  • ‎UPDATED: Ekiti tribunal upholds Fayemi’s victory

    The Ekiti State governorship election tribunal has upheld the victory of Kayode Fayemi, the candidate of the All Progressives Congress (APC) in the last governorship election in the state.

    The tribunal, in its judgment in Abuja on Monday, dismissed the petition by the People’s Democratic Party (PDP) and its candidate in the election, Kolapo Olusola, challenging the outcome of the election.

    Tribunal’s Chairman, Justice Suleiman Belgore, who read the judgment, for about five hours, concluded the petitioners were unable to discharge the burden of prove placed on them under the law.

    Justice Belgore said the tribunal found that the evidence led by the petitioners was did not meet the required standard and was insufficient to prove their claim that the election was held in substantial non-compliance with the Electoral Act.

    The tribunal resolved the two issues identified for determination, in favour of the respondents – the Independent National Electoral Commission (INEC), APC and Fayemi.

    On the petitioners’ contention that Fayemi was not qualified to have contested the election in view of his alleged indictment by a commission of enquiry set up by the state government to probe allegation of embezzlement of funds during his first tenure, the tribunal found that the alleged indictment was not sufficient to disqualify Fayemi.

    It noted that Section 182 of the Constitution, which the petitioners based their contention was no longer the law as it has since been deleted by the First Alteration of the Constitution (2010).

    The tribunal agreed with Fayemi’s lawyer, Akim Olujinmi (SAN) that “even if Section 182 was not deleted, what the petitioners were required to prove to sustain this ground, based on several decided cases, is that a court of law has found him guilty of embezzlement of funds, which did not happen in this case.

    It was also of the view that “even if Section 182 (1) of the Constitution was not deleted, the report did not make any finding of embezzlement against the 3rd respondent (Fayemi), the report only said he failed to honour the commission’s invitation, and then recommended that he should be banned from holding public office.”

    The tribunal noted that although Olusola (who testified as the petitioners’ 31st witness) and their 32nd witness (identified as a legal practitioner) denied knowledge of a court judgment, voiding the said indictment by the commission of enquiry, the tribunal saw a copy of the judgment by Justice Musa Othman of the High Court of the Federal Capital Territory (FCT) which set aside the purported indictment.

    On the second question as to whether the election was held in substantial compliance with the Electoral Act, the tribunal held that by the evidence led by the petitioners, it was left with no option than to conclude that the election was held under a peaceful and tranquil environment, devoid of violence and in total compliance with the Electoral Act.

    The tribunal said the onus was on the petitioners to effectively prove their allegations of malpractices, violence, deliberate voiding of votes, harassment, thuggery, results manipulation, among others, by calling credible and sufficient evidence.

    It noted that after analysing all the evidence led by the petitioners, the tribunal found that they were unable to prove their allegations and claims.

    For instance, the tribunal noted that the petitoners failed to call a single witness to prove their claim that 40,000 thumb printed ballot papers were brought into Ekiti a day before the election and that armed security personnel invaded the state during the election, to work for the victory of the APC and its candidate.

    The tribunal also noted that while the petitioners alleged malpractices in 1458 polling units out of the total .2185 polling units in the state, it call only 71 witnesses.

    The tribunal further noted that the statements of some witnesses tendered before the tribunal, were similar, giving the impression that they were mass produced, and therefore lacked the element of individuality as required by law.

    It also noted that the petitioners merely dumped most of its documentary evidence, particularly the voters register, on the tribunal without demonstrating their relevance to the case, a development that made the tribunal not to accord them any probative value.

    The tribunal said it was strange that, while most of the petitioners’ witnesses (who are all party agents) claimed to have voluntarily signed the results of the election, the petitioners were still contesting the validity of such results.

    It said the petitioners failed to show that the 3rd respondent (Fayemi) was not duly elected, and that majority of evidence led, which are all documentary, failed disprove the result as announced and produced by INEC.

    The tribunal said: “The law is that until the petitioners prove sufficient grounds to ground their various averments of non-compliance, malpractices, corrupt practices, manipulation and irregularities, substantial enough to warrant this tribunal to jettison the election, no duty lies respondents to put up a defence.

    “Having found that the petition fails to do so in this petition, the burden does not shift to the respondents. The petition stands on its own.

    “In the light of everything said and done, and upon a calm perusal, due consideration of the entire circumstances of this case, it is incorrect to contend that the 3rd respondent did not win the election by a majority of lawful votes. In fact the contrary is crystal clear.

    “He (Fayemi) scored a total of 197,459 votes against 178,921 scored by the 2nd petitioner (Olusola). We found the declaration and results, as shown in exhibit RA20, in order and duly made.

    “It satisfies the provision of sections 27 and 69 of the Electoral Act (as amended). We have no reason to upturn or disturb that declaration. This petition is without merit. It fails and its is hereby dismissed.

  • Ekiti tribunal chooses Abuja as sitting venue

    The Election Petition Tribunal hearing the dispute arising from the July 14 governorship election has shifted base to Abuja, the nation’s capital.

    The tribunal chaired by Justice Sulaiman Belgore had on Monday ordered the relocation of its sitting from Ado-Ekiti, the state capital, on Monday owing to insecurity at the Ekiti State High Court, the former venue.

    The action followed alleged violence by some party members at the inaugural sitting which put the lives of lawyers, litigants and court workers in jeopardy.

    People’s Democratic Party (PDP) and its candidate, Prof. Kolapo Olusola, are challenging the victory of the All Progressives Congress (APC) governorship candidate, Dr. Kayode Fayemi, before the three-man jury.

    Lawyers to all parties at the tribunal demanded the change of venue to Abuja but the panel in its ruling promised to communicate a new venue to them within 48 hours.

    Counsel to Dr. Fayemi, Chief Rafiu Balogun and Ekiti PDP Legal Adviser, Mr. Sunday Olowolafe confirmed the change of venue in a telephone chat on Wednesday.

    The Nation reporter saw a copy of the hearing notice communicating the change of venue to Abuja on Wednesday which was signed by the Tribunal Secretary.

    Although the date on the hearing notice read September 24, a member of the Tribunal Secretariat who asked not to be quoted said pre-hearing will commence on Tuesday, September 25.

    It reads: “Take notice that the above-named petition is slated for pre-hearing and will be heard at High Court No 17, Apo FCT High Court, Abuja, before Shoprite Apo, FCT Abuja on Monday, the 24th day of September, 2018 at the hour of 9.00 am forenoon or soon thereafter on such other day as the Tribunal may determine.”

    Balogun had disclosed that the change of the date of commencement of pre-hearing might have been necessitated by the fact that it falls on the day of the opening of a new legal year and swearing-in of the new Senior Advocates of Nigeria (SANs).

  • I will not disappoint Ekiti people – Fayemi

    Ekiti State Governor-elect Dr Kayode Fayemi has promised not to disappoint the people of the state who gave him the mandate in Saturday’s governorship election.

    Fayemi made the promise on Wednesday shortly after he was presented with the Certificate of Return as the governor-elect by the Independent National Electoral Commission (INEC).

    National Commissioner in charge of Oyo, Ekiti and Osun States, PrinceAdedeji Soyebi, presented Fayemi with the Certificate of Return at a
    ceremony held at state INEC Headquarters, New Iyin Road, Ado-Ekiti.

    Deputy Governor-elect Otunba Bisi Egbeyemi also received his Certificate of Return at the event. Fayemi and Egbeyemi were joined by their wives, Bisi and Margaret, respectively.

    Other dignitaries who witnessed the presentation are Chairman, Senate Committee on Trade and Investment, Senator Fatimat Raji Rasaki; state APC Chairman, Chief Olajide Awe; Commissioner of Police, Mr. Bello Ahmed; State Director of DSS, Mrs. Promise Iheanacho; Commandant, Nigeria Security and Civil Defence Corps, Mr. Solomon Iyamu and heads of federal agencies in the state.

    The certificates presented to Fayemi and Egbeyemi were signed by INEC Chairman, Prof. Mahmood Yakubu. The governor-elect and the deputy governor-elect also signed the documents.

    APC leaders and members chanted their party slogan: “APC Change! APC Change!! APC Change!!! as Fayemi collected his certificate at 11.30
    am.

    Speaking after he was presented with the document which authenticates his status as governor-elect, Fayemi said the people of Ekiti State
    will enjoy the benefit of good governance as from October 16 when he takes over the reins of power.

    The governor-elect commended the electoral agency for doing what he described as an “excellent job” of conducting the governorship poll.

    Contrary to the claim of the ruling People’s Democratic Party (PDP), Fayemi affirmed that the election which returned him as winner was
    “seamless, free, fair, credible and violence-free.”

    There was a massive security build-up along New Iyin Road and the vicinity of INEC office as people streaming to the place were frisked
    before being allowed entry.

    Security was provided by officers and men of the Nigerian Army, the Police, the Department of State Services (DSS).

    A Police helicopter was hovering over the INEC office throughout the time the ceremony lasted.

    The governor-elect noted that INEC should be commended for conducting a process of 14 steps which culminated in the presentation of the
    Certificate of Return.

    Fayemi stressed that INEC did a yeoman’s job in delivering the election in a credible and professional manner despite fears being expressed in the build-up to the poll.

    The former Minister of Mines and Steel Development also commended the security agencies for providing security back-up which gave the
    electorate confidence to come out and exercise their franchise.

    Fayemi hailed the APC National Working Committee (NWC) led by the National Chairman, Comrade Adams Oshiomhole and the State Executive Committee led by the State Chairman, Chief Olajide Awe.

    He also expressed his appreciation to the traditional rulers for the stabilizing roles played in the run-up to the election and everybody
    that contributed to the success of the election.

    He said: “For INEC, the work has just ended and for us, the work has just started. We have a responsibility not to disappoint our people.

    “Ekiti people will see the benefit of good governance by the grace of God as from October 16.”

    The Resident Electoral Commissioner (REC), Prof. AbdulGaniy Raji, expressed delight that the election was held despite the tension that
    preceded it.

    Raji commended the people of Ekiti State for the maturity displayed before during and after the election which he was successful.

    He said with the conduct of the poll, Ekiti is moving higher and expressed hope that futures elections to be conducted in the state will be successful.

    Speaking earlier, INEC National Commissioner Soyebi noted that the presentation of Certificate of Return marked the end of the process of
    the Ekiti governorship election.

    Soyebi who described Ekiti as a homogenous state urged the people of the state to continue being one another’s brother’s keepers.

    He said: “Today marks the end of the (governorship) election in Ekiti State on the part of the Commission which is the presentation of Certificates of Return to the governor-elect and the deputy governor-elect.

    “If there are issues arising from the election, there is another arm of government that will take care of that. This is another important day in the history of the state.

    “On behalf of the Commission, I congratulate everybody. Ekiti has pointed the way forward in conducting elections in Nigeria.”

  • Ekiti 2018: Fayose faults Buhari on Fayemi’s victory

    Ekiti State Governor Ayo Fayose has criticized President Muhammadu Buhari for applauding and hailing the conduct of last Saturday’s Ekiti State governorship election.

    Fayose said Buhari’s action of endorsing the poll he described as a “charade” shows that the President lacks democratic credentials and is not a democrat.

    Despite the defeat suffered by his deputy and the People’s Democratic Party (PDP) candidate, Prof. Kolapo Olusola, Fayose said: “I hold my head high and I can never be suppressed.”

    The Ekiti governor was reacting to a statement by the Senior Special Assistant to the President on Media and Publicity, Mallam Garba Shehu, in which Buhari endorsed the victory of the governor-elect, Dr. Kayode Fayemi.

    The statement conveying the Presidency’s reaction on the Ekiti poll was entitled “Fayose: In the end, a high-powered nothing.”

    Fayose, in his reaction through his Chief Press Secretary, Mr Idowu Adelusi, in Ado-Ekiti on Monday, wondered why Buhari endorsed an election he alleged was marred by violence, use of brute force and harassment of PDP members.

    Fayose accused the Police, Army, Civil Defence Corps and Independent National Electoral Commission (INEC) of criminal alliance to snatch the ‘mandate’ given to Olusola.

    He said: “President Muhammadu Buhari should not be happy and applaud this situation whereby the police, army, civil defence and INEC were used to snatch the collective mandate freely given to the Peoples Democratic Party candidate, Prof. Kolapo Olusola and delivering it to the All Progressives Congress candidate which Ekiti people rejected.

    “Can you call that election? Of course not, it was a contest between Olusola and the INEC and security agencies.

    “There was indiscriminate arrest of our party leaders, harassment and brutalisation of voters in a massive scale especially in Ado, Ikere and others areas.

    “The thugs imported by the APC operated freely under the cover of security agencies to snatch ballot boxes, create confusion, cause mayhem and drive away voters in PDP strong holds. Our party agents were driven away with gun.

    “Buhari has demonstrated truly that he is not a democrat, but a dictator who is yet to get over military mentality. Muscling of democracy in Nigeria today by the Buhari administration is not about Ekiti alone.

    “Presidential aspirants and PDP states should prepare to have taste of brutality of this administration. This is why we all need to stand up to rescue Nigeria from Buhari.

    “I am Peter Ayodele Fayose, I hold my head high. I can never be suppressed. I don’t lose battles and I will not lose this. I will laugh last. Those waiting for me, will wait in vain.

    “They should remember what the prophet said to that heady king in the Bible, which applies to them. He that wears the armour should not boast as he that removes it.”

    “It is only Buhari that will pride himself with the security shooting sporadically at polling centres, scaring people to pave the way for the APC thugs to snatch ballot boxes.

    “What Buhari has won as referendum from Ekiti people, Nigerians, and international community is shame. If APC has truly won, why is it that there is no jubilation in Ekiti?

    “The victory of Kayode Fayemi is pyrrhic. We will reclaim the stolen mandate in the court by the power of God.”

  • Ekiti: We will reclaim mandate in court, says Fayose

    Ekiti State Governor, Ayodele Fayose has finally spoken on the outcome of the governorship election held last Saturday in the state.

    Reacting in a series of Twitter posts to the election in which his deputy Professor Kolapo Olusola was defeated by Dr. Kayode Fayemi , Fayose said the mandate would be reclaimed in court.

    He said: “If APC truly won, why was it that there was no jubilation in Ekiti ? That victory of Kayode Fayemi is pyrrhic, we will reclaim the stolen mandate in the court by the power of God.”

    “As for me, I am Peter Ayodele Fayose , I hold with my head high. I can never be suppressed. I don’t lose battles and I will not lose this. By the power of God, I will laugh last.”

    Fayose said what Buhari won as referendum from Ekiti people , Nigerians, and international community is big shame.

    He said:”The President should bury his head in shame for using the police, army, Nigeria Security and Civil Defence Corps and INEC to snatch the mandate given to Olusola and deliver it to Fayemi “whom Ekiti people rejected.”

    “On this Ekiti election, President Buhari demonstrated truly that he is not a democrat, but a dictator and fascist per excellence.”

    “The President should note what the Bible says which applies to him: “He that wears the armour should not boast as he that removes it.” May God rescue our country.”

     

  • Ekiti: Fayemi’s victory, good omen for Yoruba – Ayandele

    A gubernatorial hopeful on the platform of the All Progressives Congress in Oyo State, Dr. Olusola Ayandele, has disclosed that the weekend victory of Dr. Kayode Fayemi in the Ekiti State governorship election was a good omen for the quick restoration of lost values which made the South Western part of the country the envy of others.

    The Independent National Electoral Commission (INEC), in the early hours of Sunday, declared Dr. Fayemi the winner of the keenly contested election of July 14, 2019 after the former governor had scored the highest number of lawful votes to defeat his closest rival, Prof. Kolapo Olushola of the PDP and 33 other candidates from various political parties.

    In his congratulatory message contained in a statement issued on Sunday and made available by the Director-General of his campaign organization, Hon. Ademola Ojo, Dr. Ayandele described Fayemi’s second coming as Ekiti State’s helmsman this time as a golden opportunity to facilitate the cause of regional integration of the Yoruba in the south west geo-political zone.

    He said, “The emergence of the immediate former minister of solid minerals is highly desirable at this time when the South West, which the whole world looks up to as the pathfinder, needs to present its first eleven to champion the cause of national rebirth and thus enable the country reclaim its position as the true giant of Africa.

  • Ekiti 2018: Gov. Sani-Bello congratulates Fayemi

    Niger State Governor, Alhaji Abubakar Sani-Bello has congratulated former Minister of Mines and Mineral Resources, John Ayodele Fayemi on his victory recorded in the just concluded election in Ekiti State.

    Governor Sani-Bello described the victory as well deserved and demonstrates the people’s acceptance and confidence in the All Progressive Congress (APC).

    In a statement by his Chief Press Secretary, Malam Jibrin Baba Ndace, the Governor Sani-Bello expressed optimism that Fayemi’s second coming as the Governor of Ekiti State would transform the state and bring it to an enviable level among its peers.

    “The victory itself demonstrates how much the people love and trust you. We are sure that you would do all you can to provide your people the best dividends of democracy they have ever had “.

    Sani-Bello however called on the Ekiti Governor-elect to see his victory as a clarion call to serve urging him to extend a hand of fellowship to his opponents by providing a level-playing ground for all in the overall progress and development of the state.

    YIAGA, APC, others react to outcome of Ekiti poll

    An international civil society organisation, Youth Initiative for Advocacy, Growth and Advancement (YIAGA), Africa, the All Progressives Congress (APC)  in Ekiti,  as well as other stakeholders on Sunday expressed divergent opinions on the outcome of Saturday’s governorship election which produced Dr Kayode Fayemi as winner.

    The Nation reports that Fayemi of the APC won the election after securing 197,459 votes, beating  the Peoples Democratic Party (PDP) candidate, Prof. Kolapo Olusola, who got 178,121.

    YIAGA said in Ado-Ekiti at a press conference  that accreditation, voting and counting generally complied with extant regulations.

    The Executive Director of  the organisation, Mr Samson Itodo, however, commended INEC on the timely opening of the poll with essential materials present as well as prompt  announcement of results.

    He also urged Fayemi and APC supporters to be magnanimous  in victory

    “ For those candidates who did not win, we urge them to accept the results because they reflect the votes cast.

    “ YIAGA Africa calls upon all the candidates, all parties and all Nigerians to show political maturity and to maintain the peace,’’ he said.

    The APC in the state also described the party’s victory as “ well-won and much deserved.’’

    In a statement issued in Ado-Ekiti, the Chairman of the party, Chief Jide Awe, thanked electorate for the massive turnout and  “ voting conscientiously for the party.’’

    The chairman also  thanked President Muhammadu Buhari and other party leaders for their support in winning the governorship election.

    He, however,  called for calm and appealed to the opposition parties and their candidates to accept defeat in good faith.

    “ The APC thanks the Ekiti electorate for voting for the party in the keenly-contested election.

    “ The Ekiti electorate have voted for the candidate of their choice  who they consider as having a proven track record of performance and integrity, and who will bring about the kind of turnaround the state needs at this crucial period,’’ he said.

    He gave an assurance  that the governor-elect would  be magnanimous in victory  and deliver on the expectations of the people.

    Mrs Bolanle Olatunde, a former Special Assistant on Diaspora to former Gov.  Segun Oni congratulated the governor-elect and urged  him to put the welfare of the people at the heart of his programmes.

    She also said Nigerians must learn lessons from the outcome of the elections, especially on the need for “ anyone saddled with the position of authority to  do the right thing at the right time.’’

    “Even though, there might be claims of inducement here and there, some things I have learnt especially in Ekiti is that as incumbent, you should  do the right thing  in terms of discharging your duties.

    ” While people still talk about stomach infrastructure and all that, this can only be sustained if your performance as governor is good and you don’t waste public funds on irrelevant projects.

    “Most importantly, be humble, because when you are humble, you will be promoted. In these areas, rural people see and appreciate their governor interacting with the common man, but at the same time these people still go to the same market your wife goes to.

    ” You should set up SMEs, community development initiatives  and sustainable development projects that will bring true governance to the people,’’ she said.

    The police in the state also said the election was successfully concluded without reports of violence.

    The spokesman of the police in the state, Ikechukwu Caleb, told our reporter that the election was peaceful and orderly, adding that no arrest was made during the exercise.

    The  police had  deployed 30,000 operatives, two helicopters and 250 patrol vehicles, including  Armoured Personnel Carriers, for the  election.

    The security operation for the poll was supervised by the Deputy Inspector-General of Police, Operations, Joshiak Habila, assisted by an Assistant Inspector-General of Police, four Commissioners of Police, eight Deputy Commissioners of Police and 18 Assistant Commissioners of Police.

    Mr Maxwell Adeleye, a PDP youth leader in  Ilogbo-Ekiti in Ido/Osi Local Government Area of Ekiti, however, described the conduct of the election as “ a show of shame and mockery of all tenets of democracy.’’

    He advised the PDP candidate in the election to brace up for the challenges ahead, saying “  the victory of the APC was without jubilation on the streets.’’

    Adeleye , however,  congratulated the governor-elect on his victory and wished  him well in the governance of the state.

  • I will restore Ekiti values, says Fayemi

    The governor-elect of  Ekiti, Dr Kayode Fayemi, has described his victory in Saturday’s governorship election as one “  for reclaiming the land and restoring Ekiti values.”

    Fayemi spoke on Sunday while addressing the newsmen in Isan-Ekiti  shortly after he was declared the winner of the governorship election.

    He said: ” The victory of this election, I believe, is for   reclaiming   the land and restoring the values of our people.

    “Our values in Ekiti are respect for our leaders, commitment to our people, non brigandage, nor  criminality and so on.

    ” This victory is a victory for all, it is not a victory for only Gov.  Kayode  Fayemi, it is a victory for all the Ekiti people.’’

    Fayemi also described his victory as  significant to  the future of democracy in Nigeria.

    “This was just not an Ekiti election, I want people to understand that this election has a lot of significance  to the future of democracy in Nigeria.

    ” The fact that we have witnessed a free, fair and transparent election process  has huge importance for similar exercises  like Osun State next door to  us and eventually the national elections in February 2019,” he said.

    The  governor-elect  thanked all the APC leaders, including President Muhammadu Buhari, National Leader of the APC,  Sen. Bola Tinubu, former governor of  Ogun,  Chief Segun Osoba, former interim Chairman of the party, Chief Bisi Akande,  as well as  party leaders in the state.

    He also thanked his family members, especially his wife, Bisi,  for their support  during the election campaign.

  • Ekiti 2018: Jubilation as Fayemi emerges winner

    There was jubilation in Ado Ekiti main road on Sunday after the All Progressives Congress (APC) candidate, Dr. Kayode Fayemi emerged  winner of Saturday’s governorship election in Ekiti state.

    Fayemi was declared governor-elect by the Chief Returning Officer, Prof. Idowu Abel Olayinka at 7.59 am on Sunday.
    Olayinka, who is the Vice Chancellor of the University of Ibadan, declared the poll’s outcome after party agents signed the official result sheet.
    Fayemi polled 197, 459 votes to defeat the People’s Democratic Party (PDP) candidate and incumbent Deputy Governor, Professor Kolapo Olusola who garnered 178, 121 votes.
