Proceedings were stalled on Wednesday in the criminal case against the estranged wife of former Aviation Minister, Femi Fani-Kayode, Precious Chikwendu and three others.
The Nigeria Police Force (NPF) in Abuja had charged Chikwendu and others with threat to the life and attempted murder witnesses lined up in the alleged attempted murder in a 14-count amended charge.
The other defendants, in the charge marked: FHC/ABJ/CR/01/2022, are Emmanuel Anakan, Prisca Chikwendu and Osakwe Azubuike.
At the mention of the case on Wednesday, a lawyer, Nneka Amadi said she was holding the brief of the actual prosecutor, John Ijagbemi.
Amadi said the case was slated for the defendants to plead to the amended charge, but that Ijagbemi could not attend court because he was sick.
She prayed the court for an adjournment to allow the prosecutor time to attend to his health.
Lawyers to the other defendants – Emeka Uchegbulam and Peter Abang – did not object to Amadi’s request for adjournment.
They urged the court to note that the request for adjournment was by the prosecution and that if granted, it would be at its instance.
Ruling, Justice Inyang Ekwo held that it was wrong for Amadi, who is a lawyer of the NPF to claim to be holding the brief of another lawyer from the institution.
“Don’t you know that in law, you don’t hold brief for another lawyer in government establishment?” The judge said.
Justice Ekwo then adjourned till October 6 but warned that: “This shall be the last adjournment for the prosecution.”
