Plaintiff alleges violation of order on land

A plaintiff, Mr. Olufemi Omoola Fasehun, has accused James Omolaja Odunmbaku and his associates of attempting to take over a piece of land despite an order by the Lagos State High Court in Ikeja.

Justice Yhaqub Oshoala had on May 24 ordered that the status quo be maintained pending the determination of the controversy surrounding ownership of the property on 10, Kudirat Abiola Way, Oregun, Ikeja.

The suit is numbered ID/11239LMW/2021.

The judge gave the order following an application for an interlocutory injunction by Fasehun (for himself as the administrator to the Estate of Late Ebenezer Olawanle Oladipo Fasheun and on behalf of the beneficiaries to the estate) against Odunmbaku, Cletus Nwagwu, Oluwadare Olanrewaju and others.

The claimant, through his lawyer, Otunba Remi Adeoye of Destiny and Lawlords, sought an order restraining the defendants/respondents or their agents from breaking in, entering, occupying and forcefully taking possession of the land, which is the subject matter of the suit.

The land measures approximately 9185.06 square yards as delineated in Survey Plan No. O.A 432 dated 14th October 1960.

It was prepared by Surveyor Adekunle Kukoyi and registered as No. 6 on page 6 in volume 431 at the Land Registry Office, Ibadan vide Deed of Conveyance dated January 1961.

Justice Oshoala had issued an order of mandatory interlocutory injunction compelling the defendants to forthwith stop trespassing on the said land pending the final determination of the suit.

Despite the subsisting order, Adeoye reported that Odunmbaku and others had attempted to take possession of the land. He threatened to commence contempt proceedings against them.

The lawyer urged the public to note that the land, which is also accessible through Olayiwola Street, off Kudirat Abiola way, Oregun, Ikeja, belongs to the Family of Late Ebenezer Olawanle Oladipo Fasehun, represented by Mr. Olufemi Omoola Fasehun.
