The People’s Democratic Party (PDP) has said it’s going to court to challenge the inconclusive verdict passed on last Saturday’s governorship election in Osun State.
The Independent National Electoral Commission (INEC) had declared the election, following the cancellation of the service in some local government areas.
But in a statement on Monday by its spokesman, Kola Ologbondiyan, the party insisted that the election was concluded and results announced in all polling and the collation centers.
According the PDP, that signified the lawful conclusion of the election, thus removing INEC’s powers to declare the election inconclusive.
The statement said, “Our electoral law is clear that once an election result is declared, INEC is bound to return a winner. INEC, in trying to play the card of the defeated All Progressives Congress (APC), contravened the law by refusing to announce a return, even when the declared results have thrown up a winner.
“Section 69 of the Electoral Act 2010 (as amended) states that inter-alia “in an election to the office of the President or governor whether or not contested and in any contested election to any other elective office, the result shall be ascertained by counting the votes cast for each candidate and subject to the provisions of sections 133, 134 and 179 of the constitution, the candidate that receives the highest number of votes shall be declared elected by the appropriate Returning Officer”.
“Concurrently, Section 179 (2), (a) (b) of the constitution directly prescribes that “a candidate for an election to the office of Governor of a State shall be deemed to have been duly elected where, there being two or more candidates – (a) he has the highest number of votes cast at the election; and (b) he has not less than one-quarter of all the votes cast in each of at least two-thirds of all the local government areas in the State.
“INEC’s action in declaring a concluded election as inconclusive is therefore an annulment, totally duplicitous, constitutionally illegal, ultra-vires and as such null and void”.
The PDP called for the immediate arrest and prosecution of the Osun State Governorship Election Returning Officer, Prof. Joseph Fuwape, for “succumbing to the pressure of the APC” and declaring a decided election as inconclusive.
“We demand that INEC Chairman, Prof. Mahmood Yakubu immediately summon the courage to do the needful by declaring our candidate, Senator Ademola Adeleke, as winner.
“It is completely ludicrous, that INEC and the APC are now attempting to divert the narrative from the substance of the election by making outlandish allegations against the PDP and lobbying Civil Society Organizations and Electoral Observers to validate their illegality.
“Moreover, even if the Osun governorship election is conducted over and over again, the PDP will still win as the people of the state have chosen the PDP and its candidate, Senator Ademola Adeleke.
“Nevertheless, we insist that the September 22, 2018 election, under our laws, is conclusive and our candidate must be declared winner”
Dr. Olapade Agoro, Presidential candidate of the National Action Council (NAC), on Sunday hailed the decision of the Ooni of Ife, Oba Adeyeye Enitan Ogunwusi, not to cast his vote in the last Saturday’s governorship election in Osun state.
There were media reports that Oba Ogunwusi did not vote despite the fact there is a polling unit by the palace, because he saw all the governorship candidates in the Osun State as his subjects.
Speaking with newsmen in Ibadan on Sunday, Agoro commended the revered Yoruba traditional ruler, describing his action as “very laudable and respectable”.
The NAC Presidential candidate maintained that what the Ooni Ogunwusi did was honouring the throne of Oduduwa and the whole of Yoruba race.
According to him, “The Ooni ‘risa, Oba Enitan Ogunwusi has placed himself on the side of honour. The position of the Ooni of Ife is above all political positions. The Ooni should be a rally point for all sons and daughters of Oodu, irrespective of political inclinations.
“The Ooni has been doing well since he ascended the exalted throne. He has been promoting the rich culture of the Yoruba race above political considerations. So far, so good,he has been doing good job on the throne”.
Agoro also felicitate with Ooni Ogunwusi on the forthcoming Olojo Festival that will be celebrated in Ile – Ife, advising the monarch not to allow politicians to use the traditional festival for political campaign.
He urged the Ooni of Ife to promote the Olojo Festival into a trado – cultural festival that will be celebrated beyond the confines of Ile-Ife.
The People’s Democratic Party (PDP) has rejected the inconclusive verdict delivered by the Independent National Electoral Commission (INEC) on Saturday’s governorship election in Osun State.
The party has insisted that the process was conclusive and that its candidate, Senator Ademola Adeleke, who won a total of 254, 698 votes was in clear lead and should be immediately declared winner by INEC, having met the requirements of the 1999 Constitution (as amended).
At a media briefing in Abuja on Sunday, the spokesman for the PDP, Kola Ologbondiyan, said that Section 179 (2) (a)(b) of the 1999 Constitution, (as amended), was clear and very unambiguous in spelling out the conditions for returning a candidate to the office of governor of a state.
Quoting from the said Section, the PDP said, “A candidate for an election to the office of Governor of a State shall be deemed to have been duly elected where, there being two or more candidates – (a) he has the highest number of votes cast at the election; and (b) he has not less than one-quarter of all the votes cast in each of at least two-thirds of all the local government areas in the State”.
The main opposition party insisted that the declaration by INEC of the election as inconclusive, was a “sordid robbery” of the franchise of the people of Osun State, who participated in the election.
Continuing, the PDP said, “It is obvious that having failed in their schemes to alter the final results due to the resistance of the people, the APC had to bear pressure on INEC to declare the election inconclusive so as to pave way for the perfection of their manipulative schemes, which the people of Osun state have firmly resisted so far.
“Instead of yielding to the evil machination of the APC, INEC should have summoned the patriotic courage to immune itself and end this needless controversy by returning the PDP and declare our candidate as the winner.
“It is instructive to state that the PDP will no longer accept inconclusive elections as subterfuge by the APC attain its dubious electoral manipulative schemes in our nation.
“The people of Osun state and the entire nation are already aware that the PDP won this election. They have the authentic figures from the polling units and know the candidate the voters prefer.
“The people, by their votes, have overwhelmingly declared for our candidate and we are not ready to accept any attempt by anybody to use any means whatsoever to steal our mandate freely given by the people.
“The PDP is for peace, but we will not hesitate to use every force available in a democracy to face any attempt to subvert the will of the people or rig us out in this election”
The party charged the Chairman of INEC, Prof. Mahmood Yakubu to avoid the fury of the people by immediately reversing what it described as a “fraudulent” decision by the Resident Electoral Commissioner (REC) and declaring its candidate the winner of the election.
“Anything short of this is definitely not acceptable to the PDP and the people of Osun and it is a direct recipe for crisis.
“Finally, the PDP cautions INEC and the APC to note that the game is up. The people of Osun state have decided in favour of the PDP and that has become a fact that can never be altered”, the party added.
The Independent National Electoral Commission (INEC) on Saturday declared the Osun State governorship election inconclusive.
According Professor Adeola Fuwape, INEC Returning Officer said the electoral body declared the election inconclusive because the number of cancelled votes is higher than the margin between the two top candidates – Ademola Adeleke of the People’s Democratic Party (PDP) and Gboyega Oyetola of the All Progressives Congress (APC).
He said a date will be announced for elections to be held in the affected areas.

The Nation Newspaper The Nation Newspaper
By Adesoji Adeniyi, Osogbo
The Nigeria Women Trust Fund (NWTF) and the Gender and Election Watch (GEW) in collaboration with the European Union Support to Democratic Governance (EUSDGN) on Saturday said the menace of vote buying has taken a new twist.
Addressing reporters after the conclusion of the state governorship election, the CEO of NWTF, Mufuliat Fijabi, said in spite of the effort of the Independent National Electoral Commission (INEC) to curb the menace the trend “seems to have continued using creative, discreet and advanced means.
Fijabi said the observation of the NWTF and GEW was informed by reports of the two bodies’ 63 deployed observers.
According to her, the report also showed that there was an impressive turn out of people for the exercise, adding that considerable number of women were sighted participating in the election.
In the two groups’ recommendation, they advised that there should be strict measures to detect and hold accountable perpetrators of votes buyers and sellers.
The groups also advised the INEC to increase its efficiency in supporting the participation of persons with disabilities in subsequent elections.

‘Why Ooni did not vote’
By Joseph Jibueze, Ile-Ife
The Ooni of Ife, Oba Adeyeye Enitan Ogunwusi, did not vote because he sees all the governorship candidates in Osun State as his subjects, his aides have said.
The Lowa Adimula of Ife, High Chief Adekola Adeleye, who said he is the Ooni’s second in command “to the left”, explained that the Ooni cannot be seen to be taking sides with any of the candidates.
There is a polling unit by the Ooni’s palace, but he did not come out to vote.
“It’s not good for the Ooni to vote for any candidate. If he must vote, it will be for all the candidates because he’s the father of all, but that’s not possible, so kingmakers advised him not to vote.
“He cannot take sides. All the candidates are Ooni’s subjects and so it’s better for a father to be neutral when his children are in a contest,” Adeleye told our reporter.
Ooni’s traditional Aide De Camp said the royal father only blessed all the candidates, wished them well and prayed for a peaceful election.

Mr Aboluwoye Akinwande, the State Commandant, Nigeria Security and Civil Defence Corps (NSCDC), Osun State Command, on Saturday says the ongoing election in the state is so far peaceful.
The News Agency of Nigeria (NAN) reports that the Osun gubernatorial election got underway in the early hours of Saturday morning with a large turnout of voters who came out for the accreditation exercise.
Akinwande told NAN in an interview that the election was so far peaceful, adding that NSCDC officers were also on ground in all the polling units across the state to maintain peace.
“All the officers have been deployed to their various polling units, divisions and the state in general.
“They are already on ground and the election has started. While I was on patrol this morning, I saw a lot of people going to their various polling units and the polling units I passed through were very peaceful.
He, however, noted that there were certain pockets of challenges that had to do with the political status of most of the contestants.
“Let me start with APC; the APC candidate, who happens to be the former Chief of Staff of the state.
“The PDP candidate also happens to be a federal senator. The SDP contestant happens to be a former senator and a former deputy governor and he is still very active in politics.
“Also the ADP candidate happens to be a former Secretary to State Government of Osun State before he decamped to ADP.
“He has also been a grassroots politician from ACN to AD to even APC and now to ADP. So he is a grassroots man.
“So we have all these people contesting and when they are contesting, you will find out that there might be some pockets of challenges, ‘’he said.
Akinwande also noted that due to some of these challenges, some thugs had been arrested, while some have been charged to court.
According to him, these are some of the challenges we are having but thank God the challenges have been solved.
Akinwande, however, said that a huge number of NSCDC officers had been deployed to Osun to ensure peaceful conduct of the election.
“Aside from Osun, we have officers and men from Ogun, Lagos, Ondo, Kwara and Kogi, who are actively involved in this gubernatorial election; so you could imagine the type of deployment.
“There are also deployments from the National headquarters. We have from the Directorate of Rescue Management, Peace and Conflict and Kennel.
“We have officers from Special Weapons and Tactics (SWAT) Squad, Chemical Biological Radioactive and Nuclear Explosives, among others.
“All these are just to tell you about the deployment and how active the NSCDC has been in ensuring a peaceful election in the state,’’ he said. (NAN)

“But, if what us happening here is replicated in all the polling units, I will give INEC a passmark and I will say that the exercise has been successful.
“At this polling unit, the disabled were given the opportunity to cast their votes; some of them were assisted by their able-bodied counterparts.
