    Court dethrones Ekiti monarch over ‘illegal’ selection

    AN Ekiti State High Court, sitting in Ikole-Ekiti, has dethroned the Owa of Odo Ayedun, Oba Ilesanmi Ajibade, who was enthroned in 2010 despite the pendency of a suit challenging his nomination.

    Justice Abiodun Adesodun, in the judgment, approved the nomination of his challenger, Adekunle Adeniyi, as the Owa-elect.

    He granted a restraining order against the kingmakers and warrant chiefs from disturbing the claimant’s nomination.

    He ruled that Ajibade’s selection on January 29, 2010, when the case was still pending and his approval five days later, on February 5, 2010, violated Section 132 of the Chiefs Law, which stipulated a time frame of 21 days.

    Justice Adesodun held: “It is my humble opinion that conducting the selection process on the 29/1/10 during the pendency of this case by the defendants was in contempt of this court. They cannot now approach the court for redress without purging themselves of the contempt.

    “The whole exercise, that is the appointment of warrant chiefs, the second nomination exercise of January 29, 2010 and the appointment of the 15th defendant, from the circumstances of this case and the evidence on record is nothing short of an exercise in futility.

    “Come to think of it, the 15th defendant was purportedly appointed or elected Owa-elect on January 29, 2010 and his appointment was approved February 3, 2010, five days after the election contrary to section 13(2) of the Chief Law which stipulated mandatory 21 days. Why the hurry in this case?”

    Justice Adesodun added that the claimant has been able to establish his case based on the pleadings and the totality of evidence before the court to give him reliefs sought.

    “It is hereby declared that the selection of the claimant to fill the vacant stool of Owa of Odo Ayedun is valid and legal. It is equally declared that the notice of intention to set aside the nomination of the claimant to the vacant stool of Owa of Odo Ayedun is illegal, null and void.

    “I also grant an order directing the 10th defendant to approve the nomination of the claimant as the Owa of Odo Ayedun. I also declared that the nomination of the 11th -14th defendants as warrant chiefs is null and void.

    “I also grant a perpetual injunction restraining the defendants, their agents, servants, privies or any other person from appointing warrant chiefs or taking any further step to disturb the nomination of the Claimant as Owa of Odo Ayedun.

    “On the whole, the claimant’s action succeeds” Justice Adesodun declared.

    Lagos High Court yesterday dethroned Oba Michael Gbadebo Onakoya as the Orijeru of Igboye in Epe Local Government Area.

    Justice Iyabo Kasali delivering judgement in a suit filed by representatives of Ewade Ruling House against his nomination, Justice Iyabo Kasali held that he is not from the ruling house and as such could not be nominated on its platform.

    In 2008, Justice Habib Abiru?, who is now in the Court of Appeal, in his judgement in a suit filed by representatives of Erelu and Osikadewa Ruling Houses, dethroned the monarch.

    In the 105-minute verdict, the judge granted “an order of perpetual injunction restraining? the second defendant from parading himself as a member of Ewade Ruling House of the said Igboye or presenting himself for the stool of Orijeru of Igboye on the platform of Ewade Ruling House”.

    The judge also gave an order of perpetual injunction restraining all the other defendants (Onakoya) from recognising the second defendant as a member of Ewade Ruling House of Igboye”.

    The claimants in the suit are Alhaji M.A. Quadri, Chief Dauda Kadiri and Mrs. Oladipe Otunowo for themselves and as representatives of Osekelu branch of Ewade Ruling House.

    Others are Chief Gbenro Otunowo, Mr. Yemisi Adegboyega and Mrs. Adeleke Ogunnubi, for themselves and as representatives of Okuyemi/Okuboyejo branch of Ewade Ruling House.

    Beside Onakoya, the other defendants in the case are Head of the Ewade Ruling House, Otunba Abdulwasiu Musa-Adebamowo?, Lagos State Government and Attorney-General of Lagos State.

    Justice Kasali dismissed the 35-point averrments of the second defendant contained in his amended statement of defence and counter-claims filed through his counsel, Babatunde Oshilaja.

    Justice Kasali described as fraudulent, the documents  Onakoya used for his nomination, selection and recognition by government.

    The claimants, she said, were not aware of nor participated in the meetings purportedly held by the Ewade Ruling House in August, 1991, which culminated in his unlawful nomination.

    Justice Kasali held that the claimants have locus standi to institute the action, adding that there “is overwhelming evidence that the second defendant is not a member of the Ewade Ruling House but from the Erelu Ruling House.”

    Akwa Utd spokesperson, Uwem Ekoh says the victory over defending champions, Heartland has seen the Uyo team become favourites to claim the Federations Cup ultimate price in Lagos.

    “I see Akwa Utd victory as the beginning of new things in the club, for us to qualify to semi finals, nothing will stop us from lifting the 2013 Federation Cup.

    “We have a team that can represent this country very well in any international competition, our boys put up their best to defeat the defending champion, Heartland coming behind to equalised 1-1 in such a game, it meant we are good.

    “Aside us been good, we are now the giant-killers of the 2013 edition as we eliminated two Oriental Derby teams of Rangers and Heartland.

    “I want to commend the Kaduna State Referees Council for selecting competent match officials for the match. They did not compromised standard as the officiating was 50/50, no home advantage or pressure on either side.

    “This is what is missing in the league, though there is room for improvement in that area, however Akwa Utd to good for the trophy.”

    The Court of Appeal sitting in Akure, the Ondo State capital, yesterday deposed the Zaki of Arigidi-Akoko, Oba Yisa Olanipekun.

    The court set aside the state government’s approval of Olanipekun’s appointment and told him to stop parading himself as the Zaki.

    Ruling on Olanipekun’s appeal against the State High Court’s order to vacate the seat, the Appeal Court said the government’s approval was erroneous.

    The Appeal panel judges – Justices Kudirat Kekere-Ekun, Cordelia Jombo-Ofo and Abubakar Gumel – said the lower court, on November 3, 2008, ordered parties in the suit to stay action on the matter, but the government went ahead on November 5, 2008, to approve Olanipekun’s selection.

    They said the injunction granted by the lower court did not affect the action taken by the kingmakers on October 28, 2008.

    Two princes, Tunde Olanipekun and Alfred Oloruntola, filed a suit against Salawu Olanipekun and Yisa Olanipekun challenging the Zaki of Arigidi Chieftaincy Declaration of 1989.

    The Appeal Court ordered that the substantive suit be returned to the State High Court and should be handled by another judge besides Justice Kumuyi.
