Court to hear pejury case against Obaseki Nov 16

    Our Reporter

A federal High Court in Abuja will begin hearing a suit by the All Progressives Congress (APC), and one other, accusing Edo State Governor Godwin Obaseki of lying about his academic credentials on November 16.

Justice Ahmed Mohammed picked the date yesterday following an application by the plaintiff’s lawyer, Akin Olujinmi (SAN).

Justice Mohammed reminded parties that the suit was filed on July 14 and being a pre-election case, has a life span of 180 days, which will end in January 2021.

He urged lawyers to cooperate with the court so the case can be determined before the expiry date.

The plaintiffs claimed, in their writ of summons, that Obaseki forged his university certificate which he presented to the Independent National Electoral Commission (INEC) to aid his qualification for the governorship election.

They also claimed there were discrepancies in the subject Obaseki claimed he passed in his West African Examination Council (WAEC) exam and in his testimonial.

The plaintiffs want the court to declare that Obaseki’s claim in his INEC form EC9 at column C, sworn to on June 29, 2020, at the Federal Capital Territory High Court Registry, to the effect that he obtained from the University of Ibadan in 1979, a Bachelor of Arts Degree in Classical Studies, is false and contrary to Section 31 (5) and (6) of the Electoral Act, 2010.

They also want the court to declare that Obaseki lied on oath when he swore to an affidavit on June 29, that he worked in Afrinvest Limited from 1994 to 2014 when he retired.

The plaintiffs also want a declaration that Obaseki ‘is disqualified from contesting election to the office of Edo State Governor for non-fulfilment of the constitutional requirement of Section 182(1)(j) of the Constitution of Nigeria and upon presenting false/forged certificate to INEC contrary to Section 31 (5) and (6) of the Electoral Act, 2010’.

Community policing: politicians sabotaged recruitment process

     Damian Duruiheoma, Owerri

TRADITIONAL rulers in Njaba Local Government Area of Imo State have accused the acting coucil chairman, Emeka Iheanacho, and other politicians, of sabotaging the recruitment of constables for community policing.

Chairman of Njaba Council of Traditional Rulers and monarch of Amazano community Caesar Duruegbusuo made the allegation at a stakeholders’ meeting at Nkume Community Hall.

Duruegbusuo said politicians hijacked the recruitment and sidelined the royal fathers who are the chief security officers of their communities.

According to him, this negated the instructions of Governor Hope Uzodimma, and said it could sabotage government’s security efforts.

He said: “Governor Uzodimma said traditional rulers should select people to fill up the community policing list. Unfortunately, politicians in the council decided to select their boys. We’re talking about security, and there is no way you will bring someone to secure any community without the leadership knowing who it is.

“We therefore reject the list sent for community policing from Njaba. The people we selected  were rejected by politicians who substituted them with their loyalists. No monarch should be held accountable for any security breach in any community in Njaba. Our governor should note this.”

But Chairman of the Interim Management Chairman (IMC) Emeka Iheanacho debunked the allegation, saying, “We chose only qualified candidates from the communities in Njaba”.

Iheanacho also denied that the royal fathers were sidelined in the selection process as they made contributions. He promised that the monarchs would be given the opportunity to make substantial contributions in future recruitments.

Ndam, who was a Commissioner for Lands, said: “With meagre resources at the state’s disposal, it is only now that the terrible picture of the magnitude of devastation in Calabar, Akpabuyo and Bakassi is emerging.”

He, however, believes the state can still come out stronger. “I believe all hands must support the governor in the middle of very stormy waters. This is not a time for distraction, finger pointing and blame game, as such can only dissipate energy that should be used to rebuild and restore our shattered infrastructure.

PDP admits error in Obaseki’s certificate

By Bisi Olaniyi, Southsouth Bureau Chief

The Peoples Democratic Party (PDP) has admitted the error in Edo State Governor Godwin Obaseki’s University of Ibadan (UI) certificate.

It blamed the photocopying machine for the error.

The error disqualified Obaseki from seeking a second term on the platform of the All Progressives Congress (APC).

A petition by the Action Democratic Party (ADP) and its governorship candidate, Iboi Emmanuel, accused Obaseki of forgery, giving false information and perpetuating electoral malpractices.

The party prayed the tribunal to disqualify Obaseki for his controversial first degree certificate and nullify the votes cast for him. It also prayed the tribunal to order the Independent National Electoral Commission (INEC) to conduct a fresh election, involving other qualified candidates, but excluding PDP and Obaseki.

But PDP, in its reply to ADP and Emmanuel on Tuesday, said there was a mix-up in Obaseki’s admission and graduation year.

The party also admitted that despite the error, Obaseki observed the mandatory National Youth Service Corps (NYSC) scheme. It added that the petition was incompetent and statute barred, describing it as a pre-election matter ‘which the tribunal could not entertain’.

It said: “While filling the forms for the election in 2016, Obaseki mistakenly filled in 1976 as the year of graduation, which was actually the year of his admission into UI.

“At the time Obaseki was completing his Form CF001 in 2016, he deposed to an affidavit, saying he had misplaced the originals of all his certificates, while changing offices, with the intention to apply for a re-issuance of the certificates.

“Subsequently, before Obaseki submitted his Form EC9 in 2020, the original certificate issued by UI was found, which has the signatures of then Vice Chancellor and Registrar. The original certificate was issued in A5 size. However, in order for the photocopy to be attached to the Form CF001, the size was reduced to A4 and in the process, leaving out some information on it.

“The tribunal lacks the jurisdiction to entertain the petition because it is statute barred; the issues raised by the petitioners are averments which are not relevant in determining the petition…”
