Onoh accuses NBA of culpability in conflicting court orders

Former spokesman of President Bola Tinubu in the southeast Dr Josef Onoh has accused the Nigeria Bar Association (NBA) of being more culpable in the flagrant conflicting orders granted by courts of coordinate jurisdictions across the country.

He also urged the NBA to preserve the sanctity of the Bar by not getting involved in partisan politics or agreeing to be used by the opposition political parties to misrepresent facts.

Onoh made the accusation following the NBA’s reaction to President Tinubu’s Democracy Day speech where the President said that it has become imperative that the unnecessary, illegal orders used to truncate or abridge democracy will no longer be tolerated.

The NBA President Yakubu Maikyau (SAN) replied Tinubu that what constitutes illegal orders still remains a matter within the exclusive preserve of the courts of the law and not the presidency.

Onoh however told the NBA President that he believes that any instrument no matter how legally obtained but aimed at creating illegality, disabilities on any legal foundation or Authority is also in itself illegal.

He noted that the conflicting court orders which are either final or interim orders or decisions of courts of coordinate jurisdiction are calculated to contradict clear provisions of the Constitution, statutes or regulations.

He recalled even the late Chief Justice of Nigeria – Honourable Justice Dahiru Mustapher once lamented conflicting Court Orders and decisions of Courts and said that a number of judgments from the Court of Appeal and a few from the Supreme Court appear to have created some confusion amongst practitioners and the general public.

He assured the NBA that the President does not intend and will not interfere in any way with the judiciary processes in the country, clarifying that the President’s statement simply meant inconsistent court orders that can create conflict which in turn could truncate democracy.

Onoh said that the Judiciary is being threatened by incessant contradictory and conflicting court Orders/decisions which not only cause problems among judiciary officers but also raise serious concern and suspicions for those outside the bench which he said was what President Tinubu’s statement is encouraging to stop.

He recalled that during the 1993 presidential election some controversial orders on the eve of the election by Justice Bassey Ikpeme (now deceased) of the High Court, FCT restraining the conduct of the June 12 presidential election was followed by subsequent orders of other High Courts nullifying the order.

“The events that ensued are now history; we should never forget that our justice system played an unpleasant role in the prelude to those events with devastating consequences for our democratic stability and the erosion of confidence in our justice system that culminated in the June 12 democratic revolution.

“Mr. President’s statement was purely aimed at discouraging judicial anarchy which can be a threat to look democracy. This judicial recklessness is dangerous for our democracy. It may worsen the parochial attitudes of Nigerians. It may bring economic hardship to the nation because the right to own means of production is only guaranteed in a state where laws work and not where self-help methods prevail.”

He also stated that misapplication of laws may return Nigeria back to era of the military regime where the rule of fair hearing is subjected to military decrees, stressing that if the judiciary, which is one of the tripods of democracy, continues to somersault, the military will be forced to hijack power.

“However, nobody is praying for this to happen and it will never happen under President Bola Ahmed Tinubu because the worst democracy is better than the best military regime but we should also remember that the worst military regime is better than the best form of anarchy hence the reason Mr. President gave that clear warning.

“Anarchy is inevitable in a society where misapplication of law and miscarriage of justice continue to surface on a regular basis as is the case in Nigeria. This is because misapplication of law is inimical to the rule of law and President Bola Tinubu wants to ensure that rule of law is maintained in order to preserve our democracy.

“The NBA should go down memory lane with the adventures of his political party, the PDP’s role in attempting to truncate democracy with their litany attempts at using the courts to create an epidemic of conflicting injunctions and ex parte orders on political cases.

“Finally the President will never interfere with the judiciary as assured; rather President Bola Tinubu’s administration will engage all stakeholders and support the judiciary to ensure they strengthen disciplinary measures both at the Bar and on the Bench, as well as administrative steps taken by the NJC with the issuance of the Policy Direction of 11 May, 2022,’’Onoh reassured.

Coalition urges Tinubu to probe Malami, three other ex-ministers

The Niger Delta Youth Congress, Initiative for Ethics and Value Orientation, Northern Youths Frontiers, National Movement for Democratic Change and 107 Anti-Corruption Crusade Groups, Wednesday urged President Bola Tinubu to probe some former ministers appointed by former President Muhammadu Buhari.

The ex-ministers are former Attorney-General of the Federation (AGF) and Minister of Justice, Mr Abubakar Malami; former Minister of Humanitarian Affairs, Saadiyya Umar Farouk; and former Aviation Minister, Hadi Sirika.

The groups also passed a vote-of-no-confidence on the Economic and Financial Crimes Commission (EFCC) and its suspended Chairman, Abdulrasheed Bawa.

They made the call in a joint statement signed by National Convener Niger Delta Youth Congress, Israel Uwejeyan; National Convener Movement for Democratic Change, Godfrey Osolase, and National Convener Initiative for Ethics and Value Orientation, Bello Idowu.

The statement expressed worry about corruption allegations against some top officials of the Buhari administration.

It acknowledged “the first step taken by the present administration under President Bola Ahmed Tinubu towards addressing our grievances by relieving Godwin Emefiele of his position as Central Bank of Nigeria (CBN) Governor and subjecting him to an investigation.”

Nevertheless, it expressed “major concern that action is yet to be taken on other principal collaborators.”

The statement added: “We urge the President to constitute a more credible leadership of the EFCC, or in the alternative, set up an independent investigation panel of people of reputable integrity to conduct thorough and
    comprehensive investigations.”

The coalition said it “firmly believes that a strong and credible EFCC is essential for the prosperity and development of our nation.”

  • Recycling Alliance  marks World’s Ocean Day with beach clean-up

Recycling Alliance  marks World’s Ocean Day with beach clean-up

Our environment holds the fabric of our society together and our dependence on it is undeniable, those were the words of Ziad  Maalouf, chairman, the Food and Beverage Recycling Alliance (FBRA).

It was during a symbolic beach clean-up by FBRA members to mark this year’s World Ocean Day.

The event, which was held at Elegushi Beach, Lagos, was adopted as a springboard for encouraging more sustainable practices around the country’s ecosystem.

With member companies gathered, the beach clean-up engaged attendees in a series of activities to remove plastic debris and other pollutants from the environs.

FBRA’s participation in the global commemoration models the company’s commitment to protecting and preserving the environment from post-consumer packaging material.

In step with the alliance’s mission,  FBRA is placing priority on influencing the management of plastic waste and the environmental footprints of entities across the food and beverage industry.

Maalouf, who is also  Managing Director at SBC Nigeria, said: “The journey of a thousand miles starts with one step – and the journey to a green Nigeria starts with cleaning one spot. This beach clean-up event is in alignment with our commitment to environmental stewardship in Nigeria. Our environment holds the fabric of our society together, and our dependence on it is undeniable. We must move from a linear economy to a circular economy that protects and drives profit within the Nigerian economy. This involves creating investments for a sustainable future, working with local recyclers, and preserving the profit from those streams within the country.”

One of FBRA’s key foci is to the industry’s alignment with the NESREA operational guidelines for the Extended Producer Responsibility (EPR) as well as the United Nations’ sustainable development goals to address climate action, life on land, life below water, responsible consumption and production, and other pressing themes.

Since 2012, members of the FBRA have set ambitious goals to support the circular economy and enhance its recycling infrastructure. By actively participating in FBRA and other industry initiatives, members aim to lead by example and inspire collaborative action for a sustainable future.

The Executive Secretary of the FBRA, Agharese Onaghise, who emphasised the importance of collaboration in tackling waste management and pollution, said: “Members of the FBRA have joined forces to address these issues as part of their extended producer responsibility. This event is aligned with the global theme of this year’s World Environment Day “Solutions for Plastic Pollution” as a driver to collectively address the menace of plastic pollution. We are excited to have 29 members of the FBRA from the food and beverage industry contributing to solving the issues that affect our environment and ourselves,  supporting the collection of post-consumer waste. We must continue to encourage these practices, ensuring they become ingrained in our culture.”

Member companies represented at this year’s beach cleanup included SBC Nigeria Limited, Nigeria Breweries Plc, The LaCasera Company Plc, Nestle, Guinness Nigeria Plc, CHI Limited, UAC Foods, Nigerian Bottling Company, CWAY Foods, Prima Corporation Limited, International Breweries Limited, Nestle Nigeria Plc, and Tetrapak West Africa.

The Food and Beverage Recycling Alliance (FBRA) is a non-profit industry collaboration platform set up in 2018 by a Memorandum of Understanding with the objective to galvanise responsible players in the food and beverage industry to support and scale up post-consumer waste collection, buyback schemes and recycling programmes. The Alliance is poised to implement exemplary programmes, which will help preserve our environment, ignite innovation, create jobs and entrepreneurial opportunities for repurposing of packaging waste.

  • Democracy Day: Senator Nwite Foundation hails ‘decisive’ Tinubu

Democracy Day: Senator Nwite Foundation hails ‘decisive’ Tinubu

Nigeria would not make any realistic progress in her democratic journey, should systemic failures that enable divisiveness, nepotism, and avarice be allowed to continue without decisive action by the Federal Government, Senator Polycarp Nwite Foundation for Democratic Accountability (SPNFDA) has said.

The foundation also congratulated President Bola Tinubu, on his inauguration.

. As the Chief celebrator of this year’s June 12 Democracy Day, Tinubu is reminded of the spirit of togetherness and oneness of purpose that brought Nigerians of different backgrounds and leanings together in the Pro-Democracy movement of the 90s which helped to actualise the present democratic dispensation.

The nation’s unity, prosperity, and welfare of its peoples is the single most important task of President Tinubu’s government. It said.

The foundation, named after the late Third Republic Senator Polycarp Nwite, Democracy advocate and former Senior Presidential aide who, like President Tinubu was incarcerated by the military junta, during the June 12, 1993 political crisis, made these assertions in a statement in Abakaliki, Ebonyi State by its Executive Director, Mr. Michael Nwite, to mark Democracy Day.

The June 12, 1993 presidential election, which was won by late businessman MKO Abiola, but annulled by the military administration of Gen. Ibrahim Badamosi Babangida (IBB), was adjudged to be the most transparent election in the history of Nigeria. Since then, elections in Nigeria have been fraught with ethnic and religious tensions accompanied by increasing mistrust in our democratic institutions.

According to the statement, democracy in its purest form only exists to serve the best interest of the people, in an equitable, just, transparent and unifying manner, that enables trust and engenders patriotism and pride in nationhood; and belief in democratic practice and leadership.”

Nwite said : “We are absolutely convinced and confident that President Tinubu, being one of the courageous fighters for the enthronement of Democracy in Nigeria, as the current man in the driving seat of the nation’s democratic leadership, is not only conversant with the democratic principles, norms and nuances, but he is also willing and courageous enough to lead Nigeria to the future that would abhor divisiveness, fight nepotism, ethnic and religious bigotry, government indifference and insensitivity to the plight of the people and glaring injustice of the unequal distribution of opportunities and commonwealth of the nation.

“We are most glad, and I believe that our late father, Senator Nwite would’ve shared the same sentiments, were he to be alive, that President Tinubu, who he fondly called ‘Bola’,, now has the opportunity to fix Nigeria for the good of the people, in a democratic setting, as they had dreamt about, both in the tranches and in a detention camp at Alagbon Close, Lagos State, where they were next-door cell mates in the dark days of military dictatorship.

“The tough decisions President Tinubu has made right from his first day are indicative of a President who will lead from the front and make tough calls for the overall good of the people.

“Nigeria deserves a leader that will be bold and decisive in policy formulation, implementation and declarations that guarantee democratic dividends and accountability to the Nigerian people.

“Today, as we remember and celebrate our Heroes of Democracy, both dead and alive, we urge President Tinubu to urgently take decisive steps to fight corruption, criminality, and the intractable insecurity challenges across the nation, because we are of the opinion that no system of government, would make any meaningful progress in a situation characterised by multidimensional insecurity, fear, and despondency, as we have in the nation at the moment.”

The Foundation implored the President to also take decisive action in education, health, and electricity power generation/distribution to essentially curb unproductivity, youth unemployment, and current mass migration to foreign lands, in search of better livelihood.

Senator Nwite, was a former Nigeria Ambassador to Botswana, a Senior Special Assistant to President Umaru Yar’Adua and also a frontline member of the National Democratic Coalition (NADECO), a broad coalition of Nigerians, formed in May 1994 to fight for the enthronement of civil rule in Nigeria.

The Godwin Obaseki’s administration in Edo State has rolled out modalities for the implementation of the thrice-a-week office work directive, as part of efforts to ameliorate the sufferings of the people, in the wake of the rise in prices of goods and services and overall cost of living, occasioned by the fuel subsidy removal by the Federal Government.
