    Court to hear Fani-Kayode’s, Usman’s applications

    Justice Muslim Hassan of the Federal High Court in Lagos yesterday agreed to hear the pending applications by former Minister of Aviation Chief Femi Fani-Kayode and former Minister of State for Finance, Senator Nenadi Usman.

    The Economic and Financial Crimes Commission (EFCC) arraigned them on a 17-count charge of laundering about N4.6billion. They pleaded not guilty.

    Defence counsel, including Norrisson Quakers (SAN) and Abiodun Owonikoko, had refused to cross-examine the first prosecution witness because of the pending applications.

    The defendants are challenging the court’s jurisdiction and are praying the judge to transfer the case to Abuja division.

    Ruling yesterday on whether or not to hear the pending applications, Justice Hassan said he would hear them since they were not challenging the “competence” of the charge.

    He held: “I have reproduced the relevant provisions of the Administration of Criminal Justice Act, for purposes of clarity. Section 221 of the Act provides that an objection can be taken on the basis of an incompetent charge; Section 273 provides that an accused who pleads not guilty to a charge has submitted to the court’s jurisdiction.

    “It is also the law that after the plea of an accused has been taken, an objection can be raised at any time in relation to the charge before judgment. The law also provides that trial shall be from day to day with adjournment not exceeding five times.

    “From a close reading of these statutory provisions, it is clear that the pending applications are not on the competence of the charge but outside the scope of the ACJA, as the second defendant (Fani-Kayode) is apprehensive that he will not get fair trial.

    “In view of the foregoing provisions and on the basis of fair hearing and the interest of justice, I will take the three pending applications. But I must state that cross examination of PW1 does not amount to a waiver of jurisdiction,” he held.

    Fani-Kayode is praying the judge to decline jurisdiction and transfer the case to the court’s Abuja division.

    The former minister said Justice Hassan, who worked as a prosecutor at the Federal Ministry of Justice and later EFFC before his appointment as a judge, signed the charge against him when he was previously tried and acquitted by Justice Rita Ofili-Ajumogobia for money laundering

    Usman, with two pending applications, is praying the court to allow her to be tried separately from Fani-Kayode and for her trial to be transferred to Abuja for convenience.

    Justice Hassan adjourned until February 8 for hearing.

  • Buhari’s supporters call for Fani-Kayode’s arrest

    THE Buhari Support Organisation, the umbrella body of All Progressives Congress (APC) presidential candidate General Muhammadu Buhari’s supporters, has called for the arrest of the spokesman of the Peoples Democratic Party (PDP) Presidential Campaign Organisation, Chief Femi Fani-Kayode, for violating the Electoral Act.

    The organisation praised Nigerians for turning out en masse to perform their civic responsibility and for conducting themselves peacefully.

    Director of Media and Information Technology Dr. Chidia Maduekwe said at a news conference that Fani-Kayode’s claim that the PDP was leading in 23 states was against the Electoral Act, which empowers only the Independent National Electoral Commission (INEC) to announce such results.

    He said: “We strongly condemn the recent outburst and blatant misinformation of the public by Mr. Femi Fani-Kayode that the PDP was leading in 23 states. This claim is a total breach of the Electoral Act and is designed to cause the breach of peace.

    “Gen. Muhammadu Buhari had emphasised to his supporters to maintain calm in the face of provocation by the ruling party. This recent utter exhibition of lawlessness enmeshed in the typical character of impunity by PDP is unacceptable.

    “We ask the security agencies to effect the arrest of Mr. Fani-Kayode for breaching  the Electoral Act, which forbids any organ outside INEC from officially declaring election results.  His arrest for further questioning will be an indication  that the security agencies are truly unbiased participants in this process as this declaration is also a breach  of the 1st and 2nd Abuja Peace Accord.

    “We call on the international community and observers to note the steps being taken by PDP to cause severe breach of peace and call them to order. We also ask our supporters to maintain the peace as we await the official announcement from INEC of the authentic result for the March 28 elections.”

    Maduekwe added: “The presidential and parliamentary election is a watershed in our march towards credible, fair and free elections in Nigeria. Our gratitude goes to our supporters, who trooped to the various polling units nationwide to vote for our presidential candidate General Muhammadu Buhari despite provocation, particularly in the Southsouth and Southeast.

    “Their effort and determination to resist manipulation of the outcome is commendable in the face of tyranny, intimidation, and blatant misuse of the security by PDP/government agents.

    “We appeal to our supporters to sustain their calmness in the face of provocation and abuse of our electoral processes.

    “Many independent observers have positively commented on the large turnout of voters, especially in the northern and southwestern states of the country and their orderly conduct. General Muhammadu Buhari is so far, doing brilliantly in most polling units nationwide.

    “We reject the use of security by PDP government to compromise an election process that has been commended as having high quotient of integrity by the manner voters conducted themselves. A situation where ballot papers are being thumb-printed by security agents with the connivance of PDP is condemnable.

    “It is highly regrettable that Senator Goje’s residence should be surrounded by a detachment of armed military officers, thereby undermining his ability to fulfill his fundamental  freedom of voting

    “The court order that soldiers should not be deployed was openly disobeyed in Edo and Rivers. The question should be: “who gave that order to contravene a judicial pronouncement?”

    “The shameful act by the Vice President, Namadi Sambo, in moving his polling unit in Kaduna away from where he registered is questionable. It is contrary to the Electoral Act and such action by the Vice President should be examined and the illegality addressed as these are signs of impunity by the ruling  PDP government, which INEC should not treat with levity.

    “The gruesome hacking to death of APC supporter by PDP hoodlums and Ijaw militant youth under the watchful eyes of the security should not be wished away.  There have been several reported cases of uniformed men caught in the last 48 hours thumb-printing ballot papers for PDP in Port Harcourt.

    “Some were caught at Mile 2 and reports were lodged with the police. However, the culprit was released on arriving the police headquarters in Port Harcourt while the APC agent, who made the report, was locked up in a police cell; a clear case of the patriot becoming the offender.

    The Bauchi/Gombe incident does not appear to be a Boko Haram attack. It is believed to have been arranged to cause mayhem in the state with the resultant excuse to declare curfew and waste votes in favour of General Buhari.

    “From the foregoing, we make bold to request INEC to please, adhere strictly to the guideline, which makes it mandatory for the polling units party agents to sign result sheet, forming the basis for collation of result at collation centres. We have witnessed in many instances, the security dispersing party agents before their duties were fulfilled, leading to the manipulation of the vote count by the security agents with active participation of PDP officials.”

    Alleged money laundering: Fani-Kayode’s surety withdraws

    THE Director of Media and Publicity of the Peoples Democratic Party (PDP) Presidential Campaign Organisation, Chief Femi Fani-Kayode, who is under trial for money laundering, will have to find a surety or risk being re-arrested.

    One of his sureties has applied to the Federal High Court in Lagos to withdraw from guaranteeing the defendant’s temporary freedom.

    The surety, Wale Ajisebutu, told Justice Rita Ofili-Ajumogobia that he urgently needed to make use of his Certificate of Occupancy (C of O).

    He deposited it as one of the conditions for granting Fani-Kayode bail.

    The judge was to consider the application yesterday, but the defence, it was learnt, asked for another date.

    The matter has been fixed for March 26 for hearing of the surety’s application and continuation of trial.

    Fani-Kayode was accused of making a transaction exceeding N500,000 on September 20, 2006, which was not done through a financial institution, by accepting N2.1 million in cash.

    The money, said the prosecution, was paid into his personal bank account by his aide, Supo Agbaje, while he served as Minister of Culture and Tourism. He pleaded not guilty.

    The alleged offence contravenes the Money Laundering Act.

     

  • On Fani-Kayode’s Give me Oduduwa or I die

    Give Me Oduduwa or Let Me Die is not just a slogan. It signifies the dawn of a new era, a veritable rallying platform for emancipation of South-west. What Femi Fani-Kayode said is not a diatribe but absolute truth about the hellish reality of Nigeria.

    To pretend that all is well is akin to a demented adult goat dinning and wining with pride of lions. This platform has come to stay forever. It’s our own subterfuge that will usher us to the proverbial promise land where the son and daughter of bricklayer, roadside mechanic, goat herder, plumber etc., can aspire to dream according to his or her capacity; where religion or social-economic status will not be a litmus test to gauge the capacity of any citizen; where the future of our daughters will not be subjected the whims and caprices of sexual predators.

    Today, we are living witnesses to gradual poaching of innocent citizens without provocation with brazen persecution of some citizens as persona non grata because of their faith, ethnicity and political affiliations. Never in modern history of sub-Saharan Africa have we witnessed such brazen act of bestiality where innocent citizens are endangered species in their own country; where some demented citizens have automatically acquired the medieval era franchise terrorist licence to deny innocent citizens the inalienable right to live in peace.

    With terrorism becoming an instrument of political negotiation and manoeuvre, it is obvious that the grape has gone sour and our honeymoon is over. Perhaps, some may say this is a lofty dream without substance but I make bold to say that the journey of 1,000 kilometres must start from zero point. There is no gain without pain because throughout human history, no struggle is ever successfully executed merely on rhetoric without blood and sweat.

    If Fani-Kayode is wrong by coining that phrase, we the good people of South-west don’t want to be right. Yes of course! The honey moon is over long time ago because Nigeria is splinter bomb,  imploding bit by bit. It’s a soulless entity because a section of this country deliberately wants it so and on this basis, some of us are making this solemn clarion call on our brethren that enough is enough, because it’s practically impossible to co-exist with predatory religious bigots and terrorists.

    The spate of bombing and terrorism going on in our country today is heart rending and traumatizing. These acts of savagery are alien and strange to Yoruba culture and heritage. The aspiration for a secular New State of Oduduwa is not an engagement in flight of fancy or an exercise in futility as postulated by naysayers. But like every other noble endeavours, it must pass through the normal metamorphic process because it is a realistic and legitimate project.
