Army urged to obey judgment, release traders

Two lawyers – Mr Siraj Hamza and Junaid Sanusi – have called on the Nigerian Army to comply with the judgment of a Borno State High Court directing it to release 14 of their clients from illegal detention.

Hamza also called on the Attorney-General of the Federation and Minister of Justice Prince Lateef Fagbemi (SAN) to establish a mechanism to audit detention facilities across the nation.

Hamza has A. Aliyu as the second lawyer representing the detained men.

Explaining that despite the judgment which declared that detention of his clients without trial violated their rights, the Army has refused to obey court order, suggesting that it is above the law.

He said his clients were arrested and detained on their way to rural communities where they went to buy cows meant to be slaughtered and given to indigent Muslims during Sallah.

Hamza told reporters in Ibadan, the Oyo State capital: “Sometimes on May 17, 2024 along Buratai-Miringa Road, our clients, 12 of them, were riding in two buses on their way to Tashan Alade Cattle Market to buy cattle which were to be used during the Eid Al-Kabir festival, an annual event being organised by a non-governmental organisation where cows in their hundreds are slaughtered and shared or distributed among the indigent members of the society. The exercise had been on for over a decade and has been impacting on the indigent members of Abuja and its environs, including the military.

“The exercise was extended to Bauchi, Yola and Maiduguri, hence the need to buy about 600 heads of cow for the exercise in Maiduguri. Before the incident of May 17, 2024; our clients had already purchased 241 heads of cow and transported them to Maiduguri and were entrusted with one Musa Mustapha Umar at the Maiduguri Cattle Market; while one Abubakar Ibrahim Murabus Potiskum was in the company of our clients assisting them to source money from Point of Sale (PcS) operators and filling stations due to impracticability of electronically transacting business in the various cattle markets.’’

“As earlier stated, our clients were stopped by the Civilian JTF who searched them without finding anything incriminating on them, save for the $88,737,200. When they discovered that our clients had over $88,737,200 with them, they demanded for gratification before they could be cleared to leave, but they declined as a result of which they were transferred to the military outpost in Buratai where they were again interrogated and detained. The following day which was May 18, 2024; they were transferred to Sector 2 at Damatur from where they were transferred to the Headquarters of Theatre Command, Operation Hadin Kai in Maiduguri which marked the beginning of their incarceration.

“It is also worthy to state that the first 12 of them came from Dei-Dei Livestock Market, Abuja, led by Danlami Muhammad Bashir, the alter ego of Fatima Meat, the company that was contracted to procure the heads of cow.

Few weeks after, when the detention of the judgment-creditor that is, our clients was becoming prolonged, the Chairman of their association, Alhaji Shagari Usman Yusuf, flew into Maiduguri to see them in company of their lawyer which was unsuccessful.

“Prior to that, Alhaji Musa Mustapha Umar too had been arrested and detained for having the audacity to visit them at the Theatre Command of Operation Hadin Kai.

Shagari was displeased with the actions of the military which prompted him to approach the popular Berekete Family in Abuja to ventilate their grievances. The president contacted the Army spokesman and Shagari was invited to the Army Headquarters twice.

“Ironically, a day to the Eid Adha festival, some armed military personnel armed to the teeth, stormed the Dei-Dei International Cattle Market where they arrested him, hooded him, tortured him and later found himself in an underground cell in Abuja before he was eventually brought to Maiduguri by one Colonel Wasiu Ademola Adegoke 18 days after, and detained with the others at the Giwa Barracks.”

The lawyers insisted that the disobedience to court order is against the rule of law, adding that the Army was free to appeal the judgment and apply for of execution if it so desires.

The August 6 judgment by Justice Babagana Karumi of Borno State High Court directed the Army to release the men or sue them within seven days if a prima facie case is established against them.  Hamza said the Army was still keeping his clients in detention after over 45 days of the judgment, saying it signals danger for the society.

He said: “The theme of the operations planning cadre is apt, considering the dynamic nature of modern warfare and the increasing role of technology in shaping military operations.

“As we gather here today, it is imperative to remember that the security environment is evolving rapidly. The challenges we face today are multidimensional, complex, and often transnational.

“Whether it is countering insurgency, tackling terrorism or banditry, combating crude oil thieves and illegal bunkerers or maintaining internal security, the need for innovation and adaptability in our operations planning process cannot be overemphasized”.

The GOC noted that the drive was in line with the Chief of Army Staff’s command philosophy, designed to transform the Nigerian Army into a well-trained, equipped, and highly motivated force.

He said that the cadre provided a platform for resource persons and participants to develop effective plans, enhance operational planning skills, and make informed decisions in high-pressure situations.

He added that the Nigerian Army recognized the need to evolve strategies and methodologies to stay ahead of potential adversaries, noting that the integration of new technologies, such as artificial intelligence, drones, cyber capabilities, and advanced surveillance systems, was critical to achieving successful missions.

He said: “To maintain our edge and stay ahead of potential adversaries, we must continuously evolve strategies and methodologies. He said: “As commanders, we must be able to synchronize our efforts, share intlligence and make informed decisions in real-time. This demands a new way of thinking and planning which embraces innovation and technological advancement. As we embark on this cadre, I urge you all to approach the discussions with an open mind and willingness to learn.”

Nigerian Army donates educational materials to 7,200 students in Niger

The Commander, Training and Doctrine Command of the Nigerian Army (TRADOC NA), Major General Kevin Aligbe, said that the donation was part of the second series of the TRADOC Educational Support Programme.

Making the presentation at the closing ceremony of the TRADOC Library Study Day Period 2024 organised by the Directorate of Army Training Support Centre (ATSC) in TRADOC NA, the TRADOC Commander stated that the gesture was introduced to subsidise the educational expenses of personnel in the Minna Military Cantonment and its neighbouring communities who have children in the schools.

Aligbe said that over 80 percent of the 7,200 beneficiaries were students and pupils who are children of civilians from outside the cantonment, adding that the initiative was also one of the Civil-Military Cooperation efforts of his command in support of the overall Nigeria Army’s effort towards shaping and winning the hearts and minds of communities where the army operates.

  • Senator Karimi’s military base project set for handover to Army

Senator Karimi’s military base project set for handover to Army

Kogi West Senator Sunday Karimi has informed Army authorities of his intention to handover the newly completed Military Forward Operating Base (FOB) in his Constituency.

The project, which ground breaking held in January 2024, is located at the intersection of Kwara/Kogi/Ekiti states boundary town in Egbe, Yagba West Local Council, Kogi State.

Eruku, an Okun speaking community in Kwara State, is a walking distance from Egbe.

Karimi, in the letter dated 14th September, 2024, scheduled the official commissioning of the project for Monday, October 14th, 2024.

The letter titled: “Handing over of newly constructed and furnished military base for the Nigerian Army in Egbe, Yagba West Local Government Area, Kogi State” to the General Officer Commanding (GOC), 2 Division, Nigerian Army, Ibadan, Oyo State, through the Brigade Commander,

12 Brigade (BDE), Nigerian Army, Lokoja, Kogi State, reads: “Sir, I hereby wish to inform you that I have completed the construction of a Military Base in the outskirts of Egbe, Yagba West Local Government Area of Kogi State at the border between Kwara and Kogi State for the Nigerian Army to improve Security in Kogi and Kwara States.

“The idea of the military base was conceived by me in January this year to assist the Nigerian Military and Security Agencies to ensure quick response in combating terrorists, kidnappers and criminals whose activities in recent times around the Border of Kogi and Kwara (where there is a great expanse of forests and fast becoming a fortress for criminals) has become an issue of national concern. It is also hoped that the presence of a standard military base will serve as a deterrence to these criminals and restore peace and security in the communities in Kogi and Kwara States”.

The lawmaker further stated that the urge to construct, furnish and handover the edifice to the Nigerian Army was borne out of his commitment to assisting the federal government in its fight against insecurity, protecting the lives of the citizenry and warding off criminals from the rural communities.

According to him, the newly completed military base has two hostels which have 85 bed spaces for soldiers. It is fully furnished with beds, beddings and all fittings for comfortable human habitation. There is a concrete armory and a moderately furnished office wing for the Commander of the Military Base.

The official residence of the Commander of the Military Base is a 3-bedroom apartment, fully furnished with allied fittings.

The FOB also features Officers Mess (a) and (b) for officers and soldiers in the Military Base. The armory building is a well-constructed Watch Tower with Surveillance camera for intelligence and security gathering.

The facility occupies an adequately fenced land on approximately 10,000 Square Metres, fitted with American Security Fence Wires with two iron gates provided.

There are 25KVA solar generating inverters provided for regular off-grid power supply and 22KVA standby generating set provided as alternative power source to ensure constant power supply.

Karimi reiterated his commitment to connecting the base to grid power supply (PHCN/IBEDC) immediately. Other features of the FOB are separate toilets and kitchen facilities, refrigerators, cookers and a cell for detention, among others.

“Having completed the project, it is my desire to hand over same to the Nigerian Army for the deployment of troops and for good use immediately.

“I hereby request that the hand over of the project to the Nigerian Army be scheduled/fixed for 12th October 2024 which shall coincide with the celebration of Egbe Township Day and we request your presence at the commissioning and handing over of the Military Base as part of events marking the celebration. Whilst appreciating you for your commitment to defending the Nigerian State from external aggression and suppressing armed insurrection of all kinds,” he said.

When he was interviewed former presidential aide, renowned media practitioner, Fellow of the Association of Nigerian Authors (FANA) and Adjunct Professor of Creative Writing at the University of Abuja, Dr Tunde Olusunle, conveyed the collective delight of the Okun country to this development.

Olusunle, who chairs the Yagba Action Group (YAG), said it is heartening that “All is set for the inauguration of the Forward Operating Base (FOB), initiated and wholly built by the Senator representing Kogi West District, Sunday Karimi. Karimi spent the 2023 yuletide with his constituents visiting communities and local government areas across the seven local government areas in his catchment.

“He was inundated with complaints and cries about how bandits, kidnappers and similar criminal elements, had made life unbearable for his people. The situation has badly impacted the agrarian economy of Kogi West, almost creating an existential and food security crisis.

“State and local government employees who work as teachers, agriculturists, among others vocations, have had to bank outside their domains, with attendant risks and inconveniences.

“Deadly robbers have repeatedly attacked banks and chased the First Bank, which had a brand in each of the seven Kogi West LGAs, and Access Bank, with Yagba federal constituency most affected.

“A dismayed Karimi prioritised a model FOB beginning from early this year, to mitigate the constant violation of the peace and security of his people by miscreants.

“Without awaiting the bureaucratese of raising the question of the helplessness of his people on the floor of the parliament, he chose to design and finance the initiative from his personal resources. This is a most exemplary and laudable precedent.”

  • Why we published names of disengaged soldiers regularly, by Army

Why we published names of disengaged soldiers regularly, by Army

    • …debunks alleged mass soldiers’ resignation

The authority of the Nigerian Army has explained why it publishes the names of soldiers who disengaged from the service.

It said soldiers’ disengagement from service is “routine and in line with laid down procedures.”

The army made the clarification in a statement by its spokesman, Maj.-Gen Onyema Nwachukwu, on Sunday.

The explanation came after a report in some online media alleging mass resignation of soldiers from the army due to poor welfare and corruption.

But Gen. Nwachukwu described the allegations as false, unfounded and a “deliberate attempt to sow the seeds of disaffection and acrimony, as well as denigrate the patriotic service of personnel and reputation of the Nigerian Army.”

He said: “Consequently, it is crucial to clarify that service in the Nigerian Army, like most militaries the world over, is voluntary and not conscriptive. This, therefore, provides that individuals are free and at liberty to disengage at will. The situation is the same as the Nigerian Army. personnel are at liberty to disengage from time to time in accordance with laid down procedures as contained in the Harmonized Terms and Conditions of Service (Officers/Soldiers) alike.

“Discharge from the Nigerian Army is routine and in line with laid down procedures. Only in an unorganized army would the discharge of personnel be handled haphazardly; hence, the compilation and release of names routinely, as must have been observed in the case of the Nigerian Army over the years. This process allows for personnel who are about to either mandatory or voluntarily disengage to adequately prepare and process entitlements, emoluments, pensions, and gratuity for the period of service to the nation.

“In the instance cited in the hasty and haphazardly compiled report, due diligence was not taken to ascertain reasons for the discharge of the personnel, other than the spurious allegation of low morale and corruption. Whereas reasons for the discharge of personnel are confidential, they range from voluntary disengagement, medical grounds, pursuit of other professions of interest and endeavours, and community service, amongst others. The notion that soldiers are resigning enmasse due to welfare issues is a gross misrepresentation of reality and certainly not the true picture.”

Read Also: IPOB condemns army’s alleged murder of innocent civilians

The army spokesman said that contrary to the insinuations in the report, Nigerian Army personnel are highly motivated, and their welfare is top priority under the visionary leadership of the Chief of Army Staff, Lt.- Gen. Taoreed Lagbaja.

He said: “Suffice to state that within one year of the current leadership, significant strides have been made to improve the standards of living and the overall well-being of personnel and their families. A prime example is the Affordable Housing Option for All Soldiers Scheme, aka AHOOAS, which has been launched across the nation, allowing personnel to choose where to live and own decent post service accommodation. This initiative underscores the Nigerian Army’s commitment to ensuring that personnel enjoy dignified post-service life.

“Furthermore, the Nigerian Army is currently undertaking massive rehabilitation of existing and construction of new infrastructure across Nigerian Army formations, units, and barracks in the country to ensure conducive working and living atmosphere for troops and their families.

“Additionally, allowances have been regularly paid as at when due for soldiers deployed in operational theaters. This is aside the regular free airlifting of troops proceeding on leaves and passes, as well as free medical evacuation of injured troops for both local and foreign treatments. Military hospitals and medical centres are equally receiving remodeling and upgrading of equipment for efficient service delivery to personnel and their families.”

“Therefore, the allegation of widespread resignation due to poor welfare is not only unfounded but also irrational. The Nigerian Army remains steadfast in its commitment to the welfare of its personnel. It is, however, appalling to witness concerted attempts to distort the truth for sensationalism in the media.”
