  • Osun tribunal: Oyetola to open defence Jan 30

    The Osun State Governorship Election Tribunal has adjourned to January 30 this year for the state Governor, Adegboyega Oyetola to open his defence.

    The tribunal is hearing the petition filed by the People’s Democratic Party (PDP) and its candidate in the last governorship election in Osun State, Senator Ademola Isiaka, challenging the decision by Independent National Electoral Commission (INEC) to declare Oyetaola, the candidate of the All Progressives Congress (APC) winner of the election.

    The petitioners are alleging, among others, that the election results were doctored to favour the APC candidate. It is also their contention that the election was marred with fraud and that it was not held in substantial compliance with the Electoral Act.

    Chairman of the tribunal, Justice Ibrahim Sirajo announced on Thursday, after INEC closed its case, that the tribunal will adjourn and return on January 30 when the second respondent will open his case. Oyetola is listed as the second respondent in the petition.

    INEC, listed as the first respondent to the petition, opened its case last Friday and closed on Thursday, without calling oral evidence, but relied solely on documentary evidence.

    The electoral body, while tendering all documents relevant to the election, including result sheets as announced by its officials, said it chose not to call oral evidence because the petitioners have not made out sufficient case to disprove the credibility of the election and the results it announced.

    INEC opened its case at the closure of the case of the petitioners, who tendered documents and called oral evidence.

    Most of the petitioner’s witnesses were PDP’s agents at the polling units where elections held.

    Majority of the witnesses, who were artisans and traders, were barely literate and able to express themselves in English language.

    Some of them could also not read when called upon to read portions of the statements they claimed were written for them by their lawyers, but which they signed.

  • Osun: Court rejects suit seeking to sack Oyetola (Updated)

    *Tribunal strikes out petition against Oyetola’s election

    A Federal High Court in Abuja on Friday dismissed a suit that sought to void the July 20, 2018 governorship primary of the All Progressives Party (APC) in Osun State.

    The state’s incumbent Governor, Adegboyega Oyetola won the primary and proceeded to win the governorship election held on September 22 and 27 last year.

    In a judgment on Friday, Justice Inyang Edem Ekwo held that the plaintiff, Kunle Rasheed Adegoke, could not prove his claim that the primary was held in violation of relevant laws

    Adegoke, who came a distant 8th in the primary, filed the suit marked: FHC/ABJ/ CS/804/2018, in which he argued among others, that the primary was not held in compliance with the relevant provisions of the country’s Constitution, the Electoral Act, the constitution of the APC and its guidelines for the conduct of primaries.

    Adegoke prayed the court to, among others, nullify the primary on the grounds that it was allegedly conducted in violation of the relevant laws.

    Respondents in the case were the APC, the Independent National Electoral Commission (INEC), Oyetola and the Deputy Governor, Benedict Olugboyega Alabi.

    In his judgment, Justice Ekwo, after analysing parties’ arguments and the documentary evidence tendered, held that the plaintiff failed to establish its case.

    The judge said the APC did not violate any law by electing to adopt the direct primary. He said such option was provided for in the party’s constitution.

    On Adegoke’s contention that sufficient notice was not afforded the aspirants, the judge noted that there was evidence that, although he was present where the choice of the party’s primary was announced to members on July 16, 2018, he raised no objection.

    The judge said the plaintiff’s contention, that sufficient notice was not given the INEC about the shift in the date of the primary from July 19 to 20, 2018, was misplaced.

    Justice Ekwo noted that the presence of INEC’s officials at the primary speaks volume about its power to waive the requirement for a seven-day notice.

    He said if there was any person who should complain of non-compliance with the regulations for the conduct of primaries, it is INEC and not the plaintiff.

    The judge said: “It is my opinion, upon considering the evidence in this case, that the 1st defendant acted within the power and authority vested in it in the conduct of the governorship primaries in Osun State in the circumstance of the evidence in this case.

    “Far be it that primary election of a political party would be annulled simply for the fun of doing so or in sympathy with an aspirant whose aim is just to have the primaries annulled.

    “The evidence to warrant the exercise of the power of nullification by the court must be compelling and perhaps overwhelming.

    “That being the case, I am unable to see any of the provisions of the Constitution and Guidelines of the 1st defendant, which the plaintiff says, has been contravened, which has the potency of nullifying the primary election of 20th July 2018.

    “Indeed, none of the provisions of the Regulations for the Conduct of Political Party Primaries of the 2nd defendant carries the sanctions propounded by the plaintiff.

    “The law is that the court would not and should not read into the law or any statutory instrument that which is expressly not stated therein.

    “In the same vein, I have seen no evidence that the 1st defendant breached any provisions of the 1999 Constitution so as to make its conduct of the primary election or selection of its governorship candidate unconstitutional or ultra vires.

    “I have seen no evidence that the 1st defendant breached the provisions of the Electoral Act 2010 (as amended), as such has not been established in this case, with respect to the adoption of direct primaries for the selection of governorship candidate.

    “On the whole, I find no illegal or unconstitutional act on the part of the 1st defendant in the conduct of the governorship primaries in Osun State that would warrant this court to intervene in what can be considered as its (APC’s) internal affairs, either before or on 20th July, 2018 when the said primaries was held.

    “This case lacks merit and must be dismissed, and I make an order dismissing it,” Justice Ekwo said.
    Earlier, the judge dismissed the two motion of preliminary objection filed by APC, Oyetola and Alabi.

    As against the arguments by the APC, Oyetola and Alabi, the judge said the plaintiff had the locus standi to file the suit, that the suit was properly commenced through the originating summons procedure and that the court has jurisdiction to enquire into the way a political party exercises its power and whether it complied with its constitution and regulations in its conduct.

    On the argument that the plaintiff failed to exhaust internal part mechanism before heading to court, the court held that no party regulation could oust the jurisdiction of the court to determine dispute relating to whether or not it complied with its constitution and regulations.

    The judge noted that though the party’s constitution contained measures for internal dispute resolution, he said such provisions cannot oust the jurisdiction of the court.

    On the argument by Oyetola and Alabi that the plaintiff lacked the locus standi to institute the suit because he had been expelled from the party, the judge noted that there was no evidence submitted before the court to support the claim that the plaintiff had been expelled.

    Also, the Osun State Governorship Election Tribunal, sitting in Apo, Abuja, on Friday, struck out the petition by Jumoke Lawal and her party, the National Rescue Movement.

    The petitioners had queried the legality of the governorship election on ground of alleged unlawful exclusion.
    In a ruling on Friday, the tribunal, led by Justice Ibrahim Sirajo, struck out the petition after petitioners’ lawyer, Oluwole Adja applied to withdraw it.

    The tribunal awarded N50,000 cost against the petitioners.

    Further hearing resumes on January 14 in the petition by the People’s Democratic Party (PDP) and its candidate, Senator Ademola Adeleke.

  • Osun residents set agenda for new governor

    Some residents of  Osun have called on the new governor of the state, Alhaji  Adegboyega Oyetola, to take measures aimed at ensuring regular payment of salaries for workers as well as improved living condition for all residents.

    The residents, who spoke with the News Agency of Nigeria (NAN) on Wednesday in Osogbo, expressed optimism that the new administration would herald a new dawn in the state.

    A  civil servant, Mr Segun Efunkunle, said that his expectation from Oyetola was a better welfare package and prompt payment of full salaries.

    Efunkunle decried the attitude of the immediate past administration to workers’ welfare and called for a new orientation.

    According to him,  Oyetola needs to make the welfare of civil servants a priority in view of their plight in the last eight years.

    Also speaking, a trader, Mrs Susan Egbejimi, urged the new governor to put in place viable economic policies that would stimulate the economy of the state.

    Egbejimi said she was looking forward to a buoyant economy that would attract investors and provide opportunities for the people.

    A roadside mechanic, Mr Taofeek Abdullazeez , urged Oyetola to ensure that artisans and traders enjoy patronage from workers through regular payment of salaries.

    Abdullazeez also called on the people to support and pray for the success of the new administration.

    The state’s  Chief Judge, Justice Oyebola Adepele-Ojo administered the oath of office on the new Chief Executive of the state at 1:02 pm at the Osogbo Stadium shortly after Mr  Benedict Alabi was sworn-in as the state Deputy Governor.

    Until his election on Sept. 22, Oyetola had spent eight years as the Chief of Staff to Gov. Rauf  Aregbesola who was sworn in on Nov. 27, 2010.

    Born on Sept. 29, 1954, Oyetola, who is an indigene of Iragbiji, attended the University of Lagos for his Bachelor of Science degree in Insurance in 1978 and a Masters degree in  Business Administration in 1999.

    Oyetola defeated the candidate of Peoples Democratic Party, Sen. Ademola Adeleke, during the last governorship election.

    The outcome of the Sept.22 election is still being contested at the Governorship Election Tribunal sitting in Osogbo by  Adeleke.

  • ‘Oyetola ‘ll win Osun governorship election’

    Osun State House of Representatives aspirant, Olalekan Badmus, says Governor Rauf Aregbesola will hand over power to the candidate of the All Progressives Congress, Adegboyega Oyetola, in November this year.

    A statement by Badmus, who is eyeing the ticket of the ruling party for the Irepodun-Olorunda-Orolu-Osogbo federal constituency, said Oyetola was head and shoulders above the other contestants seeking to succeed Aregbesola.

    He described Oyetola as a successful technocrat who assisted Aregbesola in achieving landmark success in education, economy, road infrastructure, security and wealth creation in the last eight years.

    As Chief of Staff, Badmus said Oyetola was a reliable interface between government and various publics in Osun.

    He said, “You can’t build something on nothing. Oyetola has the best track record among the contestants, and they all know it.

    “His success is not unknown to his rivals but they won’t just admit it publicly. But the people of Osun know Oyetola’s worth and they are prepared to vote him into the Osun State Government House on September 22, 2018.

  • ‘My government will not depend on federations account’

    Governorship candidate of the All Progressives Congress (APC) for the September 22 governorship election in Osun State, Adegboyega Oyetola has said that if elected as governor of the state, he will rely less of allocation from the federation Account, but seek other means of increasing Internally Generated Revenue.

    Oyetola also assured civil servants in Osun state that if elected governor of the state, he will pay all the outstanding salaries within 12 months of assuming office, while insisting that the current government in the state did not owe salaries to junior workers in the state.

    Oyetola who was at the APC national secretariat to complete formality for the submission of his name to the Independent National Electoral Commission also said that the resignation of the Secretary to the State Government Moshood Adeoti will affect his chances of emerging the governor of the state.

    Adeoti who was one of the aspirant foe the APC ticket withdrew from the race on the allegation that his Senatorial district of Osun West was being marginalized has however picked the governorship ticket of the Action Democratic Party (ADP).

    He said he will increase the Internally generated revenue of the state without necessarily increasing tax, but ensuring that those who are supposed to pay tax, but have not been doing so pay appropriate tax to the government.

    “First of all, most state has been challenged by the lack of fund over the years But there is this misconception on the issue of salaries about Osun state. We paid salary from level one to seven. We do not owe anybody in that category. We paid 75% for people on level 8 to 10. The only category of people we owe is actually from level 12 to 17 as well as pension.

    “So, when you talk about owing salary, people tend to forget that it is not across board. Salary is fully paid from level one to seven, up to date. Levels eight to ten, we pay 75%. It is only portion of 12 to 17 that is being paid 50%.

    “Yes, it is a challenge that we all recognize. But we believe that will not persist for too long. My attitude and the method I want to adopt is not to entirely rely on allocation that comes from the federal government but to look at the means to seriously develop the IGR, not necessarily by increasing tax, but by ensuring efficiency in terms of collection and by bringing people who have been evading tax to come into the bracket. You can still get more by doing all of that without necessarily increasing tax.

    “So we are committed to paying whatever that is outstanding and we are looking forward to be able to pay full salaries subsequently. In any case, why do we want to be in government if we can not think outside of box? We must be very creative, that is the essense of being in government anyway. I believe in another one year you would have seen that things would have changed to better.”

    “Well, SSG is my brother actually, I would have loved that he remains in the party. But as a matter of choice, he decides to leave the party. There is nothing anybody can do about that.

    “But as to whether it will affect my fortune during the election, I don’t think so. One, if you look at the result of that election, I had 127,000 votes. These are purely members of our Party. We are going to have opportunity of other voters.

    “On the average, we usually have about 600, 000 or so serious voters. If you look at the percentage of that from members of our Party alone and with the kind of programme I want to run, and the fact that people seem to have that level of trust in me, I believe I will have more not only from the APC which is our base, even from the generality of the people.

    “So, I wish him well. He is a somebody I have some regards for too.  Sometimes politics is like that. You path and meet again. I wish him well”.
