    Appeal Court to EFCC: You can’t freeze Fayose’s account

    Ekiti State Governor Ayo Fayose has secured another judicial victory against the Economic and Financial Crimes Commission (EFCC) over his accounts domiciled at the Zenith Bank which was frozen last year.

    The Court of Appeal sitting in Ado Ekiti on Tuesday threw out an application for injunction restraining the anti-graft agency from freezing the accounts the governor is operating with Zenith Bank.

    The account was last year June  frozen over allegation that it contained a sum of N2.999 billion out of the 3.2 billion dollars suspected to have been distributed through the office of the former National Security Adviser, Col. Sambo Dasuki (rtd).

    But the account was unfrozen on December 13 last year after which Fayose withdrew the sum of N5 million from the bank’s branch in Ado-Ekiti shortly after the judgment was delivered. The EFCC filed an appeal against the judgment on grounds that the money was a proceed of crime.

    The Appeal Court in panel comprising Justices Ahmad Belgore, Fatima Akinbami and Paul Elechi in a unanimous judgment held that that the EFCC did not attach notice of appeal and the Federal High Court, Ado Ekiti judgment of December 13, 2016, which ordered the anti-graft agency to unfreeze the governor’s account that the EFCC appealed against.

    The judgement read by Justice Akinbami said: “No valid appeal has been made against the judgement of the lower court which unfreeze the account. Against the judgment the EFCC was appealing against was not attached to this application.

    “EFCC also failed to show sufficient evidence that the money in the account was a proceed of crime as claimed. In doing this, we expect the EFCC to have showed evidence that the plaintiff has been tried for criminal offence before for it to assume that he can receive proceed of crime.

    “We also found that there was suppression of facts to get the account frozen in the first instance.  It was also noted that Governor Fayose in line with Section 308 enjoys immunity and his personal account can’t be frozen

    “Having not done all these as demanded by law and equity, as those facts were facts that would assist in exercising the court’s discretion either for or against as it is an application  that is predicated on discretion of the court. The application is hereby thrown out,”.

    The court also said that the alleged damning intelligent report by the EFCC, which it claimed to have received concerning money purportedly paid into Governor Fayose’s account by Senator Musiliu Obanikoro was not provided nor attached for the court to see.

    It described EFCC’s claim on the receipt of an intelligent report concerning money purportedly paid into Governor Fayose’s account by Obanikoro as mere speculation, saying; “the court does not embark on speculation.”

    The court also held that since the EFCC had admitted that N80 million had already been withdrawn from the accounts, saying that Chief Ozekhome was right to say that the cat had already been completed and an injunction cannot be granted for act already completed.

    Counsel to Fayose, Chief Mike Ozekhome (SAN), who described the verdict as “another victory over tyranny” advised the EFCC to act within the rule of law in its operations.

    Ozekhome said the anti-graft agency will continue to lose cases it filed against suspects in courts until it divorces itself of selective justice and taking biased position  in the politics of the country.

    He said: “This portrayed judiciary as the sentinel on the door of the poor, defenceless and oppressed. Governor Fayose and myself had again been vindicated that EFCC’s operations have not been based on law but on emotion.”

    Fayose to Corps members: Be security conscious

    Ekiti State Governor Ayo Fayose has called on corps members serving in the state to be security conscious and avoid unauthorised journeys.

    He made the call on Monday at closing ceremony of the orientation course for Batch ‘A’ Stream 1 corps members held at NYSC Orientation Camp in Ise/Orun/Emure.

    Represented by his deputy, Dr. Kolapo Olusola, Fayose advised the corps members to respect the norms and cultures of the host communities of service.

    Fayose also charged them to make best use of opportunity to contribute to the development of the state which he described as one of the most secured in Nigeria.

    Earlier in her address, the NYSC State Coordinator, Mrs. Nwanne Ukagha, explained that 2,084 corps members participated in the orientation course.

    She urged the corps members to give their best in serving the community of posting whether they are well remunerated or not saying their service is to the nation.

    Ekiti State Governor Ayo Fayose has hinted on his readiness to quit the People’s Democratic Party (PDP) over the protracted factional crisis tearing the green-red-white umbrella to shreds.

    The governor has also showcased new campaign buses which have no PDP name and logo fueling speculations that he had perfected plans to move to another party.

    The campaign buses have the following inscriptions: “Support Continuity 2018, Fayose Wherever You Go, We Will Go”; “Ekiti 2018…Continuity, Fayose Leads, We Follow.”

    Buses including 35-seater Toyota Urvan and 18-seater Toyota Hiace, otherwise known as Toyota Hummer bus are parked in the premises of the Government House.

    The buses which are painted lemon green are embossed with the picture of a smiling Fayose wearing black “danshiki” with red embroidery and waving.

    The non-appearance of the PDP name and logo are tell-tale signs that Fayose has made up his mind to quit the umbrella party.

    But Fayose who hosted students and youths Wednesday evening at Government House grounds whose ages range between 18 and 22 emphasized that he won’t wait a day longer in the PDP if his faction loses the case at the Supreme Court.

    Many of the students who were attracted to the Government House with the governor’s promise of giving the first 300 that arrived laptops went home disappointed when the promise was not fulfilled.

    Fayose promised to organize a raffle draw to determine the laptop winners which did not go down well with the youths who were eager to go home with their prizes.

    Addressing the audience earlier, Fayose He also dropped a bombshell that stakeholders in the party loyal to Senator Ahmed Makarfi will defect to another party, if Senator Ali Modu Sheriff wins the appeal pending at the apex court.

    He did not mention the party they (Makarfi loyalists) would defect to in the event of a loss to Sheriff.

    When asked whether he has the intention of leaving the PDP as being rumoured, Fayose stated that no law prohibited him from defecting if the PDP can’t be a veritable platform for him to advance his political frontiers in 2018.

    Fayose said: “I am still a member of the PDP and still the Chairman of the PDP governor’s forum, there are no two sides to it.

    “But the strategy for 2018 poll is strictly my own business. No law says I should not run on the platform of another party if the PDP is no longer a right direction depending on circumstances.

    “If they are bent on destroying the PDP, let them go ahead but I will never have anything to do with Senator Sheriff. The party is like a vehicle and the vehicle can’t be more important than the driver.”

    Fayose slams Police for battering woman at checkpoint

    Ekiti State Governor Ayo Fayose has slammed the Police in Ekiti State for the brutalization of a woman, Mrs. Toyin Adeyeye by some policemen on Friday for allegedly refusing to give them bribe at a checkpoint.

    Mrs. Adeyeye, her two-month-old baby, Heritage and younger brother, Adeniyi Dada, were detained at New Iyin Road Police Station but were later released following the intervention of the state chapter of International Federation of Women Lawyers (FIDA).

    While the husband of the woman, Akanni Adeyeye, claimed that about five policemen battered his wife for refusing to grease their palms, the Commissioner of Police, Abdullahi Chafe, alleged that Mrs. Adeyeye slapped one of the policemen.

    But Fayose vowed that manhandling of women in any guise will no longer be condoned in the state adding that it was unlawful for any policeman to raise his hand against a woman.

    According to a statement on Monday by his Chief Press Secretary (CPS), Idowu Adelusi, Fayose made the vow during an interview shortly before the commencement of the state’s “Meet Your Governor” programme, March edition, on Sunday night.

    Fayose said he heard about the attack on Mrs. Adeyeye, at the checkpoint which prompted a meeting with the state commissioner of police over the matter.

    “It is highly irresponsible for any man to brutalise a woman for any reason. The law that forbids violence against women is still operative in this state.

    “And I can never allow any form of brutality of women under my watch as governor in Ekiti State. Women are even described as the weaker vessel. As such even if you marry her, does that deny her of her rights?

    “It is particularly sad that such a report was coming barely week after we celebrated International Women’s Day in an unprecedented style in this state. I have already ordered investigation into the matter. Anybody found culpable in the case will face the court of law.

    “I am also using this opportunity to sound a note of warning to policemen who take people’s vehicle particulars, put them under their armpits and demand for bribe. Such cannot be allowed any longer in Ekiti State.

    “We will get to the root of the matter and make justice to prevail.”

    For attempting to extricate himself from the web of $1.09 billion Malabu oil deal, former President Olusegun Obasanjo has come under scathing attacks from Ekiti State Governor Ayo Fayose.

    Fayose in his second tirade against Obasanjo within two weeks described the former president as “the father of corruption in Nigeria who sits on stolen wealth and lacks moral rights to accuse anyone of corruption.

    While challenging Obasanjo to explain to Nigerians his source of “stupendous wealth”, Fayose in a statement on Thursday by his Special Assistant on Public Communication and New Media, Lere Olayinka, attacked the Ota chicken farmer for his alleged “holier-than-thou posture”, grandstanding and pontification on issues of corruption.

    The chairman of the People’s Democratic Party (PDP) Governors’ Forum who claimed that Obasanjo presided over one of the most corrupt administrations in the history of Nigeria restated his call that the ex-leader should refund the N10 million he (Obasanjo) forced him (Fayose) to donate alongside other 29 governors to his presidential library project in 2005 with interest.

    Fayose who described the alleged compulsion to donate the cash for the library project about twelve years ago as “extortion” also demanded an explanation from former president on the cash-for-vote scandal on his (Obasanjo’s) alleged third term bid in which National Assembly members were compromised to rework the Constitution to elongate his tenure.

    He said: “It smacked of the highest level of hypocrisy for someone like Obasanjo to be sermonizing about corruption, having superintended over a corrupt government himself.

    “The former President must come out clean on his roles in the controversial $1.09 billion Malabu Oil deal, instead of warning former Attorney-General of the Federation (AGF) and Minister of Justice Mohammed Adoke to stop mentioning his name in the deal.

    “It is on record that the out-of-court settlement on the controversial Malabu Oil Block was initiated in 2006 during Obasanjo’s administration. Obasanjo’s accusing anyone of corruption was like “Oyenusi accusing Shina Rambo of armed robbery.

    “I challenge the former President to explain to Nigerians the source of his stupendous wealth. We saw how Obasanjo was when he became president and the magnitude of both direct and indirect investments that he has now. Can he in all honesty tell Nigerians that he acquired his wealth through legitimate means?

    “Even the National Assembly affirmed him (Obasanjo) as the grandfather of corruption in Nigeria and it is on record that it was this same Obasanjo, who is always claiming holier than thou that introduced politics of ghana-must-go bags to the National Assembly.

    “Has Obasanjo forgotten how many billions of naira was deployed to lobby National Assembly members to support his third term agenda?”

    “Has he forgotten so soon that it was during his tenure that sacks of money were displayed on the floor of the House of Representatives, as bribe money given to some Reps members to impeach the then Speaker, Ghali N’abba?

    “I reiterate my demand that the former President should refund with interest, the N10 million that I was forced alongside other governors to donate to his Presidential Library project.

    “Someone like Obasanjo, who used his position as President to extort money from governors, businessmen and contractors to build his presidential library lacked moral rights to accuse anyone of corruption.”

    He added: “Other Nigerians who left offices as President are still relevant to their people, but can the same be said about Obasanjo? Was he useful to the Yoruba race as President and now as former President?

    “The bad state that he left major roads linking the Southwest to other zones in Nigeria, especially the Lagos-Ibadan expressway remains a pointer to this. Yet, he goes about postulating as if he is the only honest Nigerians who can make things right in the country.”

    Ekiti State Governor Ayo Fayose has called on President Muhammadu Buhari to unconditionally release former National Security Adviser (NSA), Sambo Dasuki and leader of Indigenous People of Biafra (IPOB) Nnamdi Kanu from prison custody.

    In a statement released on Monday by his Chief Press Secretary, Idowu Adelusi, Fayose admonished Buhari to reciprocate the mercy of God upon his life by also showering mercy on his fellow citizens.

    Fayose said: “You have received the mercy and favour of God. You have come back from medical vacation alive. By what people had said and by your own account, it is the mercy and favour of God that have seen you through as well as the prayers of everyone.

    “It is incumbent on you to now also show mercy. I advise you to show mercy to Nnamdi Kanu and Sambo Dasuki and such other Nigerians that are suffering unjust, punitive, illegal, and unconstitutional incarceration under your directive or administration.

    “Allow all those who have been granted bail by the court to enjoy their bail while their trial continues. This is the right, just, and merciful thing to do. To continue to disdain the court is reckless and unconstitutional. Moreover, it is a sin and it is oppressive.”

    Ekiti State Governor Ayo Fayose on Wednesday declared that he does not need the officers of the Nigeria Police and the Department of State Services (DSS) to give him protection again.

    He called on the Federal Government to withdraw the police and DSS men accusing the two security agencies of working for the All Progressives Congress (APC)-led Federal Government

    Fayose made the outbursts during this year’s International Women’s Day celebration held at the Oluyemi Kayode Stadium in Ado Ekiti, the state capital.

    He boasted that the APC-led Federal Government cannot capture power from him in the 2018 governorship election.

    Addressing a mammoth crowd that thronged Oluyemi Kayode Stadium, Ado Ekiti, venue of the rally, Fayose declared that he has the support of the people to defeat the APC and its federal might in the 2018 polls.

    He also reiterated his support for the People’s Democratic Party (PDP) National Caretaker Committee Chairman, Senator Ahmed Makarfi, saying he does not recognize the National Chairman, Senator Ali Modu Sheriff.

    The governor dared the Federal Government to remove officers of the Nigeria Police and Department of State Services (DSS) protecting him saying “I have local people behind me giving me protection.”

    Commending Ekiti women for their support for his administration, Fayose announced an empowerment of N500 million to empower them in farming, petty trading and grassroots economy.

    Fayose also promised to elevate a female Executive Secretary who has few days to retire to the post of Permanent Secretary. He also announced a N2 million donation to a local female musician, Bukky to purchase state-of-the-art musical instruments.

    He also promised to appoint a Special Assistant to coordinate activities of women in his administration.

    Fayose said: “In the next local government election, we must produce one-third of women as councilors, one-third of women as chairmen, one-third of women as supervisors. The era of imposition has gone; our men must stop intimidating women.”

    But the governor used the forum to make some political statements in what seemed to be a campaign rally before the Independent National Electoral Commission (INEC) lifts ban on public campaign.

    In a bid to prove his popularity, Fayose urged the crowd to bring out their voter cards and show them to the Acting President, Prof. Yemi Osinbajo, Senate President, Dr. Bukola Saraki, Aso Rock Presidential Villa and INEC.

    Fayose said: “Nobody can take Ekiti away from me; the power of the people is greater than the power of federal. We gave them 16-0 at the last election; we are going to give them 16-0 again.

    “Now Ekiti women, show them your voter’s cards, show INEC in Abuja your voter’s cards that we are going to vote them out. APC professional riggers, look at their voter’s cards. Let them see your cards at the Villa, I hope you are seeing their cards.

    “Ekiti is a no-go area; we are prepared even if you call for election tomorrow. APC exists on pages of newspapers, they exist on propaganda but we have now matched them propaganda-for-propaganda.

    “Show the performing Acting President, Prof. Yemi Osinbajo, your voter’s cards. Show Senate President Bukola Saraki, your voter’s cards. In Ekiti, we are behind Makarfi, we don’t know Sheriff.

    “Anybody moving against my government will be removed; anybody that wants to topple me will not finish their government.

    “Tell them, I don’t need their policemen, I don’t need their SSS. Let them come and remove their policemen and SSS. I don’t want APC police, I don’t want APC SSS, these people are my police.”

    Speaking on PDP factional crisis, Fayose said: “On what is going on in PDP, fear not he who laughs last, laughs best. We are not for Sheriff, we don’t believe in Sheriff. Don’t be worried at all.”

    Others who addressed the rally include Fayose’s wife, Feyisetan; Deputy Senate Minority Whip, Senator Biodun Olujimi and Niger Delta female activist, Annkio Briggs.

    For the second time within twenty four hours, Ekiti State Governor Ayo Fayose, has given further insight on his political future ahead of the 2018 governorship.

    The governor on Thursday while receiving an award from the Ado Ekiti Community declared that he won’t join the ruling All Progressives Congress (APC) following speculations that he was on his way out of the People’s Democratic Party (PDP).

    He described the APC as “a party of hunger and a Red Sea” warning APC leaders to perish the thought of annexing Ekiti to states under the control of their party saying “Ekiti is not Ondo.”

    Fayose spoke at the palace of the Ewi of Ado Ekiti, Oba Adeyemo Adejugbe, shortly after receiving the award of ‘Outstanding Achiever of Our Time’ given to him by the umbrella body of the town’s indigenes, Ado Progressive Union (APU).

    The governor was honored by Ado indigenes for the various completed and ongoing developmental projects carried out by his administration including the amphitheater in the palace, new Erekesan Market, dualization of a Ado-Ikere Road, flyover linking Fajuyi with Okesa, among others.

    Speculations are rife that Fayose and his political family are heading to the Alliance for Democracy (AD), the platform on which he hopes to anoint a successor as he is constitutionally barred from running again in 2018.

    The protracted factional crisis in the PDP which affected the party’s chances in Ondo State is believed to be the reason for planned dumping of the platform on which he had won governorship at two different occasions to another party.

    Fayose said: “I will never dump PDP for APC. I remain strong and unshaken for the PDP. I can’t jump the boat, even if I want to jump, I won’t jump into the Red Sea.

    “Why should I leave the PDP and join a party of hunger like APC? Ekiti is different from Ondo. By the grace of God, there will be a repeat of history here in 2018, I shall repeat the 16-0  that I gave them in 2014.

    “I operate like the biblical Elisha because those with us are greater than theirs. The God of Israel that conquered Philistines shall be on our side”.

    “What I said is that if the current man-made crisis rocking the PDP persists till 2018, rather than allow them mess us up like they did in Ondo, we may have to seek an alternative and credible platform.

    “We are not people who betray the confidence of our people. If there will be change at all, it will not be spur-of-the-moment. We shall carry our leaders and the people along.”

    Fayose said the development agenda of his government for Ado Ekiti will continue to pose a challenge to future administrations boasting that by the time election comes; opponents will have nothing to campaign about in the state capital.

    He added: “Chief Obafemi Awolowo died 29 years ago, but his work live on. I want people in ten, twenty, fifty years to think of one Ayo Fayose that governed Ekiti and opened up Ado Ekiti, built a new Oja Oba Market, the flyover, dualization of many towns among other landmark projects.

    “I have raised the bar of development in Ado Ekiti, I have raised the respect for Ewi and no governor can come to Ekiti and undermine this town and the throne.

    “I shall do more to promote this palace to the extent that our opponents will have no space within this palace to construct any structure.”

    Speaking on the award, Fayose said he dedicated it to his wife, Feyisetan, and the people of the state. He described the award as the best he had received in recent times saying he had received over 50 requests for awards which he declined on principle.

    In his speech, the President-General of APU, Chief Obafemi Ojo, said it was clear that Fayose had done what no former leader of the state had done for the town and the state in general.

    Ojo added that Fayose had been kind to Ado Ekiti people in terms of appointments and development.

    Oba Adejugbe said the award was in recognition of Fayose’s uncommon service to Ado-Ekiti and the state in general.

    Ekiti State Governor Ayo Fayose has challenged the All Progressives Congress (APC) to come out with concrete evidence to substantiate its claims that he is spending state funds on his case against the Economic and Financial Crimes Commission (EFCC).

    Speaking through his Chief Press Secretary, Idowu Adelusi, Fayose advised the APC to forward any evidence at its disposal to the EFCC warning the opposition to keep silent since “Ekiti people have not complained that their money is missing.”

    He said: “That kind of allegation can only come from the dirty mind of APC members in Ekiti.

    “There is nothing like that and if they have strong evidence, the EFCC which has become a department of the APC‎ is there for them to do their biddings.

    “Or has Ekiti people complained that their money is missing?‎ By the way, the APC governors whose electio‎ns were challenged in the court, where did the money spent on litigations come from?

    “The APC was in government in Ekiti 1999-2003 and 2010-2014, the PDP did not disturb them as they are waging war, fabricating lies everyday to disparage this government.

    “By the grace of God, their noise will be like that of dog before mankind.‎ The APC should stop disturbing sensibility of Nigerians and face squarely the myriads of problems confronting the people.

    “Nigerians are hungry and never had a bad government ‎as this.”

    Ekiti State Governor Ayo Fayose has insisted that he did not receive a dime from the former National Security Adviser (NSA), Col. Sambo Dasuki (retd) and former Minister of State for Defence, Musiliu Obanikoro for the purpose of funding his campaign in the 2014 governorship poll.

    Fayose who is under fire for alleged complicity in the sharing of N4.7 billion being part of the $2.1 billion meant for the purchase of arms to fight insurgency in the Northeast alleged that the anti-corruption crusade is being used to settle political scores.

    Speaking on Friday in Ado Ekiti at a rally organized by Ekiti Private Sector Union, an amalgamation of informal unions in the state, Fayose claimed that the ongoing onslaught against him was aimed at taking Ekiti by force by the All Progressives Congress (APC) at the next governorship election scheduled for 2018.

    He said Ekiti people will defend the state against the “APC invasion” in 2018 saying he is not afraid of death or incarceration in the process of defending the mandate given to him at the June 21, 2014 election.

    The governor maintained that the freezing of his personal bank accounts by the Economic and Financial Crimes Commission (EFCC) was “politically motivated and intended to silence a credible voice of opposition against a dictatorial government.”

    Fayose said: “They said I collected a sum of N1.3 billion from the office of the former National Security Adviser, Col Sambo Dasuki to fund my election. Some even said I collected it through Mr Musiliu Obanikoro. Let me put it on records that I did not know Col Dasuki and Obanikoro has not come out openly to indict me, because he has not returned from abroad .

    “They said similar thing in 2006. It was all about second term then, because they didn’t want me to contest for second term. They said the N1.3b project which I initiated was a scam, but God brought me back. The APC and  EFCC conspirators took me before a Judge and I got justice.

    “When God says yes, nobody can say no. God has given me uncommon favour over my enemies. I am presently using the mandate of God and Ekiti people and they are ready to defend the mandate and that is why you proudly came out today to express support for me.

    “Nigerians have never had it so bad like this. People are suffering and hungry and President Buhari says he is fighting corruption. How can the FG increase fuel from N86 to N145? The price of kerosene is now over N200.

    “No act of intimidation and harassment will shut my mouth. I will continue to talk about national issues. When you want to campaign or do marriage, people will give you money and my own can’t be an exemption. I am not afraid of incarceration or death.

    “APC problem is 2018 and as the God liveth, they are going nowhere. We will stand up and defend our state and the money they said they have gotten through anti-corruption should be spent for Nigerians.”

    The National Union of Road Transport Workers (NURTW) Chairman, Clement Adekola, his Road Transport Employers Association (RTEAN) counterpart and Okada Riders Association boss, Niyi Dahunsi were inaugurated as Ekiti Private Sector Union Chairman, Secretary and Vice Chairman respectively, among other executive members.

    The newly-inaugurated Union pledged their allegiance to Fayose and called on the EFCC to stop distracting Fayose.

    Adekola warned the APC against destabilizing Ekiti over the loss it suffered during  the 2014 governorship poll.

    Agbede asserted that the alleged conspiracy between the federal government and the opposition will fail and won’t materialize, just as he condemned alleged use of federal might  to rattle the governor.
