APC asks court to dismiss PDP’s objection to Abiru’s candidature

    By Robert Egbe

The All Progressives Congress (APC) yesterday asked a Federal High Court in Lagos to dismiss a suit seeking to disqualify its candidate, Tokunbo Abiru, from the by-election to fill the Lagos East Senatorial seat.

Mr. Abiru is vying to replace Senator Bayo Osinowo, who died on June 15, reportedly following complications from the Coronavirus pandemic.

But his eligibility is being challenged by the Peoples Democratic Party (PDP) and its candidate in the poll, Babatunde Gbadamosi, who are first and second plaintiffs.

The Independent National Electoral Commission (INEC), Abiru and the APC are the first to third defendants in the suit marked, FHC/L/CS/1361/2020.

The PDP and Gbadamosi are praying for Abiru’s disqualification on the grounds that he allegedly has two permanent voter cards, and that he is neither from, nor registered to vote in the Lagos East Senatorial District.

The by-election, scheduled for last Saturday, was postponed by INEC following the near nationwide #EndSARS protests. A new date is yet to be fixed.

But when the case was called yesterday, counsel to the APC, Mr. Kemi Pinheiro SAN, urged Justice Chuka Obiozor to dismiss the PDP’s suit on the grounds, among others, that it was statute barred.

He told the court that he had filed a counter affidavit and preliminary objection establishing that the case is statute barred.

According to averments in the defendants’ preliminary objection, by virtue of Section 285 (9) of the Constitution, every pre-election matter ought to be commenced within 14 days of the date of the occurrence of the event or action complained about.

The defendants contended that the acts complained of in the suit occurred on or before September 11, over a period of 14 days prior to the commencement of the suit.

“Having not commenced this suit within 14 days of the occurrence of the actions complained of, this suit is statute barred.”

They further argued that Abiru’s residency or indigene status is not recognised grounds upon which he could be disqualified from contesting an election.

In another instance, they canvassed the point that “the mode and manner in which a grievance regarding double voter registration can be ventilated have been well captured in the Electoral Act to be by a criminal charge.”

Pinheiro thus contended that the suit was “incompetent, discloses no reasonable cause of action” and that the court lacked jurisdiction to hear and determine same.

He prayed for an order staying the hearing of any other application pending the determination of the notice of preliminary objection and an order striking out and/or dismissing the instant suit for want of jurisdiction.”

PDP counsel Mr. Ebun-Olu Adegboruwa SAN told the court that he had filed an Originating Motion, but needed to file a response to the defendant’s preliminary objection.

Justice Obiozor adjourned further proceedings till November 16.

TETFUND votes N10bn for infrastructure in UNIABUJA

    By Frank Ikpefan, Abuja

The Tertiary Education Trust Fund has said it would spend N10 billion to develop critical infrastructure at the University of Abuja.

It stated that part of the money would go into the construction of a new senate building, and a 1,000 capacity international conference centre, while the agency would collaborate with the authorities of the university to develop a 2,000-bed space accommodation for the students.

The agency also stated that it would invest N1 billion each for the 12 Centres of Excellence which the University of Abuja is a part of.

Chairman, Tetfund Board, Alhaji Kashim Ibrahim-Imam, stated this during an interactive session with the management and students of the UNIABUJA.

“For the year 2020, I am happy to inform you that by the time we are done this year, we are looking at spending a total of N10 billion on critical infrastructure in the University of Abuja.

“Tetfund has designated the University of Abuja as a Centre of Excellence. We have 12 Centres of Excellence spread across the country and we are investing N1 billion in each of them. But we have also in consultation with the Vice-Chancellors decided that each of the universities will focus on one critical area. For Abuja, it is Governance and Leadership,” he said.

The BoT chairman said the agency would soon commence an on-the-spot assessment of its projects in over 50 universities in 18 states.

He said there would be a paradigm shift in needs assessment, interventions, and monitoring of such interventions by the agency in the nation’s tertiary educational institutions.

He said going forward; e-learning would enjoy priority in Tetfund’s interventions across Nigeria.

“A lot of money has been disbursed by Tetfund since its inception to better the 226 universities, polytechnics, and colleges of education. Tetfund’s interventions in the past three years and next year put together, is in the region of N1 trillion.

“So, our visit here is two-fold. Number one, we want to inspect, we want to see, we want to hear from you. Has Tetfund impacted? This is very important. Have we invested in critical infrastructure? What is the effect of our investments in research? Are we getting value for money?

READ ALSO: TETfund asks Fed Govt to increase research fund to $1b

“The second component is, what more should we do? There is a paradigm shift at Tetfund because we will not sit down at Tetfund to determine what your needs are. We must consult you, both management and students. What are the critical needs of the University of Abuja? What areas should Tetfund focus on? We want to be guided by you going forward.

“It wouldn’t do for us to just be throwing money. We want the money that we are spending to impact most positively on academia, on the faculties, on the students, on learning, on research,” he added.

Continuing, he said: “There is one very critical element that is the most important today, namely e-learning. So, Tetfund, in consultation with the University of Abuja will be investing in laying the necessary infrastructure that will facilitate e-learning on this campus. Towards this, already as I speak, 20km of fibre optics are being laid across the University.

“Today, I will also inspect the site where we are going to build a brand new and state-of-the-art ICT Centre. We want a place where students can learn in a 21st-century environment.”

Vice-Chancellor of UNIABUJA, Prof. Abdul-Rasheed-N’Allah, commended Tetfund for its various interventions in the university and the painstaking need assessment and monitoring approach, which they said the current board had brought in priming the agency’s intervention in institutions.

Ibrahim-Imam was accompanied by the Executive Secretary of Tetfund, Prof. Suleiman Bogoro, other board members and management of the agency.

His words: “You may recall that in September or thereabout, this committee had interactions with the representatives of the labour unions on this subject matter.

“During the meeting which was a sequel to our earlier intervention over the unions’ strike action against the concession, a lot of concerns were raised by the representatives of the labour unions regarding the airports’ concession.

“Several dates were fixed for the meeting but for one reason or the other, they failed to attend. The Committee had also received several letters from Stakeholders both in favour and against the Airports’ Concession.

A Benin-based gynecologist, Dr. Iwinosa Ehigiator, has charged pregnant women to take at least a dose of anti-tetanus injections to protect their newborns from diseases.

Ehigiator, who gave the charge in an interview with the News Agency of Nigeria (NAN) in Benin on Monday, said that the vaccine should be given between 27 and 36 weeks of pregnancy.

The physician recommended Tetanus Toxoid (TT) vaccination for all pregnant women to protect them and their newborns from tetanus and other diseases.

“It is very important to take tetanus injections. The purpose of giving the vaccine to women of childbearing age and to pregnant women is to protect them from tetanus and to protect their newborn infants against diseases.

“The vaccines produce protective antibody levels in more than 80 percent of recipients after two doses (1–3),” he said.

According to him, tetanus is a life-threatening disease for which there is no cure, but easily preventable with the TT Vaccine.

He said that one could get infected with the disease when tetanus bacteria, which were common in soil and dust, entered the body through an open wound.

“To relieve the pain and reduce any swelling, apply an ice pack to the site of the injection.

“Do not take pain relief to relieve your pain, it is not considered safe for use in pregnancy. If you need a painkiller, take paracetamol instead.

“But as much as possible, try to manage without the help of a painkiller and use ice to numb the area,” he said.
