubo to desist from making what they called unguarded and inflammatory remarks that could heat up the polity at a time a new administration was just settling down to business. 

    In a statement by its spokesman Ademola Ojo, NPVNBO said it was dismayed by the sweeping allegations against the military in its alleged involvement in crude oil theft and bunkering.

    “We find it appalling that Mujaheed Asari Dokubo could make such wide, off-the-mark allegations against the Nigerian Armed Forces, particularly the Nigerian Army and Navy, for their alleged involvement in crude oil theft and economic sabotage.

    “We feel such spurious and unguarded claims should better be avoided as they are capable of heating up the polity within the Armed Forces in a government that is still in transition.

    “This is obviously tactless and garrulous and we believe the nascent administration of President Bola Ahmed Tinubu should not be distracted with such unsubstantiated allegations that are capable of sowing distrust,” Ojo said.
