  • Firm urges court to order document’s release

    Lagos-based firm, Mcdonald Scientific Emporium Limited (MSEL), has gone to a Lagos High Court seeking to recover its alleged missing Deed of Assignment (Title Document), registered as No. 16 at Page 16 in Volume 2180 of the Land Registry Office of Lagos from Access Bank Plc

    The claimant accused the bank of refusing to return the document after several attempts were made to retrieve it.

    The claimant also averred that the continued withholding of the document has hindered its access to credit facilities from other banks.

    It said it had always financed its business transactions with credit facilities obtained from banks in Nigeria.

    The claimant said an offer letter dated September 15, 2008, by Intercontinental Bank Plc (now Access Bank) approved the extension of a term loan facility to it.

    The offer letter required  security for the loan, which included but not limited to a legal mortgage on property located at Plot 152 Raymond Iromaka Close by Festac/Amuwo Odofin Bridge, Amuwo Odofin, Lagos covered by Deed of Assignment registered as No. 16 at Page 16 in Volume 2180 of the Land Registry Office in Lagos. The said property is owned by, and is registered in the claimant’s name.

    Claimant said it accepted the offer and thereafter deposited the original title document with the defendant being a condition precedent for drawing down the facility.

    According to the claimant, in another bid to raise the sum of N64,944,306.84, it approached First City Monument Bank Ltd (FCMB) to seek a loan facility.

    By a letter dated 29th August, 2014, FCMB offered the Claimant a takeover loan facility. By virtue of the takeover loan, FCMB was to lend the Claimant some amount of money for two purposes to wit: To finance the replenishment of Claimant’s stock in preparation for the massive annual sales of August and September 2014 and to liquidate the claimant’s total outstanding indebtedness to the defendant as at that date using the claimant’s title deed deposited with the defendant as security for the loan.

    The claimant stated that due to the defendant’s negligence, failure and/or deliberate refusal to release the said title documents to FCMB, FCMB was constrained to withdraw the said offer letter for loan.

    It is, therefore, praying the court to hold that the original Deed of Assignment is in the defendant’s possession.

    The claimant sought a declaration that the defendant’s failure, refusal and/or negligence to respond to First City Monument Bank’s letter dated 17th November 2014 by confirming to FCMB that the Claimant’s original title document is in the defendant’s possession (so as to enable FCMB liquidate Claimant’s N9,409,089.45 debt to defendant) amounted to negligence and breach of the defendant’s fiduciary obligation and duty of care to the Claimant.

    It also prayed for an order compelling the defendant to immediately produce the original Deed of Assignment and hand it over to the claimant immediately and an order compelling the defendant to pay special damages to the claimant in the sum of N82, 599,386.92 being loss of income/profit suffered by the Claimant as a result of the defendant’s failure, refusal and/or negligence to confirm to FCMB that Claimant’s original Deed of Assignment is in the Defendant’s possession.

    In its defence,  Access Bank said: “ The said title document registered as No 85 in Volume 77 at Federal Lands Registry in the office at Lagos deposited as security for the loan granted by the bank was returned to the claimant  Mcdonald  with a Deed of Release which was issued in the claimant’s favour.”

    The defendant also claimed that the Deed of Assignment which the claimant seemed to be relying upon as its title to the property which was executed between one Philip Kayode Olusegun Ojo and the claimant does not have any registration details as a Deed of Assignment duly registered as the Lagos State Lands Registry Alausa, Ikeja.

    It, therefore, urged the court to ignore the claimant and strike out the suit for lacking in merit.

    No date has been fixed for hearing.

    EKSU VC unveils strategic plan document

    The Document containing the strategic plan for development at Ekiti State University (EKSU) for the next five years was unveiled on Tuesday during prayers to usher-in the New Year at the university.

    The Vice-Chancellor, Prof Patrick Oladipo Aina said the 267-page publication would serve as the university’s main roadmap towards meeting its goal of achieving world-class status.

    Aina who presented the book before the congregation for blessing noted that the strategic plan would enhance the university’s growth in all spheres.

    Prof. J. O. Oloyede, who is a Pastor, led the congregation in prayers to bless the document.

    In the past year, the Vice-Chancellor said God was his strength and a pillar for the university community as well.

    In 2014, he promised that there would be more buildings projects, one of which would be a Senate building.

    He appreciated the support of members of Staff for the positive development recorded in the university.

    During the prayer session, the Deputy Vice-Chancellor (Development), Prof. Victor Adeoluwa, gave the exhortation with the theme: “God is our hope and righteousness.”

    Quoting relevant Bible passages, he counseled members of staff to obey God’s words always and uphold the truth. Prayers were said for the nation, the state, the university, management, members of staff and students.

    The occasion attracted all the principal officers, deans, directors and others.

    Meanwhile the university management has given January 16 and 23 as deadline for payment of fees and registration for both fresh and returning students. While returning students have up to January 16 to pay up, fresh students have been given until 23 as deadline.

    Aina said after the deadline, students would get a late registration window of one-week and be charged N5,000 as penalty. After the expiration of the late registration period, the vice chancellor said any student who fails to meet all registration requirements, risks forfeiture of his or her studentship and would not be allowed to participate in any academic activity, including the continuous assessment tests scheduled for January 19.

     

  • FCT warns against illegal document on parks

    The FCT Administration will not release any title document on any park and garden within the 8,000 square kilometers of the Federal Capital Territory.

    The FCT Minister, Senator Bala Abdulkadir Mohammed made this disclosure, while receiving the 17-member delegation of the Indian Defence College that was in Abuja on a study tour of Nigeria, at the FCDA Conference Room, Central Business District, Abuja.

    The minister revealed that all Certificates of Occupancy meant for the parks and garden in the territory are domiciled in the Department of Parks and Recreation in the Abuja Metropolitan Management Council.

    Senator Mohammed reiterated that no title document on any of the gardens would be released to the Park Operators because such areas are only being sub-leased and would be taken back at the expiration of the lease period depending on activity on such areas.

    According to him, the activity on such parks determines the lease period, which is being graduated between five and 35 years that is the maximum.

    Senator Mohammed disclosed that since inception, the FCT Administration has been able to develop 30 percent of the Federal Capital City comprising of 250 square kilometers.

    “Accordingly, the FCT Administration has out of 79 Districts of the Federal Capital City developed 11 with 68 districts still undeveloped,” he stressed.

    The minister noted that India and Nigeria have similarities especially on their demographic challenges, which his administration is determined to turn into its utmost advantage.

    He lauded the sound diplomatic relations between Nigeria and India including their economic ties, which both nations have exploited to the benefit of their citizens.

    The leader of delegation of the Indian National Defence College, Air Vice Marshal IP Vipin appreciated the warm reception accorded his team.

    AVM Vipin who praised the rapid development being witnessed in Abuja within the short time of its conception, remarked that India and Nigeria have long standing history and would work to strengthen it.

    Nigeria coach Stephen Keshi is favourably disposed towards having Shola Ameobi, Victor Anichebe and Joel Obi in his plans for the March 23 game against Kenya in Calabar.

    Newcastle United striker Shola Ameobi could therefore be one of such players even though he stayed away from the Nations Cup in preference to his EPL club, but Keshi has already said he missed the big, experienced forward in South Africa.

    “Honestly speaking, I missed Shola Ameobi (at the AFCON). In the game against Venezuela, he had a different presence in the locker room, he came in with this coaching ability and togetherness, when he talks to these boys they listen. This was the first time he was coming,” said the Eagles coach.

    “This was what I was looking for on the pitch, somebody who could talk for me on the field, because I know what I did as a captain on the pitch. He was really, really ready to come, but what was on his contract denied him from coming.”

    Other likely stars on the Eagles radar would be Inter Milan midfielder Joel Obi, who was ruled out of the AFCON as a result of a long-term muscle injury, as well as Everton striker Victor Anichebe, who has also been battling injuries. Nigeria are also processing the nationality switch of Bayer Leverkusen winger Sidney Sam.

    The Big Boss has also said he will welcome more players who could add quality to his African champions.

    Keshi is expected to name his squad for a 2014 World Cup qualifier at home to Kenya later this month, but he said he will always be on the lookout for additions to his team.

    “We are open to fresh options for the team. We will allow additional good players in the team, those who can contribute positively to the team,” Keshi said.

    “We will give opportunity to them as Nigerians to come and show what they can contribute to make the team better.”
