    Saraki’s associate urges court to stop arrest

    The Federal High Court in Lagos has ordered the Economic and Financial Crimes Commission (EFCC) to show cause why it should not be restrained from arresting Managing Director of Carlisle Properties, Mr. Kennedy Izuagbe.

    Justice Mohammed Yunusa directed that the status quo be maintained until the commission appeared in court on October 12.

    EFCC, last Thursday, declared Izuagbe, who manages Senate President Bukola Saraki’s property company, wanted.

    Izuagbe is wanted for alleged N3.6 billion money laundering.

    He was alleged to have conspired with others to launder the money as the managing director of the defunct Societe Generale Bank.

    EFCC’s Head of Media and Publicity Wilson Uwujaren said the 45-year-old banker was declared wanted because he could not be reached by the anti-graft agency.

    But in an ex parte application, the applicant’s lawyer Efot Okoi prayed the court to stop the EFCC as well as its  Director of Operation, Olaolu Adegbite, from further unlawful harassment and intimidation of Izuagbe and the firm’s directors.

    The lawyer said Izuagbe’s intimidation was unconstitutional, null and void and a gross violation of his fundamental rights as guaranteed by sections 34, 35 and 37 of the 1999 Constitution.

    Okoi argued that until the hearing/determination of the motion on notice, the EFCC and its agents should be restrained from intimidating Izuagbe and Carlisle Properties.

    He also asked the court to stop the commission from carrying out any unlawful arrest and detention of the applicants, their agents and associates.

    The lawyer prayed for an order setting aside an invitation from EFCC to Izuagbe and Carlisle Properties pending the hearing and determination of the substantive suit.

    According to him, Izuagbe was only head of Internal Control at the SGBN and was never directly involved in loan approval.

    Justice Yunusa, in his ruling on the ex-parte application, ordered that the status quo be maintained.

    He said EFCC should be put on notice.

    •We’ll sweep Dickson out of office

    The Bayelsa State chapter of the Peoples Democratic Party (PDP), yesterday suffered a major setback ahead of the December 5th governorship election in the state.

    The PDP lost hundreds of its members to the APC in a carnival-like reception ceremony held at the state secretariat of the APC in Yenagoa.

    Among those who abandoned the PDP were former political office holders, appointees who served in different capacities in various PDP administrations and past party executive members.

    Also former aides, whose appointments were terminated in controversial circumstances by the incumbent Governor, Mr. Seriake Dickson, were among persons who joined the APC.

    They were led to the APC by a two-time member of the House of Representatives, Mr. Warman Ogoriba, who was denied the PDP ticket in the last general elections.

    Pioneer Majority Leader of the Bayelsa State House of Assembly, Mr. Ayiba Glover; former Secretary of the PDP and close associate of President Goodluck Jonathan, Prof. Tarila; former PDP Secretary, Sokari Jackson; former Commissioner for Environment in Dickson’s administration, Mr. Sylvanus Abila and former Commissioner for Finance, Mr. Charles Opuala were among the defectors.

    Others in the train of former political office holders who dumped the PDP are Gesiye Frank-Oputu, Abel Osuo, Nelson Belief, Samuel Boy, William Ofoni, Benjamin Yebouowei, Ayibakoro Nelson and Livingstone Egba among others.

    They were received by a former governor and leader of the APC in the state, Chief Timipre Sylva, in the presence of former Ambassador Felix Oboro, former acting governor, Chief Nestor Binabo, APC state chairman, Tiwe Orunimighe and former deputy and acting governor, Chief Werinipre Seibarugu.

    Sylva, while handing brooms, the symbol of the party, to the defectors, said the APC had come to end divisions in the state.

    Describing the APC as one family, he said he was highly privileged to welcome two persons who became acting governors during his administration to the APC.

    He said the APC would use brooms too sweep Dickson and his PDP government out of the state, adding that the PDP was already dead and was waiting for its funeral.

    He said all the people who matter in the state and the masses had joined the boat of the party, which he said is sailing to the Creek Haven Government House.

    He said with the number of people joining the APC, there is no way the party will not form the next government on February 14, 2016.

    “The APC ship has started sailing and everybody is welcome. It is the ship of unity and if you don’t get inside, you will be marooned. The PDP is dead. This Dickson’s government is dead. It is only waiting for its funeral”, he said.

    Oruminighe, in his welcome address, said he had predicted at the early stages of the APC that the party would form the next government.

    He said the Dickson government was unfriendly and deceitful, questioning the rationale behind the government’s move to reconstitute the Bayelsa volunteers.

    “Dickson has been there since, but he did not talk about Bayelsa volunteer. Now that he wants re-election, he started constituting the volunteers. Don’t be deceived,” he said.

    Referring to the APC as the only platform available in the state, he said the party would eliminate the existing classification of the people into core and fake Ijaw, and assured the new members of a level-playing field, adding that all the privileges available to old members would also extended to them.

    He, however, warned that the supremacy of the party must be upheld at all times.

    Advancing reasons for their defection, Ogoriba said the APC is the light while the PDP represents darkness.

    He said the government of the PDP in the state was based on falsehoods and too many talks without action.

    According to him, the Dickson-led government has ridiculed the people of the stage by building a “monkey bridge and walkway” in the name of a flyover.

    He said while the PDP was claiming to be unruffled by the defections of its members, it was busy calling defectors at night for reconciliation.

    “The APC is a sweet party and we are happy we have been accepted into it. We will subject ourselves to all the authority of the party. We have not come with any ambition. We have come to strengthen the party. With our presence here, the PDP has murdered sleep.”

    October 1 bombings: Okah’s associate bags life jail

    A Federal High Court, Abuja yesterday sentenced Edmund Ebiware, an associate of the MEND leader, Henry Okah, to life imprisonment after finding him guilty of complicity in the October 1, 2010 twin-bombings in Abuja.

    His conviction was based not on his active participation in the bombing, but because he failed to report the plot to the President or the police.

    Ebiware, who broke down in tears after Justice Gabriel Kolawole pronounced judgement, was specifically accused of withholding information on the planned attack by not using reasonable means to leak the information to the President and Peace Officer to foil the planned attack.

    “With all my struggle for the Niger Delta, this is what they are using to pay me back. God is the greatest judge,” the convict said.

    The prosecution called six witnesses, while the convict was his own witness.

    Justice Kolawole said that from the evidence before the court,there was a link between Ebiware and the leader of the Movement for the Emancipation of Niger-Delta (MEND), Henry Okah, ahead of the bombings.

    Justice Kolawole cited the analysis of Ebiware’s phone call logs as tendered by the PW5, Wasiu Agbaje, and said the convict was in contact with Okah who was convicted in South Africa on Monday for masterminding the Abuja bombings.

    The court also relied on the testimony of PW4 who told the court that the accused informed him that Okah was not happy about the Amnesty Programme because some militants were excluded.

    The court also recalled the testimony of the PW2 who said the Special Investigation Panel (SIP) set up by the government established that Henry Okah was in constant touch with the convict from the planning stage.

    A text message retrieved from his mobile phone reads: “The independence hurricane, I was deeply involved. Shake the nation. Good morning”.

    The court said the convict, in his statement, explained that by independence hurricane, he meant the independence bomb blasts.

    Justice Kolawole said the conviction will serve as a lesson to the larger society because every Nigerian has a duty to ensure peace in the society.

    Reviewing the testimony of the witnesses, the trial judge said the Prosecution Witness 4 (name withheld) was the only one with a weighty evidence against the convict. He, however, raised concern on why the PW4 was not charged along with the accused because he had fore-knowledge of the October 1 bomb blasts.

    The judge said he would take the witness of the PW4 with caution, but expressed doubt if the defence witness was a witness of truth.

    The court said the convict was not consistent in his oral testimony and written statements.

    Besides, he said, the convict did not substantiate his claim that Henry Okah threatened him even though he claimed he told his wife.

    Okah himself was convicted on Monday by a South African court for masterminding the Abuja blasts. He was found guilty on 13 counts related to terrorism.

    He also faces life imprisonment.

    Once Justice Kolawole pronounced that “the accused is hereby found guilty as charged” yesterday, Ebiware cast a glance at the ceiling and began murmuring.

    His counsel, Gordy Uche, pleaded with the court to consider the circumstance in which the accused begged for separate trial to prove his innocence.

    “The accused is a young person not up to 35 years. He is married and has two children who are still of tender ages. My lord will see that the accused person on his own volition and believing in his own innocence applied for and granted a separate trial,” he said.

    He added that Ebiware also had no previous record of conviction. In the sentence, Justice Kolawole said he was touched by the plea for leniency by the defence counsel and the fact that he had no criminal record and has two children of tender ages.

    He, however, said the essence of judgment is to serve as deterrent and to seek to reform the convict.

    He said:”When court gives sentence, it must make sure it maintains a balance because if the sentence is too harsh the goal of reform may not be achieved”.

    Justice Kolawole said he was mindful of the sad effects the October 1 bombings had on the country.

    He said: “Perhaps if the convict had reported the case, it would have saved the calamity.

    “Many of the victims are yet to recover and may not fully recover from the injuries sustained.

    “The convict is hereby sentenced to life imprisonment”.

    The judge ordered that his two phones should be confiscated as items with which the accused was convicted.

    “It is my hope that the convict will shun the company of individuals he cannot guarantee their character. It is a lesson for the larger society,” the judge said

    The judge added that it is the duty of all Nigerians to report suspicious activities that may endanger the peace in the nation.

    Others still standing trial on the bombings are Charles Okah and Obi Nwabueze.

    The fourth accused person, Tiemkemfa Osuvwo, died in Kuje Prison.

    The accused are standing trial over their alleged involvement in the Independent Day Abuja twin-bombings.

    The accused are charged for allegedly waging war against the state in order to intimidate President Goodluck Jonathan, an offence contrary to and punishable under Section 37(1) of the Criminal Code, Cap 77 Laws of the Federation of Nigeria (LFN) 1990.

    They are also accused of terrorism and conspiracy to commit treason, contrary to Section 40 (2) of the Criminal Code CAP 77, Laws of the Federation of Nigeria (LFN) 1990.

    Gunmen kill ex-Borno governor’s associate

    Some gunmen yesterday shot dead Alhaji Mustapha Flawama, an associate of former Borno State Governor Ali Modu Sheriff.

    Although not a member of the state executive council, Flawama, 62, was a member of Sheriff’s inner caucus during his tenure between 2003-2011.

    Residents said the gunmen trailed the deceased to his house at Polo area of Maiduguri.

    “They came around 10.30am in a tricycle and met him within the premises of his house. Without delay, they manoeuvred their way and fired several gun shots into his head and chest. He died on the spot. The assailants sped off, a resident said.

    They also targeted police formations and schools.

    The Chibok Divisional Police Station, a Bible and primary schools and telecom masts of GSM firms in Chibok town were burnt down.

    Chibok is 130 kilometres south of Maiduguri.

    According to an eyewitness and resident of Chibok, the gunmen came in two unmarked Golf Volkswagen vehicles armed with petrol-bombs and Improvised Explosive Devices (IEDs) to attack the police station and the schools at dusk.
