    Attack on Akunyili: Supreme Court orders Nnakwe’s trial

    A businessman, Marcel Nnakwe, charged with the attempted murder of former Director General, National Agency for Food and Drugs Administration and Control, Dora Akunyili, lost yesterday in an effort to quash the charges against him.

    The Supreme Court, in a judgment, dismissed Nnakwe’s appeal for lacking in merit and ordered him to return to court to be tried over the alleged attempt on Mrs Akunyili’s life and the murder of another person.

    Nnakwe was arraigned with seven others, including his son-Nnamdi Nnakwe – before an Abuja High Court in 2004 on a four-count charge of conspiracy, attempted murder and murder.

    At the conclusion of the prosecution’s case, he made a no-case submission and urged the court to quash counts three and four of the charge.

    He queried the jurisdiction of the court to hear the two counts and the powers of the Attorney General of the Federation (AGF) to issue fiat to the chambers of Afe Babalola SAN and Co to prosecute the charge on the ground that the alleged offences of attempted murder and murder took place in Agulu, Anambra State, where shots were fired at Akunyili’s vehicle and a man identified as Emeke Onuekutu killed.

    The trial court upheld his no-case submission and also quash the two counts.

    The prosecution took the case to the Court of Appeal, Abuja. The appellate court held in the prosecution’s favour, forcing Nnakwe to appeal to the Supreme Court.

    Justice Clara Bata Ogunbiyi, who read the lead judgment yesterday, held that the fiat issued to Afe Babalola by the AGF was in order and that the Abuja High Court has jurisdiction over the two counts even when the alleged offences were committed outside Abuja.

    “On collective deduction of Section 4(2)(b) of the Penal Code Act, read along with Section 134(a)(b)(c) and (d) of the Criminal Procedure Code Act as well as Section 301 of the Constitution, the only authority that can issue a fiat to prosecute the charges inclusive of counts three and four, is the AGF.

    “This is especially the offences having, by operation of law, automatically become those that were committed within the Federal Capital Territory (FCT) upon the entry of the appellant into the FCT. Counts three and four of the charge that took place in Agulu, Anambra State automatically become offences committed in the FCT as soon as the appellant entered the FCT.

    “Counts three and four are a continuing manifestation of the acts in counts one and two which took place in the FCT,” the judge held.

    The judge also faulted Nnakwe’ argument that Afe Babalola needed a fresh fiat to prosecute the appeal.

    Justice Ogunbiyi held that the single fiat issued by the AGF for the prosecution of the case covers all aspects of it, particularly when the appeal was an interlocutory one.

    The judge upheld the jurisdiction of the Abuja High Court to try the charge and ordered that hearing should continue before the court in relation to counts three and four of the charge.

    Justices Walter Samuel Nkanu Onnoghen, Christopher Mitchell Chukwuma-Eneh, Olukayode Ariwoola and Kumai Bayang Aka’ahs, who were on the panel that heard the appeal, agreed with Justice Ogunbiyi’s position.

    Nigeria took center stage in Niamey, the capital of Niger Republic as one of its women of valour, Professor Dora Akunyili, was celebrated for her dedication to duty and success during her tenure as the Director General of Nigerian Agency for Food and Drug Administration and Control, NAFDAC.

    The former Minister of Information was awarded the pioneer trophy by the Ministry of Women Promotion and the Incubation, Entrepreneurship and Leadership Promotion Centre (CIPEL) in a grand ceremony held at the main auditorium of the Palais des Congress.

    The 4th edition of the International Active African Woman Awards was funded by Dr. Issoufou Malika, the First Lady of Niger and supported by Prime Minister Brigi Rafini.

    While giving her vote of thanks, Akunyili said, “I especially cherish this award because it is coming over four years after I left office as Director General of NAFDAC. It makes me feel good that people are appreciating the work we did in Nigeria all over the world as intensely fought against fake medicines not only in Nigeria but also across West Africa when drug counterfeiters began migration to neighboring.”

    As part of efforts to ensure that the success in Nigeria was replicated across the African sub-region, the former Director General says she convened a meeting of all drug regulators from in West Africa. It is the achievement of the joint collaboration that has brought her international acclaim.

    Speaking with the press, she revealed that her effort at improving the quality of food and drugs in the face of an assassination attempt stems from a personal experience involving death.

    “My younger sister, the best of all my siblings died in 1988 from counterfeit insulin. Eventually, we noticed that she was getting multiple abscesses from the adulterated drug.

    “At the time, we were not sure if it was the insulin that led to her death because there was no public awareness until I got to NAFDAC and began receiving consignments of unsterile water that was bottled as insulin and my heart bleed. The personal pain became my motivation,” she finished.

    The chairperson of the organizing committee, Mrs. Issa Halimatou Almoustapha while congratulating Akunyili said, “We did this to show support to all the great women in our continent and the work Professor Dora has done is something that has saved the lives of many people. For that we appreciate her and hope that she will continue to do more.”

    The event which took place on Friday the 8th of March had awardees from Tunisia, Morroco, Benin Republic, Burkina Faso, Cote d’Ivoir and Togo in attendance.

    In view of valiant efforts made in the fight against counterfeit drugs and unsafe foods, the Republic of Niger is set to honour former Minister of Information and Communication and Director General of National Agency for Food and Drug Administration and Control (NAFDAC), Professor Dora Akunyili (OFR), with the prestigious Pioneer trophy at the 4th edition of the International Active African Woman Awards.

    The ceremony, a joint collaboration between the Niger Republic Ministry of Women Affairs and the Incubation, Entrepreneurship and Leadership Promotion Center (CIPEL), is a national occasion, sponsored by the First Lady of Niger, Dr. Issoufou Malika, under the high patronage of the Prime Minister, His Excellency Brigi Rafini.

    According to the chairperson of the organising committee, Mrs. Issa Halimatou Almoustapha, the country seeks to “pay tribute to African women leaders who support to the best of their ability, the wellbeing of women.”

    Other awards received by Professor Dora are the Time Magazine and Transparency International’s Integrity awards.

    Congratulating the former NAFDAC Director-General, Mandour Maman Hadj Daddo, the Niger Ambassador to Nigeria, felicitated with Akunyili.

    The event which will take place on Friday the 8th of March at the Palais des Congres in Niamey will have dignitaries from Cote d’Ivoire, Morrocco, Togo, Burkina Faso and Benin Republic in attendance.
