Pollution: Diri demands reparation, environmental cleanup

Bayelsa Governor Douye Diri yesterday accompanied political and traditional leaders in the state to meet with President Bola Ahmed Tinubu at the State House, Abuja.

Their mission was to demand for reparation over oil exploration and the clean-up of their environment.

Diri told State House reporters after the meeting that reparations and an extensive environmental cleanup will address decades of ecological devastation caused by crude oil in the state.

The governor highlighted the severe environmental and health crises facing his state due to unchecked oil activities.

The Bayelsa leaders said they were paying a thank you visit on the President for the appointment of one of their daughters, Mrs. Didi Lawson-Jack, as the Head of the Civil Service of the Federation, among other important appointments from the state.

Governor Diri, who presented the Bayelsa State Oil and Environment Commission Report to President Tinubu during the meeting, pointed to the extensive damage in the state’s rivers and rural areas, where oil pollution has permeated the waterways, damaging the ecosystems and local economies.

The governor also raised concerns over the alarming rise in cancer cases and other unusual illnesses among Bayelsa’s residents, linking these health crises to prolonged oil pollution.

The report he referenced traces these health issues directly to the oil industry’s operations, underscoring the urgent need for a comprehensive response.

He stressed that the livelihoods of Bayelsa residents, many of whom rely on fishing and farming, have been devastated by widespread pollution.

Diri urged the federal government to prioritise environmental restoration, similar to ongoing efforts in Ogoniland through the Hydrocarbon Pollution Remediation Project (HYPREP).

Diri noted that oil companies must assume responsibility for the damage, regardless of whether it was caused by equipment failure or acts of sabotage, pointing out that international laws hold companies accountable for pollution resulting from their facilities and equipment.

He said: “Well, the report is there. If you’re asking for the recommendations, they are not just one. They are not two. But what is more important there is the issue of our environment and in that recommendation, they are talking about the clean-up, you know about the Ogoni situation, and HYPREP, and our environment is totally gone.

“If you go into the rivers and the rooflets of Bayelsa state, you will be perceiving oil, economic activities of our people have been grounded, and up until today, you still have oil pollution all over the state.

“So, the number one thing is, first of all, restore the environment, clean up the environment, and of course, you have to pay reparations, and those who have caused these damage, most times they say, Oh, it is as a result of sabotage.

“But international law doesn’t recognize sabotage. You own those facilities and equipment, whether the oil spillages were as a result of sabotage or ageing equipment, which is most times the case, equipment failures, reparations have to be paid.

“As I speak with you today, issues about cancer are now almost like a normal thing in Bayelsa state, and this report has traced it to the activities of the oil companies, oil exploration and all other types of very bizarre types of sicknesses that were not hitherto known to the people of Bayelsa.”

Bayelsa has reasons to be thankful – Diri

Bayelsa Governor Douye Diri has said citizens of the State have numerous reasons to be thankful to God Almighty despite its challenges and that of the country.

Speaking at the Ecumenical Centre at Igbogene, Yenagoa, during the 13th Bayelsa State Thanksgiving, Diri said November 2 was enshrined in the laws of the state as a day of memorial beginning from 2012 under the immediate past administration of Senator Seriake Dickson.

He, however, noted the gathering was not as a result of legal obligation but out of profound gratitude to God for his goodness to the state.

He said the 13th edition was special after God granted him and his deputy victory in the last governorship election and throughout the legal battles.

Diri thanked people of the State for standing by him and his deputy, saying without them his administration would not have recorded the successes so far achieved.

He expressed gratitude to God that this year’s flood was not as devastating in the state as predicted after what was experienced in 2022.

He also said that another reason to be thankful was the peace and security in Bayelsa and appreciated the support of service commanders working closely with the government to maintain the peace.

On the issue of electricity that had been cut off in the State for three months due to the activities of vandals, the Bayelsa helmsman explained that though the transmission infrastructure were the property of the Federal Government, Bayelsans were the ones feeling brunt and his administration had to step in with funds the address the situation, assuring that power would be restored soon.

He stated that the darkness had to propel the government to hasten its independent power plant project, which will soon come to fruition.

Delivering a sermon, the General Overseer of Royal House of Grace, Apostle David Zilly-Aggrey, expressed gratitude to God for using the late Head of State, General Sani Abacha, to create the state, saying that was the foundation for the development and happiness of all Bayelsans.

He described thanksgiving as a necessity for humans, saying everything must not be perfect before God is appreciated.

Thugs attack SDP’s Ajaka as Supreme Court upholds Ododo, Diri, Uzodinma elections

Pandemonium broke out yesterday on the premises of the Supreme Court Abuja soon after the apex court upheld the November 11 2023 election of Ahmed Ododo as Kogi State governor.

Suspected thugs rushed at Yakubu Muritala Ajaka ,the  petitioner/appellant in the case against Ododo, booing and throwing objects at him.

The Supreme Court also upheld two other governorship elections yesterday:those of Duoye Diri of Bayelsa State and Hope Uzodinma of Imo State.

Diri described his victory at  the Supreme Court  as the triumph of truth over falsehood and evil while Uzodinma dedicated his own judgement to the people of the state.

Ajaka, whose petition against Ododo had earlier suffered dismissal at the tribunal and the Appeal Court, was at the Supreme Court yesterday to hear the final judgement which did not go as he expected.

He was met outside the courtroom by scores of thugs who sought to assault him.

He was, however, hurriedly surrounded by his own supporters and aides who hurried him into his SUV which zoomed out of the premises.

But Ododo’s party, the All Progressives Congress (APC) in Kogi State said it was SDP supporters that launched violent attacks on its own (APC’s) supporters.

Kingsley Fanwo, Director, Media and Publicity of the State APC  condemned the attack on APC supporters ,saying “the attacks reportedly began when supporters of the Social Democratic Party (SDP) started hurling stones, bottles, and plastic containers at APC supporters and leaders immediately after the Supreme Court delivered its judgment affirming Governor Usman Ododo as the duly elected governor of Kogi State.”

He added: “During the ruling, the court had advised all parties and their supporters present in the courtroom to remain seated until all matters before it were fully addressed. However, the SDP candidate, Murtala Ajaka, ignored this advice and left the courtroom with his supporters as soon as the judgment was pronounced against him.

“Upon noticing the jubilant APC members within the court premises, Ajaka’s supporters allegedly unleashed violence, attacking the celebrating APC members and causing significant disruption.

“The APC in Kogi State has condemned these actions, describing them as undemocratic and uncivilised.”

In all, the Supreme Court delivered six judgements yesterday.

All the cases sought to void the Diri, Ododo and Uzodinma’s elections.

The first judgment was on the appeal, marked: SC/CV/648/2024 by Timipre Sylva and the APC in which they prayed the court to among others, set aside the judgment of the Court of Appeal, which had affirmed the judgment of the election tribunal, upholding Diri’s victory.

The apex court’s five-member panel was unanimous in affirming the Court of Appeal’s ruling  that Sylva was wrong to have filed multiple notices of appeal against a single judgment of the election petition tribunal.

Justice Mohammed Lawal Garba, in the lead judgment held that it was wrong for Sylva and his party to file more than one notices of appeal against the single final judgment of the election tribunal.

Other members of the panel – Justice Ibrahim Saulawa, Tijani Abubakar, Sadiq Umar and Mohammed Idris – agreed with the lead judgment.

As agreed by lawyers to parties when the appeal was heard on August 19, the judgment in the appeal marked: SC/CV/648/2024  was applied to  the other four appeals which arose from the same judgment given by the election tribunal in the petition filed by Sylva and the APC.

The other four are marked: SC/CV/650/2024, SC/CV/650A/2024, SC/CV/650B/2024 and SC/CV/650C/2024.

In the second judgment, the apex court dismissed the appeal by the National Rescue Movement (NRM) and its candidate in the last governorship election in Bayelsa State, Micah Akeems.

The  court held that the appeal was without merit because the case was based on a pre-election issue of alleged supply of false information.

The court affirmed the earlier judgment of the Court of Appeal that the sole issue on which Governor Diri’s reelection was challenged by the appellants was a pre-election issue on which the election tribunal has no jurisdiction.

Justice Garba also authored and read the lead judgment in the appeal.

The NRM and Akeems had claimed that the Bayelsa State Deputy Governor, Lawrence Ewhrudjakpo submitted forged National Youth Service Corps (NYSC) certificate to the Independent National Electoral Commission (INEC) in his form 001 and EC9.

In the third judgment, Kogi: Supreme Court dismissed the appeal by the Action Alliance (AA) and its candidate in the November 11, 2023 governorship election in Kogi State, Olayinka Baimoh, seeking to void the victory of  Ododo in the election.

The court was unanimous in holding that the appeal, marked: SC/CV/653/2024, was incompetent, the notice of appeal having been filed outside the 14 days allowed by law for the filing of such notice.

Justice Sadiq Umar, who read the lead judgment, held that since the preliminary objection filed against the competence of the appeal was meritorious, it was of no use for the court to consider other issues raised in the appeal.

He proceeded to dismiss the appeal and awarded a cost of N5million against the appellants and in favour of the respondents.

In the fourth judgment, the apex court unanimously dismissed the appeal by the SDP and  its candidate Yakubu Ajaka, marked: SC/CV/654/2024,saying it  was without merit.

Justice Sadiq Umar, who authored and read the lead judgment resolved all the three issues identified for determination in the appeal against the appellants.

In the fifth judgment, the Supreme Court affirmed the reelection of Governor Uzodinma,  dismissed the appeal by the Labour Party (LP) and its candidate, Athan Achonu for being unmeritorious.

Justice Mohammed Baba Idris, who authored and read the lead judgment, resolved the three issues identified for determination against the appellants.

Justice Idris found that the appellants as petitioners at the election tribunal, failed to prove their case as required.

He proceeded to affirm the judgment of the Court of Appeal, which upheld the decision of the election tribunal, dismissing the appellants’ petition.

The apex court, in the sixth judgment, dismissed the appeal of the PDP and its candidate in the last governorship election in Imo State, Samuel Anyawu.

In a unanimous judgment, a five-member panel of the court held that the appeal was without merit.

Justice Idris, in the lead judgment, resolved all the issues raised for determination in the appeal against the appellants.

I rededicate myself to the service of Imo people, says Uzodimma

Reacting to the judgement yesterday, Governor Uzodimma expressed gratitude to God for granting him another victory, and to the Supreme Court, for upholding the law despite the barrage of blackmail and intimidation by enemies of democracy.

Governor Uzodimma said when the people of Imo  overwhelmingly reelected him last year “it was simply based on my sterling performance, which remains unprecedented in the modern history of the state.

“During my second tenure inauguration,  I pledged to serve them with renewed vigour, with honesty and transparency and accountability and with the fear of God.

“Today, with this Supreme Court victory, which I dedicate to all Imo people, irrespective of political or religious affiliation,  I rededicate myself to the service of the good people of Imo State.”

He asked his opponents in the election   to join him  in “the task of reinventing Imo to the state of our shared dreams.”

He said his  doors would  “continue to remain open to all Imo people genuinely committed to the betterment of our society.”

It’s  triumph of truth, says Diri

Governor Diri said the ruling  was not for him or his deputy alone but also for people of the state whose  choice was validated by the courts.

Governor Diri said his administration had started well and would  consolidate on the gains so far made and even introduce new programmes and policies that will benefit the people.

He said:“From the election and the tribunal to the Supreme Court, we won four-zero. This is the triumph of truth over falsehood and evil. There is hope for democracy in Nigeria.”

I am sad but we move forward,  Adebayo

The presidential candidate of the SDP in the 2023 general election, Prince Adewole Adebayo, said he was saddened by the apex court pronouncement on the Kogi election.

PDP kicks over verdicts on  Kogi, Imo

The Peoples Democratic Party (PDP) expressed joy over the   judgement affirming  the electoral victory of Gov Diri  but faulted  those on Kogi and Imo.

It described the verdict on Bayelsa State as  another victory for democracy, rule of law and the expressed will of the people of Bayelsa State in their quest for good governance and development on the platform of the PDP,” but said the decision to uphold the governorship elections in Imo and Kogi states “despite confirmed reports and evidence that the elections were heavily flawed and blatantly compromised, marred by widespread violence and manipulations by the All Progressives Congress (APC) in connivance with certain unscrupulous officials of the Independent National Electoral Commission (INEC)” further underscored a very serious challenge created by the blemished operation and violation of the provisions of the Electoral Act, 2022 and Electoral Guidelines by INEC,.

Party spokesman, Debo Ologunagba, said the verdicts “further justify PDP’s demand for the comprehensive review of the Electoral Law, especially its aspects concerning the declaration of results of election without due regard to issues and complaints arising from obvious violation of the provisions of the law and electoral processes.”

Diri visits Commonwealth, seeks remediation for polluted oil communities

Bayelsa State Governor Douye Diri has again taken his campaign for environmental justice for oil-ravaged communities in his state and the Niger Delta region to the international arena.

Diri, who met with the Secretary-General of the Commonwealth, Baroness Patricia Scotland, at its secretariat in London on Thursday, said the body’s intervention was needed to successfully implement the report of the Bayelsa State Oil and Environmental Commission (BSOEC) titled: ‘An Environmental Genocide: Counting the Humanitarian and Environmental Cost of Oil in Bayelsa, Nigeria.’

The 216-page report of the commission, which was chaired by the former Archbishop of York, Lord John Sentamu, was launched in May 2023 at the House of Lords in London.

A statement by Governor Diri ‘s Chief Press Secretary, Mr. Daniel Alabrah, quoted him as saying, while presenting the report to Baroness Scotland, that international oil companies operating in Bayelsa were divesting and exiting the Niger Delta without any concrete plan to remediate and compensate host communities polluted by their exploration activities.

Faulting the 13% derivation to oil-producing states and the federal laws on oil and gas exploration in Nigeria, he appealed to the Commonwealth to support efforts to address the environmental injustice that oil-bearing communities had been subjected to.

Diri said his administration was open to dialogue to prevent a double jeopardy for the communities as well as exploring the legal option, if dialogue failed.

He said: “The Commonwealth’s dedication to environmental protection is crucial, and we are eager to collaborate in addressing these pressing issues together. We are here because we can achieve so much in terms of the environmental challenges we face by collaborating with your office.

“We are also here because your intervention will attract the attention of our federal government back home. The recommendations of the BSOEC report will be implemented not only by our state but there are also aspects that require our federal government’s action. As a sub-national government, there is little we can do to ensure the implementation of this report. The oil and gas resources underneath our soil belong to the federal government.

“Bayelsa State has endured catastrophic environmental degradation due to decades of oil exploration, transforming our once vibrant region into one of the most polluted places on earth.

“The health implications for our people are severe, with reduced life expectancy and increased neonatal deaths. We cannot ignore the human cost of this environmental crisis. I often wonder if the oil underneath our soil has become a curse or a blessing.”

He expressed the state’s concern about Shell’s planned divestment from its onshore operations.

“It is imperative that this transition does not allow the company to walk away from the environmental devastation it has caused over the years.”

Diri also urged Shell to commit to a comprehensive clean-up and remediation plan before exiting, ensuring that the people of Bayelsa are not left to shoulder the burden of this disaster alone.

In their remarks, Lord Sentamu, another BSOEC member, Dr. Kathryn Nwajiaku-Dahou, and chairman of the Bayelsa State Traditional Rulers Council, King Bubaraye Dakolo, urged the Commonwealth to take steps to halt the “environmental genocide” in Bayelsa in particular and the Niger Delta in general.

They reasoned that the continued crude oil pollution of rivers and the flaring of gas constituted “landmines” to the health and livelihoods of people of the state and the region.

The Bayelsa State Attorney-General and Commissioner for Justice, Mr. Biriyai Dambo SAN, who also spoke, highlighted the inadequacies in the Petroleum Industry Act 2021 in addressing the issue of environmental degradation and compensation for host communities.
