The judge, who was irked at the respondent’s pronouncement of “I divorce my wife three times,” said it was not in line with Islamic practice.

He ordered the respondent to be given five strokes of the cane.

The complainant, Hauwa, had told the court that her husband chased her out of her matrimonial home since last year.

“He asked me to leave his house since last Ramadan, saying I should pack my belongings and leave. It is almost a year now and he has never checked me,” the complainant said.

  • Accused caned for stealing Holy Quran

A MAn, Auwal Muazu, got six strokes of the cane for stealing a copy of the Holy Quran and a pair of shoes in a mosque.

A Karmo Grade I Area Court, Abuja, gave the order at the weekend, following a guilty plea by Muazu, who lives at Utako village, Abuja.

Muazu was arraigned on a one-count charge of theft.

The judge, Mr. Abubakar Sadiq, said the court gave Muazu a “light punishment” because he did not waste the court’s time.

Sadiq, who warned Muazu to shun crime and become a good citizen, hoped that the sentence will act as a deterrent to others.

Prosecutor Mrs. Okagha Ijeoma told the court Muazu committed the offences on April 27 at 1:30 pm.

She said the complainant, Hadiyatullahi Abdulgani, of the National Forum headquarters Utako, Abuja, reported the matter at Utako Police Station on the same date.

Ijeoma said on April 27 at 1:30 pm, the convict entered the National Forum Mosque and stole a copy of the Holy Quran.

She added that Muazu also stole a pair of shoes belonging to a worshipper, but he was arrested and handed over to the police for investigations.

The prosecutor said the police recovered the stolen items from Muazu during investigations.

She said the offences contravened Section 288 of the Penal Code.

Ijeoma prayed the court to try the accused under Section 347 of the Administration of Criminal Justices Act, 2015, following his admission of guilt.

  • Man to be caned for calling sister-in-law prostitute

A Sharia Court in Magajin Gari, Kaduna yesterday ordered that Shuaibu Umar be given 80 strokes of the cane for calling his sister-in-law, Suwaiba Abdulkadir, a prostitute.

Abdulkadir, who filed a case of defamation against her brother in-law, said Umar called her a prostitute after a misunderstanding.   She said: “Shuaibu is my husband’s younger brother. We had a misunderstanding, we exchanged words and he called me a prostitute.

“I want this honourable court to grant me justice, as what my brother-in-law said about me has tarnished my image.”

The defendant, who did not deny calling his sister-in-law a prostitute, said he spoke in anger and had no regrets.

“I was hurt when she called me a drug addict and a thief. That was why I called her a prostitute. I won’t go back on my words,’’ he said. The judge, Malam Dahiru Lawal, ruled that Umar be given 80 lashes of the cane after giving the defendant a chance to withdraw his statement.

He said: “The defendant confirmed calling his sister-in-law a prostitute and is not ready to withdraw the statement. Therefore, I, Dahiru Lawal, rule that Shuaibu Umar be given 80 strokes of the cane.

“This is in accordance with the teachings of Prophet Muhammad, which state that one cannot accuse a person of adultery or fornication except one presents four witnesses, who have seen the activity.

“He is to receive 80 strokes of the cane in place of the person he accused because he has defamed the person.’’
