    Ex-Barcelona star Dani Alves wins appeal as court overturns rape conviction

    Former Brazil and Barcelona Dani Alves defender has won his appeal against a sexual assault conviction as a Spanish court overturned the ruling on Friday.

    The 40-year-old former right-back was found guilty in February 2024 of assaulting a woman in a Barcelona nightclub on New Year’s Eve in 2022 and was sentenced to four years, six months in prison. He denied wrongdoing during the three-day trial.

    He was released from prison in March 2024 while waiting for his appeal to be heard by a higher court.

    That court ruled on Friday that there was “insufficient evidence” to rule out Alves’ presumption of innocence.

    Alves won dozens of titles with elite clubs including Barcelona, Juventus and Paris Saint-Germain.

    He also helped Brazil win two Copa Americas and an Olympic gold medal at the age of 38. He played at his third World Cup, the only major title he has not won, in 2022.

    He was with Mexican club Pumas when he was arrested. Pumas terminated his contract immediately.

    The Alves case was the first high-profile sex crime since Spain overhauled its legislation in 2022 to make consent, or the lack thereof, central to defining a sex crime in response to an upswell of protests after a gang-rape case during the San Fermin bull-running festival in Pamplona in 2016.

    Convicted rapist Alves gets conditional bail  

    Former Brazil international Dani Alves is to be released from jail pending an appeal against his rape conviction in a one-million-euro bail agreement denounced by the victim’s lawyer as “justice for the rich”.

    The ruling came a day after his lawyer requested the 40-year-old’s release on grounds he had already served a quarter of his four-and-a-half-year sentence in pre-trial detention following his arrest in January 2023.

    In its ruling, the Barcelona court granted him “provisional release” in exchange for “the bail payment of 1,000,000 euros” ($1.08 million) also requiring he hand over his Spanish and Brazilian passports, remain in Spain and present himself to court “on a weekly basis”.

    But the decision drew a furious response from the lawyer of the young woman who was raped by Alves at a Barcelona nightclub in December 2022.

     “I’m very surprised and totally outraged… because it’s like this is justice for the rich,” Ester Garcia told RAC1 radio in the north-eastern Catalonia region and pledging to appeal on grounds it was “not in line with the law”.

     “It is scandalous that they can free a person who they know can get hold of a million euros in a heartbeat,” she said.

    One of the world’s most decorated footballers who played for Barcelona and Paris Saint-Germain, Alves was convicted last month of raping the young woman in the VIP bathroom of Sutton nightclub in the early hours of December 31, 2022.

    His lawyers swiftly appealed the conviction.

    The court’s decision on Wednesday also bars him from “coming within 1,000 metres (yards) of the plaintiff, her home, her workplace and whatever other place that she is, as well as making any attempt to communicate with her”.

    The decision was also swiftly denounced by the radical left-wing Sumar alliance, which is part of Prime Minister Pedro Sanchez’s leftist coalition.

     “Dani Alves can wait at home for his definitive sentencing for RAPE because he has a million euros. The justice system is patriarchal and classist. Enough is enough,” the party wrote on its X account.

    Since his arrest 14 months ago, Alves’ legal team has repeatedly asked for his release on bail but the request was always rejected by the court on grounds he was a flight risk.

    At Tuesday’s hearing, Alves – who spoke by videoconference from prison – promised the judges he would not flee, with public prosecutors again opposing the request on grounds he posed a high flight risk.

    Brazil does not extradite its citizens when they are sentenced in other countries.

    The victim, who testified behind a screen to protect her identity, said Alves had violently forced her to have sex in a private bathroom of the nightclub despite begging him to let her go, causing her “anguish and terror”, prosecutors said.

    Alves’ lawyers had argued the victim had been “glued” to the player while dancing at the nightclub, saying there was “sexual tension” between them.

    But in its 61-page decision, the court said that did not mean “that she consented to anything that might have subsequently happened”.

    Dani Alves once said he would “play until I’m 50” if someone threatened his record of trophies won, but his career was brought to a halt in January 2023, when UNAM of Mexico released him after the Brazilian was charged with rape.

    He was found guilty of raping a young woman at a Barcelona nightclub in December 2022 and  has sentenced to four and a half years in prison by a Spanish court.

    Between his debut for Esporte Clube Bahia in Brazil aged 18 in 2001 and his last game for the Pumas in January 2023 aged 39, Alves played almost 1,000 competitive games for club and country, accumulating trophies.

     “I have the greatest list of honours in the history of soccer, with 43 titles. If someone overtakes me, I’ll play until I’m 50,” he said in June 2022.

    His clubs included Barcelona, Juventus and Paris Saint-Germain. They coveted Alves because he was, for a long time, one of the best full-backs in the world.

    “You have to leave egos aside because if you let them emerge, you stop thinking about being happy,” he told AFP. “In life, you don’t need to be right, you need to be happy. And I’m very happy!”

    He came from a poor family in Juazeiro in Bahia State. At the age of ten, he got up at five in the morning with his brother to help his father in the fields, before heading to school.

    He made his debut for his local club but was immediately spotted by Sevilla and moved to Spain in 2002.

    He spent six seasons with Sevilla, where he won two UEFA Cups, a Copa del Rey and a UEFA Super Cup. Barcelona then bought Alves for 35 million euros.

    In his eight-season first spell at Barcelona between 2008 and 2016, Alves won 23 trophies: three Champions Leagues, three Club World Cups, six La Liga titles and four Copas del Rey as well as various Super Cups.

    In 2016, he left Barcelona as a free agent for Juventus where he stayed one season, enough time to add a Serie A title and an Italian Cup to his collection and also reach another Champions final, a defeat to old enemy Real Madrid.

     “Dani is a crazy, sunny guy who lives his life at 300 miles an hour, always with a smile on his face,” said his Juve team-mate Giorgio Chiellini.

    He moved to Paris Saint-Germain in 2017, again as a free agent, to help his old Barcelona team-mate and fellow Brazilian Neymar carry the club to the Champions League.

    The mission failed and Alves was limited by injuries. But he still won Ligue 1 titles in both his seasons in Paris, a city he did not enjoy.

     “Paris is a stressful city, I don’t like it very much,” he told GQ Brazil, adding that he did not like the “racists” in France.

    He did not back down from racists but also fought back with humour.

    In 2014, when he was about to take a corner kick for Barcelona at Villarreal, a banana flew from the crowd. He picked it up, peeled it and ate it before taking the corner as if nothing had happened.

    In 2019, Alves returned to Brazil and won the Paulista championship with Sao Paulo.

    He returned for a second, brief, spell with Barcelona.

    “Today, it’s time to say goodbye,” he wrote on Instagram on in June 2022 when he left Barcelona for Mexico, evoking “more than eight years dedicated to this club, these colours, this house…”

    He made his debut for Brazil in October 2006 and won the last of his 126 caps off the bench against South Korea in the last 16 at the 2022 World Cup in Qatar. He was an unused substitute as Brazil lost on penalties to Croatia in the last eight.

    The World Cup was the one trophy that eluded him. He lost a quarter-final in 2010 and a semi-final in 2014 but missed 2018 with a knee injury.

    He won two Copa Americas, the second replacing Neymar as captain in 2019 and, at 38, led Brazil to Olympic gold in Tokyo in 2021.

    It was his last trophy.

    After his arrest his wife, Joana Sanz, broke up with him, posting a letter on Instagram saying: “I love him and always will” but “It’s so hard for me to accept that this person could break me into a thousand pieces.”

    A court in Spain has found former Barcelona and Brazil footballer Dani Alves guilty of raping a woman in a Barcelona nightclub.

    He has been sentenced to four and a half years in prison.

    The 40-year-old, who is one of the most decorated footballers in history, had denied sexually assaulting the woman in the early hours of 31 December 2022.

    His lawyer had asked for him to be acquitted and Alves can appeal against the sentence.

    Alves had been accused of luring the woman to a toilet in a VIP section of the nightclub and had argued that she could have left “if she wanted to”. However, the court found that she did not consent.

    In a statement, the court said there was evidence other than the victim’s testimony that proved that she had been raped.

    It also ordered him to pay €150,000 (£128,500) to the victim.

    Alves has been held in pre-trial detention since January 2023 and during the course of this month’s trial he has changed his testimony on a number of occasions.

    He first denied knowing his accuser only to later claim he had met her in the toilet but that nothing had happened between them.

    He then changed his version of events again, saying that they had had consensual sex. “We were both enjoying ourselves,” he alleged.

    Prosecutors said Alves and his friend had bought champagne for three young women before asking one of them to accompany him to another area with a toilet which she had no knowledge of.

    At that point they argued he turned violent, forcing the woman to have sex despite her repeated requests to leave.

    Alves played more than 400 times for Barcelona, winning six league titles and three Champions Leagues across two spells with the club. He was also part of Brazil’s 2022 World Cup squad.

    The prosecution had asked for a nine-year prison sentence. In Spain, a claim of rape is investigated under the general accusation of sexual assault, and convictions can lead to prison sentences of four to 15 years.

    The law was changed recently to enshrine the importance of consent under the so-called “Only Yes is Yes” principle.

    Dani Alves’s rape trial begins in Spain

    Former Barcelona and Brazil football player Dani Alves has gone on trial in Spain accused of raping a woman in a nightclub.

    The 40-year-old has been in prison without bail for more than a year since the alleged incident took place in December 2022.

    Mr Alves could face up 12 years in prison if found guilty.

    He first denied having met his accuser, but later said they had had consensual sex. His trial ends  tomorrow.

    More than 30 people, including Dani Alves and his estranged wife, are expected to testify.

    The Barcelona court yesterday  denied his request to suspend the trial so that he could be given more time to prepare – rejecting his claim that he had suffered a trial by media.

    Mr Alves’s accuser was among those to give evidence on the first day of the trial – speaking from behind a screen to protect her identity.

    She alleges he lured her into a toilet in the VIP section of a nightclub in Barcelona, and then forced her to have sex with him.

    The woman’s cousin and a friend, who were both with her on the night of the alleged assault, also testified . They said that Mr Alves had groped and flirted with them earlier in the evening.

    They also said the woman had initially been unwilling to make a complaint because she feared she would not be believed.

    In Spain, a claim of rape is investigated under the general accusation of sexual assault, and convictions can lead to prison sentences of four to 15 years.

    The public prosecutor in the case is seeking a nine-year jail term for Mr Alves, and for him to pay damages of €150,000 (£128,000) to the woman.

    His mother, Lucia Alves – who was at the court yesterday  alongside her son – could face prosecution herself after she named her son’s accuser in a social media post before the trial.

    That was after a court had ruled that the woman could not be identified for her protection.

    Mr Alves was formally charged in August and a court later decided that there was enough evidence to send him to trial.

    Repeated requests for him to be released on bail have been denied because the courts considered the Brazilian national a flight risk.

    Dani Alves is one of the most decorated footballers in history and has played for a host of top clubs including Barcelona and Paris Saint Germain.

    He made more than 400 appearances for Barcelona, winning six league titles and three Champions Leagues across two spells, and was also part of Brazil’s 2022 World Cup squad.

    His most recent club, Mexican side Pumas UNAM, terminated the Brazilian’s contract with immediate effect in January 2023.

    Paris Saint-Germain’s Dani Alves has urged teammate Neymar to display more self-control after his altercation with a fan following last weekend’s Coupe de France final penalty loss to Rennes.

    Alves and Neymar featured as PSG lost again on Tuesday, this time 3-2 away to Montpellier in Ligue 1 with the former admitted that he was unable to defend Neymar’s recent behaviour.

    “It was a delicate moment,” he said. “We had just lost a title and he was hot-headed.

    “It was a reaction and one that I think was not right in that moment. You cannot get involved in this sort of thing. You have to show more control.

    “I believe that you have to make mistakes to improve. Not necessarily like this, but this mistake will cause him to reflect a bit. Neymar is an exceptional guy, but he can be a bit rash at times.

    “This sort of reaction, no matter how friendly we are, I cannot be in favour of it. I believe that he has learned, and I hope that it will not happen again.”

    PSG led twice in Montpellier but were pegged back and ultimately lost to a late Souleymane Camara goal.

    Neymar played the full 90 minutes but was unable to prevent his team from going down to their third Ligue 1 defeat in their last four matches.

    Marquinhos, who captained the side in Thiago Silva’s absence, believes that Neymar knows he made a mistake at Stade de France last Saturday.

    “I think that Neymar knows that he made a mistake,” he said. “When you attack somebody, it is a mistake. He is not a boy anymore — he knows when he is in the wrong.

    “It will serve as a lesson for him. We already know that things with Neymar are amplified — he is used to that. Mistakes happen and are there to be learned from.”

    PSG have four Ligue 1 matches left before the end of what will be their least successful season since the 2011-12 campaign — the maiden term under Qatari ownership.

    Paris St German’s experienced Brazil international defender Dani Alves said on Thursday that the club should follow his recommendations to improve in the Champions League.

    With three Champions League crowns, three Club World Cup titles and two UEFA Cup triumphs among his trophy haul the full back is the world’s most decorated active player.

    The experienced Brazilian however feels his voice is not being heard at runaway Ligue 1 leaders PSG.

    PSG have been knocked out of the Champions League in the last 16 for three years in a row, going out on away goals against Manchester United this season after winning the first leg 2-0 at Old Trafford.

    “I know how to win,” the 35-year-old, who joined PSG in 2017 from Juventus and has been negotiating a contract extension for next season, told RMC Sport.

    “When I want to say something I would like to be followed. Not because I’m better than any other but because I’ve been there.

    “When someone has been there maybe it’s good to listen to them, to rely on their experience.

    “Maybe it will work, maybe it won’t. I would like that when I say something, one would listen more.”

    Alves, who spent six years at Sevilla and eight at Barcelona before moving to Italy in 2016, felt PSG should have been less complacent and more aware that history was against them.

    “When you are up against a historical opponent in football, boxing, tennis, history will always be against you,” he said.

    PSG are on the brink of an eighth Ligue 1 title, which they can clinch on Sunday by avoiding defeat at second-placed Lille.

    The Brazilian Football Confederation (CBF) said on Friday that Paris St Germain defender, Dani Alves, would miss the 2018 FIFA World Cup in Russia due to a knee injury.

    Alves limped off near the end of Tuesday’s French Cup Final win over third-tier Les Herbiers, Reuters reported.

    The Brazilian team doctor, Rodrigo Lasmar, flew to Paris to examine the player and decided surgery was necessary after diagnosing an injury to his right anterior cruciate ligament.

    “It is clear that Daniel Alves’ call-up for the period of preparation, friendlies and consequently the World Cup, is impossible,” the CBF said in a statement.

    Brazil play warm-up matches against Croatia on June 3 and Austria on June 10, before kicking off its World Cup campaign on June 17 against Switzerland.

    The five-time world champions will also play Costa Rica and Serbia in the tournament group E.

    The 35-year-old Alves has over 100 caps and is one of the squad’s most experienced players.

    Dani Alves has apologised to Pep Guardiola and Manchester City for sensationally snubbing the Premier League club, but claims he has joined Paris Saint-Germain “to be a champion”.

    Alves had been expected to link up with his former Barcelona coach Guardiola at the Eithad Stadium after securing an early release from his Juventus contract.

    Instead, the 34-year-old was presented in the French capital on Wednesday, having opted to join PSG, who finished second behind Monaco in Ligue 1 last season and lost 6-5 to Barca in a thrilling Champions League round-of-16 tie.

    “If Pep Guardiola and Manchester City feel hurt, I am sorry… I have come here to be a champion,” Alves told a news conference.

    Alves also risked incurring the wrath of his former team, claiming “ambition” and “organisation” was the major difference between PSG and Juve.

    He added: “I’ve had the pleasure of winning the Champions League three times and I want to bring my experience here.”

    Alves revealed that former Barca and Brazil team-mate Maxwell, who left Camp Nou for PSG in 2012 before retiring at the end of last season, played a role in encouraging the move.

    “I thank Maxwell for convincing me to come to Paris,” he said.

    “I am ready to give my all.

    “There’s a very interesting project in Paris. I have friends here, I’m a man who loves challenges.

    “The work that the club has been doing over the past several years is very encouraging. It’s an ambitious team.

    “The [PSG] president [Nasser Al-Khelaifi] had a great power of persuasion. I like to make history. We can write it together here. Our goal is to win the Champions League.

    “I want to constantly open new horizons. I’m young in spirit. As long as it stays young, I’ll continue to fight.

    Paris Saint-Germain are holding a news conference on Wednesday where it is expected they will announce they have signed Dani Alves.

    The 34-year-old Brazilian is a free agent after leaving Juventus just a year after he joined the Serie A champions.

    The right-back had been in talks to join Manchester City and we understand the Etihad side will now re-double their efforts to sign Tottenham’s Kyle Walker.

    City need to sign full-backs this summer after Pep Guardiola decided not to renew the contracts of Pablo Zabaleta, Bacary Sagna and Gael Clichy.

    Alves moved to Italy on a free transfer from Barcelona last summer.

    He won the double in Italy last season and he helped Juventus reach the final of the Champions League where they lost 4-1 to Real Madrid.
