    Erisco controversy: Trial of food reviewer stalled

    The trial of Mrs Chioma Okoli, charged with allegations bordering on her online commentary on Erisco Foods Limited’s tomato paste, was, on Thursday, stalled at a Federal High Court, Abuja.

    The matter, fixed for trial, could not proceed because the trial judge, Justice Peter Lifu, went on an official assignment.

    Although Justice Lifu sat today, he however rose after taken some cases to attend a conference.

    The trial was subsequently fixed for June 19 on counsel agreement

    The News Agency of Nigeria (NAN) reports that Okoli was, on May 31, admitted to N5 million bail with two sureties after spending few days in a correctional centre following her arraignment on two counts on May 28.

    NAN reports that Mrs Okoli is being charged over her online commentary on Erisco Foods Limited’s tomato paste which the police alleged violated the Cybercrime Act, 2015.

    She pleaded not guilty to all the counts.

    The police had alleged that initial investigations revealed significant evidence suggesting Okoli’s involvement in breaking existing laws, especially concerning the appropriate use of cyberspace.

    On Sept. 17, 2023, Okoli shared a Facebook post stating that she purchased Nagiko Tomato Mix from Erisco Foods, the day before and found it utterly sugary.

    She mentioned that she normally buys Gino or Sonia brands, but they were out of stock.

    Her post generated reactions and forced the management of the company to involve the police through a petition to the I-G.

    The controversy also prompted scrutiny of the product’s registration, prompting the National Agency for Food and Drug Administration and Control (NAFDAC) to carry out an inspection on the Erisco Foods’ Nagiko Tomato Mix’s registration in 2021.

    Erisco food case: Court grants Okoli N5m bail

    Federal High Court in Abuja on Friday, May 31, granted Chioma Okoli a N5 million bail with two sureties of the same amount, over alleged conspiracy and cyberstalking over her review of a tomato mix produced by Erisco Foods Limited.

    The bail conditions include a bail bond of N5 million, two sureties in like sum, one of which must be a spouse or blood relative, and two passport photographs. The defendant must also deposit her international passport with the court.

    Okoli is facing charges related to her online remarks about Erisco Foods Limited’s tomato paste, which the police say contravened the Cybercrime Act of 2015.

    She was brought before the court by the Inspector-General of Police and indicted on two cybercrime counts.

    Okoli entered a plea of not guilty to both charges.

    The case has been adjourned until June 13, 2024, for trial.

    Erisco Foods mulls N5b suit over customer’s complaint

    Founder and President of Erisco Foods Ltd, Eric Umeofia, has said the company would be suing for N5 billion damages from a customer who he said unfairly criticized the product of the company.

    He said the company would be seeking N5 billion in damages due to the extensive harm the customer has caused the company.

    He narrated how the company lost $30 million credit line from foreign partners.

    In a statement, the company said the fund was lost following a post an unfavorable review of Erisco’s Nagito Tomato Mix product on Facebook by one of its customers.

    He said the company will initiate legal proceedings against the customer.

    The situation revolves around posting of a critical review of Erisco’s product on social media, which subsequently led to arrest of the customer by the Police and subsequent transfer to Abuja.

    He claimed that his company has faced undue pressure from a group of importers actively attempting to tarnish the Erisco brand in a bid to harm the business.

    “I am pursuing legal action against her because I feel a sense of responsibility. Is it justifiable for the customer to unfairly criticize my product, with people rallying behind her? We employ over 3000 individuals in my factory, indirectly benefiting 20,000 people. I cannot allow this kind of ‘conspiracy’ to jeopardize my business,” Umeofia said.

    Speaking during an appearance on Arise News Global Business Report show, Umeofia highlighted significant damage incurred due to the negative attention as the basis for seeking legal redress.

    “I will be suing for N5 billion. I currently have a $15 million credit line from two customers in China. Therefore, we are seeking N5 billion in damages due to the extensive harm the customer has caused. The loss of $30 million is significant, especially considering that I haven’t received credit from Nigerian banks and the Central Bank of Nigeria for the past five years,” Umeofia said.

    He had actually planned a different story for this week, but we cannot afford to ignore the storm in the media occasioned by the arrest of a female consumer, Chioma Egodi who gave a negative review of Nagiko tomato mix

    In the review, Chioma posted an image of the tomato tin which she bought from a store and wrote on her Facebook, “I decided to taste it, sugar just too much.”

    Reacting, the manufacturer, Erisco said its attention has been “drawn to a Facebook post by one Chioma Egodi jnr on September 17 2023 alleging that Nagiko tomato mix, one of the three tomato paste variants of Erisco foods Ltd, contains an unhealthy amount of sugar and therefore not fit for human consumption.

    “We will take all necessary actions against any malicious attack on our reputation”, part of the reactions reads.

    Consequently, the Federal Consumer Competition Protection Council [FCCPC] confirmed that Egodi was arrested by the company and transferred to Abuja. FCCPC said summons will be issued to Erisco Foods Ltd immediately.

    The action by Erisco has been widely condemned by consumers and many has started calling for the boycott of their products.

    In a series of post on its handle on Tuesday, Amnesty International Nigeria asked Nigerian authorities to “immediately and unconditionally” release Ms. Chioma.

    “No one should be arrested simply for exercising their freedom of expression”, the group said.

    “The arrest of Chioma shows that, despite the authorities paying lip service to police reforms, impunity for unlawful arrests remains rampant,” it added.

    A human rights lawyer, Inibehe Effiong, in a post via his X handle said the company’s management “acted viciously and irresponsibly.”

    Mr. Effiong, stressed that the company ought to have issued a public statement or even reached out to the woman to understand her view and explain their position if they disagreed with her view.

    “That would have earned the company and the brand more patronage,” he said.

    He said it is upsetting that “any charlatan” in the country can easily weaponise the police, whom he said have continued to criminalise civil disputes in the country.

    “We cannot continue like this,” he said.

    There has been outrage from different parts of the country.

    Like a Public Relations Guru, Mr. James Igodu puts it, “This is what happens when professionals are not put in their place to work. Since when has customers been arrested for voicing out their thought? Every customer has a right to review a product either negatively or positively. I do not know the tomato paste but I don’t think I will ever purchase it.”

    However, a food specialist with the Federal Institute of Industrial Research Oshodi [FIIRO] who pleaded anonymity, has also condemned the level of colouring most tomato paste manufacturers use, “After making stew with most of those tomato paste, the meat in the stew especially un fried white meat like chicken will be pink in colour.

    “I advice people to always go for fresh tomato if possible. That way, you are sure of what you are consuming.”
