    Budget padding – A crime or not?

    The controversy over the budget padding allegation rocking the House of Representatives has refused to go away. Lagos lawyer WAHAB SHITTU puts the issue in perspective

    I have followed with keen interest the controversy surrounding the allegations and counter-allegations involving the removed Chairman of the Appropriation Committee of the House of Representatives on one hand and certain named principal officers of the House of Representatives on the other hand culminating in the public declaration by the Speaker of the House of Representatives, Hon. Yakubu Dogara that budget padding is not a crime known to law.

    Expectedly, reactions have trailed Mr. Speaker’s public declaration and this intervention is meant to put matters in proper perspectives, reflecting the divergent positions taken on both sides of the divide and concluding with the issues that ought to be focused upon at the moment.

     

    Open Mind

     

    I observe that allegations and counter-allegations have been made and investigations on the veracity of same are ongoing. In the light of this development, the first point that I would make is to urge Nigerians and other interested party to maintain an open mind until we get to the bottom of the controversy. Secondly, it is also useful to urge that no one is entitled to pronounce guilty or innocent until the legal process including the investigative process are concluded and finalized.  However, given the seeming lack of sufficient information on what budget padding means, it became necessary to undertake some measure of research with a view to promoting consciousness in this area and assist in the quality of the debate.

     

    Conceptual Clarification

     

    I begin my analysis with conceptual clarification.  What is meant by padded? What is padding? What is budget padding? What are the incentives for budget padding? What consequences flow from budget padding and what are the ethical considerations involved in the process?

    The word ‘padded’ is defined by Merriam Webster’s Collegiate Dictionary, Eleventh Edition is defined as ‘to furnish with a pad or padding … to expand or increase especially with needless, misleading or fraudulent matter…’ padding is the ‘material with which something is padded’.

     

    Research Efforts

     

    In my research, I stumbled on an article written on the subject area highlighting some of the issues raised above. Danielle DeLee in an article titled ‘What is padding the Budget’ made the following observations reproduced hereunder:

    “Padding the budget is a practice that some people use in business when submitting a budget for approval. It artificially inflates the proposed budget in order to give the project room to expand or to cover unexpected costs. Many see budget padding as unethical, but its practitioners defend it on the grounds of practicality…padding the budget means making the budget proposal larger than the actual estimates for the project. This is done either by increasing a project’s expenses or decreasing its expected revenue.  The goal of budget padding is to get an approval committee to grant an artificially high level of funding to the budget maker’s proposed project.  There is some contention over the exact definition of padding; some contend that inflating expenses to take expected inflation into account is responsible foresight rather than padding, while others see any increase beyond current estimates as padding… First, they want to account for economic factors.  This is true of budget increases that anticipate inflation or, in the case of international projects, fluctuations in exchange rates.  Second, they want to avoid red tape.  If an unexpected expense arises, the padding gives the project flexibility to cover it that is called slack or breathing room.  Third, they want to make a favourable impression on their superiors.  If they propose a larger budget and then outperform the budget, then the project team will be viewed favourably by the bosses.  Finally, they fear budget cuts.  Some budget padders fight against cuts that they see as unfair by anticipating them with an inflated proposal…In theory, projects should spend according to the accurate budget estimates so that padding would have no real effect. In practice, however, budget padding has concrete consequences.  Projects with extra room in their budget tend to use it.  Recurring projects, especially, spend money unnecessarily in order to use up their entire budgets.  That way, the approval committee does not cut their budgets in the following year…Aside from the financial consequences; many people question the acceptability of budget padding because it is a deceptive practice.  They say that it breeds a harmful corporate atmosphere.  Budget padding’s defenders cite its widespread use as a justification of its acceptability.  They also argue that unfair actions on the part of bosses, like budget cuts, force them into preemptive budget inflation”.

     

    Constitutional Provisions

     

    The above may have partly addressed the definition, incentives, consequences and ethical considerations of budget padding.  However, the controversy still lingers whether in the context of our own circumstances budget padding constitutes a crime?

    Section 81(1) of the constitution provides:

    “The President shall cause to be prepared and laid before each House of the National Assembly at any time in each financial year estimates of the revenues and expenditure of the Federation for the next following financial year”.

    The question that arises from the above is the ownership of the budget in terms of preparation? I have no difficulty in saying on the strength of the constitutional provisions above that the preparation of the budget is the responsibility of the Executive. This position is fortified by Section 81(2) of the constitution.

    “The heads of expenditure contained in the estimates (other than expenditure charged upon the Consolidated Revenue Fund of the Federation by this Constitution) shall be included in a bill, to be known as an Appropriation Bill, providing for the issue from the Consolidated Revenue Fund of the sums necessary to meet that expenditure and the appropriation of those sums for the purposes specified therein”.

    But whose responsibility is appropriation as opposed to the preparation of the budget.  Again I have no difficulty in saying that appropriation is the responsibility of the National Assembly.

     

    Scope of Budget Preparation

     

    The next question that arises is what is the scope of preparation of the budget? What is the scope of the appropriation of the budget? The answers to these posers would determine whether budget padding constitutes a crime or not.

    Given the definition of padding and the synonyms of same to include ‘insertion’ and ‘mutilation’ the question that naturally arises is whether the National Assembly in the guise of appropriation is entitled to insert  estimates of projects not included in the budget preparation as laid before the National Assembly by the President.

    Budget planning and preparation are (or should be) at the heart of good public expenditure management. To be fully effective public expenditure management systems require four forms of fiscal and financial discipline namely:

    1. Control of aggregate expenditure to ensure affordability; that is consistency with the macroeconomic constraints;
    2. Effective means for achieving a resource allocation that reflects expenditure policy priorities;
    3. Efficient delivery of public services (productive efficiency); and
    4. Minimisation of the financial costs of budgetary management (i.e. efficient budget execution and cash and debt management practices).

    It is correct to say that budget preparation is the principal mechanisms for achieving items 1 and 2 while item 3 is an element of the budget preparation process of industrial countries and item 4 reflects budget execution and cash management.

    In the budget preparation process the provisions of Fiscal Responsibility Act, 2007 is relevant providing with respect to annual budget for: a) annual budget to be derived from medium term expenditure framework; b) annual budget to be accompanied by certain documents; c) preparations of estimates of revenue and expenditure by corporations etc

     

    Scope of Budget

    Appropriation

     

    What then is budget appropriation?

    The Black’s Law Dictionary defines appropriation to mean ‘the exercise of control over property, a taking of possession…a legislative body’s act of setting aside a sum of money for public purpose…if the sum is earmarked for a precise or limited purpose, it is sometimes called a specific appropriation’. In broad terms, it means the designation by the government or an individual of the use to which a fund or money is to be applied.  An appropriation bill is a proposal placed before the legislative arm of the government by one or a group of its members to earmark a particular portion of general revenue or treasury fund for the use of government objective.

    Based on the above definition of the scope of budget preparation and appropriation, it is safe to conclude that while the executive retains the exclusive right to prepare the budget, the national assembly retains the right to appropriate funds for the budget proposals. In my view, in the course of appropriation, the national assembly is entitled to reduce or increase expenditure for projects earmarked for execution by the president in the budget preparation. But with such projects cover constituency projects initiated by the national assembly itself without reference to the executive? My answer in the light of constitutional provisions is NO.  therefore, in the guise of appropriation the national assembly is not entitled to add its own projects to the budgetary estimate presented by the president if the national assembly is interested in any project, it may consult with the executive who may then add such projects to the budgetary estimate prepared by the president as part of the president’s developmental agenda for the country.  This is so because the job of the national assembly is limited to lawmaking, representation and oversight responsibilities not project execution which is the terrain of the executive.

     

    Budget Padding

    – Whether a Crime?

     

    It is in this context that budget padding may be understood particularly where there are insertions into the budget or mutilations of the budget without the consent of the owner of the document (the president) or with intent to betray the initial objectives of the budget preparation. However, padding of the budget may not be established except it is shown that the budgetary process is either broken, corrupted or compromised.  This may have introduced the element of proof.  What proof? First it is important to find out the motivation for such insertions i.e. whether designed to defeat the objectives of the budget as laid before the national assembly by the president.  Secondly, it must be shown that the act of insertion or mutilation was actually carried out by the national assembly and the persons involved in the illegal insertions or mutilations of the budget.  Thirdly, whether the acts complained of was successful? And the last ingredient is the benefit derived from the process by the beneficiaries. It will also be useful to determine whether the culprits carried out the exercise without the knowledge of the body of the National Assembly as a whole as such a scenario will confirm its illegality.  Except it is shown that the select few acted in defiance of the majority of the National Assembly, it may be difficult for the national assembly to vote something and it is regarded as padding.

    It is in this context that budget padding may be likened to corrupt practices similar in nature to such offences as abuse of office, attempt to embezzle, diversion and misappropriation of public funds, conspiracy to act corruptly and illicit enrichment – all of which offences are recognized under United Nations Convention against corruption to which Nigeria is a state party.  Further, a clear scrutiny of legislations such as Corrupt Practices and Other Related Offences Act, Economic and Financial Crimes Establishment Act (EFCC) and Fiscal Responsibility Act respectively would reveal further offences that could come within the framework of budget padding.

     

    The Focus

     

    In the budgeting process, we have tended to focus on how much we earn and how quickly such earnings can be expended without really addressing the problem whether the funds appropriated are well utilized.  The searchlight may have to be focused on efficient and effective utilization of resources appropriated during our many years of budgetary experience. This may be the key to unlocking this budget padding controversy.

    The other issue is the degree of involvement of civil servants working in major Parastatals, Agencies and Federal Ministries in the so called budget padding without limiting the enquiry to the National Assembly alone if indeed truth is to be unraveled.

    In summary, whether any offence is created would depend on the role of civil servants, individual members of the National Assembly, nature of projects appropriated for and whether such projects are actually executed and diversion of funds meant for such projects in previous years. Indeed anti-graft agencies have a lot of work to do and the starting point is to examine existing legal framework and enforce their provisions.

    Embattled Speaker Yakubu Dogara is in desperate search for  a minimum of additional  28 members of the House to retain his leadership of the Green Chamber.

    Dogara who has come under intense scrutiny  and pressure to quit on the strength of allegations by the sacked chairman of the House Committee on Appropriation, Abdul-mumin Jibrin, that he and four other principal officers of the House were involved in budget padding, has already secured the signatures of  262 of the  360 members.

    The 262, The Nation learnt, have already signed a register opened by Dogara to keep track of those backing him in the biggest threat yet to his position since he was elected in an acrimonious process in June last year.

    But he needs an additional 28 signatures from the remaining 98 members to be relatively at ease.

    The following is the breakdown of the 98 Reps who are yet to sign the register:

    Lagos -18; Sokoto -2; Kogi -1;Bauchi -2; Oyo -6; Kaduna-3; Osun -6;Niger -3;Ondo -4;Taraba -1;Ogun -1;Katsina -3;Kebbi -1;Edo -5; Kano -4;and Benue -1.

    The implication is that the Speaker has challenges in Lagos, Osun, Oyo, Ondo, Ogun.

    But he has gained more support from Sokoto, Plateau, Benue, Taraba, Kwara, Borno, Ekiti, the entire South-East and South-South both of which are controlled by the PDP.

    Dogara’s strategists are said to be shocked by the refusal of two out of the 12 Representatives from his home state of Bauchi to support him.

    A source who is familiar with the unfolding event said: “About 262 Representatives have signed the register to back Dogara although the target is actually 290 members to Ward off any threat.

    “About 98 members have not signed, undecided or on vacation.

    “The only challenge Dogara is having borders on poor support base for his Deputy, Yusuff Lasun in the South- West. Out of the 65 Representatives from the South-West, only about 30-36 signed the register. Whereas, Dogara was able to secure 95 per cent signatures of members from the North-East.

    “It got to a ridiculous extent that some chairmen of committees from the South-West stayed away from the register. The House leadership considered it a slight.

    “At a meeting of pro-Dogara loyalists during the week, the Deputy Speaker was faulted for not embracing his colleagues from the South- West after the House has reconciled.

    “Although Lasun gave the details of his rapprochement with Representatives from the South-West, members were not convinced at all.

    “Dogara is however doing a lot to persuade Reps from the South-West to forget the past. If the House Leader, Femi Gbajabiamila pitches his tent with Dogara, then it will be an easy ride for him.

    “So far, there is a lot of pressure on the Deputy Speaker to wield influence on his colleagues from his geopolitical zone to back Dogara.

    “Gbajabiamila has a onerous task at hand. The former Chairman of the House Committee on Appropriation, Jibrin was on his side before he made a volte face at the last minute. Jibrin’s switch of support earned Dogara the Speakership.

    “Members are eager to see whether Gbajabiamila will pay Jibrin back in his own coin or stand by Dogara based on privileged information at his disposal.”

    A member of the House in Dogara’s camp said: “It is going to be a battle to the finish. Some of us have suspended our vacation because of the challenge at hand.

    “What I can assure you is that Dogara will survive this battle because he is innocent of all the allegations against him.”

    However, it was gathered that there is even no guarantee that the 262 that have signified their support for him in the survival battle will line up behind him when the chips are down with sources citing the fluidity of the House politics

    The Speaker and his loyalists are said to have been reaching out to as many Reps as possible in an attempt to ensure that  Dogara is not brought down by the Jibrin allegations.

    Reps are being wooed to back the present leadership.

    Sources said the Speaker had to call off a foreign trip to enable him personally monitor events as they unfold on the budget padding allegations.

    Some of the lawmakers are said to have  shunned the register outright  while  some other are either out of the country or have not yet made up their mind on the issue.

    About eight governors, from Dogara’s APC and the opposition PDP are said to have rallied round him to ensure that he survives the plot to oust him.

    Meanwhile, fresh facts emerged yesterday that Dogara was at the Presidential Villa on Friday to brief President Muhammadu Buhari on the controversy over the padding of the budget.

    Another government source said: “Despite the fact that the president already had security reports on the problem in the House, Dogara came to explain the situation to him.

    “But after listening to him, Buhari did not make any commitment. He only noted what Dogara said.”

    A group of serving and former members of the House of Representatives has added a twist to the budget padding allegations after threatening to go to court to subject Section 80 (4) of the constitution to legal interpretation on the ownership of the budget document.

    Section 80 (4) says: “No money shall be withdrawn from the Consolidated Revenue Fund or any other public fund of the Federation, except in the manner prescribed by the National Assembly”.

    The lawmakers under the aegis of Faculty Board of Initiatives ( FBI ) are of the view that  the controversy generated by the budget padding issue has made it expedient to approach the court for proper interpretation of the law.

    Spokesman for  the group, Eseme Eyibo described  ‘padding’ as a misapplication of the word because the constitution allows  budget proposals to be adjusted which is why it is  presented as a bill by the President.

    According to the former House spokesman, the annual Appropriation bill flows from the Executive to the Legislature and goes back to the Executive after its passage before assent and implementation.

    The Police Special Investigation Panel (SIP) has re-invited former House of Representatives’ Appropriation  Committee chairman Abdulmumin Jibrin for questioning over his petition on alleged padding.

    The panel, it was learnt, wants him to clear some grey areas in the petition

    Jibrin is expected to appear before the Assistant Inspector-General of Police (IGP) Amodu Ali-led panel either today or on Monday.

    The SIP has shifted the planned interrogation of Speaker Yakubu Dogara,  Deputy Speaker Yusuff Lasun , Chief Whip Alhassan Ado Doguwa and Minority Leader Leo Ogor till after its session with Jibrin.

    It was learnt that the panel will communicate a new date to the four principal officers, who were earlier given a date for  today.

    Investigation by our correspondent revealed that the panel observed some gaps in Jibrin’s petition.

    A top source in the police said: “Having gone through the petition, the panel has discovered that more documents are required to be able to isolate allegations which the four principal officers will respond to.

    “The SIP on Thursday (yesterday) invited Jibrin to bring more documents to fill in some gaps in our profiling of his petition.

    “We expect Jibrin to be with us either on Friday (today) or on Monday. After getting all documents, we will then formally quiz Jibrin on record.

    “We have shifted the interaction with the principal officers until we are done with Jibrin. So, the  invitation which they received has been postponed.

    “A new date will be communicated to the principal officers.

    “If you look at Jibrin’s activities after submitting the petition, he has been making more revelations. New investigative clues have come up from his comments on his tweeter handle and in interviews that granted. We have different figures to investigate which include: N284billion, N90billion, N40billion and N20billion, the amount bandied at various times.

    “The list of suspects has also been growing on a daily basis. Jibrin has to appear before the panel to assist it to streamline all the allegations and the suspects.

    Jibrin had alleged that about 2,000 projects  worth N284billion were “inserted” into the 2016 budget.

    He insisted that  Dogara, Lasun, Doguwa and Ogor must resign for “unfettered” investigation into the  budget scam.

    Jibrin said: “I strongly believe with every conviction that in cleaning up the budgeting system and considering what transpired during 2016 budget, which I have all the facts and documents Speaker Dogara, Deputy Speaker Lasun, Whip Doguwa and Minority Leader, Ogor should resign.

    The national leadership of the All Progressives Congress (APC) Thursday asked embattled former Chairman of the House of Representatives committee in Appropriation, Hon. Abdulmuminin Jibrin to stop speaking on the controversial budget padding issue, saying the party found the development embarrassing.

    In a letter addressed to Jubrin with referenced APC/NHDQ/NAM/01/016/14, dated 4th August, 2016 and signed by the Deputy National Chairman (North), Senator Lawal Shuaibu, the party said it has decided to wade into the matter with a view to finding solution to it.

    The part ask him not to issue and public statement either through the social media or any other means of passing information to the public and commended him for honoring the party’s invitation and pledge to work with the party in resolving the matter.

    The letter reads: “As you are aware, the party and indeed the government have not been happy over recent developments in the House of Representatives over the issue of the 2016 budget. We found it embarrassing to have to deal with another new phenomenon you tagged ‘budget padding’.

    “However, I write to thank you for your cooperation in honouring our intervention and your readiness to afford the party the chance to handle the House of Representatives budget padding crisis.

    “Arising from the series of meetings we held with you over the subject matter, the National Working Committee had decided to request you to henceforth aviod issuing public statement on this matter.

    “This however includes statements through the social media or other means of transmitting an opinion on the matter to the public, as the party is now looking into it towards finding possible solution. While counting on your cooperation, please accept my sincere best wishes”.

    The Nigeria Labour Congress (NLC) on Thursday cautioned against using the current budget padding controversy to weaken the leadership of the National Assembly or settle political scores.

    In a statement issued by its president, Comrade Ayuba Wabba, NLC said the current controversy is showing evidence of weakness in the nation’s budgeting system and the fact that projects are not conceived and implemented based on the needs of the people, but those behind the projects.

    The congress said rather than go after individuals, government should do a soul searching and x-ray the nation’s budgeting system that has failed to address the needs of the people.

    The statement reads: “The ongoing controversy over the padding of the 2016 budget is an incontrovertible evidence of the inherent weaknesses in our budgeting process and accordingly underscores the need for a thorough revisit.

    “It also reveals the imperfections and the distrust in project identification and implementation system and consequent failure of the present model of capital budgeting without a developmental framework. It shows that projects are not implemented according to needs-value or priority but who is behind which.

    “In light of the foregoing, we wish to state that instead of going after individuals, government should do a soul-search as well as x-ray a budgeting system that fails to address the needs of the people.

    “We caution against the use of the present development to settle political scores or unduly weaken the National Assembly.

    “A strong National Assembly is a necessity for a vibrant democracy.  We urge Nigerians to be slow to anger in matters of this nature even as they have little or no reason to be too trusting of any political office holder, so that in the end, they do not end up victims of other peoples’ wars.

    “Even as vitriol and bile have risen, it is important to distinguish between genuine and phony constituency projects, for in truth, constituency projects are obligations owed constituents by parliamentarians.

    “Finally, we call for caution, because how the issues in contention are resolved will shape the direction of our democracy; deepen or weaken it. Equally important is the fact that it avails us an opportunity to revisit our budgetary system and the need for development planning.”

    The budget paddings scandal took yet another turn Wednesday as the former Chairman, House of Representatives Committee on Appropriations, Hon. Abdulmumin Jibrin accused the Speaker, Yakubu Dogara of bribing some members with 25,000 dollars each.

    According to Jibrin, the alleged sum was for the selected members to sign a vote of confidence for the speaker and three other accused principal officers.

    The lawmaker made the allegation in a statement issued to journalists yesterday in Abuja, saying members of the House of Representatives were given 25,000 dollars to sign a register opened at the Speakers Asokoro guest house.

    He further states: “This disgraceful act is coordinated by Hon. Zakari Mohammed, Hon. Jagaba Adams Jagaba and DCOS to Mr Speaker Hon. CID Maduabum.

    “It is a shame that Mr. Speaker has not responded to any of the allegations raised against him but has resorted to look for fraudulent cover

    “My stand is that the corrupt Speaker Dogara, Lasun, Doguwa and Ogor must listen to Nigerians, reconvene the house immediately and step aside.

    “Investigation by anti-graft agencies is already on and I pledge to support the investigation and prosecution of these corrupt public officers, “he said.

    However, in a swift reaction to the allegation, one of the lawmakers accused of distributing the money, Hon. Zakari Mohammed in a tweet quickly debunked the allegation.

    He said: “My attention has been drawn to yet another tweet by the former chairman appropriation committee, Hon Abdulmumin Jibrin saying that I and others were distributing $25,000 to each member of the House, to generate signatures for speaker Dogara’s vote of confidence, “I want to state that the accusation is not only untrue but it is another tales by moonlight to hoodwink Nigerians to malign my image.

    “Fellow countrymen please disregard this cheap blackmail aimed at playing to the gallery, I challenge Mr. Jibrin to name at least 10 members or less who benefitted from the bribe.

    “My advice to Mr. Jibrin is that he should stop the mudslinging of my person and concentrate on licking his self-inflicted wounds.”

    Acting Inspector-General of Police (IGP) Ibrahim Idris has raised a five-man special team to probe the alleged padding of the budget by House of Representatives Speaker Yakubu Dogara and some of his principal officers.

    The Assistant Inspector-General of Police (AIG) Amodu Ali-led Special Investigative Panel (SIP) has invited Dogara, his deputy Yusuff Lasun, Chief Whip Alhassan Ado Doguwa and Minority Leader Leo Ogor to appear before it on Friday.

    The panel yesterday had what was called “a preliminary session” with ousted House Committee on Appropriations chairman Abdulmumin Jibrin, who accused Dogara and others of padding the budget with N284 billion.

    The All Progressives Congress (APC) has met with the warring Dogara and Jibrin to resolve their differences. Jibrin was at the party’s secretariat in Abuja where he met with the National Working Committee (NWC) members.

    Dogara was said to have earlier met with the committee. The day of the meeting was, however, not given.

    Last Monday, Jibrin petitioned the police, the Economic and Financial Crimes Commission (EFCC) and other anti-corruption agencies over the matter.

    Jibrin was said to have “furnished the SIP with vital information and a heap of documents” at their meeting yesterday.

    A highly-placed police source, who spoke in confidence, said Ibrahim has directed the SIP to conduct a “comprehensive investigation into Jibrin’s petition.”

    The source said: “We have commenced full investigation into the N284billion budget padding in the House of Representatives based on a petition from Hon. Jibrin.

    ”A Special Investigative Panel (SIP), with a crack detective, AIG Amodu Ali as the chairman, is the one saddled with the responsibility of looking into the allegations in the petition. The same Ali uncovered the lid on the $620,000 bribery scam in the House for which a former Chairman of the House Committee on Fuel Subsidy Management, Mallam Farouk Lawan, and the Clerk of the committee, Mr. Boniface Emenalo were indicted. The case is in court.

    “You will recall that Ali was deeply involved in the investigation of the $180million Halliburton scam. So, the SIP is led by an officer who is tested.”

    Asked of the preliminary work done by the SIP, the source added: “As I am talking to you (4pm yesterday), a letter of invitation has been addressed and sent to the Speaker, the Deputy Speaker, the Chief Whip and the Minority Leader.

    “They will be interrogated by the SIP on Friday. As a prelude to the invitation of the principal officers, the SIP chairman and members had a session with Jibrin on Tuesday.

    “It was not a grilling session. But Jibrin furnished the team with vital information and a heap of documents to back up the petition he submitted on Monday.

    “We are going into the merit or otherwise of the petition on Friday by inviting Dogara and three others. It is going to be a gradual thing but we will crack the padding controversy.”

    Also yesterday, Jibrin confirmed that security has been beefed up around him by the Department of State Service (DSS) and the police.

    He also asked the All Progressives Congress (APC) to prevail on Dogara to reconvene the House and step aside to face prosecution for alleged budget padding.

    Jibrin, in a message on his Twitter handle, said: “My attention has been drawn to media reports that I have been summoned to appear before a disciplinary committee of our great party.

    “That I received a letter yesterday evening (Monday) inviting me to a meeting in respect of the crisis in the House on Tuesday (yesterday) by 2pm at the party’s office.

    “The letter did not in any way indicate it as a disciplinary committee. And I have responded that I will attend the meeting despite my tight schedules shuttling between security and anti-corruption agencies to provide support and evidence against Speaker Dogara and nine others.

    “I am confident that the party will do the right thing by throwing its weight to support our resolve to wipe out corruption in the House and direct Speaker Dogara, Deputy Speaker Lasun, Whip Doguwa and Minority Leader Ogor to reconvene the House immediately and step down to face imminent prosecution and save the party and our dear country from further embarrassment.”

    Budget padding: Group calls for overhauling of NASS

    Following controversies trailing the budget padding scandal, a civil society group under aegis of the Concerned Nigerian Citizens Tuesday called for total overhauling of the National Assembly (NASS).

    The group during a briefing on state of the nation in Abuja described actions of both leaders of the national assembly as unhonourable.

    CNC National Coordinator, Barr. Olusegun Bamgbose emphasised that corrupt practices of the Senate Leader, Bukola Saraki and Hon. Yakubu Dogara was capable of destroying future of young Nigerians, thus unworthy of being in the NASS.

    However, he called for the sack of the leadership of both chambers over the corruption allegations.

    Bamgbose noted that the House has been desecrated and in dire need of urgent sanitation, as it lacks what he called the “TEA principle of good governance, that is, Transparency, Equity and Accountability.‎”

    His words: “The entire leadership should be overhauled for sanity to prevail in the legislature. The national assembly has been polluted and there is need for urgent sanitation of the system. There is need for total overhauling of the polity.

    “As concerned citizens of Nigeria, we have a choice, either to act and rescue our Nation or watch our Nation fall. We will not watch our Nation fall. If we refuse to contain and curtail corruption, corruption will crush us.”

    Speaking on Saraki’s case, the group expressed concerns, stressing that, “As concerned Nigerians citizens we deem it absurd, unethical and unacceptable for Dr. Bukola Saraki to still hold on to his position as Senate President. This is unheard of in any civilized and progressive country.

    “How can we have a Senate President that is standing trial for false declaration of assets and forgery and he still deem it fit to occupy the honourable position of the third citizen of the Federal Republic of Nigeria. This is absurd. When he is called up in the court, he is referred to as the Accused person and yet presides over our hallowed chambers. This is not acceptable to us.”

    “As a matter of principle, we urge the speaker, Hon. Yakubu Dogara to step down for proper interrogation,” he added.

    The group utters their concern over the future of the country in the face of corruption and called everyone to join in the fight against corruption.

    “The fight against corruption will amount to be a mockery if these matters are swept under the carpet.

    “The ruling party should not for any reason ‘kill’ these matters in the name of political settlement. We equally urge the Attorney General of the Federation never to withdraw the charges against the Senate President.

    “On our part as concerned citizens of Nigerians we want to tell the leadership of the National Assembly to stop playing politics with the future of Nigerians.” The group warned.

    Former Chairman of the House of Representatives  Committee on Appropriations Abdulmumin Jibrin was yesterday at the Economic and Financial Crimes to submit a petition against Speaker Yakubu Dogara.

    Jibrin said the visit was also to provide insight into his petition against the leadership of the House on   the alleged N284billion budget padding.

    Also yesterday, House Leader Femi Gbajabiamila spoke for the first time on the issue, pleading that Dogara should not be judged by Jibrin’s allegations.

    On his Twitter handle, Jibrin said he had added the name of  Abonta Abonta to his petition.

    Abonta had some hours earlier taken up  issues with Jibrin on a political programme on Channels TV.

    Jibrin said:  “What a day! Submitted petition against Speaker Dogara and 12 others. Now, it is over to the security and anti-corruption agencies. “I added one new name to my petition, Hon. Abonta Abonta. The member who spoke after me on Channels and denied corruption exists in the House.

    “Let me use Hon. Abonta as a case. I have asked the anti-graft agencies to investigate his office running cost. Wait for the shocking outcome

    Head of Media and Publicity of the EFCC, Mr. Wilson Uwujaren said: “Jibrin was here but I do not have the details yet.”

    The Chairman of the House Committee on Basic Education, Mohammed Zakari has faulted Jibrin’s claim that he was one of those involved in budget padding.

    He said since November 2015, he had not had any dealing with Jibrin.

    Zakari, in a statement in Abuja, said: “I was shocked on Saturday to read how the immediate past Chairman of the House of Representatives, Hon.  Abdulmumin Jibrin,  was casting aspersions on me as part of his rantings over his removal by the House leadership. It was obvious his tweets were designed to drag every credible members of the House along because he does not want to bear his travails on the mismanagement of the consideration of 2016 Budget alone.

    “His mud-racking at me was the second in a week.”

    Ordinarily, I would have ignored his face-saving tweets but the fact that he is deceptively carrying many Nigerians along makes it imperative to protect my hard-earned integrity and about 10 years of unblemished career as a political office holders.

    “Prior to joining politics, I worked as a civil servant for 14 years with outstanding records. I cannot allow a desperado, who is also a gold digger, to rubbish my impeccable integrity.

    “I have not spoken or had personal contact with Jibrin since November 2015 because I have always had reservations on his conduct and overrated expertise in budgeting. He held every member in contempt and arrogated usurped powers to himself. He was so overwhelmed by his ambition to drag me into his plot to the extent that he referred to me as the chairman of the House Committee on Higher Education. He exposed his agenda of a revenge mission against me.

    “I wish to place on record that throughout the period of consideration of the 2016 Appropriation Act, I did not meet or write Jibrin for assistance to include any item or projects.

    “ I concentrated on my job as the Chairman of the House Committee on Basic Education. The proposals for Basic Education were easier in treating because the enabling Act of UBEC is explicit on how it should be funded.

    “For the avoidance  of doubt, I  want to state that my submission on the 2016 budget was a product of my committee’s relentless work, in conjunction with the Senate Committee on Basic Education. I challenge Jibrin to point out the specific areas that my committee fell short of its duties.

    “In addition, this is my 5th year in the National Assembly I have never heard of a budget being padded. What a sitting President brings to the National Assembly, according to Section 80(1) and (2) of the  1999 Constitution is an estimate which the Legislature is expected to consider and assist the Executive in reviewing appropriations for its plans and projects for the country.

    “Jibrin should look elsewhere for his prey. “As for Jibrin’s formal  report to the EFCC, I am more than ready to appear before any agency or anywhere to prove my innocence. I have no skeletons in my cupboard.”

    The leader of the House of Representatives, Femi Gbajabiamila Monday said fellow lawmakers and by extension all Nigerians, should not judge the Speaker of the House of the House of Representatives, Yakubu Dogara and three other principal officers accused of “insertions” of billions into the 2016 budget.

    Gbajabiamila made the appeal Monday in a statement to his colleagues made available to National Assembly reporters.

    “Yes, allegations have been made but I strongly believe judgment should not be passed based on allegations. We operate a constitutional democracy and we must at all times submit to its dictates and ethos. All parties are innocent until otherwise proven. This should be our guide. I plead with all members. The mudslinging must stop.

    The lawmaker also denied that he is working against the Speaker of the House, Yakubu Dogara, over the allegations of budget padding leveled against him by the former Chairman of the House Committee on Appropriations, Abdulmumin Jibrin.

    A text message making the rounds amongst members of the House alleged that Gbajabiamila is working with the former Appropriation Chairman to remove Dogara, but the House Leader in a statement yesterday said the allegation is far from the truth.

    He further states: “Since the budget controversy that engulfed the House  about a week ago, I have pointedly maintained a dignified silence. I did this for the sake of the institution I represent and which I have labored hard to grow and protect, knowing that whatever I say could be impactful both within the House and outside it.

    “I was determined to keep in place the glue that holds an otherwise
    O fragmented House, protect its integrity and at same time avoid eroding the little confidence and vestiges of hope Nigerians have in us.

    “Unfortunately, the controversy has now taken a different turn following the rather strange if not comical text making the rounds amongst members about my complicity in this rather sordid matter.   I am being dragged into an arena I tried very hard to stay out of only for the good of the House.

    “The Speakership election has come and gone. The election was divisive and acrimonious but I have since worked hard to heal the wounds some of which still fester amongst members on both sides. It is my responsibility to bring all tendencies in a House I lead together and I have worked well with the Speaker and all other Principal officers in a bi partisan manner and in the interest of the institution and the country.

    “This text message, which desperately seeks to finger me in some macabre plot to destabilize the House is a throw-back and echoes our dark post Speakership election history. The resurfacing or resurgence of the faceless text messengers will not help us as a House and let me quickly add that it will fail.

    “My strongest critics and biggest political adversaries in the House cannot deny the fact that my commitment has always been to strengthen the legislature and its processes and our democracy as a whole. I consider everyone a friend and colleague and urge that as we collectively work towards a stronger legislature and strive to deepen our democracy, we do not pull back the hands of the clock nor lose sight of the enormous responsibility placed upon us by providence as members of a critical arm of government.”

    The House Leader however, admitted that the budget process needs to be reformed:

    “On the budget issue at hand, it is clear that our budget process needs radical reform and very quickly too,” he said.
