    ESVARBON prosecutes valuers for misconducts

    The Disciplinary Tribunal of the Estate Surveyors and Valuers Registration Board of Nigeria (ESVARBON) has begun prosecution of some estate valuers accused of professional misconduct.

    The tribunal sitting in Lagos is hearing several cases brought before it by the Nigeria Institution of Estate Surveyors and Valuers (NIESV) and other members of the body.

    In one of the cases brought before it, NIESV vs ESV Toyin Ilori, the defendant was charged with colluding with a non-registered company to secure and execute compensation/valuation job.

    The charge sheet reads: “That you ESV (Mrs.) Toyin Ilori in or about 2019 and 2020, being in the habit of executing compensation valuation jobs awarded to Oserepal Nig.Ltd., a non-Estate Surveyor and Valuer and unknown non-Estate Surveyor and Valuers who get such valuation jobs, execute the same for such unqualified persons contrary to Regulation 6, 8(1), 9(1) of the Estate Surveyors and Valuers Regulations 2014, and Code 9 the Code of Professional Conduct for Estate Surveyors and Valuers 2015, thereby committing an offence of professional misconduct, punishable under section 14 of the Estate Surveyors and Valuers (Registration, etc) ACT CAP E13 LFN 2004.”

    Ilori pleaded not guilty to the charge, the defense counsel, however, pleaded for more time to study the charge as it was recently amended by the prosecuting counsel.

    Based on the advice of the assessor to the Tribunal, the case was adjourned to 3rd September 2020.

    In another case, NIESV vs ESV Paschal Chinyelu, the defendant was accused of posting abusive contents on the Whatsapp platform of the NIESV Abuja chapter and refused to remove it even after the executives of the body had reached out to him.

    When asked to plead his case, the defendant claimed not to remember anything as he had an accident in January 2018, which affected his memory.

    In its ruling on the case, which by law, is referred to as ‘direction’, Chairman of the ESVARBON Disciplinary Tribunal, Sir Nweke O. Umezuruike PPNIVS, noted that while the defendant had claimed not to remember anything concerning the allegation, including his response to the query issued in July 2018 as he claimed loss of memory, he was able to remember his bank accounts when asked.

    “…the Tribunal came to the conclusion that the health condition of Paschal Chinyelu appears to be acute loss of memory, which makes him not to be in a position to practice the profession of estate surveyors and valuers and hereby directs that his name be struck off the register on all the instruments of registration recovered from him dated this 28 day of July 2020,” the ruling read.

    Commenting on the legal backing for the Tribunal, the Registrar, ESVARBON, ESV. (Barr.) Ifeanyi Uzonwanne, stated that the law establishing the board provided for it to have a disciplinary tribunal.

    “In the area of enforcement of discipline, it is no longer going to be business as usual. The board may have waited for cases of professional misconduct to be reported to it, without using the powers conferred on it by Section 13 of the Act setting it up. That section charges the tribunal with the duty of considering and determining any case referred to it by the investigating panel and any other case of which the tribunal has cognizance,” he said.

Okoro & Associates, Dr Meckson Okoro in a bid to foster real estate development and job creation in the country,

    Upon paying a courtesy call on the new President of NIESV, Emma Okas Wike in Lagos, recently, Okoro expressed readiness of his company to make the partnership a rewarding one. The meeting was predicated on four major policy thrusts for real estate development in the country.

    Intimating journalists on the development, Okoro said the partnership will “create a very strong bridge between the Federal Government of Nigeria, all state governments and Nigerian Institution of Estate Surveyors and Valuers, with a view to assisting the government at all levels on the best way to generate all the necessary funds to finance government activities and public-oriented projects in Nigeria without having to resort to borrowing or dependency on oil, revenue partcularly at this crucial period in the world that the unfortunate COVID-19 pandemic has created serious dislocation in the world economy.”

    Both parties agreed that the on-going National Advocacy and Publicity drive established by the immediate past regime of NIESV, in which Okoro functions as the Chairman, must continue to create positive impact within the Nigerian public. They noted that, within a very short time, the advocacy and publicity drive would stamp in the heart of the Nigerian public the identify of professional estate surveyors and valuers without the confusion of who estate surveyors and valuers are, as presently the case in Nigeria.

    The meeting further x-rayed the viability of using the National Real Estate Today and NIESV Half-hour, two TV programmes sponsored by Okoro and NIESV respectively, to generate jobs for members of the professional body through active penetration in government, corporate organisations and multinational companies.

    Both parties, however, agreed to collaborate effectively in using the advocacy and publicity machineries and platforms at their disposal to maximise and polish the image of NIESV and promote their membership.

    The President of NIESV commended Dr Chief M l Okoro whom he said “has sacrificed a lot of his resources for the image of NIESV”, and promised to discuss with the Council of the institution in order to fashion out a way to support National Real Estate Today which is the brain child of Okoro.

    In his response, Okoro noted that the incumbent President of NIESV was his assistant when he (Okoro) was the National Publicity Secretary of institution. The popular real estate professional recalled the peaceful working relationship with Wike, hinged on serving their institution better than they met it. He commended Wike for rising to become the President of NIESV, while promising to deploy his contacts and resources towards making him succeed in office.

    Austine, who believes real estate players are just scratching potentials in the industry, identified public perception as the strongest pillar for strong brands.

    The prime mover of Real Estate investors’ platform said: “No matter how good and reliable your product is, it’s not good enough until the public deems it fit to associate with it.”

    He demonstrated this as Chief Strategist for DPKay Homes and Property Limited when he led the team to overcome wrongful execution of court order by AMCON on one of its properties on Lekki Epe Expressway.

    The Lagos Wealth Summit 2018 keynote speaker at the University of Lagos recalled the victory with great relish.

    A real estate and property development expert, Mr Babajide Odusolu, has urged the Nigerian Government to partner private sector in solving housing problems across the nation.

    He said that government has no business engaging in the direct construction of homes for Nigerians.

    Odusolu made this submission during the ongoing Virtual Abuja International Housing Show.

    According to him, instead of the wasteful errors of the past, government should focus on providing a robust structure and support for the private sector to engage in the development of affordable homes needed to meet the huge housing deficit Nigeria currently faces.

    The immediate past MD of the Ogun State Property Investment Corporation (OPIC), said while the government’s desire to provide housing is laudable, his experience in the public sector has shown that government cannot by itself provide all the housing units needed, nor operate as effectively as the private sector.

    Odusolu said that the FG’s plan to provide 300,000 housing units in 12 months is not just impracticable but also insufficient to scratch the tip of the deficit.

    He said: “Government needs to actively involve the private sector in solving the problems of housing and home ownership in Nigeria. An enabling environment in terms of supporting policies and improved access to capital would bring urgently need stability and growth to the real estate industry. The government should focus on offering location incentives such as tax waivers, rebates and significant concessions to encourage property developers to invest in semi-urban and less premium locations that will make it easier for Nigerians to afford homes.”

    He added that the existing practice of developers focusing on delivering homes in premium areas is tied to a need to get quick returns on investment.

    “If an enabling environment is created and property developers are incentivized to build housing units in semi and peri-urban areas with government entering into guaranteed purchase agreements to secure off take, there will be a huge leap in the delivery and provision of affordable housing units,” he said.

    Such purchase guarantees, according to him, can be tied to a contractual obligation to train and use specified numbers of local artisans in every location.

    This he said would also deliver much-needed jobs in a sustainable manner.

    Odusolu who is presently the CEO of Octo5 Holdings, a real estate and property development company, said the old norm of Government awarding housing construction contracts would not offer the needed transparency required to attract long term capital to the industry. This is because “such contracts are usually tied to political patronage, are ineffective and actually dis-incentivizes investors; whereas if government provides access to seed capital, the private sector will deliver more than the announced number of homes at prices that are affordable for the average Nigerian.”

    The Nigerian Institute of Building (NIOB), is set to hold a virtual workshop that will alter the landscape of project delivery in the built environment for the better.

    In an environment of embarrassing and unwarranted building collapses with the attendant loss of lives and properties, the Institute is taking the bull by the horns in organising the workshop with the theme, ‘Building Production and Structural Stability’

    The workshop is scheduled to hold from Wednesday.

    The workshop addresses critical knowledge and practice areas which include the following: Fundamentals of foundation design and construction, basic structural analysis and design of building superstructure, software application and design of building structural system, structural failure in buildings, design of concrete mix and field application, builders and formwork design in building construction, and detailing of structural element in buildings

    The resource persons are highly experienced practitioners from various parts of the globe, including Australia, Middle East, South Africa and Nigeria.

    The Architects Registration Council of Nigeria (ARCON) has reiterated its commitment to play leading roles in the construction sector to eliminate poor building construction and save the nation from incessant building collapse.

    President, Architects Registration Council of Nigeria (ARCON), Oladipupo Ajayi lamented the incursion of the sector by quacks and those without sufficient knowledge to undertake the complexities of building.

    In a chat with The Nation over the weekend while reviewing the council’s activities in the last two years, he hailed the Federal Government for her approval for the association to commence the development of its Abuja office and the massive refurbishment of their Lagos office for optimum service to the public.

    He recalled that Minister of Works and Housing, Babatunde Fashola, inaugurated the current ARCON council on June 12, 2018 in Abuja.

    He bemoaned the inability of the architects’ regulatory body to get an office of its own, though it has been in existence since 1969 and promised to put machineries in place towards solving the age-long challenge.

    He however said the dream of a self-owned building was already coming true as ARCON had just gotten recertification of a landed property allocated to it by the Federal Capital Territory Administration (FCTA).

    “We wish to inform you that the council was allocated two plots of land at the Jabi District of the Federal Capital Territory in 1999 like other regulatory bodies in the built environment. The council, just like all other regulatory bodies, was affected by the activities of the land speculators. However, it is gratifying to note that the current council has successfully retrieved the land and would commence development. Members of the council have made personal commitments in terms of monetary, material and moral contributions towards the immediate commencement development”, Ajayi said.

    Appreciating the Minister of FCTA, Alhaji Muhammad Bello, Ajayi said the recertification could not have come at a better time than now.

    The ARCON president also thanked Fashola, his Minister of State, Abubakar Aliyu, an engineer, the ministry’s permanent secretary, Dr. Mohammed Bukar for ensuring quick approval to renovate its Lagos office.

    He revealed that the renovation of the Lagos office, a bungalow from the Federal Ministry of Works and Housing, is being undertaken by the supervising Ministry.

    Ajayi said upon completion, both offices will be fully automated, befitting modern day architectural practice.

    “The council was dubbed a council of change because we wanted to move architecture into the digitalized world. We have successfully put in place a portal that would serve the council better in this regard,” Ajayi said.

    The institute said the honour was for Ibrahim’s “renowned urban planning/housing development personality of international repute, exceptional entrepreneurial colossus and trailblazing technocrat.”

    Established in May 1995, the international institute is professionally structured to strategically advance entrepreneurial proficiency, cultivate management excellence and enhance the drive towards zero tolerance for corrupt practices in the various sectors of a nation’s economy, both in the public and private sector.

    The award was presented by the Executive Directors from the institute led by the Head West African Operations Dr Richards Ikpada Kpoku.

    Kpoku said the award is given to only individuals who have consistently demonstrated uncommon resilience and innovation in their various economic engagements.

    According to him: “Noah Ibrahim’s pioneering attitude towards urban planning/housing development, advocating for the use of renewable energy in real estate development and his exceptional entrepreneurial colossus has not gone unnoticed.

    “As a matter of fact, the institution is very proud of his national service delivery and the niche he has carved for himself leaving an unerasable mark in the Nigerian real estate sector.

    On motive behind this award, the Head West African Operations said: “The institution pays particular attention to identifying and recognizing highly resourceful and well-meaning individuals in any part of the world who have established and greatly distinguished themselves in their respective areas of stewardship towards nation-building and development.”

    Ibrahim appreciated the institute for recognising his works and promised not to relent in his efforts to tackle the housing deficit in Nigeria while creating a path that the next generation of real estate professionals can follow and use as a template in forging their own path.

    Prominent entrepreneur and Chairman of M.I. Okoro and Partners, Meckson Okoro, has said that there is no standard measurement for a plot of land in the country.

    Making the disclosure recently on a television show, National Real Estate Today, sponsored by his company, Okoro said, “There is no standard measurement for a plot of land in Nigeria. Some may even tell you that if you can’t build on a acre, forget it. I can authoritatively tell you that there is nothing like an official measurement for a plot of land in Nigeria.

    “It varies from state to state, and neighbourhood to neighbourhood, but no such thing as a standard measurement in the country. In Ikoyi today, some talk of a 3/4 acre. So, the issue of measurement has to be treated independently.

    “There is a difference between a tenancy agreement and a lease agreement. The tenant has no right to sublet to a third party without the consent or the landlord or his agents and he must also not carry out any structural renovation without the approval of the landlord.”

    In a bid to drive home his point, Okoro explained the obligations of a tenant in every tenancy agreement.
    His words: “The tenant may not refuse to carry out his obligations as contained in the tenancy agreement. For any reason, if the tenant wants to vacate the premises, there is a clause in the agreement that he must inform the landlord before the tenancy expires. Such notice must be issued between three to six months.

    “The tenants can’t just wake up and pack out. If the tenanat is living with other tenants, he has to consent to what is called service charge to ease the cost of the services commonly enjoyed by all. On such issues like the septic tank, waste management or generator power supply. These are the obligations of the tenant. He is even to repair what has been spoilt due to wear-and-tear during the tenancy or the occupation of the house.

    Okoro had, recently, called on investors, entrepreneurs and small business owners to invest in the Lekki Trade Centre. Similarly, the popular entrepreneur also spoke on the ultramodern Tejuosho Shopping market which has over 1,600 shops in the care of his company.

    His relentless calls on prospective entrepreneurs had necessitated a sightseeing visit by the members of Phone and Allied Products Dealers Association (PAPDA) to the Lekki Trade Centre.

    Recall that Okoro, recently, disclosed that efforts to promote real estates related ventures have taken a new shape, necessitating him to float the property television show, National Real Estate Today, aired on Sundays at 5:30pm on Television Continental (TVC), Saturdays at 10pm on NTA 2 Channel 5 and Thursdays at 2pm on Silverbird TV.

    Having bagged several advertorial deals, owing to its rich content and massive publicity, the show has continued to appeal to the senses of many businessmen and investors in the real estate subsector.

    A Real Estate Consultant, Simon Adozi, has revealed that the real estate business was more affected by the nationwide lockdown than the COVID-19 pandemic itself.

    Nigeria went into a total lockdown in March in Lagos, Ogun and Abuja, as part of measures to curb the spread of the deadly virus that has affected millions across the globe.

    The economic effect of the virus has been damning on many nations including Nigeria, as many have been rendered jobless while companies had to cut jobs/cost due to its effect.

    Speaking with our correspondent, Adozi who is an expert majorly in Commercial and residential properties in Nigeria and Dubai said that they “recorded more sales in May than in January and February.”

    As a real estate solution provider, Adozi assists individuals and families in the purchase of Real Estate properties and investments without hassles.

    “I felt so pained seeing people being scammed, their hard-earned monies lost due to bad decision making i.e buying properties that are not genuine from untrusted Real Estate or property agents and also, buying properties that they do not need. I had to step into the Real Estate business in order to rescue same from such bad investment decisions and also, educate intending investors so as to prevent recurrent losses,” he said.

    For Adozi, life as a real estate consultant is not a bed of roses. He revealed that “in a bid to source for cheaper lands and property investment, innocent investors fall prey to these fake Real Estate Agents, unprofessional and unqualified Brokers who rip them off their hard-earned funds as decisions taken may lead to loss of lands, investment properties and loss of tens and millions of Naira (funds) in most cases.”

    Speaking on the effect of COVID-19 on his line of work, he said that “Real Estate wasn’t directly affected by the COVID-19 Pandemic but rather affected by the LOCKDOWN as we recorded more sales in May than in January and February. More properties were sold after the LOCKDOWN than before. The only roadblock was that physical site inspection could not be achieved.

    “Soon, the normal movement will begin and site inspection will become possible.”

    Adozi also predicts that “after the Pandemic, the Real Estate sector will definitely be a hot cake because in RECESSION, Real Estate is the surest form of investment! In the Pandemic, it is also the surest form of investment! Therefore, to the Real Estate sector, the pandemic is a BIG advantage. The Pandemic sent Nigerians in Diaspora back home, making them purchase more houses and in turn, this increases the value of Real Estate sector.”

    The real estate sector also has other challenges apart from the coronavirus pandemic. According to Adozi, such problems range from regulation to marketing and so on.

    “Non-regulation by the Government of all Real Estate companies who are involved in Real Estate Business and marketing Real Estate properties is a very huge challenge because untrusted companies pose a high risk to intending investors. The Government should regulate the Real Estate Sector in order to protect the interest of property investors and limit or eradicate fraud in the Real Estate sector,” he said.

    For Nigerians planning to invest in Real Estate e or purchase land and property in Nigeria, Adozi believes that “there are properties that sell for as low as N50,000 and can be affordable by many.

    He, however, noted that “real estate investment is actually intended for those who want to be rich and not just for those who are rich as is perceived by some.

    “So, if you do not have a Real Estate Property Investment, you have no real claim to being a citizen in Nigeria. Pastor Paul Adefarasin made a statement about his father’s long term investment such that when it was liquidated was enough to start them up in life and also saw them all through school.”

    To guide upcoming Realtors, Adozi revealed that he has written a book titled ’10 DEADLY MISTAKES TO AVOID IN REAL ESTATE INVESTMENTS’ which “will guide you through the process of acquiring an investment or properties in the Real Estate sector in order to help you make wise investment decisions and this book will also resolve the major challenge of ‘IGNORANCE’ which some intending investors who lack knowledge of Real Estate investments and processes possess.”
