    APP sues APC over refusal of ‘reinstated’ council executives to vacate offices

    Action Peoples Party (APP) has sued All Progressives Congress (APC), its state chairman and others for contempt, following the refusal of sacked local government executives to vacate office.

    APP is challenging APC at the Federal High Court, Osogbo, Osun State in suit number FHC/OS/CS/103/22 and joined Independent National Electoral Commission (INEC), Allied Peoples Movement (APM) and others as defendants.

    APP said the matter was filed in pursuant to judgment of November 30, 2022.

    The suit noted that the Federal High Court judgment tagged the conduct of the poll as unconstitutional, invalid, null and void, subsequently sacking them from holding offices.

    The plaintiff prayed the court to commit the defendants to prison for contempt if they fail to comply with the court judgment.

    The motion said: “This court has been informed that even as at today, March 11, you are yet to comply with the lawful order of the Federal High Court by forcefully occupying offices in the 30 councils in the state.

    “You are hereby directed to comply with the court order forthwith by vacating the offices or you will be guilty of contempt of court.”

    Little known Action Peoples Party (APP) has swept the 22 local government areas out of the 23 councils so far declared by the Rivers State Independent Electoral Commission (RSIEC).

    The Chief Electoral Officer and Chairman of RSIEC, Justice Adulphus Enebeli (retd) made the declaration at the Collation Centre in Port Harcourt shortly after the election.

    Enebeli said all chairmanship candidates of the APP won the in the 22 local government areas apart from Etche Local Government Area, where he said results were still being awaited by the commission.

    All the candidates of the APP are loyalists of Governor Siminialayi Fubara, who left the Peoples Democratic Party (PDP) to contest the elections on the new platform following the crisis rocking the PDP in the state.

    Rivers crisis: APP vows to appeal judgement on 27 lawmakers

    The Action Peoples Party (APP) has vowed to appeal the judgment of the Federal High Court in Abuja, that nullified its case against the 27 members of the Rivers State House of Assembly.

    The court, presided over by Justice Peter Lifu on Friday delivered a judgment on APP suit that prayed it to mandate the Independent National Electoral Commission (INEC) to conduct a by-election to fill the vacant elective positions in the Rivers State House of Assembly.

    But Rivers Legal Adviser of APP,  Henry Ekine, said the judge did not consider the merit of the case explaining that the APP never requested the removal or sacking of the Speaker, Martin Amaewhule and 26 others from the State House of Assembly.

    He argued that the party relied on the provisions of the 1999 Constitution of the Federal Republic of Nigeria, to request the court to ensure that no vacuum was allowed to exist in line with existing law.

     Ekine said the APP has started reviewing the judgment and would take further necessary action soon.

    He said:  “What we want you to know here is to tell the public: our esteemed members and the general public, that nothing substantial has changed. All of the decisions that have come out from the various high courts; courts of coordinate jurisdiction, I think will be settled when we get to the Supreme Court.

    “What is fundamental is that the judgment of Justice Peter Lifu of the Federal High Court, Abuja is not final, and then, it has not changed substantially the position of the Rivers State House of Assembly with respect to its leadership as far as APP is concerned. 

    “That is why we went to court. We feel strongly, up until now, that there are vacant positions in the Rivers House of Assembly, and those positions need to be filled. To our knowledge, they are three members that are left. The Speaker, in that regard, is the person of Rt Hon Victor Oko-Jumbo. This is what the public needs have.” 

    Ekine claimed that the judgment by Justice Lifu alluded that the matter was a pre-election concern, filed beyond the statutory timeframe of 14 days as mandated by Nigerian law, citing judgments.

    Ekine noted that even the judgment of Justice Omotosho, including the Interlocutory Order by Justice Okoroewo, were directly connected to the reasons why APP went to court.

    He insisted that it was the duty of everybody, including all judicial officers, and the President of Nigeria to protect the nation’s Constitution and its provisions.

    He claimed that Justice Lifu’s judgment had not changed anything as far the leadership of Rivers State House of Assembly under Victor Oko-Jumbo was concerned

    He  insisted that INEC must conduct election to fill the vacant seats following the alleged defection of Amaewhule and others on December 11, 2023.

    But the National Youth Council of Nigeria (NYCN), Rivers Chapter, led by Chimenem Worlu, congratulated  Amaewhule and 26 others on their victory at the Federal High Court.

    Worlu said: “This judgment brings an end to the long-standing legal battle, upholding the rule of law and judicial independence. As Rivers State youths, we solidly support the authentic Speaker,Chike Amaewhule through thick and thin.

    “We also commend our Grand Patron, Minister of the Federal Capital Territory (FCT), Abuja, Nyesom Ezenwo Wike, for standing firm for justice and supporting the House of Assembly against the Governor’s attempts to remove them.

    “Together, we’ll continue to advocate for democracy, ensuring the legislature functions effectively for the people of Rivers State. The youth demand governance, not political turmoil.

    Thank you, Federal High Court, for ending this prolonged battle and restoring focus on governance”.

  • Pupils develop app on traffic gridlock

    Four female pupils have developed a solution to address obstructive parking in the country.

    The innovative application (app), called Frostbits, will be useful in cities, such as Lagos, with its use of location sensors, database, and the app inventor’s interface and more.

    The four pupils from Princeton College, Surulere, Lagos under the tutelage of New Horizons Computer Learning Centres Limited, the school’s information communications technology (ICT) partner,  emerged African regional winner for this year’s Technovation contest held at Pan Atlantic University, Lekki, Lagos.

    The app came first in the ‘Senior Division Regional 2019 Technovation competition.  The app developers are Daniella Ekekwe (Grade 11);  Gbopemioluwa Olukoga (Grade 11);  Victory Yinka-Banjo (Grade 11); and  Tanyalouise Ekekwe (Grade 12).

    According to them, users can easily park their cars without worrying about interference from other drivers.

    Education Director, Princeton Schools, Dr Dolapo Bankole  said: ”Our emphasis in Princeton School is to produce pupils with 21st Century skills in sciences and technology, so that students from our school can compete effectively with their counterparts in Europe, America and Asia.”

  • Court asked to reverse INEC’s ban on campaigns

    The Federal High Court in Abuja has been asked to declare unlawful the decision by the Independent National Electoral Commission (INEC) that political parties could no longer campaign despite its postponement of elections.

    The request is contained in a suit marked: FHC/ABJ/CS/206/2019, filed by the Action People’s Party (APP).

    The plaintiff argued that by virtue of “the combined effect of the mandatory statutory provisions of Sections 99(1), 100(1) and 101(1) of the Electoral Act, 2010 (as Amended)” INEC could not validly bar campaigns by registered political parties for the 2019 general election before a period earlier than 24 hours prior to the date of the election”.

    It wants the court to determine, “Whether by Sections 99(1), 100(1) and 101(1) of the Electoral Act, 2010 (as Amended) the announcement, directive or order by INEC directing registered political parties, including the APP, to stop or end their campaign for the 2019 General Elections on February 14, 2019 for polls that will hold on February 23, 2019 is not ultra vires its powers, illegal, null, void and of no effect whatsoever”.

    In the substantive suit, the plaintiff sought among others, “A declaration that INEC cannot issue any directive or make any order stopping, barring or ending campaign by registered political parties, including the APP, for the 2019 General Elections to a period other than 24 hours prior to the date of the elections;

    “A declaration that the announcement, directive or order by INEC directing political parties, including the APP, to stop or end their campaign for the 2019 General Elections on February 14, 2019 for polls that will hold on February 23, 2019 is ultra vires its powers, illegal, null, void and of no effect whatsoever; and

    “A declaration that in view of the postponement of the 2019 Presidential and National Assembly Elections till February 23, 2019, APP Party and indeed all registered political parties in Nigeria are legally entitled, pursuant to Sections 99(1), 100(1) and 101(1) of the Electoral Act, 2010 (as Amended), to resume forthwith and/or recommence campaign until February 21, 2019 been 24 hours prior the date of the election.”

    In an ex-parte application of urgency filed with the suit, the plaintiff wants an order of injunction restraining the defendant from stopping, ending or in any other manner whatsoever giving effect to the directive or order purported ending or stopping campaign by political parties for the 2019 general elections on February 14, 2019 pending the hearing and determination of the substantive suit.”

    The suit, filed on Monday, is yet to be assigned for hearing.
