    Illegal detention: Court awards N40m damages against El-Rufai, Police

    A Federal High Court in Abuja has awarded N40million damages against Kaduna State Governor, Nasir el-Rufai, the Inspector General of Police (IGP) and two others over the unlawful detention of the promoter of Lagos-based record company, Chocolate City Group, Audu Maikori.

    Justice John Tsoho ordered the award yesterday in a judgment in a fundamental rights suit brought by Maikori.

    Justice Tsoho held that the arrest and detention of Maikori between February 17 and 18, 2017, and again March 10 and 13, 2017 by the police, on instigation of the Kaduna Government was unlawful.

    The judge equally ordered the respondents (el-Rufai, Kaduna State’s Attorney General, Police Commissioner in Kaduna and IGP) to pay  N1, 430 to the applicant as the cost of instituting the suit.

    Justice Tsoho said the judgment should  not serve as a bar on Miakori’s ongoing trial before a court in Kaduna.

    He said the police possess the constitutional power to legitimately arrest suspects for allegedly violating law and order on the cyberspace.

    Maikori was arrested on allegations of posting “inciting” tweets alleging the killing of some Southern Kaduna students by Fulani herdsmen.

    The details of the tweets later turned out to be false, but Maikori claimed he obtained information from his driver.

    He later expressed regret over the posts and retracted them.

    The police subsequently obtained an order of arrest from a Magistrate’s in Kaduna with which the arrested him in Lagos on February 17, flew him to Abuja where they detained him and released him on bail on February 18.

    Justice Tsoho granted 14 out of the 25 prayers sought by the applicant.

    The judge said Maikori’s arrest in Lagos was unlawful, the police having failed to register the arrest obtained from a magistrate’s court in Kaduna in any court in Lagos where it effected on the businessman.

    He said: “The arrest was improper, irregular and wrongful. By necessary implication, the arrest was unlawful despite being released after 24 hours.”

    The court upheld that argument by applicant’s lawyer, Miss Gloria Ballason, that Maikori was arrested and detained between March 10 and 13 even when the police was aware of his respiratory health challenge, thereby violating his right to life and dignity.

    He said, “By virtue of exhibit 3 (medical report) an affidavit evidence, the police was made aware of the health challenge of the applicant. This fact was not controverted by all the respondents.

    “The attitude of the respondents threatened the applicant’s right to life. Right to life and human liberty includes right to human dignity and other things that make life worth living.

    “Under Section 46(1) of 1999 Constitution, as amended, the court stated that anticipated infringement of fundamental right is protected, adding that “it is appropriate for applicant to seek redress in court.

    “This court found and held that the conduct of police infringes on the applicant’s right to life, liberty, dignity, freedom, movement as enshrined in Sections 34, 35, 40 and 43 of the Constitution.

    “The judgement is without prejudice to the offences that the applicant is standing trial.

    “Social media cannot be  without social responsibility. It would amount to an invitation to anarchy to say that the cyber space is beyond control.”

    The judge noted that the Cyber Crime Act  was enacted for the control and regulation of the cyberspace.

    He disagreed with the position canvassed by some friends of the court (amicus curiae) to the effect that the social medial use should be left unhindered.

    The judge said there must be law and order in the cyber space.”

    Chocolate City Boss, Audu Maikori was on Monday arraigned before a Kaduna Chief Magistrate Court 1 Ibrahim Taiwo Road on a two count charge of attempt to incite the general public through false information contrary to Section 24 of Cyber Crime Act Law of the Federation of Nigeria 2015.

    Audu Maikori who was arraigned alongside his driver Simon Joseph were later granted bail to the sums of N100, 000 each on self-recognition.

    Moving for application for the bail, the lead Counsel to Audu Maikori, Barr. Reuben James said the first Accused person is of good reputation and on personal recognition who will not temper with police investigation and will always make himself available throughout the trial.

    He also said that Audu Maikori should be granted bail because during his first arrest in Lagos and his subsequent bail by the police, he always reported to the police and fulfilled conditions of the bail.

    According to him, “My Lordship, the accused person after re-arrested on Friday suffered ill-health and was taken to the police clinic. We tendered the police report in respect to that and subsequently asked the court to grant him bail based on his ill-health.

    “We want also to bring to the notice of Your Lordship that the accused person is a legal practitioner of the Supreme Court of Nigeria and should be granted bail on liberal ground.

    Responding, the lead Prosecutor Barr. Bayero Dari said he was not going to oppose the bail application of the lead Counsel. He however called on the Court to attached stringent conditions to the bail terms.

    In his ruling, the presiding Chief Magistrate Emmanuel Yusuf said haven listened to the two sides and looking at the bail condition before him, the two accused persons are thereby granted bail to the sums of N100,000 each and on personal recognition. The case was however adjourned to the 20th of April, 2017, for mentioning.

    Speaking to journalists outside the court one of the Counsels to Audu Maikori, Barr Mark Jacob said there was no case against the accused person and the team of lawyers is ready to proof that.

    In his own remarks the Prosecutor; Barr Bayero Dari said before the next adjourned date, the prosecution would have properly arraigned the accused before a Federal High Court who has jurisdiction over the case.

    Audu Maikori, the Chief Executive Officer, Chocolate City, Lagos was on Monday granted bail after his  arraignment before a Kaduna Chief Magistrate’s Court over alleged criminal conspiracy and spreading falsehood.The charge sheet indicated that he was also alleged to have incited disturbance of public peace.

    Maikori was arraigned along with one Simon Joseph, as first and second accused.

    Prosecution counsel, Dari Bayero, told the court that the duo, on January 23, 2017 conspired and spread a false story, in the social media, that five students of Kaduna State College of Education were ambushed and killed by Fulani herdsmen.

    “This false information was inciting and capable of disturbing the public peace,” he alleged.

    Bayero said that the the offences were punishable under section 24 of Cyber Crime Act, Laws of the Federation 2015.

    He, however, said that investigation was ongoing, and urged the court to give him more time to conclude the investigation and filed the case to an appropriate court.

    Counsel to the first accused, Mr Reuben James, urged the court to grant his client bail on the ground that the offences for which he was dragged before the court were bailable.

    Similarly, counsel to the second accused, Mr Desmond Tabakwot, also urged the court to grant the second accused bail.

    Chief Magistrate Emmanuel Yusuf said he lacked jurisdiction to try the case, and thereafter granted the accused persons bail in the sum of N100,000 and one surety each.

    Chocolate City boss Maikori slumps at public event

    Chocolate City boss, Audu Maikori, on Tuesday collapsed at the 2017 Women in Management, Business and Public Service (WIMBIZ) holding at Muson Center.

    Although it was not clear what the immediate cause of his collapse is, reports state that doctors at the venue were able to revive him and he was taken to St Nicholas hospital for further medications.

    The music entrepreneur had just finished moderating the Q and A sessions with Mo Abudu and was taking a selfie with fans when the incident occurred.

    Maikori was recently in the spotlight for sharing some gruesome photos of what he alleged to be corpses of people killed in the violence that has engulfed Southern Kaduna.

    Although he admitted to being misinformed and issued an apology, the Department of State Security (DSS) subsequently arrested him and kept him in detention for almost 24 hours, after which he was released, following the intervention of some top Nigerians.

    Despite his release, the Kaduna State governor, Nasir El-Rufai is insisting the entertainment mogul must be prosecuted.

    Speaking at the Social Media Week in Lagos last week, El-Rufai said it was irresponsible of Maikori to have posted such information without verification.

    According to him, Maikori’s messages could have sparked off a crisis which could have in turn led to the deaths of some Fulani people.

    “Audu Maikori rushed to publish a false story without checking with anyone. But before then, he had been posting fake pictures by posting Boko Haram attacks, Rwanda genocide as southern Kaduna killings which elicited a lot of emotions on social media,” El-Rufai said.

    Kaduna State governor Nasir El-Rufai has vowed to prosecute CEO of Chocolate City, Audu Maikori, for the inciting tweets that led to his arrest on February 18.
    Agents of the Department of State Services (DSS) arrested Maikori after claiming five students of College of Education Gidan Waya, Kaduna were killed in the conflict in southern Kaduna on the social media.
    Speaking at the Social Media Week in Lagos, el-Rufai said it was irresponsible of Maikori to have posted such information without verification.
    According to him: “He is going to be prosecuted. He was arrested. His statement has been taken. His fate will be decided by a judge.
    “It’s not Nasir El-Rufai. It’s nothing personal. I have nothing against him. He has worked with the state government in the past.”
    He said Maikori’s messages could have sparked off crisis which led to the deaths of some Fulani people.

It is totally irresponsible to do that.
    “And even when pointed out to him that this information is not true that the College of Education does not run a mass communication programme and that the school had been closed down since November, he still posted that he stands by his story.
    “He questioned the authenticity of the press statement. He was totally and completely irresponsible.”

    The top three participants will pitch their business plans at a finale session to a panel of industry experts chaired by AuduMaikori.

It is therefore an absolute honour to be back again as a judge, to find like-minded individuals who are not only successful within their own rights but sharing their success with their communities. This is profit with purpose,” Maikori said of his relationship with the brand.

    The winner will join the other 32 participants across the world in an Accelerator Week programme in Oxford, UK and will represent Nigeria at The Venture final event in the USA, July 2017.

    MaikorI, a lawyer, social activist and entrepreneur is the founder and Chairman of the Chocolate City Entertainment.

    We cannot be ‘Youth’ forever, says Audu Maikori

    President of Chocolate City Group, Audu Maikori, has an axe to grind with the President Muhammmadu Buhari-led adiminstration. The former boss of Chocolate City group recently made his thoughts known on the new ministerial list, especially as regards the age of those who made the cut.

    He took to his Twitter handle on Tuesday to vent; “Instead of my juniors and my age mates getting nominated for ministerial roles it’s their fathers that are being nominated … #Relegation.

    “You see the reason why they keep us tagged as ‘youth’ is to justify their long stay in power. We cannot be ‘Youth’ forever,” he posted.

    Maikori was recently announced as one of the judges for a new social entrepreneur competition tagged The Venture. Confirming the contract, he stated; “if you are a social entrepreneur The Venture competition should interest you. I will be leading a panel of judges at the forthcoming competition brought to you by Chivas Regal.”

    According to Maikori, one winner will be selected to represent Nigeria on the global stage which will have 27 other finalists from 27 countries around the world. The grand prize for the competition of one million US dollars ($1 million) will help the winner invest.

    Organisers of The Venture say that the competition is created to inspire, discover and reward those who believe that business can be a force for good.

    A statement from the organisers reads; “With $1Million in funding and expert support, The Venture will enable a new generation of social entrepreneurs to create positive change. If you have a business that makes the world better and the ambition to match, it’s time to step forward.”

    AS former Chocolate City boss, Audu Maikori marked his birthday on Thursday, artistes and the movers and shakers of the Nigerian entertainment industry sent in their felicitations. However, in the midst of all the birthday messages stood that of the label’s new boss, Jude Abaga, aka Mr Incredible.

    Known for his sense of humour, MI wasted no time in bringing his gift to bear in his message to his former boss.
