CSU certificate saga: Atiku chasing shadows

    • By Joseph Eshanokpe

A Stalwart of the All Progressives Congress (APC), Chief Livinus Chukwudi Okwara, has said that President Tinubu is eminently qualified to lead Nigeria, given his widely acknowledged administrative acumen, human and other resources management.

He said the hue and cry over the former Lagos governor’s certificate is a mere distraction. Okwara said: “Some analysts have argued that graduates of American universities have the freedom to redesign their certificate to their tastes. Since the Chicago State University (CSU) has affirmed that Tinubu graduated from the university and did not err in redesigning his diploma, what is the hullabaloo all about?

The APC chieftain described the US as a free society, pointing out that Tinubu would overcome his current challenges despite the attempt to degrade him. He said: “Tinubu came from a poor home; he is self-educated; he studied in the US and became a senator and two-term governor of Lagos State, before attaining the highest leadership position in the country.

“He is a good example of a humane, trusted and tested person. Look at his struggle for survival and democracy for Nigeria and Africa in the US, and how he helped many Nigerians to survive there and in the country. He is extremely kind and generous!”

He urged Nigerians to invest in agriculture as advised by Tinubu, adding that Tinubu’s governance records in Lagos in all parameters, including roads, education, housing, security, and other management issues, remain enduring and a reference point to other states and governments across the world.

Okwara said he is delighted by the president’s leadership skill, which has encouraged him to nurse the idea of investing in agriculture on his 400 acres of land in Ogun State. He said Tinubu won the presidential election fair and square and is on track to lead Nigeria to great heights.

He called on his (Tinubu’s) political opponents, including Abubakar Atiku of the Peoples’ Democratic Party (PDP) and Peter Obi of the Labour Party (LP) to join hands with the APC-led administration to move the country forward.

Okwara said he was also encouraged by the ongoing effort of the government to establish community centres, where people from all walks of life could meet and make decisions about their lives and communities.

He warned that any attempt to derail the current government will be resisted.  “They will find us in the streets,” he said.

The APC stalwart warned members of the political class not to tear the country apart because of their inordinate ambition.

He said they are overheating the polity with their emphasis on certificates. He advised Nigerians to tread cautiously on the matter to avoid throwing the country into crisis. He added: “Too much education is a disease. Some people are taking the education issue as an excuse to cause a crisis in the country; leaders in the country should now, more than ever before, be more careful about the criteria that should be adopted to pick our future political leaders.”

Okwara, the proprietor of Rimax Institute of Computer Technology, Meiran, Lagos, said Tinubu had met all the criteria to govern the country. He said: “The purpose of education is to enable you to read and write. Tinubu has met the condition. It is stated in the 1999 Constitution (as amended). So, the issue of certificate forgery being woven around him is a distraction, and should be discarded.”

He called for the promotion of indigenous languages like Yoruba, Igbo, and Hausa-Fulani, saying that some states like Lagos, Zamfara, Kebbi and Kano are already adopting their indigenous languages in schools and legislative chambers together with the English language to conduct their affairs.

He said what Nigeria needs now is sincere leadership; adding that while dissecting Nigeria, the late Chinua Achebe once said that Nigeria’s problem is sincere leadership.

Clear doubts on CSU saga, Obi tells Tinubu

The presidential candidate of the Labour Party in the February 25 general election, Peter Obi has called on President Bola Tinubu to come clean by “telling Nigerians who he is.”

Obi said the recent controversy generated by the Chicago State University was unnecessary.

He said “only president Tinubu can put to rest the controversy surrounding his identity.”

The former Anambra Governor said this during an ongoing press conference on Wednesday in Abuja.

The CSU released Tinubu’s academic record to the Presidential candidate of the People’s Democratic Party, Atiku Abubakar after weeks of legal tussle.

The former vice president on Friday filed the CSU documents as fresh evidence at the Supreme Court.

Atiku and Labour Party’s presidential candidate, Peter Obi, had filed 86 grounds of appeal at the Supreme Court to nullify the Presidential Election Petitions Tribunal’s judgment that affirmed Tinubu’s victory.

Speaking on Wednesday, Obi said the saga had further “dented the image of Nigerians globally.”

Obi said “Nigerians deserved to know the true identity of their president.”

He added: “The president should come clear on his name, age, where he schooled, who he went to school with and others.

Respectfully, I am pleading that this issue be attended to now.”

Atiku, PDP seek Supreme Court’s leave to tender CSU registrar’s deposition

    • To also present other documents in Tinubu’s academic record

The candidate of the Peoples Democratic Party (PDP) in the last presidential election and his party have have asked the Supreme Court for leave to present the deposition made by the Registrar of the Chicago State University (CSU), Caleb Westberg and other documents relating to the academic records of President Bola Tinubu which they obtained from the Chicago State University (CSU).

The request is contained in a motion on notice filed around 7pm on Friday by the team of lawyers for Atiku and the PDP, led by Chris Uche (SAN), in which they seek two main prayers.

They are praying the court for:

*An order granting leave to the appellants/applicants to produce and for the court to receive fresh and or additional evidence by way of deposition on oath from the Chicago State University for use in the appeal, to wit: The certified discovery deposition made by Caleb Westberg on behalf of Chicago State University on October 3, 2023 disclaiming the certificate presented by the 2nd respondent (Bola Ahmed Tinubu) to the Independent National Electoral Commission.

*And upon the leave being granted, an order of this court recieving the said deposition in evidence as exhibit in the resolution of this appeal.

Atiku and the PDP stated among others, that the ground from the motion was that it took them time to obtain the deposition.

They claimed that the documents were relevant to the prosecution of their pending appeal before the apex court.

Atiku and the PDP stated: “One of the grounds of the appellants/applicants’ petition before the court below is that the 2nd respondent was not qualified at the time of the election to contest the election as required by section 137(1)(j) of the Constitution of the Federal Republic of Nigeria 1999 (es amended).

“Based on facts available to the appellants/A

Applicants at the time of filing their petition, the 1st appellant/applicant (Atiku) through his United States of American lawyers, Alexander de Gramont and Angela M. Lin of the law firm of Dechert LLP of 1900 K Sweet, NW, Washington DC 20006-1110, unsuccessfully applied to Chicago State University for the release of copies of the academic records of the 2“Respondent.

“Given the strict privacy laws in the jorisdiction of Chicago State University, the request for the release of the academic records and certificate issued to the 2nd respondent could not be granted without an order of court and for the purpose of use in pending court proceedings.

“The 1st applicant through his said US-based Attomeys thereupon brought an action in the U.S. District Court for the Northern District of Illinois – In re: Application of Atiku Abubakar for an Order Directing Discovery from Chicago State University Case No. 23-CV-05099 for an order for the production of documents and testimony for use in a proceeding in a foreign court, seeking documents and testimony from Chicago State University concerning the authenticity and origin of documents purporting to be the education] records of the 2“ Respondent, Bola A. Tinubu.

“The 2nd respondent applied and was joined in the matter as an Intervenor, vehemently opposing the application.

“On September 19, 2023, the court issued an order granting the application.

“Thereafter, the 2nd respondent applied for an emergency stay of the court order, claiming that he would suffer irreparable damage and injury if his educational records were released; which order of stay was granted.

“On September 30, 2023, the court overruled the 2nd respondent’s objections and ordered Chicago Stste University to produce the documents on October 2, 2023, and to produce a wimess for deposition on October 3, 2023.

“On October 2, 2023, Chicago State University produced the documents pursuant to the court’s order.

“On October 3, 2023, also pursuant to the court’s order, Chicago State University provided a witness to give deposition testimony, in which deposition, Chicago State University disclaimed ownership and authorship ef the document that the 2° Respondent presented to INEC, purporting to be ‘Chicago State University certificate’ and also disclaimed issuing any replacement certificate to him.

“The deposition was not in existence or available at the time of filing the Petition or at the hearing of the Petition.

“The deposition sought to be adduced is, along with its accompanying documents, such as would have important effect in the resolution of this appeal.

“The deposition is relevant to this matter, having confirmed that the certificate presented by the 2nd respondent to the Independent National Electoral Commission (INEC) did not emanate from Chicago State University, and that whoever issued the certificate presented by the 2nd respondent, did not have the authority of the Chicago State University, and that the 2nd respondent never applied for any replacement certificate nor was he issued any replacement certificate by the Chicago State

“The deposition which is on oath and deposed to in the presence of the 2nd respondent’s attorney is credible and believable, and ought to be believed.

“The deposition is clear and unambiguous, and no further evidence is needed to be adduced on it.

“The evidence is such that could not have been obtained with reasonable diligence for use at the trial, as the deposition required the commencement of the suit in the United States of America before receiving same. It was not possible to obtain the said evidence before the trial at the Court below.

“The deposition was made on October 03, 2023 after the conclusion of trial at the court below, and was not available to be tendered at the trial.

“Presentation of a forged certificate to the Independent National Electoral Commission by a candidate for election to the office of President of the Federal Republic of Nigeria ts a weighty constitutional matter, requiring consideration by the Courts as custodians of the Constitution.

“The original certified deposition bas been forwarded to the honourable court by a letter addressed to the Chief Registrar of the Supreme Court.”

  • Conspiratorial coalition shows true colour

    Conspiratorial coalition shows true colour

Halfway into former vice president Atiku Abubakar’s voyage of discovery into President Bola Tinubu’s academic records in the United States, it was all but clear that the expedition was an exercise in futility. The school attended by the president, Chicago State University (CSU), insisted he was their student, and had even finished on the honours list. Disappointed by how unencumbered the real story about the president’s university days was, and miffed by the explosion of all their myths and concocted stories about the records, the coalition of conspirators who had sworn to exposing the president and diminishing his 2023 presidential election victory have embarked on another fruitless journey. This time, apart from trying to damage the president’s personality and destroying his credibility, which they have kept in view, the conspirators have also trained their guns on his supporters or anyone that as much as offers a kind or sympathetic word in his favour.

The spatial distribution of the conspirators, not to say the victims of the social media-led campaign designed to ridicule and stigmatise, should alarm any Nigerian anxious about national stability. The conspirators may be unaware of their regional locus, and perhaps may calm down or desist altogether if they recognise the regional and ethnic implications of their campaigns, but few people can tell exactly how their minds work. The northern opposition to President Tinubu’s victory, with the possible and singular exception of Alhaji Atiku, has been considerably tame or even silent. Despite the social and economic dislocations the president’s economic policies have unleashed, the Southwest has also been largely silent, save for a few netizens and rejected or diminished Yoruba leaders and opinion moulders. Having spent an inordinate amount of time fighting the emergence of the president, the largely Christian Middle Belt, pleasantly shocked by the distribution of appointments, particularly in the security services, have quietened down and moved on.

Disturbingly, as if revealing their real identity and objectives, the coalition of conspirators has unleashed a fusillade on Southwest religious leaders whom they allege have lent support to the president. Deploying social media tools to devastating effect, Charles Oputa, aka, Charly Boy, former Aviation minister Osita Chidoka, DJ Switch, an upstart unknown before EndSARS, and Oby Ezekwesili have pilloried Pastors W.F. Kumuyi and Enoch Adeboye for saying nothing more than that Nigeria would prosper and receive political healing. Mrs Ezekwesili mocked the president over the eventual release of his academic records, wondering whether it would not have been far easier for him to have done it willingly than be coerced by US courts. And because the elections did not favour Labour Party (LP) candidate Peter Obi, and instead President Tinubu was declared winner, she advocated the ‘root and branch reform’ of both the electoral umpire, INEC, and the judiciary.

DJ Switch, whose real name is Obianuju Catherine Udeh, was cynical, rude and irreverent. She said: “Pastor Adeboye constantly urging Nigerians to pray for Nigeria… but rarely calls out the cause of Nigeria’s woes! Rarely calls them out for a failure to serve. The Jesus you worship served and called out corruption point blank! Some of una go say touch not my anointed! Anointing wey no dey anoint.” Her sarcasm was directed at Pastor Adeboye after he called for national healing during an October 1, 2023 service in Lagos. DJ Switch was unmindful of her youth and the age of the cleric she gave a full length of her tongue. In fact, weeks earlier, she had had ridiculed Pastor Adeboye for ‘finding his voice’ when he suggested that God would help President Tinubu fix Nigeria. In July, Charly Boy drew inspiration from the street revolt in France over the police killing of a 17-year-old immigrant to urge Nigerian youths to the streets. As far as he was concerned, Mr Obi’s votes were stolen, and the election was badly flawed and not credible.

Responding to Alhaji Atiku’s success in getting President Tinubu’s records released, and not minding whether what was released was seismic enough to cause any damage or embarrassment, Mr Chidoka weighed in against the president thus: “That all the aforementioned institutions allowed a man to be sworn in without definitive statements about his qualifications is a national tragedy. For 23 years, the issue of President Tinubu has been a recurring decimal in our national equation. Under his reign, a current youth corps member is serving as minister, and people under investigation by the EFCC and made public are sitting in the Federal Executive Council. And they all passed through security screening.” For many like the former minister, every opportunity, real or imagined, strong or weak, had to be seized upon to excoriate the president. It was, therefore, not surprising that the Emmanuel Onwubiko-led Human Rights Writers Association (HURIWA), which lent itself to the services of Mr Obi in the last presidential election, also responded to the released academic records by describing it as a ‘shameful case of identity theft and certificate forgery’, and asking the Supreme Court to disqualify the president or compel him to resign. The organisation offered no credible grounds for their prejudices and conclusions.

Nobel laureate Wole Soyinka is the latest victim of the regional castigators. Presuming to quote Prof James Gibbs, but it was in fact one of the deliberate concoctions with which the Tinubu antagonists have suffused the social media, they allege that the eminent professor falsely claimed to have got a first-class in Literature from the University of Leeds.

He has challenged them. However, the more he challenges them, the more he arms them with some relevance. They will not relent; for they are not motivated by anything noble, true or good. Since the professor took on Mr Obi and his running mate, Datti Baba-Ahmed, describing their electoral views as fantasies and their excoriation of the Supreme Court as a manifestation of fascism, they have continued to assail him. But the country has taken note of all that is happening, the spatial distribution of the anti-Nigerian and antidemocratic views, the effort to incite youths into rebellion and goad the military into subversion, and Nigeria will speak with one voice in the next election cycle.

UPDATED: CSU confirms diploma Tinubu submitted to INEC valid

    • School Registrar expresses readiness to testify

The Chicago State University (CSU) has insisted that the diploma certificate submitted by President Bola Tinubu to the Independent National Electoral Commission (INEC) was valid.

CSU’s Registrar, Caleb Westberg, who stated this, also insisted that Tinubu grated from the institution on June 22, 1979.

According to Westberg, whatever discrepancies that may exist in either date, font, signature or seal in the earlier issued copy of the certificate and the certified copy issued later are immaterial as they could have occured owing to human errors.

The CSU Registrar stated these a seven-paragraph affidavit he swore to before the Circuit Court of Cook County, Illinois.

He said in the U.S., diplomas are considered merely ceremonial documents, even though some other countries may consider more.

Westberg added that, in the U.S., more reliance is placed on transcripts and not on diplomas.”

In the affidavit marked: 2023 L. 006854 expressed his readiness to testify in relation to the fact stated in the affidavit.

The court documents reads: “Caleb Westberg, first being duly sworn, states that if called to testify in this matter, I am over eighteen years of age and could competently testify as to the facts contained herein, and do affirm as follows:

“I am employed as the Registrar of Chicago State University and am authorized to submit this Affidavit on its behalf.

“Bola Ahmed Tinubu graduated and was awarded a degree from Chicago State University on June 22, 1979.

“Chicago State University provided a diploma to Bola Ahmed Tinubu, and subsequently provided a certified (or official) copy of that diploma.

“Both are valid and authentic diplomas of Chicago State University.

“There are certain differences between the diploma and the certified copy because all diplomas are signed by the current President/Board Chair.

“There are also differences in the font and seal on the diploma versus the certified copy because the University updated its font and seal after the diploma was issued.

“The difference in the date of award on the diploma versus the certified copy is likely the result of human error.

“The graduation date on the certified copy is typed in manually by a person and can be inaccurate.

“In the United States of America, institutions of higher education often consider the diploma to be a ceremonial document.

“The official records of Chicago State University reflect and verify that Bola Ahmed Tinubu graduated and was awarded a degree as stated above.”

The presidential candidate of the Peoples Democratic Party (PDP) has claimed, among others, that Tinubu submitted forged diploma certificate to INEC preparatory to the February 25 presidential election.

Atiku subsequently applied to a US court to compel the CSU to produce four categories of documents, including a copy of the certificate he claimed was forged, a request the court granted.

In his deposition made pursuant to to the September 30 order by Justice Justice Nancy Maldonado of the United States District Court of the Northern District of Illinois,  Westberg maintained that the Bola Tinubu that attended and graduated from the CSU is the same, who is now the President of Nigeria.

Westberg’s testimonies are contained in a deposition he made in the office of Angela Liu, Dechert LLP on 35 West Wacker Drive, Suite 3400, Chicago, IL 60601.

Liu is lawyer to former Vice President, Atiku Abubakar, who got an Illinois court to compel the CSU to release to him the academic records of President Tinubu.

The CSU registrar said the admission letter the CSU issued to Tinubu showed clearly that the Tinubu, who attended the school between 1977 and 1979, was a male.

The CSU was represented by Michael Hayes. Five other lawyers from Liu’s firm joined by zoom.

Lawyers Victor P. Henderson and Oluwole Afolabi appeared for Tinubu.

The registrar said: “There were materials in Mr. Tinubu’s records that show that he was a male. I see the application to CSU. Mr. Tinubu identified himself as a male. His letter of admission identified him as a male. It says: ‘Dear Mr. Tinubu’

In the deposition, he said: “We believe Bola Tinubu who attended CSU is the same person who is the president of Nigeria today.”

On why he believes the person who is the president of Nigeria is the same person who attended CSU, the Westberg said: “Tinubu is an unusual name in the US. He matched the Records in the file against the information provided by the student or on behalf of the student.

”We believe Bola Tinubu who attended CSU is the same person who is the president of Nigeria today. The university only has diplomas that students didn’t pick up in its possession.”

On Tinubu’s gender when he enrolled in the school, the registrar explained: “Tinubu applied to the university as a male and a letter of admission was issued to a male.

On why Tinubu requested a diploma and not pick it up or ask that it be sent to him, the registrar said: “You would have to ask him.

“In the U.S., diplomas are considered merely ceremonial documents. In some other countries, it may be considered more.

”In the U.S., more reliance is placed on transcripts and not on Diplomas.”

Insisting that no interaction existed between him and Tinubu’s men, Westberg said: “Mr. Tinubu’s counsel did not prepare any affidavit for me. He didn’t draft anything for me.

“My statement that Mr. Bola Tinubu graduated from CSU was based on the transcripts in our possession.

“I have never met Bola Tinubu. I have never seen him. He did not visit our campus. He does not donate money to the school.”

On the replaced diploma, he said: “When there is a replacement diploma, it is done by outside vendors. I don’t know who created Exhibit # 6.

“The institution decided that my name should not be typed on the ‘To whom it may concern’ letter because of the sheer volume of requests I was getting.

“Before CSU, I was at UC, Berkeley and UC, Irving. I’m sure people make mistakes in data entry from time to time. Before this lawsuit, I didn’t know anyone Bola.

”It was possible that someone assumes Bola to be a female and therefore marked the Southwest transcript as such. I am familiar with the affidavit filed by Olajide Adeniji. I don’t recall his gender.

”I don’t know if Atiku Abubakar is male or female but I heard is a male. I can’t tell by his name. I checked the record and confirmed that Olajide Adeniji and Bola Tinubu were at CSU at the same time.

”The person (Olajide) said he ran in a closely-contested race against Bola Tinubu for the leadership of the Accounting Student Union.

“I see that he said the same person he ran against is now the president of Nigeria.

”The Bola Tinubu who attended Southwest College took Accounting courses. I see the address indicated for Bola Tinubu. It’s not far from CSU.

“I looked at the whole record in making the determination that the Bola Tinubu who is the president of Nigeria today is the same person who attended CSU.

“The entries’1952’ and ‘1954’ could have been made in error. The courses taken by Bola Tinubu at Southwest and CSU are consistent.

“Right after the entry ‘F’, the SSN entered indicated in the Southwest transcript is the same as the one that was indicated in CSU records. That is one of the indicia that we use to identify students. A social security is a unique identifier.

”I recognise Southwest College as a feeder school for CSU. Bola Tinubu graduated with Honours. It’s a GPA distinction. It is awarded to high performing students.

Accounting is a rigorous major. He graduated with Honours.

”As far as I know, he’s the president of Nigeria. There were materials in Mr. Tinubu’s records that show that he was a male. I see the application to CSU. Mr. Tinubu identified himself as a male.

”His letter of admission identified him as a male. It says:

‘Dear Mr. Tinubu’ I see the entry on APC’s website wherein President Bola Tinubu was said to have been born in Lagos on March 29, 1952. I don’t have a copy of the diploma that was submitted to INEC. So, I can’t comment on it.

”I am not aware of the fact that in the form that he submitted to INEC he claimed a different nationality or date of birth.

”Yes, our records show that he was born on March 29th. One has ‘1954’ while the other shows ‘1952’. From time to time, people do make mistakes when making such entries. We know Mr. Tinubu’s Social Security #. It’s contained in his records,” Westberg said.

A United States District Court for the Northern District of Illinois in Chicago has ordered Chicago State University to produce President Bola Tinubu‘s “only all relevant, non-privileged documents”

academic records to People’s Democratic Party’s (PDP) presidential candidate Atiku Abubakar.

In her ruling on Tinubu’s emergency application in case No. 23 CV 05099, Judge Nancy L. Maldonado  directed CSU “to produce all relevant and non-privileged documents in response to Requests for Production Nos. 1 through 4 (as narrowed by Judge Gilbert and adopted here) in Mr. Abubakar’s subpoena, by 12:00 p.m. (noon) CDT, on Monday, October 2, 2023. The Rule 30(b)(6) deposition of CSU’s corporate designee must be completed by 5:00 p.m. CDT on Tuesday, October 3, 2023”.

On September 23, Tinubu appealed against the ruling of Judge Jeffrey T. Gilbert, sitting at the United States’ District Court of Northern Illinois which ordered the Chicago State University (CSU) to release all relevant records pertaining to him to Atiku.

Tinubu pleaded with Judge Nancy Maldonado to block all other details, especially the gender and admission records, among others of the owner of the certificate.

In the judgment on Sunday, Justice Maldonado said: “Given the October 5, 2023, filing deadline before the Supreme Court of Nigeria, the Court will not extend or modify these deadlines.”
