  • Court dissolves 23-year-old marriage over battery

    A Badagry Customary Court sitting at the City Town Hall on Tuesday dissolved a 23-year-old marriage on grounds of battery.

    The court President, Mr Shakirudeen Adekola, dissolved the marriage between Florence Ajayi, 43, and Olubisi, 46, following a petition by Florence, who said Olubisi constantly beat her even for asking questions.

    Adekola gave the custody of three of five children produced by the mariage to the petitioner.

    The court president held that the remaining two children were above 18 years and were  at liberty to decide which of their parents to live with.

    “From the evidence adduced by both parties in court, it is very clear that this marriage has broken down irretrievably and both parties are better allowed to go their ways.

    “The respondent shall have unfettered access to the children of the marriage, and they are allowed to spend holidays and vacation with him,” he said.

    The court president ordered the parties to maintain peace between themselves, their families and communities wherever they would meet.

    “Olubisi shall pay to the plaintiff a sum of N20,000 monthly allowance for upkeep of the three children to be with the plaintiff.

    “Both parties are allowed to appeal against this judgement within 30 days from May 7.

    “Finally, violation of any of these orders shall be deemed contempt of court and shall be dealt with accordingly,’’ Adekola held.

    Earlier, Florence, who resides at Bayo Bus Stop, off 10 Shops, Aradagun, Badagry,  told the court to dissolve her marriage over constant beating by Olabisi.

    “My lord, my husband beats me anytime I ask him reasons for not sleeping at home.

    “Each time my husband answers phone calls from his concubines, he leaves the home and will not sleep at home that day.

    “As a trained nurse, I built shops inside my husband’s house where I sell medicines and attend to patients after returning from the hospital where I work.

    “Anytime, we have a misunderstanding, after beating me, he will go right to my shop and scatter my things and send away my customers,” she said.

    Responding, Olabisi,  who lives at Elijah Bus Stop, beside Apulu Church, Badagry, however, denied the allegations.

  • ‘I caught my husband having sex with our housemaid’

    A Badagry Customary Court in Lagos on Wednesday dissolved an eleven-year-old marriage between Risikat Kadiri and her husband, Muheem Kadiri over infidelity and theft.

    Risikat, a 41-year-old trader told the court that apart from numerous cases of his following women around, her husband used to sneak into their maid’s room to sleep with her.

    “I am aware that my husband flirted with different women, but I was surprised the day I saw him having sexual intercourse with our housemaid, Taiwo Ogunlade.

    “I had to send the maid away before he impregnated her.

    “Apart from this, my husband was in a relationship with a widow who lived close to our house.

    “Muheem connected our generator light to the woman’s room through a hidden conduit hole, such that each time we put on our generator, she would be supplied.

    “This woman used to pass the night with my husband, taking the advantage of proximity of his room to her own.

    “I did not know this until I packed out of his house and later discovered that the woman had packed in as his wife,” she said.

    The petitioner also alleged that Muheem used to steal her money.

    “My husband is a thief; he has the habit of stealing my money. If I put money inside my safe, he would enter my room and steal N20, 000 or more in between the bundles.

    “But if i asked him, he always confessed taking it in some occasions,” she said.

    The respondent, however, denied all the allegations and said he was a responsible man.

    The 51-year-old petroleum dealer said he did not have anything with a widow nor had any sexual intercourse with their housemaid.

    He however confirmed that he used to take the petitioner’s money whenever he was broke.

    Muheem said he was not interested in the marriage and asked the court to give Risikat the custody of their two children until they attain 18 years.

    Delivering the judgment, the court president, Mr Sakirudeen Adekola dissolved the marriage on the ground of mutual consent.

    He said “Since both parties consented to the dissolution of their marriage, this court has no choice than to dissolve the marriage.

    “The court hereby pronounces the marriage between Mrs Florence Anyasi and Mr Stanley Anyasi dissolved today.

    “Both of you henceforth cease to be husband and wife, each of you should go on his or her separate ways unmolested.

    “The custody of the two children of the union is hereby granted to the petitioner as the respondent did not contend for their custody.

    “The respondent is hereby ordered to pay a sum of N20, 000 on monthly basis for the upkeep of the children in the custody of the petitioner, which must be channeled through the court.

    “Muheem shall be responsible for the school fees and medical bills of the children as obtained in government school and hospital respectively unless otherwise mutually agreed.

    “Violation of any of the orders of this court shall be deemed contempt of court and shall be so treated with appreciate sanction.”

  • ‘My husband attacks me with deadly weapon’

    A housewife, Sylvia Ekejelape, 38, on Tuesday pleaded with a Badagry Customary Court to dissolve her 13-year-old marriage alleging that her husband, Stanley, always attacked her with dangerous weapon when fighting.

    Sylvia, a businesswoman and a mother of three, who now resides at No1, Oja Tuntun, Akure, Ondo State, also told the court that she could no longer tolerate his adulterous behavior, adding that there was no more love in the marriage.

    “I met my husband in 2004 at Alaba International Market, Lagos; he proposed to me and i agreed.

    “We did introduction; he married and paid my dowry in May 7, 2006.

    “But eight months after our wedding, he started maltreating me like a slave.

    “He always beat me and throw my belongings out of the house in the middle of the night, telling me to go anywhere I like.

    “The reason for the beating was that my husband is a womanizer and he used to bring them home without any regard for me and my children.

    “Anytime we are fighting, he used to attack me with deadly weapon like bottle, knife and iron rod.

    “He is a very dangerous man, who has no respect for me, he has publicly disgraced me on many occasions, I am through with his womanizing attitude,” she said.

    The respondent, Stanley, however, denied all the allegations against him by her wife, Sylvia.

    Stanley, 40, an electrical contractor, who lives at No 8, Muriana Str., Ajangbadi, Lagos, said that he was not against the divorce suit filed by the wife.

    The court President, Mr Sakirudeen Adekola, adjourned the case until Nov. 8 for judgment.

  • Divorce: My husband is a gossip, liar

    A 43-year-old housewife, Titilayo Akaba, on Thursday asked a Badagry Customary Court in Topo Garage, to dissolve her marriage to Maselin Akada, whom she accused of been a habitual gossip and liar.

    Titilayo, a food vendor, who resides at Baale Street., Torikoh, Badagry, in her application for divorce, told the court that she had spent a night in police custody because of her husband’s lying habit.

    “I met Maselin in 1997 and we both married without my parents’ consent because he was 30 years older than me.

    “No dowry was paid and I have three children for him.

    “He did not give me rest of mind and he talks too much at his age.

    “Maselin will be rolling on the ground, crying that i have stolen and hidden his documents whereas he is lying.

    “My husband went to Area K Police Command in Morogbo to report me that i sent hired killers and badoo boys to kill him.

    “They transferred the case to Badagry Police Station, where i was detained for 24 hours for what i did not do.

    “My lord, i don’t have rest of mind staying under the same roof with this man, he is a liar,” she said.

    Titilayo pleaded with the court to grant her custody of the three children, and alleged that Madelin was old and had vision challenge.

    The respondent was, however, not in court.

    The court’s President, Mr Sakirudeen Adekola, adjourned the case until Oct.9 for further hearing.
