    Falana debunks threat claims by MohBad’s father

    Falana and Falana’s Chambers has dismissed allegations of threat to the life of MohBad’s father, Mr Joseph Aloba, by Femi Falana (SAN).

    The law firm said it would not withdraw from representing Mrs Wunmi Cynthia Aloba, widow of the late music star, Ilerioluwa Oladimeji Aloba, a.k.a MohBad.

    In a statement by Taiwo Olawanle, the firm faulted an interview by Mr Aloba on Max FM 102FM, which was published by other media.

    It reads in part: “Mr. Aloba is definitely deceiving himself if he believes that his empty vituperations and vulgar abuses will force us to withdraw from further representing Mrs Wunmi Cynthia Aloba to enable him to inherit the assets of his late son, Ilerioluwa Oladimeji Aloba (a.k.a. Mohbad). 

    “Having said the above, we find it preposterous that Mr Joseph Aloba has said that Mr. Falana and Mrs Wunmi Cynthia Aloba be held responsible if he is killed.

    “We have taken appropriate measures under the law to restrain Mr. Aloba from further associating Mr. Falana with murder and other forms of criminal offences. 

    “We will not allow Mr. Aloba and his cohorts to destroy the reputation which Mr. Falana has built at home and abroad.”

    The law firm explained its involvement in the case.

    The statement adds: “It is no longer news that Mohbad died in September 2023 under questionable circumstances. 

    “Upon the death of this young man, many well-meaning Nigerians and human rights groups contacted our office to assist in unravelling the circumstances surrounding his death and getting justice for the family. 

    “The widow of the late singer, Mrs Wunmi Cynthia Aloba also contacted our office to help in a similar vein. 

    “At that juncture, Mr. Falana called Mohbad’s father and commiserated with him and assured him of his readiness to ensure that the law takes its cause. 

    “Our office immediately petitioned the Commissioner of Police, Lagos State Command requesting a thorough investigation into the case. 

    “In addition to the above, our office also wrote the Chief Coroner of Lagos State requesting a Coroner’s Inquest into the remote and immediate cause of the death of Mohbad. 

    “Our office sent a delegation of lawyers to Mohbad’s residence at Orchid in Lagos to take the statements of those close to the late singer including his wife, parents and staff. 

    “As events unfolded, we realised that the late Mohbad’s father, Mr Joseph Aloba is not interested in unraveling what led to the death of his son but after his estate. 

    “Hence, he rushed the burial of Mohbad in an unmarked grave without any autopsy to know the cause of death of the deceased. 

    “However, at our request, the body of Mohbad was later exhumed for investigation by the Police. 

    “Since our aim and goal in the matter is to unravel the circumstances surrounding the death of Mohbad through the instrumentality of the law, we had no choice but to distance ourselves from Mr Joseph Aloba‘s opportunism and puerile blackmail. 

    “While the matter is still pending before the Coroner and Police investigation has not been concluded, Mr Joseph Aloba through his solicitors wrote a letter dated the 25th day of November 2023 to our office wherein he requested Mrs Wunmi Cynthia Aloba to hand over her son for DNA test to ascertain his paternity.

    “While our client and our law firm are not opposed to conducting the test as stated in our reply, we drew their attention to Section 57 of the Child’s Right Law of Lagos State which empowers only the Court to order the use of scientific tests including blood tests and DNA where paternity is in issue. 

    “Furthermore, we made it clear that under the provisions of the Child’s Right Law of Lagos State, the only person who has the locus standi to request a DNA test to confirm the paternity of a child is the father of a child. 

    “Notwithstanding the position of the law, we advised that due process of the law be followed i.e. obtaining a valid court order for Mrs Wunmi Cynthia Aloba to present her son for the test. 

    “Since our position was made known, Mr Joseph Aloba has not taken steps to obtain the court order to enable Mrs Wunmi Cynthia Aloba to submit her son for the test.”

    Falana faults police brutality as Lagos lawyers protest

    Mr Femi Falana, Senior Advocate of Nigeria (SAN), has berated the police for inhuman treatment of lawyers and the general public.

    Falana, a human rights activist, made the remark on Thursday in Lagos when hundreds of lawyers trooped out to protest against the alleged brutality of the personnel of Lagos State Police Command.

    The Ikeja, Ikorodu, Badagry and Epe branches of the Nigerian Bar Association (NBA) carried out the peaceful protest.

    Falana said the five branches of the NBA decided to come together to fight police brutality due to the recent maltreatment of a lawyer.

    The News Agency of Nigeria (NAN) reports that the protest was in response to the alleged unlawful detention of a lawyer, Mr Olumide Sonubi, by the police at Gowon Estate Police Station, Lagos, for two days.

    The lawyer was reportedly hospitalised after detention by the police on Dec. 30, 2023, over an alleged assault of a police officer during negotiations.

    Falana said the NBA decided to make a case through the affected colleague to say no to brutalisation of lawyers and the citizens by the police.

    He said the NBA demanded full investigation of the incident.

    “I am happy the commissioner of police announced today that investigation is ongoing.

    “The commissioner also indicated that lawyers should be prepared to be members of the committee since the police have nothing to hide.

    “Beside the report, the NBA is also also taking certain steps to file actions to protect the human rights of our colleagues to make a point that if anything of that nature happens to any lawyer, the NBA will take it up.”

    The Chairman of NBA, Ikeja Branch, Mr Seyi Olawunmi, also condemned the act of the divisional police officer of Gowon Estate and called for a thorough investigation which would involve the NBA.

    Olawunmi said the protest was not about their colleague but about seeking justice.

    He said: “If our member has behaved in an unruly manner, let the law take its course.

    “Lawyers are not above the law and we need to press the fact that this is about an ordinary man on the street.

    “So, we are not coming out because it is our colleague that is involved but we are saying if you go to a police station as a Nigerian, you have a right to be treated in a civil manner that you deserve.”

    Olawunmi said it was wrong of the police to ask Nigerians to drop their phones before they could get access at police stations.

    “You cannot go in there and they subject you to any form of harassment.

    “They tell you to drop your phone at the entrance.

    “I mean if you are not doing anything at your station that is unholy, why would you, why are you asking us to drop our phones,” he said.

    NAN also reports that the Lagos branch of the NBA mobilised about 700 lawyers across the state for the protest march from the secretariat of the NBA Ikeja Branch to the headquarters of the Lagos State Police Command.

    Other NBA Chairmen present at the protest were: Mr Olabisi Makanjuola, Lagos NBA Chairman, Mr Emeka Ralph, Badagry NBA Chairman and Mr Wale Adegoke, NBA Ota Branch.

    It’s constitutionally wrong to say Nigerians have no right to bear arms – Falana

    Femi Falana, a Senior Advocate of Nigeria (SAN), has criticized Lieutenant General Taoreed Lagbaja, the Chief of Army Staff, for his remarks expressing his disapproval of the freedom of people to bear weapons, arguing that it is inaccurate to claim that Nigerians have no such right.

    He made this comment following coordinated attacks on Plateau state during the Yuletide by assailants.

    “I do not support that. I think that is a call for anarchy,” the Army chief said on Sunday in an interview on Channels Television.

    However, Falana responded to the army chief’s remarks in a Wednesday interview on Channels Television’s Sunrise Breakfast.

    Falana said: “In the first place, it is not correct to say Nigerians have no right to bear arms, Apart from the fact that the penal code applicable in the North and the criminal code applicable in the South recognises the right to self-defence.

    “In the first place, we have to discuss the rights and proceed to examine the propriety. In other words, if someone aims a gun at me, and I can quickly grab another gun, I have the right to shoot.”

    When asked to clarify if the law allows for one to bear guns, Falana noted that one needs a gun licence.

    He said: “But you are required to apply for the licence first.”

    However, Falana called for caution regarding what the constitution mandates when it comes to self-defence.

    Falana said: “I am just saying the right to self -defence which is also guaranteed by the constitution.

    “All I am not allowed to do is not use a force that is not proportional to the threat. In other words, if you are going to hit me with a cane I must not go for a gun which is not proportional.

    Falana’s endorsement of citizens’ rights to bear guns coincides with several legislators and governors pleading with the federal government to permit its residents to defend themselves against attacks by robbers and terrorist organizations.

    Falana seeks compensation for air strike victims

    Activist-lawyer Femi Falana (SAN) has asked the Federal Government to pay adequate compensation to the victims of all airstrikes that have occurred in Nigeria in the past seven years.

    He said instead of setting up a new panel of enquiry, government should publish the findings of the Georgewill Judicial Commission.

    The activist, who is also the Chairman of Alliance on Surviving COVID-19 and Beyond (ASCAB), noted that if the government failed to do this within the next two weeks, “we shall sue the Federal Government at the Federal High Court to secure the enforcement of the fundamental right of the victims to life”. 

    Falana said this in a statement, titled: No Justice for Civilians Killed in Airstrikes in Nigeria, yesterday in Lagos.

    He said: “Between March 2014 and December 2023, the Nigeria Air Force and the Nigerian Army dropped bombs in some states in the northern part of the country on 16 different occasions.

    “The airstrikes claimed the lives of not less than 400 people. The most tragic incident occurred on January 17, 2017, when two bombs were dropped in the middle of Rann, Borno State, which hosted thousands of internally displaced persons (IDPs).

    “The incident left 170 people — including aid workers and refugees — dead, and many more injured.

    “No doubt, the military authorities accepted responsibility for the airstrikes and claimed that the crashes were caused by ‘accidents’. But no compensation was paid to those who were injured and the families of scores of people who lost their lives in the tragic incidents. 

    “Shortly after the unfortunate incident, the Federal Government instituted a commission of enquiry, headed by Justice Biobell Georgewill of the Court of Appeal.

    “The commission was mandated to review extant rules of engagement applicable in the Armed Forces of Nigeria as well as the extent of compliance with the rules.

    “Part of the mandate of the commission was to also proffer means of preventing violations of international humanitarian and human rights law. 

    “The commission was given 90 days for the assessment. Our law firm represented the victims of the Rann airstrike at the Commission of Enquiry.

    “Upon the conclusion of the assignment, the commission submitted its report. But up until now, the Federal Government has neither published the report nor implemented the recommendations of the commission.”

    Owolabi Jamiu Falana was a deputy director for youths in the Tinubu/Shettima and Sanwo-Olu Hamzat Independent Campaign Council, currently serving as a director, the Lagos State Universal Basic Education. He is the youngest-ever board member of the Lagos SUBEB when he joined September 2022. He spoke with GBENGA ADERANTI

    The Appeal Court just affirmed the victory of Gov Sanwo-Olu. How will you react to this confirmation of his reelection?

    Mr. Governor’s victory at the Appellate Court is a welcome development but it did not come as a surprise to me because he worked hard during the campaigns by involving all stakeholders, and I was actively involved so I watched him closely winning the minds of our people.

    Furthermore, the Appeal Court verdict stands as a confirmation of the choice of Lagosians and will further strengthen the governor’s resolve to deliver valuable service to our people and achieve what we now term as THEMES+ Agenda.

     What’s your opinion about the governor’s programmes and policies for the education sector in Lagos?

    The 3rd pillar of THEMES+ Agenda is Education and Technology. Infusing technology into the basic education sector has helped a great deal in aligning with global best practices. As the Permanent Board Member in charge of Basic Education Quality Assurance at Lagos SUBEB; I can tell you that monitoring of the teaching and learning process is now digitalized and all our officers have gadgets through which they use to track punctuality, delivery of teaching activities, attendance, etc. All our teachers are also connected to the same platform that enables us to track their activities real-time, from our Situation Room.

    At the Tertiary Education level, in addition to the creation of 2 new specialized universities – Lagos State University of Education (LASUED) and Lagos State University of Science and Technology (LASUSTECH); our state-owned institutions did not join the recent ASUU Strike which lasted for 8 months that brought stability and systemic organization to our education system.

    Do you think the ruling APC and President Tinubu have carried the youth along in this administration?

    The President wrote in the Renewed Hope Manifesto that at least 20% of political appointments would be given to youths and he has in fact surpassed the target. This is the first time that we will be having two young people below the age of 40 heading the Ministry of Youth. He has not only appointed youths as Ministers, he also assigned them to key Ministries such as Digital Economy, Humanitarian, Arts and Culture, etc. The same is true for Agencies and Parastatals like the Nigerian Communications Commission, NASENI, NIPOST, etc which are headed by young people.

    I can tell you that in spite of all I’ve said about my foray into politics and education administration in Lagos State, my success story today is made possible because our party, the ruling APC, gives room for the youth to thrive in public service.

    But for the youth-centric nature of the party and our leader, President Bola Ahmed Tinubu as well as Governor Jide Sanwo-Olu, the story would be different today.

    That is why I can boldly tell you that APC is the most youth-friendly political party in the country today. President Tinubu has further affirmed that with the constitution of this cabinet.

    Sanwo-Olu has given you the opportunity to serve in his government, what are you doing to lift youths?

    One of the most exceptional aspects of my journey is my ability to inspire and empower today’s youth. Through engaging speeches, mentorship programmes, and active participation in youth-oriented initiatives.

    Many of the youths see me as a beacon of hope.

    I also feature regularly on various media platforms as a public affairs analyst, offering a unique insight into national and local issues bedeviling our dear country.

    With all modesty, I would say with my good track record in public management, business development, project management, entrepreneurship, and innovation, I participated fully in culturing the next generation, having led various youth groups, and participated and still participating in numerous policy dialogues across Nigeria and Europe.

    Recognising my leadership skills, passion for social development, youth empowerment, and nation-building, probably prompted the government’s recognition of my potential, which prompted the Lagos government to consider me for an appointment.

    What are the things you’ll say contributed to your political growth as a young politician?

    I will say preparation and readiness. As a thoroughbred Mushin indigene, I had both my primary and secondary education in Mushin and graduated top of my class, pursued higher education in Economics at Kharkiv National University of Radio Electronics in Ukraine, graduating with first-class honours. I also hold an MA in Public Management from Babcock University Ilisan-Remo and I am an alumnus of the FATE Foundation Entrepreneurs Program AEP60. This explains my commitment to education at all levels.

    Of course,  the journey has been marked by challenges given my modest background, but I  overcame it with unwavering determination and resilience to reach beyond the limitations.

    However, being a youth alone is not enough to prepare you for public office. Before my appointment to LA-SUBEB, I held key positions in various organizations, such as Administrative Manager at Kenako Ukraine, European Regional Representative for STUNTS Group LLC, Marketing Manager at Wealthteam Properties Ltd, and in 2016, founded Ohjay Group, which is fast becoming a foremost construction and project management company in Nigeria. I prepared myself as a catalyst for change, encouraging young people to actively participate in politics and make a difference in their communities and I’m showing this by example.

     Would you say you are doing enough to make a mark as a young politician in the position given to you?

    I began my political journey as the ACN Party Agent for Ward G1 in Mushin during Fashola’s gubernatorial election in 2007 and continued to rise through the ranks,

    I was later nominated as the Youngest National Delegate from Lagos State at the APC National Convention in 2022.

    I founded Jide Sanwo-Olu Youth Movement (JISYM) in 2018, and served as the Deputy Director for Youths in the Tinubu /Shettima and Sanwoolu Hamzat Independent Campaign Council.

    West Africa’s media defence lawyer and Senior Advocate of Nigeria, Femi Falana, has asked the Israeli government to spare innocent and unarmed citizens as it continued the bombardment in Gaza.

    He said though the terrorist attack by Hamas fighters must be condemned, Israel must cease the “collective punishment” meted out to Palestinians, especially women and children.

    Addressing the 2023 West Africa Media Excellence Conference and Awards (WAMECA) in Accra at the weekend, the human rights activist described the war in Gaza as a “mockery of our humanity.”

    “While Israelis are entitled to defend themselves against terrorist attacks, we insist that the collective punishment being meted out to all Palestinians, including women and children, who are being killed is not acceptable.

     “What is currently going on there (Gaza) is collective punishment, which is tantamount to a crime against humanity,” he stated.

    Falana noted that collective punishment was a crime under the Geneva Convention and that the world was against “the unprovoked attack on the innocent people of Palestine”.

    He maintained that most Palestinians were opposed to the operations of Hamas, therefore, all citizens could not be punished for the violence unleashed on Israel by the group.

    He tasked journalists to join the human rights community demanding “immediate and unconditional” ceasefire in Palestine.

    Israel launched attack on Gaza after the Hamas attack on October 7, 2023, which saw 1,200 people killed and more than 200 taken hostage.

    More 11,000 lives, including about 4,500 children, are said to have been lost as fighting continued with more people fleeing the city.

    Media reports as of November 12, 2023, indicate that the Israeli military had agreed to help evacuate babies from Gaza’s Al-Shifa hospital to a “safer” facility.

    The rights activist described the war in Gaza as a “mockery of our humanity”.

    “While Israelis are entitled to defend themselves against terrorist attacks, we insist that the collective punishment being meted out to all Palestinians, including women and children, who are being killed is not acceptable.

    “What is currently going on there (Gaza) is collective punishment, which is tantamount to a crime against humanity,” he stated

    Falana noted that “collective punishment” was a crime under the Geneva Convention and that the world was against “the unprovoked attack on the innocent people of Palestine”.

    Activist lawyer Femi Falana (SAN) has urged former governors in the Senate to stop collecting pensions from their states.

    He said such an act amounts to collecting double salary.

    The popular lawyer urged the former governors to emulate Senators Gbenga Daniel and Ibrahim Dankwanbo who have stopped collecting pensions, following their election into the Senate.

    Falana said since the Houses of Assembly of Kwara, Imo, and Zamfara states have abolished the governors’ pension scheme, other Houses of Assembly should follow suit without any delay.

    “In the suit number FHC/L/CS/1497/2017 (Socio-Economic Rights and Accountability Project (SERAP) v Attorney General of the Federation) filed at the Federal High Court, the plaintiff challenged the constitutional validity of the scandalous pension paid to former governors in Nigeria.

    “In a landmark judgment delivered on November 26, 2019, Justice Oluremi Oguntoyinbo (now retired) declared the payment of the pension illegal and unconstitutional. Consequently, the court ordered the Accountant-General of the Federation and Minister of Justice to recover the life pensions collected by former governors serving as senators and ministers.

    “Similarly, in suit number NICN/JOS/26/2016 (Alhaji Garba Umar v Taraba State government) Justice K. I. Amadi of the National Industrial Court declared as null and void the payment of pension and gratuity to former governors and deputy governors. The pension was provided for in Taraba State Governor and Deputy Governor’s Pension Law 2015.

    “In compliance with both judgments, Senators Gbenga Daniel and Ibrahim Hassan Dankwambo have requested the governors of Ogun and Gombe states, respectively, to stop paying them the scandalous pension.

    “This is highly commendable at a time when not less than 20 former governors in the executive and legislative branches of government are receiving double salaries.”

    Use N50m to improve inmates’ welfare, Falana urges Minister of Interior

    Activist-Lawyer Femi Falana (SAN) has urged the Minister of Interior, Olubunmi Tunji-Ojo, to review his plan to spend N500 million on the payment of fines imposed on some 4,000 prison inmates.

    The plan forms part of efforts to decongest the prisons.

    Falana, who also chairs Alliance on Surviving COVID-19 and Beyond (ASCAB), in a statement yesterday, admonished the minister to spend the N500 million on the welfare of inmates while alternative decongestion policies are considered.

    He advised the minister to request the President and governors to exercise their prerogative of mercy by granting pardon to the 4,000 convicts on grounds of impecuniosity to facilitate their release from custody.

    Admitting that the minister deserves commendation for the initiative, he insisted on his call for a review of the plan.

    According to Falana, it is on record that the federal government had released 7,813 inmates from prisons across the country during the outbreak of COVID-19 to curb its spread.

    He also recalled that the convicts and awaiting trial inmates were granted amnesty and released on the orders of former President Muhammadu Buhari, as part of the prison decongestion policy of the Federal Government.

    The lawyer also urged the minister to request the Chief Justice of Nigeria and Chief Judges of states and the Federal Capital Territory (FCT) to visit the correctional centres and exercise their powers under the Criminal Justice (Release from Custody) (Special Provisions) Act by ordering the release of all inmates whose detention is either manifestly unlawful.

    The number of Senior Advocates of Nigeria (SAN) rose by 58 yesterday with the conferment of the rank on a new set of lawyers.

    They include rights activist, Dr. Kayode Ajulo, and wife of activist lawyer, Mr. Femi Falana (SAN), Funmi.

    The Chief Registrar of the Supreme Court and Secretary of the Legal Practitioners’ Privileges Commines (LPPC), Ms. Hajo Sarki Bello, announced this in a statement yesterday in Abuja.

    She said the LPPC approved the elevation of the 58 lawyers at its 159th plenary session on October 12, with its Chairman, the Chief Justice of Nigeria (CJN), Olukayode Ariwoola, in attendance.

    Out of the 58 lawyers only one, Prof. Babatunde Adetunji Oni, made it from the academic category, while the other 57 are from the advocate category.

    Ms. Sarki-Bello said: “The rank of a Senior Advocate of Nigeria (SAN) is a mark of excellence to members of the legal profession who distinguished themselves as advocates and academics.

    “The meeting further considered four different petitions written against some of the applicants and determined that each of the petitions lacked merit and thus dismissed them.

    “The swearing-in ceremony of the 58 successful applicants is scheduled to take place on Monday, November 27.”

    Also on the list are: Olumide Olujinmi, son of former Attorney General of the Federation (AGF) Akin Olujinmi (SAN) and a former National Legal Adviser of the Peoples Democratic Party (PDP), Emmanuel Enoidem.
