    ICRC clarifies on national carrier

The Infrastructure Concession Regulatory Commission (ICRC) yesterday absolved Ministry of Aviation of secrecy and non – compliance with rules guiding execution of the public – private partnership on the national carrier project.

ICRC, which handles Outline Business Case for the proposed national airline told National Assembly in a memo due processes and approvals were secured.

The commission, which is leading negotiations for the deal, said Ethiopian Airline has 49 per cent; MRS Oil and Gas, 15 per cent; SAHCO, 15 per cent; Federal Government, five per cent while 16 per cent was  yet to be allotted.

ICRC memo showed the proposal was turned down five times by Federal Executive Council under Buhari before it was eventually approved the sixth time.

The body said the project was initiated by Ministry of Transportation in 2016 as part of Aviation Sector Roadmap, and approved by the former President.

It was to be implemented as a public-private partnership, for which ICRC’s regulatory guidance was sought. The ICRC provided the required guidance for implementation in line with requirements of ICRC Establishment Act 2005 and National Policy on PPPS.

Following the guidance provided, the following milestones were achieved:

“Constitution of project steering committee and a project delivery team to guide the implementation of the project. Appointment of a Transaction Adviser – this was done in compliance with the Bureau of Public Procurement Act. Lufthansa Technik was first procured but later changed to Airline Management Group/Traniero after obtaining FEC approval. Development and submission of an Outline Business Case by the Airline Management Group in 2018.

“The structure involved the Federal Government of Nigeria holding five per cent equity, while the remaining 95 per cent is held by private partners (the foreign partner who is required to have undertaken at Ieast 10 years scheduled international operations) will hold a maximum of 49 per cent, while the Nigerian partners hold a minimum of 46 per cent.”

The ICRC said its Certificate of Compliance to the OBC confirmed the viability and creditworthiness of the project.

Speaking on the reason why FEC rejected the proposal five times, the ICRC noted, “It is important to note that the OBC was presented to FEC six times before it was approved. This was due to the insistence by FEC that the Federal Government will not contribute any funds to the take-off of the airline as was initially structured. FEC requested that the project should be fully privately financed since it’s viable and bankable,” Ohiani noted.

The ICRC said after 10 weeks of advertisement, only the Ethiopian Airlines consortium submitted a bid and that the project proceeded to the negotiation stage, based on Section 5 (a) of the ICRC establishment Act 2005.

The section states that if after advertisement in accordance with Section 4 of this Act only one contractor or project proponent applied or submits a bid or proposal, or only one contractor or project proponent meets the prequalification requirements, the ministry, agency, corporation, body may undertake direct negotiation without competitive bidding for any contract to be entered into, pursuant to Section 1 of the Act.

On the reason why the documents were yet to be signed, the memo noted, “Several preparatory meetings were held as a prelude to negotiations between the Ministry of Aviation and other government stakeholders before engaging with the Ethiopian Airlines Consortium.

“The commission thereafter requested the implementation of the following before negotiations: the consortium to be a Special Purpose Vehicle; consortium to sign a shareholders’ agreement/updated consortium agreement; the 16 per cent unallotted shares to be fully allotted in compliance with CAMA 2022 and transparency principles; and project to adhere fully to the requirements of the request for proposal document.”

The memo indicated that negotiation was thereafter convened to discuss the issues highlighted for the consortium to implement but had to be suspended when it was observed that members of the consortium were working at cross-purposes.

This, it said, was based on the following observations/complaints by members; that the consortium had not agreed on their structure and function; some members were not privy to the documents under consideration; the consortium had not met on their own and had informed the meeting that the TA to the ministry had been the one calling for all their meetings and guiding their interactions.

It continued, “The consortium was thereafter requested to meet and resolve all their issues and present a common position for the purpose of negotiations and executing the PPP agreement with the government. They were unable to resolve their issues and sign the shareholder’s agreement as requested.

“This led to a letter of complaint from SAHCO expressing its concerns and not accepting the shareholders’ agreement as presented. Ethiopian Airlines responded with justification for the issues raised. Efforts to mediate through physical meetings and correspondences towards ensuring the signing of the shareholders’ agreement are ongoing.

“A meeting of the government representatives was thereafter convened at the ICRC to harmonise the position of the government before engaging in any discussion with the private proponent.”

It said the meeting agreed that every member of the consortium would be required to sign the PPP agreement individually as well as the shareholders’ agreement.

It added that the meeting further agreed that the 16 per cent unallotted shares must be fully allotted; that the project must have duration to comply with the requirements of the ICRC Establishment Act and that all clauses that allocate financing and regulatory risk to the government must be reviewed and adjusted appropriately.

The ICRC said it wrote a regulatory position to all members of the consortium on April 17, 2023, with a review and highlighted issues that needed to be addressed and corrected before the shareholders’ agreement could be signed.

According to the commission, some of the issues included that the Ministry of Finance Incorporated to hold the five per cent Federal Government’s equity and sign the shareholders’ agreement on behalf of the government; full allotment of the 16 per cent unallotted shares in the consortium recognition and valuation of the Bilateral Air Services Agreements as part of Federal Government’s contribution to the project; provide clarity on the status of local airlines currently operating regional and international routes, in view of request for total rights over all the existing BASAs; and “the deletion of the clause that waives sovereign immunity by Nigeria.”

The ICRC added that the ministry convened a negotiation meeting on April 18 and 19, 2023, at the ministry “but could not proceed as representative of the Federal Ministry of Justice cited a court order restraining any action on the project.”

The memo indicated that the next step was for all shareholders to sign the shareholders’ agreement and that negotiation should resume and be concluded once the court order was lifted.

On the next step, the ICRC memo added, “Full Business Case to be prepared and submitted to the ICRC for review and issuance of certificate; presentation to the Federal Executive Council for approval; vetting of draft PPP agreement by Ministry of Justice; and contract execution” the report concluded.

Reacting to the report, a trade union leader in the aviation sector said he had followed the process of the Nigeria Air project from the beginning and was convinced that the right things were being done but had faced a lot of sabotage by people who, for reasons known to them, want to ensure that Nigeria Air does not see the light of day.

The unionist who preferred to be anonymous because of the sensitive nature of the issue, said the ICRC memo had exonerated the former Minister’s position that the process leading to the establishment of the national carrier has been transparent in all ramifications.

An aviation expert who craved anonymity said  local airlines are simply afraid of competence and capacities ET will willing to the Nigerian aviation industry.

Speaking in  a recent television interview,  the Chairman/Chief Executive Officer  of Air Peace, Mr. Allen Onyema  disclosed: ” Without SACHOL on the deal, Nigeria would have been in trouble.

He stated : ”  When you look at the shareholding agreement on Nigerian Air, without SACHOL, Nigeria would have been in trouble. The leadership of the entire management, the CFO, the CEO, all the management positions will be Ethiopians while the deputies will be Nigerians.

” This is farther  from the truth. Both the submissions from the Federal Ministry of Aviation and the ICRC confirmed that negotiations were still ongoing and there was firm agreement reached on the structure of the airline. This includes the management composition and other fine details that the were required to smoothly run the airline” so where did Onyema get that from? He queried. The expert also indicated that the ex-Minister, “Sirika was completely not a party to what each shareholder was negotiating and had no powers to decide who gets what. The ICRC was to midwife every step of the way like they’ve done on the project since inception.”

  • ‘Tourism can address revenue challenge’

    ‘Tourism can address revenue challenge’

Federal Government has been urged to de-emphasise its reliance on earnings from petroleum in its efforts to address its revenue inadequacy.

A United States-based tourism expert, Peter Egbudom, said it was time governments focus more on developing other sources of revenue, particularly culture and tourism.

Egbudom, the brain behind the annual Igbo Fest in Minnesota, United States, noted Nigeria is in need of legitimate foreign investment through tourism.

He said the country’s rich cultural heritage can be harnessed to attract Foreign Direct Investment (FDI).

“Our rich cultural heritage is an area governments and the private investor should develop to earn foreign revenue through tourism.

“With the Igbo Fest in Minnesota in the U.S, scheduled between August 10 and 11,  Nigerians can showcase our rich and diverse cultural heritage, as avenue to further promote our tourism potential.”

Egbudom, who spoke in Abuja, said the festival, the 28th, is organised by Umunne Cultural Association in Minnesota..

“It is no longer news Nigeria is facing its biggest challenge arising from diminishing internal revenue and inadequate foreign investments.

“With this scenario, Nigeria needs legitimate foreign investment through tourism .

“Our diverse cultural heritage and related potential have been left untapped. These  opportunities could be harnessed to attract investments.”

Centre seeks fair deal for visually impaired persons

RESOURCE Centre for the Blind (RCB) has said government should include visually impaired persons in normal schools and workforce.

Executive Director, Temitayo Ayinla,  spoke during a tour of the centre at its  “Open Day”  organised to mark visually impaired persons day.

The event, attended by people with vision and alumni of visually impaired institutions, showcased a day in the life of a visually impaired pupil.

Ayinla said the event celebrates the strength and capabilities of the visually impaired, and to highlight importance of inclusion for people with disabilities.

“We are showcasing the strength and capacities of the visually impaired and explore how we can foster an inclusive and enabling society for them,” she said.

Ayinla noted there is lack of inclusive schools, and many attend special schools, which isolate them from society.

She said there is a high unemployment among the visually impaired due to discrimination and stigmatisation.

“People feel that they are not capable to work because of their impairment,” she said.

Ayinla urged the government to implement laws that protect the rights of people with disabilities, and to provide resources to help them become more independent.

“There are many laws and policies in place to protect the rights of persons with disabilities, one of which states that five percent of a workforce in any organization should be reserved for special needs people,” she said. “The government should ensure that these laws are not just on paper but implemented and enforced.”

Ayinla also called for adequate infrastructure to be put in place for visually impaired people, such as accessible communication, transportation, walkways, buildings, and traffic light indicators.

“We want to change the myth that blind people are not an integral part of the society and that they cannot be major contributors to economic and social development,” she said.

The Open Day event was a great opportunity to raise awareness about the challenges faced by visually impaired people, and to celebrate their strengths and capabilities. RCB’s call for inclusion is an important one, and it is one that we should all support.

  • NDPC probes banks over data breach

NDPC probes banks over data breach

    • •Faults CBN’s collection of social media handles

The Nigeria Data Protection Commission (NDPC) said it has started probing some banks, an insurance company, a private university and other organisations for data breach.

The Commission’s National Commissioner, Dr. Vincent Olatunji, said the Commission had been inundated with complaints about data breaches.

He said: “In the last few weeks, the NDPC has received complaints bothering on unlawful data processing, unauthorised access to personal data, and violation of data subjects’ rights.

“Under part 10 of the newly-signed NDPA Act 2023, a data controller with a turnover of N200 billion yearly may pay as high as N2 billion, which represents two percent of the gross revenue. Not only that, but offenders also risk up to a one-year jail term.

“We are currently investigating Guarantee Trust Bank, Fidelity, Unity, Zenith banks, Leadway Insurance and Babcock University, among others, for data breach.”

Dr Olatunji said many microfinance banks are yet to align their operations with the requirements of data privacy and protection.

He also said loan organisations would face the law with the new mandate of the Federal Competition and Consumer Protection Commission (FCCPC) which requires lending firms to seek compliance and clearance from NDPC before approving online lenders.

“The commission is investigating over 400 complaints in the online lending sector. Soko Loan is already working on a comeback to the digital lending market, but yet to be approved,” he added.

Dr. Olatunji also faulted the recent policy of the Central Bank of Nigeria (CBN) directing commercial banks to collect the social media handles of their customers, saying it “is not necessary”.

On Sunday, the apex bank directed banks to collect and verify social media accounts as part of their know-your-customer (KYC) procedures for permanent or occasional clients.

The financial regulator said the new directive aims to prevent financial crimes and terrorism while boosting the precision and thoroughness of customer identification.

Dr. Olatunji, said data collection ought to go through due process.

Olatunji said before the enactment of the Nigerian Data Protection Act (NDPA) on June 12, indiscriminate collection of citizens’ data by the Data Controller Organisations (DCO) was not taken seriously.

He said there are requisite steps any data controller must take prior to the collection of data from the data subject.

The commissioner said any organisation that defaults was going against the law and causing a data breach, and as such, would attract fines.

“There are provisions in the law to go against any data controller be it private or government office, NGOs, hotels, because we are pro-citizens.

“The whole idea of this law is to protect the rights, the interests of Nigerians who are data subjects.

“We are already engaging with the CBN to let them know that what they have done is against the law because there are basic principles you must meet when you want to collect citizens’ data.

“There is data minimisation, meaning you don’t collect data beyond the purpose for which it was intended, purpose limitation, what purpose is it for,” he said, insisting that  “asking for social media handles is not necessary”.

Olatunji, however, said if the collection of the social media handles happens under public interest, which could include monitoring some transactions, there should be proper awareness among the customers.

He also called for an inquiry into why the CBN regulation came up and how best to resolve it in line with global best practices.

The Commission said it is investigating three banks, one university, and other suspects over an alleged data breach.

Olatunji said the investigation came following complaints from data subjects.

With the new NDPA, he said the Commission has been empowered with a legal framework to address issues of citizens’ data breaches.

Donkey Dealers Association of Nigeria has said it did not ask for N1 billion compensation for alleged confiscation and destruction of 414 sacks of donkey meat in Kebbi State.

Horse and Donkey Sellers Association had pleaded with the Federal Government to probe seizures of donkey meat by Customs in Kebbi.

Association’s President, Dike Ifeanyi, who spoke in Abuja, said the body that made the demand is unknown to it.

He described the action of Ikechukwu Aniude, who addressed himself as national president of the association, as impersonation of the national president of the body.

Ifeanyi alleged the unknown body is trying to come between it, Nigeria Agricultural Quarantine Service (NAQS) and Customs.

Threatening action, Ifeanyi expressed support for NAQS and customs for their efforts in sanitising donkey business.

“We thank NAQS for its support in regulating the industry, we also thank National Animal Production Research Institute (NAPRI) for its efforts in donkey breeding and ranching, and we are grateful to Customs for doing their duties within the law”, he added.

  • Agenda for Akpabio at ‘uncommon’ homecoming

Agenda for Akpabio at ‘uncommon’ homecoming

    By Anietie Ekong

It had all the trappings of a “state visit.” And indeed it was a state visit. It was Senator Godswill Akpabio’s first visit to his home state: Akwa Ibom State after he was elected the President of the Senate. As recalled by the Senator, people last saw him as a Senator-elect but on June 24, he returned to Akwa Ibom State as the President of the 10th Senate and the Number three man in the country.

Akwa Ibom State has produced many great men and women who have shaped the history, economy and politics of Nigeria. They include such great Jurist as Sir Egbert Udo Udoma, an astounding economist, Chief Clement Nyong Isong, the super cop, Mr Etim Okon Inyang, a great educationist, Chief Ibanga Udo Akpabio among many others.

In contemporary times the State has been blessed with such great leaders as Obong Victor Attah, Air Marshal Nsikak Eduok, Atuekong Don Etiebet, Dr Ime Sampson Umanah among others who contributed their quota to the growth and development of the State and Nigeria as a whole.

But none of these great men had risen politically to the position that Senator Akpabio currently occupies. So the excitement of the people during the homecoming of Senator Akpabio knew no bounds.

It turned out to be very prophetic that many years ago the people had gathered in unison to bestow the title of Uko Akwa Ibom (the pride of Akwa Ibom State) on Chief Godswill Akpabio.

The significance of his visit was not lost on Akwa Ibom people as the people led by the State Governor, Pastor Umo Eno turned out en masse to behold and welcome their pride, their illustrious son to the State and to wish him well as the Chairman of the National Assembly.

Governor Umo Eno has proven to be a different breed of politician unlike his predecessor, Mr Udom Emmanuel. Despite differences in political affiliation, many were surprised on June 13, the date of the inauguration of Senator Akpabio as the President of the Senate, when he led politicians in the State, including Senator Akpabio’s estranged allies to congratulate him on his election.

In the words of Governor Eno, “Today I’m leading a delegation to celebrate what God has done for us as a people. And this celebration is across party lines.

“We thank God for the gift of our Senate President, a son of Akwa Ibom State and we have come to celebrate with him. Today party politics have broken down and for the first time after the elections, I see everyone coming together to celebrate this great feat of our state….”

The sentiments on the homecoming of Senator Akpabio were not different.

The joy and enthusiasm on the faces of the people who turned out at the Victor Attah International Airport, Uyo to receive Senator Akpabio was not misplaced. The last time anyone from the Southsouth occupied the position of the Senate President was in 1979 through the late Dr Joseph Wayas. Pastor Umo Eno led the State Deputy Governor, Senator Akon Eyakenyi, captains of industry and who-is-who in the State to receive the Senate President at the airport.

The joy of the ordinary people was no less ecstatic as they lined up the streets from Uyo to Ikot Ekpene where the thanksgiving Mass was held at the Regina Pacis Auditorium of St. Anne Cathedral, Ifuho, Ikot Ekpene, to wave to the long convoy of Akwa Ibom people who had joined the Senate President in a show of support, solidarity and appreciation for his elevation to the position of Senate President and the Uncommon Transformation Chief Akpabio had brought to the State as the Governor between 2007 and 2015.

For those who are familiar with the discipline of the Catholic Church it was no mean feat for the Bishop, Most Rev Camillus Umoh to have agreed to celebrate the thanksgiving mass which was scheduled at very short notice. But the celebration reflected the mood of the people of Akwa Ibom State and the Church was not left out.

Setting the tone for the Mass, the priest saw the elevation of Senator Akpabio as the fulfilment of a self-imposed prophecy of 2018.

“He told the mammoth crowd that gathered to witness his defection from the Peoples Democratic Party to the All Progressives Congress at the Ikot Ekpene Township Stadium some years ago, that he is on a mission to reconnect the State and the Niger Delta region to the centre of Nigerian politics. What many people did not take seriously then has turned out true before our very eyes,” the priest said.

In his homily, Most Rev Camillus Umoh, charged Senator Akpabio to leave his marks on the sands of time at the end of his tenure as the Senate President.

“Our prayer is that at the end of your tenure, Nigerians would be able to say that a man from Annang land landed in Abuja and left with the imprint of Annang land and that you brought to bear the Catholic character of justice and fairness,” he said.

The Chairman of the Stability Group and former Governor of Ebonyi State, Senator Dave Umahi, who led other Senators to the Mass, in his goodwill message thanked the Catholic Bishop for accepting to hold the thanksgiving mass outside Sunday service. He likened the emergence of Senator Akpabio and the Church to that of a woman who prayed for a child but was blessed with twins.

“You did not only pray His Excellency into a great success at the election, but your prayers were also so intense, were so acceptable to God, that

Senator Akpabio was not only successful in the election, but became the Senate President of the Federal Republic of Nigeria,” he said.

Senator Umahi recalled the uncommon transformation of Akwa Ibom State under Chief Akpabio as Governor: “I was here last in the year 1991 as a young Engineer when I built Ibom Hall. And when I came back today after over 30 years, my case was like that of Queen Sheba that visited King Solomon. She said that the splendour she had been told of cannot be compared with what her eyes had seen. I missed my road because of this Uncommon Transformer. I could not believe it,” he said to the applause of the congregation.

An obviously elated Senator Akpabio thanked the people for their support and show of love.

“I thank you all for coming out to celebrate God’s goodness in my life and that of my family. I thank you for your support during the campaigns and election proper.

“To those who didn’t vote for me, I will represent you well. Continue to pray for me and my colleagues as we daily navigate and steer the ship of the National Assembly for the betterment of all Nigerians.

“This show of love humbles me. You will see the difference. What I want you to take back home is the fact that Nigerians have elected an Uncommon Senate President.

“We will run an Uncommon Senate for the benefit of the uncommon people. That is why I am here today to thank God for what he has done for me,” he stated.

Senator Akpabio also used the occasion of the homecoming to tour some Local Government Areas in his Senatorial District to say thank you to his constituents for their support during the campaigns and the elections. There was a general consensus that Senator Akpabio has started well and the people expect him to attract dividends of democracy to them.

JNI urges mutual respect, peace, harmony among Nigerians

The Jama’atu Nasril Islam (JNI) has called for mutual respect, peace and harmony among Nigerians.

The Islamic organisation stated this while facilitating Muslims on this year’s Eid-el-Kabir celebration in a statement by its Secretary General, Prof. Khalid Aliyu, yesterday in Kaduna.

The statement said the JNI, under the leadership of His Eminence, the Sultan of Sokoto, Muhammad Sa’ad Abubakar III, was delighted to extend heartfelt greetings and best wishes to the Muslim Ummah on this year’s Eid-ul-Adha.

Eid-ul-Adha is a significant festival celebrated by Muslims worldwide…

“It commemorates the devotion and obedience of Prophet Ibrahim (AS) to Allah’s command, as well as his willingness to sacrifice his son, Ismail, as an act of submission and faith,” it said.

According to JNI, this auspicious occasion serves as a reminder of the values of sacrifice, compassion and unity that are at the core of Islam.

“As we gather with family, friends and loved ones to observe the eid, let us reflect upon the importance of selflessness and generosity.

“This festive occasion encourages us to share our blessings with those less fortunate, fostering a sense of compassion and social harmony within our communities.

“The JNI commends the Nigerian Muslim Ummah for their steadfast commitment to the principles of Islam, their resilience in the face of challenges, and their unwavering dedication to promoting peace and harmony in our society,” it said.

The Islamic organisation said the festival provided an opportunity for Muslims to strengthen their bonds of brotherhood and sisterhood, reinforcing the message of love and unity that Islam embodies.

“In these times of adversity, JNI emphasises the significance of embracing diversity and fostering inclusive dialogue.

“It is through understanding, empathy and mutual respect that we can overcome barriers, bridge divides, and build a prosperous nation.

“We extend our sincere appreciation to the religious and community leaders who play a pivotal role in nurturing an atmosphere of peace, tolerance and coexistence.

“Their efforts in promoting harmony are commendable and contribute to the social fabric of our nation,” JNI added.

It also extended its felicitations to the new leaders at all levels in the executive and legislative arms.

“They should be mindful of the trust reposed in them by Allah and humanity, on which they will be asked to give account on the Day of Judgment. Nigeria is at a crossroads in every ramification.

“The new leaders should do everything possible as fast as they could to make life easier for the common Nigerians,” the statement said.

JNI noted with concern the continuous deteriorating condition of average Nigerians due to extreme poverty and high level of inflation.

It noted that only the common Nigerians were making painful sacrifices to keep the nation moving, “but the leaders are perpetually living in affluence, at the detriment of the malnourished commoners”.

The JNI urged Nigerian leaders to cut their extravagant lifestyles, make adjustments and come up with policies that would make life livable among Nigerian masses.

The Islamic organisation called for prayers for the well-being, prosperity and unity of Nigeria.

“May this festival inspire us all to work together for a brighter future characterised by mutual respect, peace and harmony.

“JNI wishes everyone a blessed eid filled with joy, love and blessings,” the statement added.

    ‘Strengthen personal relationship with Allah’

Lagos State Chairman of the ruling All Progressives Congress (APC), Cornelius Ojelabi, has admonished Nigerians to be obedient to Allah’s commandments.
