  • PDP queries Buhari’s protection of suspended NHIS boss

The People’s Democratic Party (PDP) has tasked President Muhammadu Buhari to come out clear on why he has been protective of the Executive Secretary of the National Health Insurance Scheme (NHIS) Prof. Usman Yusuf.
Yusuf, who was on Friday suspended by the Board of the NHIS, has been fingered in various alleged corrupt practices, including the alleged siphoning of over N25 billion from the coffers of the agency.
Despite the suspension order, Yusuf reported for work on Monday and was escorted into his office by a detachment of armed policemen.

In a statement Monday by the spokesman of the PDP, Kola Ologbondiyan, the party accused the “Presidency cabal” of directly complicit in the alleged NHIS fraud and seeking every means to ensure a cover up.

The PDP recalled that the Executive Secretary was in July 2017 suspended by the Minister of Health, Prof Isaac Adewole over alleged gross misconduct and corrupt practices.
The party also recalled that how President Buhari, upon his return to the country from vacation in February, 2018, reinstated Prof Yusuf while he was still being investigated by the Economic and Financial Crimes Commission (EFCC).

The statement said, “The PDP invites Nigerians to note how the Presidency has continued to provide official cover for accused official even without the slightest investigation of the allegations and sanction by both the Minister and the Governing Council.

“We ask: Why is the Presidency protecting an official of government openly indicted for corruption? What is the Presidency trying to conceal by ensuring that Prof. Yusuf remains the Executive Secretary after his indictment?

“Furthermore, why is the Presidency vehemently opposed to any form of investigation on the activities of NHIS under Prof. Yakubu? Is it true that there are fears in the Presidency that an investigation will expose the alleged involvement of individuals close to the President in the reported fraud in the scheme?

“Finally, while the PDP describes as reprehensible that an administration which prides itself as fighting corruption will continue to provide official cover for its officials indicted of corruption, the party urges Nigerians to continue to hold President Buhari responsible for the corruption in NHIS, as well as the siphoning of trillions of naira from various agencies, under his watch”.

  • EFCC arraigns ex-banker for ‘stealing from customer’

The Economic and Financial Crimes Commission (EFCC) on Monday arraigned former banker Ali Kareem at the Federal High Court Lagos for allegedly stealing N8.7 million from a customer.

He allegedly conspired with others at large to impersonate a Union Bank customer, Alexander Cherembem, to fraudulently facilitate the withdrawal of funds from his account.

Kareem was charged before Justice Chuka Obiozor on a three count charge of conspiracy, impersonation and fraud.

He was accused of processing a “request” for Union Mobile for the customer’s account without obtaining his proper identity.

EFCC said Kareem impersonated the victim so as to facilitate the withdrawal of about N8.7 million from his account through the Union Mobile platform.

    Kareem pleaded not guilty.

Defence counsel Olatimihan Ogunbiyi said he filed a bail application.

Justice Obiozor ordered the remand of Kareem in prison pending the hearing of his bail application.

    He adjourned until November 5.

  • Imams call for space for religious leaders in EFCC, ICPC operations

Islamic scholars have called for inculcation of religious leaders into the operations of the anti-graft agencies like the Economic and Financial Crimes Commission (EFCC) and Independent Corrupt Practices and other related offences Commission (ICPC).
They believe that, inculcation of Muslim and Christian scholars into the operations of the agencies will go a long way in reducing corruption and killings in the country to the bearest minimal.
The Chief of Imam of Wuse Zone 3 Mosque, Tajudeen Mohammed Adigun and Chief Imam of Al-Habibiyyah Islamic Society, Dr. Fuad Adeyemi made the call in Kaduna on Saturday at a Train the Trainer Workshop organised for Imams and Scholars against corruption.
Imam Adigun said, EFCC and ICPC cannot succeed in the fight against corruption if the religious leaders are not involved, as he said the war cannot be won with gun and prosecution of offenders alone.
According to him, “99 per cent of Nigerians proclaim one religion or the other, therefore religious leaders should be involved, to preach to people in their mosques and churches on the ills of corruption and the punishment awaiting those who engage in it in the hereafter.
“God himself in the Holy Qur’an condemns corruption and urges Muslims to desist from it, as it will lead to killings if it becomes prevalent. That is exactly what is happening in Nigeria today. The killings here and there are as a result of injustice caused by corruption.”

Earlier in his opening remarks at the workshop tagged: Encouraging Accountability and Transparency through Faith Based Intervention (EAT FIn), Imam Fuad Adeyemi said, corruption will stop in Nigeria only if Imams and Scholars will mainstream the messages against corruption in their sermons, teachings in Islamic schools and other places.
He said, it becomes necessary for Scholars to get involved because of the unprecedented damage that corruption has done to Nigeria, saying that, injustice and bad governance are responsible for the killings in the country.
“You will discover that, everyone wants to be in government. Governance has become very attractive, not because people want to perform, but because of the corruption involved, if it is just about performance, you will not see people fight to lead.” He said.
Imam Adeyemi said, at the end of the programme, the participants are expected to gather enough knowledge on the subject, which will enable them spread the message.

  • Army hands over 680,000 adulterated diesel, kerosene to EFCC

The Nigerian Army has seized over 680,000 litres of adulterated diesel, kerosene and “black oil,” an official said.

Brig.-Gen. Sunday Igbinomwahia, Chief of Staff of Nigerian Army 6 Division Port Harcourt, spoke at a formal handover of 17 trucks to the Economic and Financial Crimes Commission (EFCC) in Port Harcourt on Friday.

Igbinomwahia said that the products, if supplied to the public may have led to explosions and possible deaths.

He explained that the trucks and petroleum products were seized after troops raided an abandoned compound formerly used by Union Dicot Salt Company in Port Harcourt.

According to him, illegal bunkers used the illegal refining facility to store and deliver substandard petroleum products to unsuspecting users.

“The 17 trucks had been in our custody since Oct. 2 it was seized to enable investigators to determine the authenticity of the petroleum products.

“Our investigators after carrying out thorough preliminary investigation on the matter came to the conclusion that the petroleum products were illegally refined.

Igbinomwanhia said each truck was loaded with about 40,000 litres of adulterated petroleum products awaiting distribution to the public before there seizure.

The officer said the seizure was made by the division’s Special Company that was specifically set up to checkmate activities of illegal bunkers in the state.

“We have concluded our preliminary investigation, and as such, the trucks and other exhibits will be handed over to EFFC for further probe of the case.

“The division is in forefront of fighting criminals who are hell bent to sabotage the nation’s economy through there illegal bunkering and vandalism of pipelines,” he said.

Igbinomwanhia said the division’s special task force had so far seized over 300 suspected illicit trucks and vehicles that were currently in different stages of investigation.

Receiving the trucks and products, Mr Abdulhamid Bawa, Head of Asset Forfeiture and Recovery Management Directorate of the anti-graft agency, said the commission would conduct speedy investigation into the matter.

“The petroleum products will be sent to the Department of Petroleum Resources to determine if the product is genuine or adulterated.

“If the product is genuine, then there is no case; but if found to be illegally refined then the owners of the trucks would be arraigned in court,” he assured.

Dikwa addressed the ex – Airways workers and pensioners allaying fears that hitches thus far experienced in the exercise were being looked into.
He said government was aware of the hitches and had approved extension of the verification by one week to ensure all beneficiaries are accommodated.
But, scores of pensioners and former workers have berated officials of PICA for the sloppiness of the exercise as there were not enough personnel to attend to beneficiaries that are very sick and the elderly.

  • Learn from Fayose’s downfall, Cleric tells Fayemi

Egbeyemi: Our govt will take care of everybody

An Islamic cleric, Alhaji Raheem Arikewuyo Olowoyo, has advised Ekiti State governor, Dr. Kayode Fayemi, to learn from the downfall of his predecessor, Mr. Ayo Fayose, in exercising power given to him by the electorate.

Olowoyo said those who wield the position of power will leave office one day and should always ponder on life after office.

According to him, people in position of power must learn from the fact that Fayose, who still wielded power of life and death just a week ago, is now cooling his heel in the custody of the Economic and Financial Crimes Commission (EFCC).

Olowoyo, who is the Awiye Adinni of Ekiti land, said transience of power should motivate those holding positions of leadership to do well and be accountable to people because of the impending day of reckoning.

The cleric spoke on Thursday at the Interfaith Thanksgiving Service held at the Government House, Ado-Ekiti as part of activities to mark the coming to power of the Fayemi administration.

The service was attended by the Deputy Governor, Otunba Bisi Egbeyemi; wife of the governor, Erelu Bisi Fayemi; wife of the deputy governor, Mrs. Margaret Egbeyemi; Speaker of the House of Assembly, Mr. Adeniran Alagbada; traditional rulers, religious leaders and senior civil servants.

The Awiye Adinni spoke while leading Muslim prayer for the success of the new Fayemi administration.

Anglican Bishop of Ekiti Diocese, the Rt. Rev. Christopher Omotunde, prayed that God will not allow Ahithophels to get into government and mislead the governor.

Olowoyo said: “By this time last week, it was whoever Fayose wanted that will be allowed to enter this Government House and whoever he did not want will not be allowed in.

“But where is Fayose today? Where is Fayose today? Fayose is now a former governor, the governor that is there today will be a former governor tomorrow.

“Three days have gone out of four years and that is how the four years will be reducing gradually. People are talking about good things and bad things Fayose did in power.

“Fayemi is a good man and God has given him a wonderful woman as wife and they don’t underrate people. My prayer is that God will not allow evil people to be part of this government.”

Delivering the Muslim sermon, the state Missioner of Ansar-ud-Deen Society, Alhaji Baba Abdul Salam, described position of power as “trial from God.”

Abdul Salam urged leaders in the country to rule with justice and fair play adding that Fayemi has begun well and must be supported with prayers to succeed.

He said: “This is a good beginning, Fayemi is exposed, he has interacted with Presidents and world leaders and he has come to do well in this second term.”

Delivering the Christian sermon, Ekiti Provincial Pastor of the Redeemed Christian Church of God (RCCG), Pastor Goke Kuti, assured that the state will take its pride of place in Nigeria under Fayemi.

Speaking on the topic: “Possess Your Possession,” Buti said God the Fayemi administration should not see any impossibility but must go forth and do exploits for the people

Buti said: “In this administration, we should not see impossibility, it is time for God to make Ekiti great. We can overcome poverty, unemployment and other problems confronting this state.”

Speaking on behalf of the governor who was attending the Governors’ Forum meeting in Abuja, Egbeyemi assured that the new government will not discriminate in making people feel impact of governance.

Egbeyemi said: “Whether you are a member of APC, PDP or any other party, if your children are in public schools, they will enjoy free education because this government is a friend to everybody.

“We will do more than what we did during the first tenure. I moved round with the governor during the campaign and there are projects to show in all towns and villages.

“We have said we are not probing anybody but we want to look into the books because workers want us to pay them, pensioners want us to pay them and we are going to work out how we will pay them.

“An emaciated child cannot be fed to become robust in one day; we will be doing it gradually. We want our spiritual fathers to keep on praying for us to succeed in this task.”

  • Presidency orders EFCC to detain Fayose indefinitely, PDP alleges

…I ll stay and fight this battle, says Fayose

The People’s Democratic Party (PDP) has alleged has alleged that the Presidency has directed the Economic and Financial Crimes Commission (EFCC) to detain indefinitely, the outgoing governor of Ekiti State, Mr. Ayodele Fayose.

In a statement issued Monday by its spokesman, Kola Ologbondiyan, the PDP said information at its disposal and in the social media, indicated that the Presidency has put the EFCC on the alert to arrest the governor at midnight today and detain him indefinitely.

Read Also:Ekiti: Fayose ends tenure in tears, says he will be back

The party said the alleged directive by the Presidency was not unconnected with alleged plot to use the EFCC and other security agencies to incarcerate the governor for his persistent criticism of the President Muhammadu Buhari-led APC government.

The statement said, “This uncompromising stand of the outgoing governor against the present administration was the reason Ekiti State was invaded and taken by force during the last governorship election.

“By 12 midnight, the governor’s residence is expected to be surrounded by armed men of the EFCC under the pretense that they had information of his plot to escape. This is to achieve their plan to humiliate the governor and portray him in bad light to the public by dramatising his arrest.

“Nigerians can recall that it was the governor who offered to submit himself to the EFCC despite the commission’s clear display of bias and partisanship as demonstrated in its various actions, especially its tweets and putting the governor on security watch-list.

“The EFCC even unprofessionally showed its bias in deriding the governor, making light of a very serious matter by mocking him and asking him to come before his tenure elapsed, which the governor declined in line with his constitutional immunity.

“It is now beyond dispute that Governor Fayose is not a scoundrel running away from justice. Whatever the EFCC, APC, and the Presidency’s spin-doctors may say, it is also clear to everyone that Fayose is not a coward; neither is he afraid of the EFCC”

The PDP said Fayose is prepared and ready to defend himself in the court of law, adding that neither the Presidency nor EFCC is a court of law.

The party said having claimed to have dusted up Fayose’s files; the EFCC should be ready to take him to court once he presents himself at the agency’s office on Tuesday.

“Governor Fayose has offered to walk to the EFCC office by himself and nothing must happen to him. The PDP condemns this resort to fascism by the APC government. The whole world should be at alert to see another demonstration of crude disrespect for the rule of law and rights of Nigerians”.

Meanwhile, Fayose has reiterated his readiness to honour the EFCC’s invitation today, adding that he would “stay and fight this battle”.

Fayose, spoke in Abuja Monday night at a send-forth ceremony organised in his honour by the PDP Governors Forum.

According to him, he would continue to criticise the Buhari administration as his tenure ended midnight.

Commenting on the All Progressives Congress (APC) led administration, Fayose said, “They got power by deceit. But they gave no solution. Tell them at the Villa; my name is Ayodele Fayose, Peter the Rock.  By the Grace of God, I will be at the EFCC tomorrow (today) by 1pm. I am not a coward.

“Let it be said to them that today is their own.  Tomorrow is our own. I will not run away, they will rather run away. They took me to Court 13 years ago, I won after 8 years.

“They harassed my family and I got judgment three times against them. This time will not be an exception. Those who wait for me will wait in vain. EFCC is no court”.

Present at the send-forth ceremony were Governors Udom Emmanuel (A/Ibom); Nyesom Wike (Rivers); Darius Ishaku (Taraba); Seriake Dickson (Bayelsa); Ifeanyi Okowa (Delta); Dave Umahi (Ebonyi); Aminu Tambuwal (Sokoto); and the National Chairman of the PDP, Prince Uche Secondus.

  • EFCC seeks transfer of cases from Justice Nyako

    Raises likelihood of bias

The Economic and Financial Crimes Commission (EFCC) has requested that cases involving it and its Acting Chairman, Ibrahim Magu be withdrawn from Justice Binta Nyako by the Chief Judge of the Federal High Court and handed to any other judge of the court.

The request is contained in a letter by the EFCC, addressed to Chief Judge of the Federal High Court, Justice Adamu Kafarati.

The EFCC said its request was informed by the need “To avoid bias and conflict of interest, because the commission is prosecuting the spouse and step son of His Lordship (Justice Nyako), namely; Admiral Murtala Nyako (rtd) and Senator Abdulazeez Nyako respectively.”

Lawyer to the EFCC, Wahab Shittu, who wrote the letter, dated July 31, 2018, said he was acting based on a written instruction by Magu, dated July 30, 2018, demanding that the cases, numbering about 17 be reassigned.

On Tuesday, Shittu drew the court’s attention to a fresh letter dated October 5, this year, which he authored and addressed to the Registrar of the court, reminding it about his earlier letter of July 31 to the Court’s Chief Judge.

The October 5 letter reads:”Respectfully,  we write to draw His Lordship’s attention to our letter dated 31st July,  2018, addressed to the honourable Chief Judge of the Federal High Court conveying our client’s request to the Chief Judge to the Federal High Court that all matter concerning the subject matter above be transferred from this honourable court for reasons contained on our clients attaches letter.

“Respectfully we tremble in requesting that out client’s position be respected in the interest of justice in this matter.

“Kindly draw His Lordship attention to our clients ‘ predicament as expressed  in attached letter now receiving the consideration of His Lordship,  the Chief Judge of the Federal High Court.”

    The affected cases include:

The matters in question are; Barr Bello Bakari vs. AGF; Abubakar Sani vs.the Senate of the Federal Republic of Nigeria;  Jibrin Samuel Okutepa vs. President of the Federal Republic of Nigeria and Lady Chidinma Udebani.

Others are the Incorporated Trustees of Justice Mission International vs. AGF;  Barr Alia Jamilu vs. President, Federal Republic of Nigeria & 4 others; Emmanuel Esero vs. Ibrahim Magu;  the Registered Trustees of African Patriotic Youth Assembly vs. Ibrahim Magu & 6 others.

There are also the cases involving Wale Balogun vs. the President of the Federal Republic of Nigeria and 4 others;  Chijioke Kanu vs. AGF and Johnmary Chukwukasi Jideobi vs. the Senate of Federal Republic of Nigeria and 3 others be transferred.

Most of the cases relate to the dispute over whether or not Magu could continue to occupy the headship of the EFCC without the confirmation of his nomination by the Senate.

The court had, earlier in the year, upon a directive by the court’s Chief Judge, directed that all cases relating to the non-confirmation of Magu be transferred to Justice Nyako’s court for determination.

When all the cases were all concentrated in her court by virtue of the Chief Judge’s directive, Justice Nyako, with the agreement of all lawyers in the case, elected to consolidate all the cases a render a single judgment that will bind all, because most of the issues were similar.

Many lawyers in the case however expressed surprise on Tuesday on learning about EFCC’s request.

They doubted EFCC’s reason for seeking the transfer of the case, but claimed the commission might have acted the way it did to prevent prompt determination of the cases.

Justice Nyako has however adjourned the cases indefinitely.

  • Fayose to EFCC: Meet me in my office on September 20

Ekiti State Governor Ayo Fayose has fired another letter to the Economic and Financial Crimes Commission (EFCC) suggesting a September 20 date for the agency to interrogate him in his office in Ado-Ekiti.

Fayose said the Commission should wait till October 16 at the expiration of his immunity if it cannot deploy its interrogators to Ado-Ekiti on the suggested date.

He criticized the EFCC for writing Nigeria Customs Service (NCS) and other security agencies demanding that he be placed on a watch list to prevent him from escaping from the country to evade justice.

These were contained in another letter Fayose forwarded to the EFCC in which he restated his readiness to make himself available for investigation and interrogation.

He contended that the action of the EFCC raised a serious question about its impartiality, neutrality and independence.

The latest letter from Fayose’s table dated September 14 was made available to reporters in Ado-Ekiti, the state capital on Tuesday.

The governor however said should the EFCC be so much in a hurry that its investigation cannot await October 16, 2018, which the first day after the expiration of his tenure, “without prejudice to Section 308 of the Constitution, I will be willing to answer questions from your team of investigators should they be willing to meet me in my office in Ado Ekiti on the 20th September 2018” indicated in the EFCC’s letter dated September 13, 2018.

He reminded the EFCC that “in 2007, precisely on the 19th day of December, I willingly presented myself for EFCC investigation at your Lagos office.”

Fayose said: “There is therefore nothing new or strange in my letter of 10th September 2018 which has been received and treated in bad faith and taste. I thought I was assisting due and fair process of law.”

“As a responsible citizen of the Federal Republic of Nigeria, who currently enjoys immunity under Section 308 of the Constitution, it would amount to a breach of the Constitution which I swore to uphold if I appear in your office on any date earlier than 16th October 2018.
If done otherwise, it will set a wrong precedent for the Constitutional Institution that I represent.

“I carefully chose that date (October 16, 2018) being the next day after the expiration of my tenure upon which the immunity I enjoy will lapse to avoid any form of insinuation and was in good faith.

“While drafting my response to yours of 14th September 2018, my attention was drawn to your widely publicized letter of 12th September 2018 to the Comptroller General, Nigeria Customs Service and similar agencies, directing them to watch-list and arrest me on an imagination that I might leave Nigeria to escape investigation. It has finally put in context, your Commission’s hurriedly deleted online statement vide EFCC Nigeria @OfficialEFCC a day after the Ekiti governorship election that: “The parri is over; the clock of immunity turn apart, and the
staff broken. Ekiti Integrated Poultry Project/Biological Concepts Limited N1.3bn fraud case file dusted off the shelves. See you soon.”

“Your Commission by its actions, no doubt has presumed my ‘quilt’ even prior to the commencement of “investigation”. This raises serious question about the impartiality, independence or neutrality of the Commission in the matter. I feel harassed, intimidated and embarrassed by the imputation of crime and the innuendos of criminality underlining your correspondence which has been maliciously circulated widely. This in all implies a case of persecution rather than prosecution.

“While I have handed a copy of your letter to my Solicitors for a careful study and advice, let me state here for the records, that there is nothing about me or my antecedents, as a long standing public figure to justify the Commission’s action. I have never been a coward or criminal.

“You may wish to recall that in 2007, precisely on the 19th day of December, I willingly presented myself for EFCC investigation at your Lagos office. There is therefore nothing new or strange in my letter of 10th September 2018 which has been received and treated in bad
faith and taste. I thought I was assisting due and fair process of law.

“Notwithstanding the demonstrated hate and prejudice, I reaffirm my willingness to make myself available to answer questions within my knowledge on the day you may indicate after expiration of my term of office on the 15th October 2018.

“If for any good reasons, your investigation cannot await the date suggested in my earlier letter, without prejudice to Section 308 of the Constitution, I will be willing to answer questions from your team of investigators should they be willing to meet me in my office in Ado
Ekiti on the 20th September 2018 indicated in yours.

“Save as above, I will appreciate any date convenient to you after 15th October 2018, otherwise, expect me on the 16th October 2018 at 1pm as earlier stated.”

  • $500,000 ‘fraud’: Court freezes suspect’s three bank accounts

A Federal High Court in Lagos Friday froze three bank accounts belonging to one Ajineh Pius Erovwose, being investigated by the Economic and Financial Crimes Commission (EFCC) for an alleged $500,000 fraud.

The accounts are domiciled in First City Monument Bank (FCMB), United Bank of Africa (UBA) and Union Bank Plc.

Justice Sule Hassan made the order following an application by EFCC counsel George Chia-Yakua.

He froze the account, pending the conclusion of the EFCC’s investigation.

Justice Hassan held: “I have listened carefully to the submission of the applicant’s counsel, and gone through the summons with the affidavit of urgency, affidavit in support, written addresses and the exhibit attached.

“This application succeeds and the prayer sought is granted”.

In an affidavit in support of the application deposed to by EFCC investigator, Paul Okoli, the agency said it got intelligence that Erovwose defrauded an American of $500,000 under false pretence through the said bank accounts.

It asked the banks to place Post No Debit (PND) on the accounts, but Erovwose obtained a magistrates’ court order setting aside the PND.

The suspect allegedly withdrew the $500,000, leaving a balance of $14,000 before absconding.
The anti-graft agency said the addresses used to open the said accounts were discovered to be fictitious and that it would be difficult to conclude the investigation or arrest Erovwose unless the accounts were barred.
