    Maina ran bank account through sms, email, EFCC tells court

    A Federal High Court in Abuja heard yesterday how huge sums belonging to pensioners were allegedly diverted by former Head of Service of the Federation (HOSF) Stephen Oronsaye and former Chairman, Presidential Task Force on Pension Reforms, Abdulrasheed  Maina through phoney contracts.

    Maina the court was told ran a bank account using sms and sending electronic mails.

    An operative of the Economic and Financial Crimes Commission (EFCC), Rouqayya Ibrahim ,said pension funds were allegedly diverted by the duo through various companies.

    Rouqayya spoke yesterday while testifying as a prosecution witness in the trial of Oronsaye, the Managing Director of Fredrick Hamilton Global Services Limited, Osarenkhoe Afe and the company on a 24-count charge bordering on stealing and obtaining money by false pretence.

    They are alleged to have been involved in contract awards during Oronsaye’s tenure as HoSF.

    The prosecution alleged that the fraud, involving about N2 billion, was allegedly perpetrated using firms like Cluster Logistic Limited, Kongolo Dynamic Cleaning Limited, Drew Investment and Construction Company Limited, and Xangee Technologies Limited.

    Led in evidence by lead prosecution lawyer Rotimi Jacobs (SAN), Rouqayya said in the course of investigation, the EFCC requested for payment mandate from the office of the Head of Service (HOS).

    She said: “We analysed the mandate, obtained necessary information like bank account numbers, and then requested for the account statements from the banks,” she said.

    She stated that the analysis revealed a company, Xangee Technologies Limited, which she noted, was already being tried before Justice Abubakar Talba of the High Court of thr Federal Capital Territory (FCT), Gudu, for alleged pension fraud.

    The witness said: “We discovered that the company received payment of more than N183 million for biometric enrolment, but there was no biometric contract executed by the company, instead the money was withdrawn cash, converted to US dollars and handed over to Abdulrasheed Maina, through his brother, Khalid Biu.”

    She added that three other companies – Mofshad Ventures, Mofshad Limited and Kombosko Nigeria Limited— received more than N400 million for non-existent contracts.

    The witness said: “We discovered that the three companies were associated with one Emmanuel Olanipekun, who is also currently standing trial, and one Chidi, also standing trial, and the monies were withdrawn in cash with part of it given to Mr. Oronsaye.”

    She said investigation of the pension account in Union Bank showed that there was a letter, instructing that the money be transferred to another pension account.

    “We saw another letter on it, on which there was a minute and instruction from Mr. Oronsaye, to transfer about N113 million to a Unity Bank account belonging to the State House, which we discovered he was the sole-signatory.

    “As at the time the transfer was made in 2010, Mr. Oronsaye had ceased to be the Principal Secretary in the State House and had become the Head of Service. We discovered that the monies were withdrawn through cheques, but all efforts to get the person to whom they were issued to, was unsuccessful, and Mr. Oronsaye could not explain the reason for the disbursement,” the witness said.

    She said: “There was also another account in the name of Abdulrasheed Maina, and his brother, Biu, an employee of the bank, who opened the accounts and was the account officer.”

    She added that  after Biu resigned from the bank, another employee, Toyin Meseke, took over as the account officer.

    The witness said: “We invited him for an interview and discovered that all the accounts were operated by Abdulrasheed Maina, even though his name, picture and signature were not anywhere in the opening account packages.”

    She said Maina operated the account mainly through text messages and emails, as “instructions regarding payment or withdrawal were sent to Meseke by text or email”.

    Rouqayya said forensic analysis of Meseke’s phone was carried out, which revealed how funds were fraudulently diverted from the account. She added: ”The account officer will, after receiving instruction from Maina, convert the money to US dollars and deliver same to him in Dubai.”

    According to her, Maina, a former Chairman, Presidential Task Force on Pension Reforms, remained at large.  She said Maina never showed up in the course of investigations, and deserted his known residence.

    Earlier, Jacobs tendered three statements made to EFCC’s investigators by Oronsaye, during the course of investigations. The statements were identified by Ibrahim and admitted in evidence by the court when defence lawyers, Joe Agi (for Oronsaye) and Oluwole Aladedoye (for Afe and his company) failed to object.

    Justice Kolawole adjourned till December 5,  for continuation of the judicial trial.

    Director of United States Federal Bureau of Investigation, James Comey has cleared Democratic candidate Presidential candidate Hilary Clinton of criminal prosecution over her use of private email servers during her time as secretary of state.
    Comey according to agency report informed key lawmakers on Sunday that his conclusion came after FBI agents reviewed all of the newly discovered messages to or from Clinton found on electronic devices that belonged to her top aide’s estranged husband, former congressman Anthony Weiner.

    “The FBI investigative team has been working around the clock to process and review a large volume of emails from a device obtained in connection with an unrelated criminal investigation,” Comey said in his letter.

    “During that process we reviewed all of the communications that were to or from Hillary Clinton while she was Secretary of State. Based on our review, we have not changed our conclusions that we expressed in July with respect to Secretary Clinton,” he continued.

    Bill Cosby: Email may derail case against entertainer

    Former district attorney in Montgomery County, Pennsylvania, claims he agreed more than a decade ago that his office wouldn’t use a civil deposition given by Bill Cosby in any criminal matters, an email obtained by CNN shows a revelation that could call into question the viability of the criminal case against the comedian.

    The 2015 email sent by former District Attorney Bruce Castor to successor Risa Vetri Ferman — details an apparent verbal agreement the prosecutor had a decade earlier with Cosby’s attorneys for Cosby to testify in a civil sexual assault case brought against him in 2005. In the email, Castor writes that his intent in making the deal was to create an atmosphere in which Cosby accuser Andrea Constand would have the best chance of prevailing in her civil suit against the 78-year-old comedian by removing the prospect of Cosby invoking his 5th Amendment right.

    CNN reports that the email was sent three months before criminal charges were filed against Cosby in Montgomery County in December, and could call into question the viability of the case, CNN has learned.

    In it, Castor writes to Ferman: “I can see no possibility that Cosby’s deposition could be used in a state criminal case, because I would have to testify as to what happened, and the deposition would be subject to suppression.

    “I cannot believe any state court judge would allow that deposition into evidence. …. Knowing this, unless you can make out a case without that deposition and without anything the deposition led you to, I think Cosby would have an action against the County and maybe even against you personally.”

    The deposition is a key piece of evidence, cited by prosecutors as the impetus for reopening the case.

    At the center of the case are allegations made by Constand, a former Temple University basketball employee, who says Cosby sexually assaulted her in his home in 2004.

    Dolores Troiani, an attorney for Constand in 2005, told CNN’s Jean Casarez on Friday that she never knew about any such agreement between Cosby’s attorneys and prosecutors.

    Castor, when asked by CNN about the email, declined to comment.

    The current district attorney, Kevin Steele, who was elected in November after serving as Ferman’s longtime top deputy, told CNN on Friday: “There is a specific legal method to grant immunity. That was not done in 2005.”

    Steele also noted that in Castor’s 2005 press release declaring there was insufficient evidence to prosecute Cosby that Castor himself said he would “reconsider this decision should the need arise.”

    Daniel Ademinokan’s email hacked

    IF the information available to us is anything to go by, it appears that the industry is yet to see the end of the breakup of the marriage between movie director, Daniel Ademinokan, and his estranged wife, actress Doris Simeon.

    Daniel’s email was said to have been hacked, thereby exposing some of his confidential chats.

    The email in question read in part:

    “Good day, sir. How is the family, sir? And how is the ministry too, sir? I hope all is well. I know that by now, you’re probably tired of my case, but you are the only one I can speak to at this point.

    “Sir, it seems the moment Doris speaks to everyone and brings out her ‘acting’, people just flip and turn.

    “Nobody sees when she calls, threatens and curses the life out of me and everything else. But I have always taken it with a pinch of salt.

    “As you said, sir, she has a right to be angry and do anything, but I equally have a right to have my son and look out for his best interest. I have a right to be angry and run to the press to talk about all her infidelity and affairs, but I chose not to because I was the fool who looked away because I wanted to keep my home. I was the one playing ‘mumu’ for her.

    “After all the lies she told in court, am I still supposed to just be granting her every single request and need? She lied that she had not seen David and me since 2011. This is the same girl that came to Abuja twice to see David and me. The same girl that I flew to Lagos to see personally and privately to discuss David’s custody. This was in January. We also met in London in March, when I went to shoot a music video. I have pictures to prove it. I even gave her money to shop as well. It was in London she told me about her new affair with Wale. I didn’t crucify her; I just told her to be careful and find true happiness, period! What she does with herself is really none of my direct business.

    “Pastor, based on what you and I discussed, I offered to fly her to the United States twice a year, all expenses paid for by me, so she can bond with David. I also said she could come one million times if she likes, but I would only pay for two trips. But she refused. Now, she still wants to be calling me every second to bother me about David in private, when she is making a mess of my character in the press and the public. She is using everything and everyone out there to mess me up and I’m supposed to still give her audience and grant all her wishes?

    “Pastor, na this girl life I go tie my whole existence to? How can I continue to be civil with her when she is playing dirty and acting holy to everybody?

    “Nobody is seeing what I’m seeing and it is just a pity. She does not care about David. She is doing all this gra gra just to save face. She wants to ruin David’s life all in the name of winning!

    “Pastor, below is a conversation I had with Doris before your trip to the US that we spoke. How does this show that I have been mean to her? How does this show that I kept her away from David? She used to talk to him every single day. The dates are right there and she has just been lying to everyone. I was forced to send this to you because I am just tired of all her endless lies and pretence.

    “I’ve since refused to speak to her because she cannot be killing me on both sides. If she wants to talk and dialogue, she should get outta court and stop messing me up in the press with her media sugar daddies. If she wants to stay in court, I don’t have a problem with that. She should leave me alone and do according to the court’s rulings.”

    Although Doris couldn’t be reached for comment, her publicist simply said she had decided to keep mum over the matter.

    It will be recalled that Daniel allegedly relocated to the US with actress Stella Damasus sometime last year.
