    El-Rufai’s lawyer accuses NBA of bias

    A senior Advocate of Nigeria, Mr. A.U. Mustapha, who is the counsel to Kaduna, Governor Mallam Nasir El-Rufai has protested to the Nigerian Bar Association(NBA) for its alleged bias against the Governor.

    He said the disinvitation of the Governor by the association to its conference was politically motivated.

    He also said it was unfortunate that El-Rufai was not given fair hearing by an association of legal minds.

    Mustapha made his position known in an August 21 letter to the outgoing President of NBA, Mr. Paul Usoro (SAN).

    He said an association, which ought to serve as expected to serve as the conscience of the nation, has descended into the realm of partisanship,

    The statement reads: “The decision taken by the NBA to withdraw their invitation to Governor El-Rufai on the basis of the wild and unsubstantiated allegations contained in the Open Bar Initiative petition without any reference to the governor is not only a naked affront on the rule of law but also a contradiction of the NBA’s motto which held itself out as the custodian, defender and guardian Angel of the rule of law in Nigeria.”

    “The implications of this grievous decision by the NBA demonstrate a total disregard for the basic constitutional provision of fair hearing which is the foundation and bedrock of the rule of law designed for the safeguard of fundamental right and freedom in any civilized and democratic society.

    “It therefore beats all imagination that an elitist professional body like the NBA could take a decision that negates the very essence of this fundamental constitutional provision, no matter how tempting or appealing the reason may be.”

    He said NBA’s decision negated the rule of law especially the right to fair hearing for El-Rufai.

    He said it will not be out of place to insinuate political motives behind the disinvitation.

    He added: “Going further, it is also instructive to note that the NBA sat down, constituted itself unto a court and adjudged Governor El-Rufai guilty of all the allegations contained in the said petition without hearing a word from the Governor and thereafter proceeded to apply the sanction requested by the petitioners which is a withdrawal of the invitation. What a “court?” Can this be called justice and fairness? Is this exemplary?

    “It would certainly not be out of place to insinuate political motives behind this unfortunate  decision as the NBA as a professional body which is supposed to be in the fore front of the protection and promotion of the rule of law in Nigeria should know better than this.

    “After all, members of the NBA Executive and Annual Conference Planning Committee as constituted can be counted among the brightest legal minds in Nigeria.”

    He advised NBA to remain apolitical instead of taking actions which can cause discord.

    An effective synergy among the three arms of government including representatives of the legal profession would be a useful approach to confront the urgently required reform of Nigeria’s administration of justice system, and such collaboration is in the works.

    Vice President Yemi Osinbajo, SAN, dropped this hint on Saturday at the virtual edition of the Wole Olanipekun & Co (WOC) Justice Summit.

    The summit themed “Developing an Institutional Concept of Justice in Nigeria” featured prominent speakers including, the convener, Chief Wole Olanipekun, SAN; Prof. Fidelis Oditah, QC, SAN; Mr Yemi Candide-Johnson, SAN; notable economist, Prof. Pat Utomi; and a prominent lawyer from the UK, Brie Stevens-Hoare, QC, among others.Osinbajo in a statement by his media aide Laolu Akande said, “I think it is important for us to sit together – the leadership of the profession, the executive, the judiciary and the legislature, to take a second look at some of these issues.”

    Prof. Osinbajo said the collaboration to get the reform going should also include states, saying, “working together, the sub-nationals and the federal government and their judiciaries, we can make a fundamental change. This is obviously a matter that we must take seriously and address, not just as professionals but we must involve all the arms of government.”

    Continuing, the Vice President said “because of the kind of system that we run, the reform of the Justice System is many-sided. It can’t be done by one segment. It cannot be done by the executive alone, it cannot be done by the judiciary alone, and it certainly cannot be done by the legislature alone.“There is a need for us to appreciate that it is a many-sided thing, complicated and we have to simply look for ways to work together. I am seeing that critical mass of individuals in the legal profession, in the executive and also in the judiciary who are willing to reform. We are working quite hard to see how we can all come together to make a real change.”

    The Vice President noted that “the big question is also the relevance of our paradigms of justice to the major socio-economic circumstances that confront us. The law is a social construct and makes sense only within a social context. To treat the law as something apart from society, or as a body of technical abstractions is to strip it of meaning and to alienate the legal order from the very people it is meant to serve.

    “Consequently, a definition of justice that focuses on the social and economic rights of the people is not only more meaningful, it is more just. These rights include the right to food, shelter, employment, education and a reasonable national standard of living, care for the elderly, pensions, unemployment benefits and welfare for the physically challenged.”

    Continuing, Prof. Osinbajo said, “our progress in the observance of socio-economic rights must also be prosecuted in terms of the struggle to reduce the basic problems of ill-health, malnutrition, illiteracy, and famine which daily afflict our people.”

    He added that “where social and economic rights are unsecured, people are unable to fully maximize their civil and political rights. For instance, access to qualitative education enhances and enriches the freedoms of expression, thought and conscience.“Conversely, pervasive illiteracy can nullify the entire idea of the freedom of the expression. In the progressive vision, political rights and socio-economic rights are mutually reinforcing.”

    Still on the concept of justice that addresses the socio-economic needs of the people, Prof. Osinbajo said “socio-economic rights even where wholly justiciable mean nothing unless there is a fiscal commitment to enforcement. This is the crucial intersection of politics, ideology and notions of justice.”

    “This may explain why the opposition in Nigeria was prepared to abolish our social investment program if they won, while our party’s understanding of the imperative of delivering social justice was the provision of a massive social safety net.

    “This was a fundamental feature of our manifesto. So, our Social Investment Programme which is the most ambitious welfare programme on the continent and our effort to expand universal health insurance all aim at ensuring that our most vulnerable citizens are not abandoned to the vicissitudes of fate,” the Vice President explained.The summit also addressed such issues including judicial appointments, delays in the courts, the issue of technicalities, among other critical elements of the justice sector reform agenda.Speaking specifically on the appointment of judges as an important area of reform in the system, the Vice President said, “judicial appointments should follow a merit based system and this is absolutely necessary, we need to insist on mandatory tests and interviews for all applicants.

    He added that “clearly, we need to look more carefully at how our judges are selected. There has to be an objective process of selecting judges. We cannot insist that the only way to become a judge is to be a (judicial) career person or move from the high court to the Court of Appeal, to the Supreme Court. We must be able to bring in practicing lawyers, academics to be justices of the Court of Appeal and Supreme Court. If it requires rewriting the rules, then let us rewrite the rules.”Referring to other areas in the system that have been identified as areas requiring urgent reform, Prof. Osinbajo said, “a lot of those things that have been said today can be achieved.”According to him, “for example, we can ensure that the process of criminal trial is short and we get justice within a reasonable time.“Issues like rape, there are all sorts of sociological issues and barriers that need to be encountered. The way the system responds to rape cases is also a problem. So, we need a change of mindset as well as the legal system responding adequately and promptly to situations where rape is reported.”

    Still on aspects of justice administration requiring new approaches and models, the Vice President said the model of adjudication in criminal cases which largely dispenses retributive justice is not entirely adequate to meet the demands of justice especially in complex scenarios and situations that are peculiar to Nigeria.“Given the tensions and frictions generated by contending passions and grievances, and the social reality of inequality and inequity, there is the recognition that some of the most serious situations which threaten to even, sometimes, break the fabric of society, require much more than just retributive sanctions by our judicial system, they require restorative justice to bring about healing and the reconstitution of the communities.“This is one of the approaches that we are looking at as part of our efforts to resolve protracted ethnic and religious conflicts. In many of the cases, it is not enough to arrest, detain, prosecute, and jail terrorists. There is a need somehow to find a process by which restorative justice can be brought to bear, by which the communities’ feelings of violations can be assuaged,” the Vice President stated.

    Prof. Osinbajo said although the National Policy on Justice embodies some of the prescriptions and offers pathways of innovation for more holistic approaches to justice delivery, there is still much work to be done to meet the needs of persons in search for justice.In his contribution, the keynote speaker, Prof. Fidelis Oditah said pertinent issues that require urgent reform in the administration of justice system include, the reform of dispute resolution mechanisms and an overhaul of the current system that focuses more on technicalities rather than the substance of cases brought before the courts, amongst others.Oditah referring to instances where appellate courts overturned decisions merely based on technicalities without addressing the public interest implications, noted that such judicial behavior is not desirable, should be avoided and possibly prevented as much as possible through the reforms.

    Inter head coach Antonio Conte has said that he may not be at San Siro next term.

    The former Juventus and Chelsea boss enjoyed an excellent debut season with the Nerazzurri, which saw them push the Turin giants in Serie A before finishing second while they were also Europa League runners-up.

    Speaking after 3-2 loss to Sevilla in the Europa League final on Friday, Conte suggested that it might have been his last game in charge of the club.

    “We’re going to meet next week with the club and we’ll decide about my future. I’m not sure that I’ll be the Inter manager next season, we’ll decide together,” he told Sky Sport Italia . “Inter will plan the future with or without me.”

    Conte’s future has been in doubt since the conclusion of the Serie A campaign earlier this month, after which he launched a scathing attack on the club’s directors.

    “I don’t think the work of the players has been recognised and I don’t think my work has been recognised,” he said.

    “We all received very little protection from the club, absolutely zero.

    “I don’t like it when people jump on the bandwagon – they have to be there in the good times as well as the bad and here at Inter it wasn’t like that, I’m sorry to say.

    “We have to grow and improve in all areas, including off the field, and a big club should protect its players more.”

    After Friday’s game in Cologne, Inter president Steven Zhang did little to ease fears over the future of the 51-year-old.

    “He and his staff, together with the players and all the other members of the club are doing a great job,” he told Sky Sport Italia .

    “Now the players and the staff will rest, because they deserve it, and then we will plan for the future.

    “We want to improve next season. The balance of this season is very positive. We are on a path that has allowed us to get to the final.

    “All of us, on and off the pitch, are doing a great job and are heading in the right direction.

    “Winning or losing is part of football, but getting to the final makes us optimistic for the future.”

    LAGOS State Safety Commission (LSSC) has trained officials of the Lagos State Traffic Management Authority (LASTMA) and Lagos Neighbourhood Safety Corps (LNSC) on safety management.

    It gave the officials kits after the training.

    Director-General of LSSC Lanre Mojola said the training and donation of kits were to curb spread of Coronavirus.

    “We organised the training and presented safety kits to sensitise rescue operators on the need to curb the spread of COVID-19. We educated them on hygiene and adherence to safety precautions,” he added.

    Mojola said the pandemic could be prevented if Lagosians, especially rescue operators, adhered to safety and hygienic steps as specified by the Nigeria Centre for Disease Control (NCDC) and Ministry of Health.

    Kwara State Governor AbdulRahman AbdulRazaq has appointed Brig.-Gen. Saliu Bello (rtd), former Military Administrator (MILAD) of Kebbi State and Aliyu Muyideen, an intelligence and counter-terrorism expert, as special adviser and senior special assistant on Security Matters.

    A statement on Thursday by his Chief Press Secretary, Rafiu Ajakaye, said Adekunle Dunmade, a professor of Otolaryngology and director of the University of Ilorin Stem Cell Research Centre, was appointed special adviser on Health Matters.

    It reads: “The assemblage of a crack security team is to ensure a safe environment for more investments. Gen. Bello, who hails from Erin-Ile, Oyun Local Government Area, was Kebbi MILAD between 1993 and 1996. He was a colonel general staff for the Nigerian Contingent in Liberia, and former chief instructor at Military School, Zaria (1988 to 1992).

    “Muyideen, who retired as principal staff officer, Operations (DSS), has a Master’s degree in Peace and Strategic Studies from the University of Ilorin, where he also got a Bachelor of Arts in History.     “Dunmade, who hails from Ifelodun, replaces Prof. Wale Sulaiman, who is leaving the state executive council to pursue a career in global health and non-health sectors.”

    The West African Examinations Council (WAEC), Nigeria has said none of its question papers for the ongoing West African Senior School Certificate Examination (WASSCE) for school candidates 2020 leaked ahead of time.

    Rather, supervisors and candidates take pictures of the questions during the live Examination and share with outsiders to perpetrate examination malpractice.

    A statement signed by the Council’s Ag. Head, Public Affairs Demianus Ojijeogu, for the Head of National Office, Mr. Patrick Areghan, warned members of the public to ignore such papers shared on the social media, while urging supervisors to keep to the rule.

    It reads: “The attention of the West African Examinations Council (WAEC), Nigeria has been drawn to publications on social and other media alleging the leakage of its question papers in the ongoing WASSCE for School Candidates, 2020. Some have even gone ahead to (mis)quote the Head of National Office of WAEC-Nigeria, Mr. Patrick Areghan, as confirming same. This is far from the truth and we take very strong exception to it.

    “For the avoidance of doubt, and for the benefit of the general public, there has been no leakage of any paper, whatsoever. The Council’s Monitoring/Investigations have revealed that some unscrupulous and unpatriotic Supervisors/Invigilators, and in some cases, candidates, snap the question papers (while the examination is in progress) and forward to their outside collaborators who in turn, provide solutions to the questions which they send to their subscribers via criminally-inclined websites, SMS and WhatsApp, even as this is against our regulation of: USE OF CELL PHONES IN THE EXAMINATION HALL IS NOT ALLOWED. Some culprits who were caught in the act in Bauchi, Nasarawa and Rivers States have been arrested and will be prosecuted.

    “The Council once again wishes to advise candidates, invigilators and supervisors to shun every act of examination malpractice. The Supervisors, who are secondary school teachers, should justify the confidence reposed in them by the various State Ministries of Education that nominated them to supervise the ongoing WASSC examination.

    “The Council also wishes to admonish all news media to guide against sensational and irresponsible journalism.

    “Once more, the Council would like to re-assure its stakeholders and the general public that contrary to the misleading impression, which the publications sought to portray, the integrity of the ongoing WASSCE for School Candidates, 2020 has not been compromised, as none of the question papers has leaked.”

    Markanthony Chibueze Opurum, chairman of Murupo Group, better known as Ogologo Tallest has confirmed the likelihood of bringing the Meukow Cognac to Nigeria before the end of the year.

    However, he urged the government to make the business environment friendlier to investors and entrepreneurs by providing basic infrastructure. “Having a steady power supply, good transportation and road network will go a long way towards the ease of doing business in the country,” he said.

    He also commented on the lockdown situation around the world as a response to contain the novel coronavirus pandemic that has grounded global economy.

    “The lockdown of the airport is a good safety measure for the health of Nigerian citizens. This has prevented people from coming from different parts of the world, bringing cases of Covid-19 and spreading it around the country,” he observed.

    While 2020 has been a challenging year for most businesses around the world, Ogologo Tallest, who is also the president of Independent Trans Serv and Opurum Oil and Gas, claimed he is motivated to continue doing business nonetheless. “I have an unquantifiable passion for business,” he declared, “therefore, in boom or bust, I will continue to push on.”
