    EFCC opposes bid by ex-minister, senator to quash money laundering charge

    THE Economic and Financial Crimes Commission (EFCC) yesterday urged the Federal High Court in Lagos not to grant an application by Senator Ayo Adeseun challenging the court’s jurisdiction to try him for money laundering.

    The commission charged Adeseun along with a former Minister of the Federal Capital Territory (FCT), Jumoke Akinjide, for allegedly laundering N650 million.

    Also named in the charge are Peoples Democratic Party (PDP) stalwart Chief Olanrewaju Otiti and former Minister of Petroleum Resources, Mrs. Diezani Alison-Madueke, who was said to be at large.

    Adeseun, through his lawyer Michael Lana, filed two applications, both of which were adopted by Akinjide and Otiti.

    In the first one, the defendants are praying Justice Muslim Hassan to strike out the charge because it was not properly served on them as provided in the Administration of Criminal Justice Act (ACJA) 2015.

    Lana said Section 382 (2) of ACJA provides that the court shall within 10 working days of assignment of a case “issue notice of trial to the witnesses and defendants…”

    According to him, the EFCC did not comply with the provision as it was prosecuting counsel, Rotimi Oyedepo, who personally served the defendants with the charge.

    “The charge had the endorsement of the prosecuting counsel and he undertook to serve. The fact that the defendants are in court does not cure the non-service of the charge. Our objection is on non-compliance, not the validity of the charge. Once there’s no service before an arraignment, everything collapses. We have not been served,” he said.

    On the fact that the court issued a hearing notice, the lawyer said the ACJA does not make provision for substituted service.

    “It is the court that is to serve the charge on the defendants, not the prosecutor, who is an interested party. The registrar of the court must issue the notice and serve it either through the police or the bailiff,” he said.

    Akinjide’s lawyer Chief Bolaji Ayorinde (SAN) agreed with Lana’s submissions, adding that the procedure adopted by EFCC in serving the charge was “incompetent”, therefore, “the charge should be struck out”.

    Otiti’s lawyer Akinola Oladeji said the EFCC counsel “personally handed over the charge to the defendants,” adding that “it was not his (Oyedepo’s) business to do so”.

    He insisted that “the procedure in the law was not followed”.

    In the second application, Adeseun is praying the court to decline jurisdiction because the charge does not fall under issues over which the court can adjudicate on as provided in the constitution.

    But, Oyedepo urged the court to dismiss the applications.

    On the issue of non-service, the EFCC lawyer said the judge directed that notices be issued, adding that with the defendants’ arraignment, the application had become an academic exercise.

    “The essence of the notice is to ensure that parties are made aware of the charge. The defendants are here (in court), meaning they have been notified,” he said.

    On the issue of jurisdiction, Oyedepo said EFCC would prove during trial that the laundered money came from agencies over which the court has jurisdiction.

    EFCC accused the defendants of conspiring to obtain the N650 million from Mrs. Alison-Madueke, in the build-up to the 2015 general elections.

    The prosecution said they reasonably ought to have known “that the money formed part of the proceeds of an unlawful act”.

    The defendants pleaded not guilty. Their trial will resume today.

  • Ex-minister donates books, art works to varsity

    Ex-Minister of Culture and Tourism Mr. Edem Duke has donated 250 books and art works, worth N5 million, to Arthur Jarvis University, Calabar, Cross River State.

    The donation was made yesterday at the late Brig.-Gen. Dan Archibong Memorial Park, Calabar.

    The books cover subjects, such as Arts and Culture, Film and Photography, Hospitality and Tourism, Nigerian History, among others.

    Duke said the donation was part of his contributions to development of the university, adding that the state is blessed to have Arthur Jarvis University as its first private university.

    “Arthur Jarvis University is a young, but first private university in the state.

    “The school has established a centre of excellence in Hospitality and Tourism.

    “Today, I am donating these books from my private library and these art works to Arthur Jarvis University to boost its academic performance.

    “Art plays an important role in the life of the people. The university is not only building good ambassadors of this country, but also grooming future leaders,’’ he said.

    The former minister promised to give the best graduating student in the Department of Hospitality and Tourism N100,000 and same amount to the best overall student in the first graduating year.

    He hailed the management for striving for excellence, saying the institution has enhanced development of the state.

    The Vice Chancellor, Prof. Julian Osuji, said the university had a policy to reduce tuition fee for indigenes from N360,000 to N250,000, covering accommodation and other charges for one year.

    “In the last National University Commission ranking, which involved assessment of Open Educational Resource Repositories, we came 24th of 50 participating universities. This achievement is a stepping stone.

    “We appeal to the government and well-meaning indigenes to support us with funds, links to funding agents, endowments, donations and other forms of goodwill, to help achieve our vision and mission,’’ Osuji said.

    He thanked Duke for the donation, saying it would help the institution to establish a centre of excellence in Hospitality and Tourism.

    The Chancellor, Arthur Jarvis-Archibong, advised people to key into the establishment of universities, noting that the number of applicants seeking admission yearly is high.

    He enjoined politicians to support the school.

    Massive security in Ekiti as ex-minister joins governorship race

    There was a heavy security presence yesterday in Ado-Ekiti, the Ekiti State capital, as a former Minister of State for Works, Prince Dayo Adeyeye, declared intent to vie for the governorship seat.

    Adeyeye, who intends to run on the platform of the Peoples Democratic Party (PDP), condemned alleged attempts by the state government to stop the declaration.

    He accused Governor Ayo Fayose’s administration of ordering some television stations not to cover the event.

    Adeyeye’s campaign office at Coca-Cola area of Ikere Road and the open field on the opposite side, where the declaration was held, were cordoned off with heavy security presence.

    A police armoured personnel carrier, two vehicles belonging to security agencies and battle-ready armed policemen were on the ground to avert likely breakdown of law and order.

    There was a massive lockdown on the busy Ado-Ikere roas as Adeyeye’s supporters resorted to trekking to the declaration venue.

    The former PDP national spokesman said he was joining the governorship race to give good governance to Ekiti residents and make life better for them.

    Adeyeye, who was joined by his wife, Adetomilola, accused the Fayose administration of inflicting hardship on the people.

    He promised not owe civil servants, teachers, local government workers and pensioners, as being witnessed in the state.

    The governorship hopeful promised to repair Ekiti, which he said had been damaged by bad governance.

    Adeyeye said he would invest in agriculture, create jobs and give economic empowerment to the people.

    He urged Ekiti residents, who are yet to collect their Permanent Voter Cards (PVCs) to do so to enable the exercise their franchise on Election Day.

    At yesterday’s proceeding, EFCC counsel, Mr. Rotimi Oyedepo, told the court that the agency had an amended 24-count charge and urged the court to admit same as their charge in the suit.

    He said Akinjide, Adeseun and Otiti acted contrary to Section 18(a) of the Money Laundering (Prohibition) Act, 2012.

    The amended charge was not opposed by the defence team, following which Justice Hassan ordered the registrar to take the plea of the defendants.

    Trial commences on February 5, 6, 13 and 14.

    Diezani cash: Ex-Minister Akinjide to face trial in Lagos

    The case of a former Minister of the Federal Capital Territory, Jumoke Akinjide, has been transferred to the Federal High Court in Lagos.

    It has been re-assigned to Justice Muslim Hassan.

    Akinjide was charged along with former Minister of Petroleum Resources, Mrs Diezani Alison-Madueke, who is said to be at large.

    Others named in the charge are Senator Ayo Adeseun and a Peoples Democratic Party (PDP) stalwart Chief Olarenwaju Otiti.

    They were accused of conspiring to directly take possession of N650million, which they reasonably ought to have known forms part of the proceeds of an unlawful act.

    They were arraigned last June before Justice Joyce Abdulmalik in Ibadan.

    It was learnt that the Acting Chief Judge, Justice Adamu Kafarati, moved the case to Lagos at Akinjide’s instance.

    The former minister was granted bail on self-recognition when she was arraigned in Ibadan. She was also asked to submit her international passport.

    Prosecuting counsel Mr Rotimi Oyedepo confirmed to our correspondent yesterday that the former minister would be tried in Lagos.

    “Yes, we have been served with a Hearing Notice by the Federal High Court, Lagos Division, that the case is coming up before Justice Hassan next week,” he said.

    The defendants allegedly received the money from Mrs Alison-Madueke in the build- up to the 2015 general election.

    It was said to be part of the $115 million allegedly disbursed by Mrs. Alison-Madueke to influence the outcome of the 2015 presidential election.

    One of the charges reads: “That you, Mrs. Diezani Alison-Madueke (still at large), Oloye Jumoke Akinjide, Senator Ayo Ademola Adeseun and Chief Olarenwaju Otiti on or about the 26th day of March, 2015, in Nigeria within the jurisdiction of this Honourable Court conspired amongst yourselves to directly take possession of the N650 million which sum you reasonably ought to have known forms part of the proceeds of an unlawful act.

    “That you, Oloye Jumoke Akinjide, Senator Ayo Ademola Adeseun and Chief Olanrewaju Otiti on or about the 26th day of March, 2015 in Nigeria, within the jurisdiction of this Honourable Court did conspire amongst yourselves to commit an offence, to wit: making cash payment of the sum of N650 million which sum exceeded the amount authorized by Law without going through financial institution and you thereby committed an offence.”

    The defendants pleaded not guilty.

    It was learnt that Akinjide held plea bargain talks with the EFCC. The case may come up before Justice Hassan on Tuesday.

  • Ex-minister gets court’s nod to treat breast cancer abroad

    THE Federal High Court in Lagos yesterday permitted former Finance Minister (State) Senator Nenadi Usman to treat herself abroad for breast cancer.

    The Economic and Financial Crimes Commission (EFCC) re-arraigned her and former Minister of Aviation Chief Femi Fani-Kayode for alleged N4.6 billion laundering and fraud.

    They were re-arraigned along with a former National Chairman of the Association of Local Government in Nigeria (ALGON) Yusuf Danjuma, and a company, Jointrust Dimensions Ltd.

    They pleaded not guilty to the 17-count charge of money laundering.

    Mrs. Usman applied through  her lawyer Chief Ferdinand Orbih (SAN) to the court to release her international passport to enable her travel overseas on December 18 for cancer treatment.

    She said she wished to be away for 45 days, promising not to jump bail.

    EFCC’s lawyer Rotimi Oyedepo did not oppose the application. He said: “I will leave it to the court’s overriding discretion.”

    Justice Rilwan Aikawa granted the application and directed Usman to submit her international passport to the court’s Deputy Registrar once she returns.

    According him, there would be dire consequences, if she fails to comply with the directive.

    The court earlier admitted Fani-Kayode’s bank account statement in evidence.

    He dismissed the defendants’ objections that the statement did not comply with Section 90 (1) (1) (1-IV) of the Evidence Act. The judge held that the prosecution complied with the section.

    Count one of the charge reads: “That you, Nenadi Esther Usman, Femi Fani-Kayode, Danjuman Yusuf And Jointrust Dimentions Nigeria Ltd on or about the 8th day of January, 2015, within the jurisdiction of this Honourable Court conspired amongst yourselves to indirectly retain the sum of N1,500, 000,000.00, which sum you reasonably ought to have known forms part of the proceeds of an unlawful act to wit: stealing.”

    The defendants were also accused of indirectly retaining N300 million, N400 million and N800 million, all proceeds of corruption, according to EFCC, which added that the allegedly offence was committed between January 8 and March 25, 2015 ahead of the general election.

    Justice Aikawa adjourned until January 31, 2018.

    Ex-minister dies at 71 in Kwara

    Former Minister of State for foreign affairs, Alhaji Saidu Isa is dead. He was aged 71.

    The deceased who hailed from Lafiagi, Edu local government area of Kwara state was said to have died in the early hours of Wednesday in Ilorin, the state capital.

    Until his death, the deceased was the Chairman Governing Council, Kwara State University, Malete, and occupied the same position at the Federal College of Education Osi-Ile, Abeokuta in Ogun State.

    Kwara state Governor Abdulfatah Ahmed, has described the death one time Secretary to the State Government as a big loss to the state and the country as a whole.

    In a statement Chief Press Secretary to the governor, Alhaji Abdulwahab Oba said the deceased made outstanding contributions and selfless services to humanity and his fatherland.

    “My heart goes out to the families, friends and well wishers of the former ambassador and Pro Chancellor of Kwara State University, Malete. Indeed, this death is shocking”, Governor Ahmed said.

    The governor said the deceased was a community leader and technocrat par excellence whose wealth of experience would be missed by all.

    The governor prayed Allah to forgive the shortcomings of the deceased, grant him Aljanatul firdaus and give his families solace and fortitude to bear the irreparable loss.

    Ex-minister implicated in plot against Nwoye

    A former Minister has been fingered in the attempt to coordinate a ‘deal’ to nullify the results of the governorship primaries of the All Progressives Congress(APC) in Anambra State.

    The ex-powerful minister, who is from the North, has been lobbying members of the National Working Committee (NWC) and working in cahoots with Abuja Forces to drop the elected governorship candidate, Hon. Tony Nwoye for Sen. Andy Uba.

    But the Governor of Borno State, Kashim Shettima, who conducted the primaries, may cut short his trip to Saudi Arabia to brief President Muhammadu Buhari and the National Chairman of the party, Chief John Odigie-Oyegun on how he conducted a transparent governorship primary election in Anambra.

    Shettima was said to be disturbed by the plot to discredit the primaries and nullify Nwoye’s election.

    A reliable party source, who briefed our correspondent, said: “A deal to annul the APC primaries in Anambra is already being hatched.

    “A former Minister is working in concert with some members of the National Working Committee(NWC), ranking Senators and members of the House of Representatives and some Abuja Forces to drop the party’s elected candidate, Hon. Tony Nwoye for Sen. Andy Uba.

    “The ex-Minister has opened discussions with NWC members and other stakeholders on why Andy Uba must be made the party’s candidate. He has been hiding under the guise of Uba being an alleged electoral asset to the party.

    “But unknown to many APC leaders, the overall game plan is to secure Anambra State ahead of the defection of many to the Peoples Democratic Party(PDP) after November 18 poll.

    “I can tell you that what is happening is that some powerful politicians in the PDP and in the National Assembly, who are more comfortable with Uba want him to contest against Governor Obiano with the hope that once he wins, he would return to the PDP, from where he crossed over to the APC early this year,” the source explained.

    Meanwhile, there were indications that Governor Kashim Shettima might cut short his trip to Saudi Arabia to brief President Muhammadu Buhari and the National Chairman of the party, Chief John Odigie-Oyegun on how the governorship primary election was conducted, won and lost in Anambra State.

    A source close to the governor, who spoke in confidence, said: “Shettima is feeling sad that some Abuja Forces had perfected plans to annul the results of APC primaries in Anambra State.

    “He has insisted that he conducted a free, fair and transparent primary election which was applauded by all candidates and stakeholders.

    “The position of the governor is that it will be against what APC stands for to cancel the outcome of the primaries under any guise.

    “Despite pressure, the governor gave equal opportunity to all the candidates and the voting process was televised live. This backdoor approach will not help the electoral fortunes of APC in Anambra State.”

    Responding to a question, the source added: “The governor may cut short his trip to Saudi Arabia to brief President Buhari and the National Chairman of APC, Chief Odigie-Oyegun on how the primaries was conducted.

    “He is also going to present his position on the danger of annulling the election to the electoral chances of APC not only in Anambra but in 2019.”

    But Nwoye has pleaded with the party’s leadership to respect the wishes of APC members in the state.

    Condemnations yesterday trailed the early morning killing of worshippers  at St. Philips Catholic Church in Ozubulu community.

    Residents,  in separate interviews with our reporter and the News Agency of Nigeria (NAN), described the attack as “heinous, unjustifiable and totally unwarranted”.

    A community leader, Sir Jude Emecheta, said such a thing had never happened in the area. He described it as “unfortunate”, adding that ”a dark cloud has befallen my peaceful town”.

    Emecheta, who is the Managing Director of Anambra Signage and Advertisement Agency (ANSAA), said that the losses from the attack were too much for the people to bear.

    He wondered why brothers could visit such an attack on their people and urged those involved to ‘’sheathe their swords”.

    Former Minister of Aviation Osita Chidoka, who is a governoship aspirant, said he was saddened by the incident.

    Chidoka decried the desecration of the temple of God, adding that nobody attacked anyone in the church even during war times.

    “This is tragic. The church is a place of refuge to anyone who runs into it, and this wicked, barbaric and mindless bloodletting shows that something has gone wrong on our psyche.

    “My heart goes to the bereaved at this moment of pain. I pray that God grants the soul of the departed eternal rest as I urge the security agents to fish out the perpetrators and make them face the law,” he said.

    A former Secretary to the state Government, Mr. Oseloka Obaze, said such callous attacks dehumanised the society.

    “Our heart goes to the family and parishioners of St. Philips Catholic Church, Ozubulu…

    ‘’Such violent incidents dehumanise our society.”

    All Progressives Grand Alliance (APGA) National Chairman Victor Oye  said that no amount of provocation could justify the killing of innocent people who had gone to worship in a church.

    Oye, who described the attack as “wicked”, urged the security agencies to unravel those responsible for the dastardly act.

    “As a political leader, I totally condemn the Ozubulu church shooting as dastardly, unjustifiable and callous.

    “Nobody has the right to kill innocent citizens. The Police and other relevant security agencies should ensure that the perpetrators of this crime are caught and made to face justice,” Oye said.
