    • As first daughter seeks DNA for siblings, exhumation of father’s body

There is currently ongoing legal battle in the family of the late former governor of Oyo State, Otunba Christopher Adebayo Alao-Akala, as his first daughter, Mrs Oluwatoyin Alao-Aderinto, has approached an Oyo State High Court sitting in Ibadan, seeking an order for a Deoxyribonucleic Acid (DNA) test on seven individuals claiming to be biological children of the deceased.

Oluwatoyin Alao-Aderinto is also seeking an application for the exhumation of the late governor’s body to carry out the DNA test.

In a suit filed before Justice Taiwo of Court 12 at the state High Court, Ring Road, Ibadan, with Motion Number I/443/2024, Oluwatoyin Alao-Aderinto, through her counsel, Oladipo Olasope (SAN) is praying the court to direct that the DNA tests be carried out on herself, including her siblings, Olamide, Adebukola, Olamipo, Olamiju, a serving member of the House of Representatives, Tabitha and Olamikunle, as listed in the motion on notice filed before the court.

She also said the test  should be conducted at a court accredited laboratory to determine their true biological relationship with the late governor.

As part of the application, Oluwatoyin Alao-Aderinto is also seeking an order of court, directing exhumation of Otunba Alao-Akala’s remains from the mausoleum built in the former governor’s Ogbomoso country home for the purpose of carrying out the paternity test.

The results of the tests, she pleaded, should be filed under a sealed envelope and delivered directly to the presiding judge for pronouncement in open court.

The fresh application brought before the court is a new twist in what has become a messy and prolonged family feud over the vast estate of the late politician who died on January 12, 2022.

The crisis which has been brewing silently since his burial became public in October 2022 when one Kemi Alao-Akala and Olamide Alabi, believed to be one of the deceased’s daughters, obtained a Letter of Administration from the Oyo State Probate Registry without the knowledge or consent of Oluwatoyin, the first child.

According to Oluwatoyin Alao-Aderinto, this singular act was a deliberate and unlawful exclusion that contravene applicable laws guiding intestate succession in Nigeria.

In her affidavit and accompanying exhibit filed in support of her motion, she accused the duo of manipulating facts to claim sole control over the estate, despite the presence of other biological children and heirs.

The estate in question is said to be massive, spreading across several properties in Ibadan, Lagos, Abuja, United Kingdom and the United States of America, including a five star hotel in Ghana, vehicles and multiple bank accounts containing hundreds of millions in naira, dollars and pounds sterling.

Oluwatoyin’s position on her deceased father’s estate stems from her strong resolve at ensuring that every individual, including nuclear and extended family members, aides of the former governor, who served him meritoriously without blemish and yet to be identified children among many others are catered for, as against the winner takes it all approach adopted by the duo of the defendants.

The said administrators listed only seven individuals as legal heirs, but Oluwatoyin’s position, as articulated by her counsel, is that there is no consensus on the paternity of these persons and that the inclusion of some and exclusion of others in the administration of the deceased’s estate raises troubling questions of authenticity and equity. It is on this basis she seeks judicial intervention through scientific means.

It will be recalled that in an August 2023 letter made public, counsel to Oluwatoyin, Oladipo Olasope SAN, warned that the exclusion of the claimant who is the first daughter of the late Alao-Akala, violated both moral norms and legal rights, stressing that unless resolved, the dispute could further polarise the family and damage the late governor’s political legacy.

Prince Fasinu said it is a great insult to the good people of Owo that a new king is about to be installed when suspects of the killing of his brother are standing trial and the court hasn’t resolved it yet.

He lamented that the Governor Ibikunle Amosun – led government has not done anything about the killing of Oba Oyeniran Fasinu, saying it would amount to dishonor if the proper thing was not done for the late monarch before installing a successor – Oba.

  • UPDATED: Witness’ absence stalls Akala’s N11.5b fraud trial

The trial of the former governor of Oyo State, Otunba Christopher Alao-Akala, and two others for alleged fraud was on Wednesday, adjourned to May 2, 2019 due to absence of the prosecution witness who was to give evidence in support of the 11-count charge preferred against the accused by the Economic and Financial Crimes Commission (EFCC).

Justice Olalekan Owolabi of the Oyo State High Court, sitting in Iyaganku, Ibadan, granted the EFCC’s request after its counsel, Dr. Ben Ubi, told the court that the second witness, Mr. Abdulrasheed Bawa, who is also the current head operations in the commission’s Port Harcourt zonal office, was unable to make it to the court.

The former governor is standing trial alongside the commissioner for Local Government and Chieftaincy Matters during his tenure, Hosea Agboola and an Ibadan-based businessman, Femi Babalola.

The charge against them borders on conspiracy, awarding a contract without budgetary provision, obtaining by false pretence, acquiring property with money derived from an illegal act and concealing the ownership of such property, among others.

Among the offences, according to the information on the court papers, was a road contract worth N8.5bn, which Alao-Akala awarded between 2007 and 2009 to Pentagon Engineering Services, Babalola’s company, allegedly without budgetary provision.

The said contract was executed on behalf of the 33 local governments in the state.

Also in the charge is the allegation the former governor ordered the supply of drilling machines on behalf of the 33 local governments in the state to the tune of N3.5bn.

Apart from the allegation of conspiring with Agboola to withdraw N2.9bn from the Oyo State Local Government Joint Account, the anti-graft agency is equally prosecuting the former governor for allegedly illegally acquiring some property on Old Bodija road, off Rotimi Williams road, when he was in office.

The offences were said to contravene Section 22 (4) of the Corrupt Practices and Other Related Offences Act and Section 1 (18) of the Advanced Fee Fraud Act.

The case was originally filed in 2011 and has witnessed series of adjournments due to the volume of evidences and witnesses prepared to reinforce the prosecution’s argument.

Though, the court was to continue with the trial on Wednesday that could not happen since the witness billed for cross-examination was not present.

Dr. Ubi told the court that the witness was unable to attend the proceeding because he was involved in election duties.

“My lord the reason our witness is not in court today is because he is involved in the election processes in Rivers State,” he said, praying the court for another date.

Counsel to the first and third defendants, Hakeem Afolabi (SAN), and his counterpart holding the brief of the second defendant, Richard Ogunwole (SAN), did not oppose the prayer.

The presiding judge then adjourned the matter to May 2, 2019 for continuation of trial as he ordered the prosecution to make its witnesses available at the next date.

  • ADP to Alao-Akala: don’t rejoin APC

The  Action Democratic Party (ADP)  leadership has asked former Oyo State Governor and the Action Democratic Party  (ADP) governorship candidate Christopher Adebayo Alao-Akala to bury the thought of leaving the party to rejoin the ruling All Progressives Congress (APC).

The ADP said it was too late in the middle of the game for Alao-Akala to align with any political party.

It stated that as far as the party’s leadership was concerned, Alao-Akala remains its governorship candidate.

Besides, the ADP said it has embarked on mobilisation of the party’s members and supporters to educate them on the need to reject Alao-Akala’s decision to align with the APC candidate, Bayo Adelabu, in the March 9 governorship election.

Alao-Akala had struck a deal after a meeting with the APC National Leader Asiwaju Ahmed Bola Tinubu to support Adelabu in the forthcoming governorship poll in Oyo State.

ADP Southwest Chairman Chief Lateef Arowosaye, in a statement in Ibadan at the weekend, said the party was unaware of any pact with the APC.

According to the party, members and supporters of ADP should cast their votes for all ADP candidates, including Alao-Akala in next Saturday’s election.

The statement reads: “Our attention has been drawn to the statement by Otunba Alao-Akala to the effect that he has withdrawn his candidacy from the gubernatorial election in Oyo State scheduled for next week. The ADP wishes to make the following clarifications after consultations at all levels of the party’s leadership:

“We have not been formally informed by Otunba Alao-Akala of his decision to withdraw from the gubernatorial race.

“The gubernatorial ticket belongs to the party and not the candidate.

“The legal department of our party is fully informed and appropriate legal advice is being awaited. The ADP, therefore, remains in the gubernatorial election, moreso when the window of substitution of candidates has closed.

“We call on our teeming members and supporters of the ADP to troop out on March 9, 2019 and vote for the ADP in the gubernatorial and House of Assembly elections.

“The ADP wishes to also state that it is not in alliance with the APC in Oyo State.

“We have campaigned on the strength of our positioning as the credible alternative to the ruling APC in Oyo State. It will, therefore, be ridiculous to turn around at the 11th hour and embrace what we have used the lifetime of the ADP to condemn.

“The ADP is, however, in talks with other opposition parties in Oyo State to give the people of Oyo State a new breath of life. We shall duly inform party members and the public at large of this initiative at the fullest of time.”

Ojo who is also the APC Candidate for Ogbomoso North, South and Oriire Federal Constituency in this weekend’s National Assembly elections stated this today while featuring on a live radio programme on Ajilete FM, Gambari, Ogbomoso.

While reacting to an allegation made today by former Governor Adebayo Alao-Akala on a private radio station in Ogbomoso that Hon Ojo and other politicians betrayed him by not defecting with him to ADP, the Speaker pointed out that he never betrayed the former Governor for he did not invite him or brief him for once when he decided to leave APC for ADP.

  • I will ensure completion of Ibadan Circular Road– Alao-Akala

Former Gov. Adebayo Alao-Akala, the governorship candidate of Action Democratic Party (ADP) in Oyo State,  has promised to ensure the completion of Ibadan circular road if elected.

He made the promise on Wednesday at a programme tagged,  ‘Meet the Ibadan Electorate, ‘ organised by the Central Council of Ibadan Indigenes (CCII), a pan-Ibadan socio-cultural group.

Alao-Akala was at the programme alongside his running mate, Prof. Abideen Olaiya,  and Oyo South Senatorial candidate, Dr Fola Akinosun.

Alao-Akala promised to continue his urban renewal programme, embark on massive road projects in Ibadan and across the state when as soon as he was sworn in as governor.

“Ibadan is very big and as an administrator with experience, this city needs massive road expansion. I demonstrated this during my first term as governor of this noble state.

“And if you can remember vividly, I started the Circular Road and I am promising that it will be a priority project of my administration if I am elected.

“I will open up more places with Circular Road construction in Ibadan.  I have listed in my manifesto some other 14 roads in the state that need urgent attention in Ibadan.

“I will also create access road to our rural areas through re-construction and rehabilitation of more roads in the state,” he said.

The former governor reiterated his determination to improve the internally  generated revenue of the state through taxation of the rich to provide for the poor

Alao-Akala described Adeoyo Hospital, Yemetu, Ibadan,  as very historical, promising to give it a facelift like he did to the ancient Mapo Hall.

He also pledged to solve the ownership problem affecting Ladoke Akintola University of Technology, Ogbomoso .

Earlier, Chief Yemi Soladoye, the CCII President-General, said the platform was neither for debate, campaign nor anointing of any candidate in whatever form.

“It is very clear that what the CCII is organising is a meeting, not a debate or a campaign.

“ We, the people of Ibadan,  are known to be tolerant and hospitable to all and sundry.

“The CCII will not provide a platform to ridicule, embarrass or expose the past and background of any of our candidates. This meeting is strictly going to be 100 percent issue-based with zero percent personality-based.

“We believe that there is direct correlation between the five elements of education, infrastructure, business revolution, financial empowerment and job creation.

“To what extent does our next governor understand this correlation? We do not believe that the fortunes of Oyo state and the future of our children should be tied to oil.

“We achieved our ‘pacesetter’ status from our home-grown resources in South West Nigeria, ” he said.

He also said that the CCII would at the end of the exercise not anoint any candidate, adding it was an avenue for people to make informed decision about who should govern them in the next dispensation.(NAN)

  • I am on a rescue mission, says Alao-Akala

THE former governor of Oyo State and governorship candidate of the Action Democratic Party (ADP), Otunba Adebayo Alao-Akala, has said he is on a rescue mission in the state.

He alleged that Governor Abiola Ajimobi has not done enough for the state, adding that 90 percent of his  programmes and projects are not in the interest of the people.

Alao-Akala spoke at a ceremony marking the presentation of the Alao-Akala/Olaiya ticket and the inauguration of the Akala-Olaiya campaign organisation.

The former governor said his advice to the governor fell on deaf ears.

He alleged that the ruling All Progressive Congress (APC) is conniving with some officials of the Independent National Electoral Commission (INEC) to rig the poll.

Alao-Akala said: “I’m seeking another opportunity to govern the state. I am, on a rescue mission to reposition the state for the betterment of our people and investors.

“Service to humanity especially holding a public office is not a function of age but mental capacity, experience, maturity, good vision and mission, sensitiveness, responsiveness, credibility and popular acceptability of a person. I am offering myself again to serve the good people of Oyo state because I am healthily and mentally fit for the rigorous tasks of governance.

He added: “My heart aches because 90 percent of the outgoing government’s policies, programmes and programmes and projects are best described as anti-people which leave our people in pain and despondency.

“Instead of criticizing, I made myself available to guide the incumbent government on how best to run proactive and pro-people governance but the driver lacks the required goodwill. Today, the major sectors of our economy, which are education, health, agriculture and environment, have been either neglected or bastardised. Oyo state is in a serious mess.

“When a serious duty of overhauling government calls, experience counts. On July 4th of this year, I responded to Oyo State Patriots’ clarion call to contest the 2019 governorship elections, so that succor, humane posture, robust economic activities, even and equitable infrastructural developments that were once entrenched in governance of the state during my past tenure could be repeated and improve upon with renewed vigor.

“Immediately after the inauguration of our government come May 29th, 2019, we shall hit the ground running by declaring state of emergencies in the education and health sectors of Oyo state. Our dying LAUTECH, EACOED, The Polytechnic Ibadan and other state-owned tertiary institutions will be rescued and their pride statuses in the comity of educational institutions will be restored.

“Also, we are determined to initiate and implement policies and proagrammes that would transform the state, improve the welfare of the residents and create an environment conducive to business growth and security as well as wealth and employment.

“May I use this occasion to inform the stakeholders in the Nigerian electoral system and the world at large that information reaching us from competent sources is that some bad elements in the Independent National Electoral Commission (INEC) are conniving with the ruling APC to disenfranchise thousands of voters across the state and weakening the leading opposition candidates in their strongholds by engaging in state-wide illegal relocation of voters from their units/local government of origins to another units/LGAs.

“We call on the INEC chairman and the constituted security agencies to put a stop to this advanced rigging method.
