    N650m: Ex-FCT Minister Akinjide in plea bargain talks with EFCC

    A former Minister of the Federal Capital Territory (FCT), Jumoke Akinjide, yesterday told the Federal High Court in Lagos that she was holding plea bargain talks with the Economic and Financial Crimes Commission (EFCC).

    Mrs. Akinjide, Senator Ayo Adeseun, and a People’s Democratic Party (PDP) chief, Mrs. Olanrewaju Otiti, were accused of laundering N650 million.

    EFCC said they allegedly received the money from former Minister of Petroleum Resources Mrs. Diezani Alison-Madueke, who was named in the charge as being at large, ahead of the 2015 general elections.

    Trial was billed to resume yesterday with EFCC set to call its witness. But Akinjide’s lawyer Chief Bolaji Ayorinde (SAN) said the N650 million had been returned to the Federal Government as part of the plea bargain.

    He said: “My lord, the charge before this court is essentially in relation to the PDP campaign funds for the 2015 elections in Oyo.

    “Before trial commenced, the defendants, who were chieftains of the PDP in Oyo at the time, acting on the collective decision of the party, decided to refund the monies mentioned in the charge.

    “In the light of the above, before the trial commences full-blown, we are imploring the court to allow parties to explore possible amicable settlement.

    “I have had a talk with the lead counsel for the prosecution, and so, going forward, we think it wise not to subject this matter to further adjudication, so as not to waste the time and resources of the court.

    “In that light, I have suggested that all counsel meet, so as to look at a way forward on this charge, especially considering the fact that the monies complained of, has already been refunded.

    “My application, therefore, is that this court adjourns further hearing, pending the outcome of discussion by counsel.”

    Prosecuting counsel Rotimi Oyedepo confirmed that the money had been returned, adding that the case was not only about the money, but the fact that the defendants allegedly dealt “with proceeds of unlawful activity”.

    He added that the N650 million was recovered from Akinjide and not from chieftains or principal members of the PDP.

    Referring to Sections 270 of the Administration of Criminal Justice Act (ACJA), Oyedepo said the law allows for such “settlement discussions” by parties.

    He said EFCC was not opposed to such discussions even though his witness was in court.

    Justice Muslim Hassan adjourned the case to enable parties conclude the talks.

    He said: “In line with Section 270 of the ACJA, which allows parties to explore plea bargain, this case will be adjourned.”

    The section reads: “The prosecutor may receive and consider a plea bargain from a defendant charged with an offence either directly from that defendant or on his behalf; or offer a plea bargain to a defendant charged with an offence.”

    The defendants, who pleaded not guilty, were re-arraigned on a 24-count charge of conspiring to obtain the N650 million from Mrs. Alison-Madueke, a sum EFCC said they reasonably ought to have known “formed part of the proceeds of an unlawful act”.

    Justice Hassan adjourned till February 22.

    The Economic and Financial Crimes Commission (EFCC) has withdrawn the five-count charge it filed before the High Court of the Federal Capital Territory (FCT), Abuja, against former FCT minister, Senator Bala Mohammed.
    The former minister filed a motion for bail through his lawyer, Chief Chris Uche (SAN).
    When the matter came up for arraignment yesterday before Justice Talba at the High Court 9, Gudu, EFCC lawyer Larry Peters Aso applied to withdraw the charges, on the ground that the prosecution wanted to put its house in order.
    The application was not opposed by Senator Mohammed’s lawyers.
    After listening to the lawyers, Hon. Justice Talba struck out the case.

    Former Minister of the Federal Capital Territory (FCT), Bala Mohammed, has faulted his continued detention by the Economic and Financial Crimes Commission (EFCC).
    He has sued the commission before the High Court of the Federal Capital Territory, seeking among others, an order for his immediate release.
    In a supporting affidavit, the former minister said he reported at EFCC’s office on October 24, on its investigation of allegations of conspiracy, abuse of office and money laundering made against him.
    In a supporting affidavit to the fundemantal rights enforcement suit, Mohammed averred that since he reported at the commission’s office, he had been detained.
    He said rather than being released on bail, he was dumped and abandoned in the cell since then, while his health deteriorated and he faced untold psychological trauma and mental torture.
    Mohammed is seeking a declaration that his arrest and detention since October 24 is illegal, unlawful, unreasonable, unjustified and unconstitutional.
    The former minister is also seeking a declaration by the court that he is entitled to be released on bail by the EFCC (Respondent) pending the investigation of allegations against him pending any arraignment before a court of law.
    He prayed an order of court enforcing and restoring his fundamental right to personal liberty enshrined and guaranteed by Section 35 of the 1999 Constitution, which had been violated and is being violated by the respondent.
    He is asking for N100 million as special and general damages against the EFCC for the illegal, unlawful and unconstitutional arrest and detention.
    Justice Husseini Baba Yusuf, whose court the case has been assigned, has fixed hearing for November 24.

    Agency obtains court order to detain ex-FCT minister

    THE Economic and Financial Crimes Commission (EFCC) has obtained a court order to detain a former Minister of the Federal Capital Territory, Senator Bala Mohammed and a former Special Adviser on Media and Publicity to the President, Dr. Reuben Abati.

    The anti- graft agency however granted bail to Abati, but he was yet to meet the conditions for such reprieve.

    The bail terms include getting a surety, who must be a civil servant at the directorate level, with landed properties in Abuja.

    The agency seized the former presidential spokesman’s passport.

    A source in the commission said it was necessary for the EFCC to obtain a court order to detain the ex-minister because he has allegations to clarify.

    It was gathered that Mohammed was confronted with many official documents showing approval of some funds and allocation of many plots of land.

    The source added: “The former minister has more days to spend with us because there are a lot of allegations against him which he ought to clarify.

    “We have secured a court order in order to keep him legally with us. We have some other suspected official accomplices under investigation too. We may need to interrogate them with the ex-minister.

    “We have uncovered a lot of mess in the FCT. We hope the ex-minister will cooperate with our team or else, we may extend the detention order. If he responds to all issues as fast as possible, we will grant him bail.”

    Mohammed was arrested in connection with alleged N1billion fictitious contracts.

    He is also being questioned on alleged allocation of 12 choice plots to his son, running into billions of naira; 37 other commercial plots of land worth about N8 billion to his suspected front called Tariq Hammoud and the controversial N1trillion Abuja land swap.

    A mansion allegedly worth N782million, belonging to the ex-minister, has been placed under Interim Assets Forfeiture.

    On Abati, the source said: “The EFCC has granted him bail but he has not been able to meet the conditions attached to such a right.

    “We will release Abati once he fulfills the bail terms. It is left to him to get a reliable surety.  Already, we have seized his passport and got a court order to detain him till he meets the conditions for his bail.”

    A former Minister of the Federal Capital Territory (FCT), Sen. Bala Mohammed, and five others are in the race for Peoples Democratic Party (PDP) national chairman, it was learnt yesterday.

    Others are Prof. Ahmed Alkali, a former Special Adviser on Political Affairs to  former President Goodluck Jonathan, former Minister of State for Power Mohammed Wakil and Deputy National Publicity Secretary Jalo Abdullahi.

    Some governors are pushing for ex-Governor Sule Lamido, a onetime National Secretary of the defunct Social Democratic Party (SDP) and a former Deputy National Chairman of PDP and ex-Katsina State Governor Ibrahim Shema.

    But party leaders, including some members of the Board of Trustees (BOT), are insisting that the Northeast should retain the position.

    It was, however, learnt that Dr. Jonathan might play a key role in the choice of the new chairman.

    Jonathan’s camp is said to be in favour of young elements leading the party.

    The party is awaiting the date for a mini-National Convention to elect the chairman.

    A source, who spoke in confidence with our correspondent, said: “Most leaders and members are uncomfortable that we have an Acting National Chairman.

    “Already, six candidates appear to be interested in leading the party. While four of the candidates are from the Northeast, two others from the Northwest (ex-Governors Lamido and Shema) are being recommended by some governors and leaders of the party.

    “We are not sure whether or not the former governors are interested in leading the party.”

    A member of the NWC said: “So far, only the ex-FCT Minister appears to have launched a subtle campaign for the post. The other candidates have been consulting.”

    The PDP National Executive Committee (NEC) is expected to release the guidelines for the election soon.”

    But it was gathered that party leaders, including some members of the BOT are insisting that the Northeast should retain the chairmanship slot in line with Article 47(6) of the PDP Constitution.

    The Article says: “Where a vacancy occurs in any of the offices of the party, the Executive Committee at the appropriate level shall appoint another person from the area or zone where the officer originated from…”

    The NWC source added: “Anyone elected from the Northeast will be completing the tenure of the erstwhile National Chairman, Alh. Bamanga Tukur, who was elected on March 24, 2012.”

    But some forces in the party have said its constitution is not sacrosanct on the choice of the new national chairman.

    They cited Article 49 of the PDP constitution to support their backing for Lamido and Shema.

    The Article reads: “Every registered member of the party who has satisfied the requirements for nomination and election under this constitution, the Constitution of the Federal Republic of Nigeria or any other law, rules or regulations in force shall be eligible to contest for any of the offices of the party.

    “The guidelines for election to any office of the party shall be approved by the NEC of the party in accordance with the provisions of this constitution.

    “No member of the party shall be qualified for nomination or election or appointment into any of the offices of the party, unless he or she has been a registered member and is of good financial standing in the party.”
