    Niger’s highest court lifts immunity of deposed President Bazoum

    Niger´S highest court lifted the immunity of the country´s democratically elected president, Mohamed Bazoum, nearly a year after he was overthrown by mutinous soldiers, his lawyer said Friday, opening the door for the military junta to prosecute him for alleged high treason.

    Bazoum and his family have been under house arrest since a military coup that overthrew his rule last summer. The junta authorities said they planned to prosecute him for “high treason” and for undermining national security, and earlier this year initiated legal proceedings to lift his immunity in a newly created State Court, which became the country´s highest judicial authority.

    Before Bazoum was forcibly removed from power, Niger was the West´s last major security partner in the Sahel, the vast region south of the Sahara Desert that has become a hot spot for violent extremism.

    But the military junta ordered the withdrawal of Western troops from the country and turned to the Russian mercenary group Wagner for security assistance. U.S. forces are poised to leave by the middle of September, the Pentagon said earlier this month.

    The proceedings before the State Court have been marred by serious irregularities, including violations of Bazoum´s rights to present evidence in his defense, to communicate with his legal counsel, and to be heard before an independent court, according to Human Rights Watch, a leading rights group.

    Bazoum´s lawyer, Reed Brody, criticized the ruling as a “mockery” of the rule of law in Niger. “We never even got to speak to our client,” Brody said. “This is a travesty of justice.”

    Bazoum´s lawyers have been unable to communicate with him since last October and have had restricted access to case material, according to HRW.

    Late last year, the highest court of West African regional bloc ECOWAS ruled that Bazoum and his family were arbitrarily detained and called for him to be restored to office.

    Nigeria lauds release of Bazoum’s wife, son

    Nigeria’s Foreign Affairs Minister, Yusuf  Tuggar,  has lauded the release of the dethroned Niger President Mohammad Bazoum’s wife and son from house arrest.

    Bazoum’s family have been under house arrest since the coup on July 26, 2023, by the National Council for the Safeguard of Homeland, the ruling military junta in Niger.

    This is contained in a statement by the Special Assistant to the minister on Media and Communications Strategy,  Alkasim Abdulkadir, in Abuja.He said Tuggar, who was also the Chairperson of the Mediation and Security Council of the Economic Community of West African States (ECOWAS),  said it was a logical step in returning normalcy to Niger and the region in general.

    Tuggar reiterated the call to the government led by Gen. Abdourahamane Tchiani, to hasten the release of Mohammed Bazoum from its custody, and allow him to fly to a third country as a step towards further talks on lifting sanctions.

    According to Tugger, the release of Bazoum will also initiate the transition to constitutional rule in the interest of the people, peace and stability of Niger and the region.

    The News Agency of Nigeria (NAN) reports that on July 26, 2023, a coup d’état occurred in Niger.

    The country’s presidential guard detained President Mohamed Bazoum, and Presidential Guard commander,  Gen. Abdourahamane Tchiani, proclaimed himself the leader of a new military junta, shortly after confirming the coup a success.

    ECOWAS issued an ultimatum to the coup leaders, threatening military intervention if deposed Bazoum was not returned to power.

    ECOWAS member states suspended relations with Niger and closed their land and air borders with the country.

    Niger says it foiled attempted escapeby deposed President Bazoum

    The military administration in Niger foiled an attempt by deposed President Mohamed Bazoum to flee the country this week, an official said.

    Col. Maj. Amadou Abdramane, the government spokesperson, said Bazoum tried to escape in the wee hours of Thursday together with his family, two cooks, and two security personnel.

    “The carefully planned attempted escape was thwarted thanks to the swift and determined action of the Nigerien defense and security forces,” Abdramane said on national television late Thursday.

    “The situation is under control and the main perpetrators of the escape attempt, as well as their accomplices, were arrested.”

    Abdramane added that an investigation has been launched by the public prosecutor which would shed more light on the escape attempt.Bazouom, who was detained at the presidential palace following his ouster, had planned to flee to Nigeria using a “helicopter belonging to a foreign power” which had been organized to evacuate him from Tchangarey neighborhood on the northern outskirts of the capital Niamey, according to Abdramane.
