    Legal implications of Fed Govt’s activation of NASENI tax

    Following President Muhammadu Buhari’s March 1, 2021 directive to the Federal Inland Revenue Service (FIRS) to comply with the tax law on the National Agency for Science and Engineering Infrastructure (NASENI), Chukwuemeka Eze explains the basis and implications of the order.

     

     

    The National Agency for Science and Engineering Infrastructure (hereinafter referred to as “NASENI”) was established under the NASENI Act of 1992. The Board of the agency is headed by the President, meaning that President Muhammadu Buhari is the chairman of the Board while the Executive Vice Chairman is the Chief Executive.

    Section 20 of the Act provides for the Fund of the Agency to wit:

    (1)  The  Agency  shall  establish a  fund  from  which  shall  be  defrayed  all expenditure  incurred  by  the  Agency  for  the  purposes  of  this  Act.

    (2)  There shall be paid and credited to the fund-

    (a)  1 per cent  of  the Federation Account  in  the  first  instance,  to  be increased  to  three  per  cent  by  the  year  2000;

    (b)  levy  on  income  or  turn-over  of  commercial  companies  and  firms  with turn-over  of  N4million  and  above,

    (c) Which shall be –

    (i)  at  the  rate  of  one  per  cent  in  the  first  instance;

    (ii) collected  by  the  Federal  Board  of  Inland  Revenue  or  by  any  other suitable  means  as  may  be  specified  by  the  Agency;  and

    (iii) credited  to  the  account  of  the  Agency;   contributions  from  the  organised  private  sector;

    From the above provisions, section 20(2)(b) and (c)(ii) of the Act should be of interest to the taxpaying community. Subsection (2)(b) of the principal Act provides that commercial companies and firms shall pay 1 per cent of their income or turnover as NASENI Tax.

    TheCable reported on March 1, 2021 that President Buhari has directed FIRS to comply with the tax law on NASENI.

    In a letter signed the President’s Chief of Staff Ibrahim Gambari, Buhari asked the FIRS to remit the deducted levy on turnover of commercial companies and firms.

    “I write to inform you that on 24th January 2021, Mr. President approved the prayers of the Executive Vice Chairman (EVC) of the National Agency for Science and Engineering Infrastructure (NASENI) on the funding of NASENI activities,” the letter said.

    “In accordance with the NASENI Establishment Act, one of the prayers of the Executive Vice Chairman relates to the funding of the agency via a levy on income or turnover of commercial companies and firms with turnover of N4million (later increased to N100million) by the NASENI Governing Board) at the rate of a quarter per cent (1/4 per cent) of turnover.

    “Accordingly, you are kindly requested to act on the implementation of this provision of the NASENI Act as soon as possible.”

    The directive was also communicated to Zainab Ahmed, Minister of Finance, Budget and National Planning.

    In the NASENI Establishment Act 2004, FIRS is expected to deduct and remit to it a quarter per cent of the levy on turnover of firms earning over N100 million and above.

    Although NASENI was established in 1992, the law guiding its funding has not been complied with by successive governments.

    But in January, President Buhari decided to ensure compliance with the NASENI Act.

    He also approved the placement of NASENI directly under the supervision of The Presidency instead of the Ministry of Science And Technology.

    The directive was said to be due to seven key projects (inventions) being undertaken by NASENI with funding as a major hindrance.

    One of the key projects is a made-in-Nigeria helicopter which the President has mandated NASENI to produce.

    Others are:

    • Establishment of first made-in-Nigeria transformer plant and high voltage testing laboratory to be located in Okene, Kogi State.
    • First made-in-Nigeria plant for the manufacturing of Silica which is the major material needed for local manufacturing of solar panels to resolve alternative/renewable energy supply for the nation.
    • Funding of the plant for the first made-in-Nigeria smart prepaid energy meter (SPEM), which is already patented, before transferring them to private sector entrepreneurs as stipulated by its mandate.
    • Establishment of zonal (six geo-political zones) agricultural machinery & equipment development institutes which had already been approved by the president.
    • Completion of work on first made-in-Nigeria e-voting solutions designed and produced by Nigerian engineers in NASENI.

    . Completion of work on the reverse engineering process of five-kilowatt small hydro-kinetic turbine. This project is to facilitate energy supply to Nigerian rural areas as an alternative to the national grid.

    Tax implications

    1. Commercial companies and firms with an annual turnover of N100 million shall pay 0.25 per cent of their turnover to the FIRS.

    Those excluded are: companies and firms with a turnover of less than N100 million; companies limited by guarantee.

    1. The collection agency shall be FIRS.
    2. FIRS may likely release guidelines for its collection.
    3. It is not a new tax because the Act provides for it, but this is the first time the federal government has activated its collection.
    4. NASENI has been removed from the Federal Ministry of Science and Technology to the Presidency.
    5. This is a new tax burden for large companies.

    Teachers recruited by the Ondo State government under the State Universal Basic Education Board (SUBEB) have started collecting their appointment letters.

    The successful teachers were given their appointment letters after the conduct of an online examination.

    Chief Press Secretary to Governor Oluwarotimi Akeredolu, Olabode Richard Olatunde, who confirmed the distribution of the appointment letters said the online examination was to ensure that the best brains were selected among the applicants.

    Olatunde said the 1000 newly recruited teachers started collecting their appointment letter since last Friday.

    He said the teachers were employed to fill vacant positions in all public schools across the state.

    It was learnt that recruitment of teachers into public schools in Ondo State was last done 13 years ago during the administration of Adefarati.

    Troops kill two bandits in Kaduna ambush

    Troops of Operation Thunder Strike killed two bandits during an ambush operation on Friday night on the Gwagwada-Chikun Road in Chikun Local Government Area of Kaduna State.

    Internal Security and Home Affairs Commissioner Samuel Aruwan said in a statement yesterday that some bandits approached the ambush on two motorcycles, “and on sighting the ambush, returned fire in an attempt to charge through.”

    He added: “They were however overwhelmed and two bandits were neutralised by the troops, while the others retreated with gunshot wounds.”

    One motorcycle, one locally made rifle, a mobile phone and some wraps of Indian hemp were recovered from the scene along with the corpses of the bandits.

    The commissioner said Governor Nasir El-Rufai congratulated the troops for the successful operation while he also praised their pro-active disposition.

    “Citizens are again urged to report any persons seeking medical attention for suspicious injuries in the general area to the Kaduna State Security Operations Room on the emergency lines 09034000060 and 08170189999,” Aruwan said.

    The rising star who hails from Osun State, Iwo town, spent his formative years in Ibadan, one of the largest cities in Nigeria and West Africa.

    Describing his kind of sound and message in his songs, the indie artist said: “My sound speaks to the soul so literally I’m an afro soul singer and the message in my songs it to give people hope and free them from themselves”, he said.

    Giving an insight on his educational background and journey into music, he said “I obtained O’level result from Mount Olivet grammar school, Bodija; and that allowed me to attend Federal College of Education for Nigeria Certificate in Education(NCE) program where I got certified in 2010.

    “Fast forward to 2016, I got my first degree from the Adeyemi college of education now Adeyemi University of education, but I didn’t need the degree for anything cause I’ve always been an entrepreneur right from childhood and right now I’m having a good time with my Master’s program in Ukraine. I started music professionally during my NYSC program in 2018”, he said.

    Talking about his latest project, he said: “I’ve released evergreen spiritual songs like ‘Binary’ and ‘Know’, songs that speak directly to the souls plus I’ve worked with veterans like Chuddy K and we came up with a jam for them girls but we ain’t stopping anytime soon and this is just the beginning. I love singing anytime I hear good sounds, I sometimes get lost in the moment so music is basically everything for me”, said Maximo.

    Maximo hopes to bless his fans with more singles from his forthcoming Extended Project(EP) in time to come.

    Sokoto varsity graduates 1473 students Saturday

    No fewer than 1,473 graduands from across three Faculties of Arts and Social Sciences, Education and Sciences will on Saturday be awarded various Bachelor’s Degrees at the combined convocation of the Sokoto State University, Sokoto.

    Its Vice Chancellor, Prof. Muhammad Sani Dangoggo said 36 of the graduating students made first class.

    Also three eminent personalities, including the Chancellor of the University, Emir of Dutse, Alhaji Nuhu Muhammadu Sanusi; Managing Director/Chief Executive Officer of BUA Group of Companies, Abdulsamad Isiyaka Rabiu; and the university’s pioneer Pro- Chancellor,  the late Umaru Ali Shinkafi (post humous) would be conferred with honorary doctorate degrees of the university.

    The ceremony would be preceded by a convocation lecture to be delivered tomorrow by Vice President Yemi Osinbajo.

    Dangoggo said the convocation was for three sets who graduated in the 2016/2017, 2017/2018 and 2018/2019 academic sessions.

    “A total of 231 graduands are for 2016/17; 541 for 2017/18 and 701 for 2018/19.

    “We have 529 second class upper students, 894 second class lower and 14 obtained third class”, he said.

    The Vice Chancellor said the university began academic activities in 2013/2014 session with undergraduate students strength of 774.

    In addition to its faculties, Dangoggo said the university has three research centres and supporting units; Centres for study of Sokoto Caliphate, Mathematical Sciences, Entrepreneurial Research and Development, Academic Planning unit, SIWES unit, among others.

    The Vice Chancellor said the institution has a standard modern library facility with a sitting of 1610 users and 21,431 books.

    Other programmes of activities to mark the convocation are: a novelty football match between academic and non-academic staff teams and a  dinner.

    With coconut trees being one of the best plants that naturally remove excess carbon dioxide from the atmosphere (Carbon sequestration) to mitigate global warming, Rector of the Lagos State Polytechnic (LASPOTECH), Dr. Oluremi Nurudeen Olaleye has flagged off the planting of 2,000 coconut seedlings.

    Olaleye said agriculture had a special place in his nine-point agenda aimed at positioning LASPOTECH to compete as a world-class agriculture-focused tertiary institution.

    He spoke of plans to partner  multinational investors to improve agricultural development in the institution and explore the coconut value chain.

    The Dean, School of Agriculture, Dr. Adebayo Ashafa, appreciated the management for the initiative, stating that staff and students were ready to key into the agricultural plans the institution would venture into.

    In Ilorin, Kwara State faith-based Al-Hikmah Univer sity is partnering security agents to ensure security of lives and property on its campuses.

    Its Vice Chancellor Prof Noah Yusuf said this in Ilorin, the state capital, on this year matriculation of the school.

    Yusuf added that the institution had a high lead on its students enrolment for the first time in the last eight years.

    He warned the new intakes to eschew anti-social behaviour like drug abuse, cultism, theft and others, adding that the university has zero tolerance to social vices.

    “Anyone caught engaging in any misconduct will either be rusticated or dismissed and handed over to law enforcement agencies for prosecution,” he added.

    He said: “For the first time in the past eight years, we had a leap in the students’ enrolment this year. This leap is not connected with COVID-19 pandemic or ASUU strike, it is rather based on the grace of almighty God.

    “This year, we have matriculated 1005 students. I should also add that admission is still on. The Joint Admissions and Matriculation Board (JAMB) gave us a caveat that admission for private universities closes May 2021 and we are still in March.

    ‘’We set a target of 2000 students enrolment, but we thank God that with over 50 percent, it is okay. We are on course.

    “The breakdown is as follows: Faculty of Agriculture 90; Faculty of Education is 122, Faculty of Health Sciences 212; Faculty of Humanities and Social Sciences 181; Faculty of Law 64; Management Sciences 82 and Natural and Applied Sciences 244.”

    Glow Initiative for Economic Empowerment under its Solar Up Nigeria (SUN) programme has launched the Solar for Schools Community Project in Community Secondary School, Ebenebe, Awka North Local Government Area, Anambra State.

    The project was financially supported by Access bank plc.

    This project championed the installation and handover of a 2.5KVA solar PV system to the school which powers will provide electricity for the computer center, ICT and digital skills education.

    The founder and Executive Director of Glow Initiative, Ms. Glory Oguegbu, said the project was to foster education in energy-deprived rural communities by providing them access to electricity.

    According to her, powering education is key in the 21st century where students need digital skills to thrive and be able to compete favorably with their counterparts in other parts of the world.

    She further encouraged the students to make use of the educational resources at their disposal to become champions in their desire fields of endeavour.

    The principal, Mrs. Bibian Chikeluba, said the school sells farm produce to afford a generator for computer practical during the examination.

    She said: “Community Secondary School Ebenebe has for years been without access to electricity and this constituted a great impediment for effective learning in the school.

    “I informed the team on how the school sell palm fruits which grew in the school compound so that we can be able to afford to ‘rent’ a generator so that only the final year students (SS3) could conduct computer practicals during the exam period.

    “This was highly ineffective as not all students could have access to the school computers due to limited resources to bear the cost of power supply.

    “However, with the installation of the Solar PV system in the school and a guaranteed 24hour supply of electricity, students could now have unlimited access to their computers for learning,” she added.

    The traditional ruler of Ebenebe community, Igwe Nnaemeka Christopher Nnaegbuna, said he was elated that his community could benefit from such a laudable initiative.

    The traditional ruler said despite the proximity of his community to Awka capital territory, initiatives and interventions such as the “Solar for School community Project” often elude his community.

    “Education is an important tool in shaping and helping young people become better citizens in society and every effort to make learning processes seamless and convenient for students is a welcomed development.

    One of the students, Miracle Nwankwo, thanked the organisers of the project for bringing electricity to their school.

    According to him, they can now learn computers unhindered.
