  • Akinjide: Court rejects PDP chief’s bid for foreign medical trip

    LAGOS Federal High Court yesterday dismissed an application by an Oyo State Peoples Democratic Party (PDP) leader, Chief Olanrewaju Otiti, for permission to travel to the United States (U.S.) to treat a liver problem.

    Justice Muslim Hassan held that allowing her to travel was too risky as she might not return.

    Chief Otiti is on trial with former Minister of the Federal Capital Territory, Jumoke Akinjide, and a former senator representing Oyo Central, Ayo Adeseun.

    They were charged along with a former Minister of Petroleum Resources, Mrs. Diezani Alison-Madueke, who is said to be at large.

    The Economic and Financial Crimes Commission (EFCC) accused them of conspiring to directly take possession of N650 million, which they reasonably ought to have known was part of proceeds of an unlawful act and without going through a financial institution.

    They pleaded not guilty.

    Otiti, through her lawyer, Akinola Oladeji, promised not to run away if she was allowed to travel.

    “The applicant is seeking a conditional release of her passport for a trip to attend to her health challenges,” Oladeji said.

    The lawyer said Otiti had been suffering from the ailment for long, and that she was receiving treatment abroad when EFCC asked her to return.

    He said his client left her treatment in the U.S. and came to Nigeria.

    After making a statement at EFCC, she returned to the U.S. to resume the treatment but was again invited by the EFCC and was subsequently arraigned.

    The lawyer said the University Teaching Hospital in Ibadan issued a report that the PDP chief had “two cysts on the left and one on the right”.

    But Justice Hassan refused the application as lacking in merit and dismissed it.

    He adjourned until May 16 for continuation of trial.

     

  • EFCC denies inducing ex-minister Akinjide to make statements

    THE Economic and Financial Crimes Commission (EFCC) yesterday denied inducing a former Federal Capital Territory minister Ms Jumoke Akinjide to make statements.

    The former minister and her co-accused told the Federal High Court in Lagos that their statements to EFCC were not made voluntarily.

    They claimed they were threatened with incarceration.

    Akinjide disowned five extrajudicial statements, which she allegedly made.

    The other defendants – a former senator representing Oyo Central Senatorial District Ayo Adeseun, and a Peoples Democratic Party (PDP) leader in Oyo State, Chief Olarenwaju Otiti – made similar claims.

    Akinjide’s lawyer, Mr. Olusegun Williams, opposed moves by EFCC’s counsel Rotimi Oyedepo to tender the statements in evidence on the basis that they were obtained under duress.

    He urged the court to order a trial-within-trial to determine if the statements were made voluntarily.

    Other defence counsel Mr. Michael Lana and Akinola Oladeji also claimed that their clients’ statements were not made voluntarily.

    After Justice Muslim Hassan ordered a trial-within-trial, Oyedepo called his first witness, the leader of its Special Task Force 4, Usman Zakari, as a witness.

    Zakari said: “I’m surprised. The first defendant (Akinjide), when she reported to our office, came along with Barrister Olusegun Williams and her husband. I was the one that interviewed her.

    “During the course of the interview, the payment receipt of the N650 million, which the defendant signed, was shown to her and she volunteered to react in writing regarding the payment receipt. There and then, I instructed my subordinate, Tosin Owobo, to caution her. And he read the cautionary words to her, which she understood.”

    Justice Hassan adjourned until April 23 and 24.

    N650m: Ex-FCT Minister Akinjide in plea bargain talks with EFCC

    A former Minister of the Federal Capital Territory (FCT), Jumoke Akinjide, yesterday told the Federal High Court in Lagos that she was holding plea bargain talks with the Economic and Financial Crimes Commission (EFCC).

    Mrs. Akinjide, Senator Ayo Adeseun, and a People’s Democratic Party (PDP) chief, Mrs. Olanrewaju Otiti, were accused of laundering N650 million.

    EFCC said they allegedly received the money from former Minister of Petroleum Resources Mrs. Diezani Alison-Madueke, who was named in the charge as being at large, ahead of the 2015 general elections.

    Trial was billed to resume yesterday with EFCC set to call its witness. But Akinjide’s lawyer Chief Bolaji Ayorinde (SAN) said the N650 million had been returned to the Federal Government as part of the plea bargain.

    He said: “My lord, the charge before this court is essentially in relation to the PDP campaign funds for the 2015 elections in Oyo.

    “Before trial commenced, the defendants, who were chieftains of the PDP in Oyo at the time, acting on the collective decision of the party, decided to refund the monies mentioned in the charge.

    “In the light of the above, before the trial commences full-blown, we are imploring the court to allow parties to explore possible amicable settlement.

    “I have had a talk with the lead counsel for the prosecution, and so, going forward, we think it wise not to subject this matter to further adjudication, so as not to waste the time and resources of the court.

    “In that light, I have suggested that all counsel meet, so as to look at a way forward on this charge, especially considering the fact that the monies complained of, has already been refunded.

    “My application, therefore, is that this court adjourns further hearing, pending the outcome of discussion by counsel.”

    Prosecuting counsel Rotimi Oyedepo confirmed that the money had been returned, adding that the case was not only about the money, but the fact that the defendants allegedly dealt “with proceeds of unlawful activity”.

    He added that the N650 million was recovered from Akinjide and not from chieftains or principal members of the PDP.

    Referring to Sections 270 of the Administration of Criminal Justice Act (ACJA), Oyedepo said the law allows for such “settlement discussions” by parties.

    He said EFCC was not opposed to such discussions even though his witness was in court.

    Justice Muslim Hassan adjourned the case to enable parties conclude the talks.

    He said: “In line with Section 270 of the ACJA, which allows parties to explore plea bargain, this case will be adjourned.”

    The section reads: “The prosecutor may receive and consider a plea bargain from a defendant charged with an offence either directly from that defendant or on his behalf; or offer a plea bargain to a defendant charged with an offence.”

    The defendants, who pleaded not guilty, were re-arraigned on a 24-count charge of conspiring to obtain the N650 million from Mrs. Alison-Madueke, a sum EFCC said they reasonably ought to have known “formed part of the proceeds of an unlawful act”.

    Justice Hassan adjourned till February 22.

    The case of a former Minister of the Federal Capital Territory, Jumoke Akinjide, has been transferred to the Federal High Court in Lagos.

    It has been re-assigned to Justice Muslim Hassan.

    Akinjide was charged along with former Minister of Petroleum Resources, Mrs Diezani Alison-Madueke, who is said to be at large.

    Others named in the charge are Senator Ayo Adeseun and a Peoples Democratic Party (PDP) stalwart Chief Olarenwaju Otiti.

    They were accused of conspiring to directly take possession of N650million, which they reasonably ought to have known forms part of the proceeds of an unlawful act.

    They were arraigned last June before Justice Joyce Abdulmalik in Ibadan.

    It was learnt that the Acting Chief Judge, Justice Adamu Kafarati, moved the case to Lagos at Akinjide’s instance.

    The former minister was granted bail on self-recognition when she was arraigned in Ibadan. She was also asked to submit her international passport.

    Prosecuting counsel Mr Rotimi Oyedepo confirmed to our correspondent yesterday that the former minister would be tried in Lagos.

    “Yes, we have been served with a Hearing Notice by the Federal High Court, Lagos Division, that the case is coming up before Justice Hassan next week,” he said.

    The defendants allegedly received the money from Mrs Alison-Madueke in the build- up to the 2015 general election.

    It was said to be part of the $115 million allegedly disbursed by Mrs. Alison-Madueke to influence the outcome of the 2015 presidential election.

    One of the charges reads: “That you, Mrs. Diezani Alison-Madueke (still at large), Oloye Jumoke Akinjide, Senator Ayo Ademola Adeseun and Chief Olarenwaju Otiti on or about the 26th day of March, 2015, in Nigeria within the jurisdiction of this Honourable Court conspired amongst yourselves to directly take possession of the N650 million which sum you reasonably ought to have known forms part of the proceeds of an unlawful act.

    “That you, Oloye Jumoke Akinjide, Senator Ayo Ademola Adeseun and Chief Olanrewaju Otiti on or about the 26th day of March, 2015 in Nigeria, within the jurisdiction of this Honourable Court did conspire amongst yourselves to commit an offence, to wit: making cash payment of the sum of N650 million which sum exceeded the amount authorized by Law without going through financial institution and you thereby committed an offence.”

    The defendants pleaded not guilty.

    It was learnt that Akinjide held plea bargain talks with the EFCC. The case may come up before Justice Hassan on Tuesday.

  • Ladoja’s aides, Akinjide, others attend Oyo PDP exco

    Notable stalwarts in Oyo State Peoples Democratic Party (PDP) yesterday attended the maiden State Executive (Exco) meeting after efforts to bring back aggrieved members who left the party.

    The meeting, which was attended by a former Minister of the Federal Capital Territory (FCT), Oloye Jumoke Akinjide, Senator Femi Lanlehi and aides to former Governor Rashidi Ladoja, climaxed with release of a timetable for ward congresses on October 21.

    The party fixed its local government congresses for October 28 while state congress is slated for November 4.

    PDP’s State Caretaker Chairman Tunde Akogun, who spoke at the Premier Hotel venue in Ibadan, said the development would help elected members take part in the national congress.

    The chairman warned members not to convene the party’s meeting at state level without approval of the appropriate authority.

    He warned that whoever goes against party rules would be sanctioned.

    Akogun pledged to ensure that PDP becomes a viable and active party.

    The chairman said the party’s glory would be restored, even within his limited time, adding that he will ensure free, fair and transparent atmosphere for members.

    He said: “We will conclude our assignment by supervising the congress at the ward level on October 21, while local governments’ comes up on October 28 and the state’s on November 4, to enable elected candidates vote at the national convention. I appeal to you to give us your sincere and fullest cooperation in order to finish the job successfully and as scheduled.

    “Let me warn that on no account should anyone hold a PDP meeting at the state level without my approval as any such person(s) will be sanctioned.

    Court remands Akinjide, Otiti in EFCC’s custody

    Federal High Court sitting in Ibadan has ordered that a former Minister of Federal Capital Territory (FCT), Oloye Jumoke Akinjide and another chieftain of the People’s Democratic Party (PDP) in Oyo State, Chief Olanrewaju Otiti, be remanded in Economic and Financial Crimes Commission’s (EFCC) custody over the N650 million allegedly collected to fund the 2015 election.

    The court ordered the anti-graft body to produce unfailingly the second defendant in the case, Senator Ayoade Adeseun, who has failed to appear in court to face trial over the alleged fraud.

    At yesterday’s hearing , counsel to the first and second defendants,  Oloye Akinjide  and Adeseun (at large) – Chief Bolaji Ayorinde SAN  and Chief Michael Lana – announced their withdrawal from the case amid heated argument over a ruling by Justice Joyce Abdul-Malik.

    In the charge, the defendants were accused of conspiring to take possession of N650 million unlawfully and thereby committed an offence contrary to Section 18 (a) of the Money Laundering Act, 2012 and punishable under Section 15 (3) & 4 of the Act.

    Before the court took the plea of the defendants, Justice Abdul-Malik ordered that the12-count charge should be read out to the defendants, to which they pleaded not guilty.

    Some of the count charge reads in part: “That you Mrs. Diezani Alison-Madueke (still at large), Oloye Jumoke Akinjide, Senator Ayo Ademola Adeseun and Chief Olanrewaju Otiti on or about March 26, 2015, in Nigeria within the jurisdiction of this honourable court conspired among yourselves to directly take possession of the N650million, which sum you reasonably ought to have known forms part of the proceeds of an unlawful act and you thereby committed an offence contrary to Section (18) of the Money Laundering Act , 2012 and punishable under Section 15(3) & 4 of the same Act.”

    The counsel to the first defendant, Ayorinde SAN, in his submission, urged the court to refuse an alleged defective prosecution applications dated March 9, 2017 and March 20, 2017, for not having the seal of the Nigerian Bar Association (NBA).

    He said it was improper for prosecution counsel, Mr. Rotimi Oyedepo, to seek to substitute a charge without an order or permission of the court.

    He challenged the EFCC counsel for seeking to replace the originating charge with another charge sheet dated March 20.Ayorinde argued that the charge sheet to be amended was defective.

    Lana, counsel to Adeseun, while supporting the position of Ayorinde, SAN, submitted that once there is no seal in a charge sheet, it is deemed not to have been filed.

    The EFCC counsel, while reacting, argued that the contentious charge sheet is competent and valid before the court, since it carried a receipt issued by the NBA .

    In resolving the issue, Justice Abdul-Malik, after listening to the submission of the counsel, ruled that the court would not harbour any charge sheet not bearing the seal of the NBA.

    The judge ordered that the prosecution counsel could substitute the defective charge with the one with the NBA receipt.

    There was, however, emotional outburst while the prosecution counsel was seeking to substitute the charge sheet, as the defendant counsel rose against it, which led to the decision of the two defendant counsel to announce their withdrawal from the case.

    But Akinjide and Olanrewaju, through an application, sought to enter into plea bargain.

    The prosecution counsel informed the court that the parties have agreed on the plea bargain agreement and that negotiation has begun.

    Counsel to Otiti, Adeniyi Ishola, while aligning himself to the plea bargain agreement, also moved application for bail for the third defendant.

    Justice Abdul-Malik, who ordered the defendants to be remanded in EFCC custody, adjourned the case to 12 September.

    Hearing on the bail application for the third defendant was adjourned to July6, 2017.

    Akinjide hospitalised at UCH

    Former Attorney General and Minister of Justice in the Second Republic Sir Richard Akinjide (SAN) was yesterday admitted to the University College Hospital (UCH), Ibadan.

    The legal luminary was brought in in a UCH ambulance yesterday morning, following a distress call from his home.

    He was later admitted into the private ward after initial examination.

    A source said the octogenarian suffers old age-related ailments.

    Since his admission, Akinjide is said to have undergone series of tests including the Magnetic Resonance Imaging (MRI).

    Born in Ibadan, the Oyo State capital, on November 4, 1931, Akinjide was called to the English Bar in 1955.

    He became famous during the litigation over the 1983 presidential election when he as the counsel to the National Party of Nigeria (NPN) proved that winning in 12 of 19 states passed the two-third requirement of winning the election.

    Akinjide’s group: Folarin responsible for Oyo PDP’s defeat

    The Peoples Democratic Party (PDP) in Oyo State has entered another round of crisis after its defeat in the last general elections.

    Cracks emerged last week when a faction of the party under the leadership of Yekini Adeojo and Senator Teslim Folarin issued a statement suspending Jumoke Akinjide and a few others for alleged anti-party activities.

    But the group headed by Akinjide, who is the Minister of State for Federal Capital Territory (FCT), lambasted the other faction, saying it was responsible for the party’s disgraceful defeat.

    The Progressive Youths Frontier blamed Folarin, who was the governorship candidate, and other leaders of the faction for refusing to allow Senator Rashidi Ladoja return to the PDP and contest as its governorship candidate.

    The group in a statement by its Secretary, Abiodun Adeniyi, insisted that working with Ladoja was the best option because of the agreement that he would return to the PDP after winning the election under the platform of Accord.

    The group further blamed Folarin for forcing out Alao-Akala and Makinde from the party.

    With the latest brickbats between the two factions, the PDP has entered another phase of internal crisis after failing to resolve the first phase which started in 2003 between the late Chief Lamidi Adedibu and former governor Rashidi Ladoja.

    The crisis protracted till 2006 when Ladoja was illegally impeached. It continued till 2011 when Alao-Akala emerged the governorship candidate of the party and continued to this year when both Alao-Akala and Makinde opted out of the party.

    “Those who worked with Ladoja at the 11th hour were only saving democracy and sowing the seed of strengthening the PDP in Oyo State to which Ladoja could have returned after winning the election.”

    Minister of State for the Federal Capital Territory Oloye Jumoke Akinjide, Senator Ayoade Adeseun and a former factional chairman, Alhaji Kunmi Mustafa were yesterday suspended from the Peoples Democratic Party (PDP) in Oyo State for alleged anti-party activities.

    Also suspended was a PDP leader in Ogbomoso, Chief Saka Balogun, a former House of Representatives member, Dr. Maroof Akinwande and a host of others believed to have supported Rashidi Ladoja’s Accord Party or Labour Party’s Adebayo Alao-Akala during the April 11 governorship election.

    Their suspension was said to have been unilaterally authorised by the state leader, Alhaji Yekini Adeojo.

    For the first time since 1999, Oyo PDP performed woefully. Save for a single House of Representatives seat won by Segun Odebunmi in Surulere/Ogo-Oluwa constituency, the party did not win any seat in the senatorial districts.

    It also lost the 32-member House of Assembly to the ruling All Progressives Congress (18), Accord’s eight and LP’s six.

    This is coming 24hours to the zonal meeting of the Southwest PDP leaders in Ekiti, which was said to have been convened by the duo of Ekiti and Ondo states governors.

    The Contact and Mobilisation Committee of the Ajimobi Campaign Organisation has condemned the statement that the Peoples Democratic Party (PDP) would create Ibadan state, if President Goodluck Jonathan is elected.

    Describing it as evil and mischievous, the committee said PDP has failed Ibadan people in the last 16 years.

    A statement by the committee’s director, Wasiu Olatubosun, said the message could be best described as a package of lies, “used to play on the intelligence of sons and daughters of Ibadan land, who have been yearning for Ibadan state in the last 30 years.

    “If truly PDP is sincere in the creation of Ibadan state, why did it take this long to get it done and why has it used it as one of its cardinal campaign promises in the state since 1999.

    “After deceiving the good people of Ibadan, they are here again with the same old fable, thinking that Ibadan people would fall for their deceit.

    “The people, especially Ibadan people, should beware of the antics of ‘People Deceit Party’as deceit is the hallmark of  the Jonathan-led PDP administration and his state campaign coordinator, Oloye Jumoke Akinjide, is using the Ibadan state creation to hoodwink the people.

    “It would interest the public to know that the creation of Ibadan state was not in the final document submitted to the President through the National Conference.”

    Olatubosun urged the people to ignore both the message and the sponsors.

    The committee also advised the public to be wary of the antics of some people, who were collecting Permanent Voter Cards (PVCs) from voters in exchange for money.
