  • Oni vs Fayemi: Court sets hearing for Sept 25

    *Okays ex-gov’s amended processes

    A Federal High Court in Abuja has fixed September 25 this year for hearing in the suit challenging the eligibility of Ekiti State Governor-elect, Kayode Fayemi for the last govrnorship election in the state.
    Justice Nnamdi Dimgba chose the date on Wednesday after granting an application by the plaintiff, Segun Oni, for an amendment to the originating processes.

    Earlier, Oni’s lawyer, Anthony Adeniyi told the court that his client has complied with the order for substituted service on the defendants.
    Fayemi’s lawyer, Rafiu Balogun said his client was just served with the court processes and needed time to respond.
    He agreed to file his client’s response before the next date.

  • Fayemi: we’ve uncovered Fayose’s plan to sell govt property

    Ekiti State Governor-elect Dr. Kayode Fayemi and his outgoing counterpart, Mr. Ayo Fayose, have accused each other of breaching public trust.

    While Fayemi said he had uncovered an alleged plan by Fayose to secretly sell off some government property through some shady deals, Fayose said Fayemi’s agents were making moves to block the allocation of new shops to traders at the new Erekesan Market.

    In a statement yesterday in Ado-Ekiti, the state capital, by his Special Adviser (Media), Olayinka Oyebode, the governor-elect said Fayose was planning to sell off the Erekesan Market, many parcels of government land and other utilities.

    He warned that anybody transacting business with the outgoing governor was doing so at his own risk.

    According to him, the incoming administration will not honour such transactions.

    The statement said: “The attention of …Dr. Fayemi has been drawn to the clandestine moves by outgoing Governor Fayose to hurriedly dispose off some valuable properties of Ekiti State government through shady arrangements.

    “Some of the properties are:

    1. A large expanse of land between Ondo State Civil Service Commission and Elan Club, in front of Government Printing Press, Alagbaka, Akure.
    2. Erinfun Livestock Development Centre, covering 600 hectares of land on Federal Polytechnic Road, Ado-Ekiti.

    iii. The new Oja Oba Market, among others.

    “We hereby inform and advise the public, particularly prospective buyers, to be circumspect in entering into any transaction with outgoing Governor Fayose in respect of any of the properties mentioned above or any other one whatsoever as the incoming administration may not recognise or give effect to such transactions.

    “A word is enough for the wise!”

    But in a statement by his Special Assistant on Public Communications and New Media, Lere Olayinka, the governor said Fayemi’s agents were allegedly planning to take a legal action to stop the allocation of shops to market men and women.

    He said: “Desperate All Progressives Congress (APC) goons, led by Fayemi’s Deputy, Chief Bisi Egbeyemi, have concluded plans to scuttle allocation of the over 700 lock-up shops in the new Oja Oba Market to beneficiaries, who have already obtained forms.

    “They are set to go to court to stop allocation of the shops.

    “Meanwhile, these same APC people were against the market project when it started.

    “But now that the project is nearing completion, they want to allocate the shops to their cronies, not minding owners of the shops, which were demolished to pave the way for the new market.

    “Ekiti people should remember how these same APC people shared the Irewolede Housing Estate, Ado Ekiti duplexes built by the Segun Oni Poples Democratic Party (PDP) government.

    “This time round, however, the people will prevail. The lock-up shops will be allocated just the way the over 200 open shops were openly allocated a few weeks ago.”

  • Ekiti poll tribunal: Fayemi assembles eight SANs, 27 others for defence

    •1,009 witnesses to testify for governor-elect

    All is set for legal fireworks at the Ekiti State Election Petitions Tribunal following yesterday’s filing of the defence of the governor-elect, Dr. Kayode Fayemi, at the registry.

    The governor-elect filed a 2,558-page reply to the petition filed by the defeated candidate of the People’s Democratic Party (PDP), Prof. Kolapo Olusola.

    The incoming governor also brought to the tribunal’s registry 3,500 exhibits, including a plethora of documents gathered to defend his victory at the poll.

    Fayemi, who contested on the platform of the All Progressives Congress (APC), was declared winner of the July 14 governorship election by the Independent National Electoral Commission (INEC).

    The governor-elect has also assembled a crack team of lawyers, including eight Senior Advocates of Nigeria (SANs) and 27 other lawyers to be led by Prince Lateef Fagbemi.

    Fagbemi, an election petition expert, was renowned for achieving victory in court for former Rivers State Governor Chibuike Amaechi, when the Supreme Court ruled that he be sworn in without participating in the 2007 election.

    The apex court held that the votes Amaechi were deemed to have been cast for his then party, the PDP.

    It sacked Mr. Celestine Omeiha from office after five months in power.

    Others SANs in Fayemi’s legal team are: former Attorney General of the Federation (AGF) and Minister of Justice, Chief Akinlolu Olujinmi; Dr. Kayode Olatoke, Mr. John Baiyeshea, Mr. Abiodun Owonikoko, Mr. Yomi Aliyu, Mr. Adesegun Ajibola and Mr. Hakeem Afolabi.

    Fayemi is praying the tribunal to dismiss Olusola’s petition for “lacking merit”.

    On August 3, Olusola filed a 700-page petition, urging the tribunal to declare him winner.

    He claimed that he scored the highest number of lawful votes in the governorship poll.

    Addressing reporters after filing the petition, Olatoke, who spoke on behalf of his colleagues, said Olusola’s petition was a “waste of time as it lacked substance”.

    The lawyer also said it was sure that the case would be dismissed by the tribunal.

    He added that Fayemi won fair and square in 12 of the 16 local government areas of the state, while Olusola won in four.

    Responding to Olusola’s petition on alleged over-voting in some polling units, Olatoke described the claim as frivolous and baseless.

    The lawyer said Olusola’s first ground in his petition is based on Fayose’s phantom indictment, which he insisted had been nullified and set aside by a competent court.

    He added: “The second ground of Olusola’s petition is alleged over-voting, which is another false claim. In any case, the petition in itself is self-defeating.

    “The third ground is on deliberate voiding of votes, as alleged by Olusola, but in actual fact, majority of the voided ballots were votes meant for Fayemi. The fourth ground is on vote-buying, which is baseless as it was Olusola’s sponsor, Governor Ayodele Fayose, who is guilty of this.

    “Fayemi won convincingly based on his popularity.”

    No date has been fixed for hearing.

  • Fayemi condoles with Ojo’s family

    Ekiti State Governor-elect Dr Kayode Fayemi has commiserated with the family of a member of the All Progressives Congress (APC), Bunmi Ojo, who was killed last Friday by gunmen in Ado-Ekiti, the state capital.

    The late Ojo, who was a member of the Federal Character Commission, was said to be watching a football match with other soccer fans in Adebayo area of the state capital when assailants shot him dead.

    In a statement by the Director of Media and Publicity in the office of the governor-elect, Wole Olujobi, Fayemi expressed shock and sadness over the late Ojo’s murder.

    The governor-elect said the killing was a sad commentary that shattered the relative peace the state had enjoyed after the July 14 governorship poll.

    He commiserated with the family of the late politician.

    Fayemi urged security agencies to get to the root of the killing and bring the perpetrators to justice.

    The governor-elect said he knew Ojo in his youth as an activist with vision and commitment to human development.

    The statement said: “This is a sad development that should not be allowed to go away without getting to the root of this killing. But then, the public must give security agencies the chance to do their job – to get to the root of this sad development. Security agencies are enjoined to swing into action to apprehend the perpetrators of this heinous crime to check the activities of criminals in Ekiti State.

    “This is the minimum responsibility the security agencies owe the public so that Ekiti people can live in peace without any threat to the security and peace of the state.

    “While commiserating with the family of the deceased and entire members of APC, we pray God to grant him eternal rest.”

  • Tribunal gives PDP order of substituted service on Fayemi

    The Election Petitions Tribunal sitting in Ado-Ekiti, Ekiti State capital, yesterday granted an ex parte order to the Peoples Democratic Party (PDP) to serve the candidate of the All Progressives Congress and Governor-elect, Dr Kayode Fayemi, through substituted means.

    The PDP candidate, Prof Kolapo Olusola, last Friday, filed a 700-page petition challenging the declaration of Fayemi by Independent National Electoral Commission (INEC) as validly elected.

    The governorship election, which produced Fayemi, was conducted on July 14, but it has become the subject of litigation, following Olusola’s objection to the results.

    At yesterday’s sitting, tribunal’s Chairman, Justice Suleiman Belgore, ordered PDP to paste the service at APC’s office in Ado-Ekiti or convey the message to the respondent through newspaper publications.

    The bailiff had complained he could not effect service on the second and third respondents – APC and Fayemi – as the party’s office in Ajilosun, Ado-Ekiti, was shut and, while the third respondent is out of the country.

    Following the circumstance, the PDP and its candidate, through their legal team, led by Yusuf Ali (SAN), filed a motion ex parte pursuant to paragraphs 8 (2), 47 (1), (2) and 54 of the Electoral Act, 2010 (as amended), Order 6, Rule 5 of the Federal High Court.

    The motion, moved by Obafemi Adewale, who represented the petitioners, sought the following: “An order of the tribunal granting leave to the petitioners/applicants to bring this application before the pre-hearing session and to hear and determine same accordingly.

  • Ekiti poll: Tribunal grants Fayemi access to electoral materials

    The Ekiti State Governorship Election Petitions Tribunal sitting in Ado-Ekiti, the capital, yesterday granted leave to Governor-elect Kayode Fayemi to inspect and obtain certified true copies (CTC) of polling documents, ballot papers and other electoral materials used in the July 14 election.

    This followed the motion ex-parte filed by Fayemi under Section 151 of the Electoral Act in defence of a petition against his declaration by Independent National Electoral Commission (INEC) as winner of the poll.

    The reliefs Fayemi is seeking include leave to hear and determine the application for the inspection before pre-hearing session.

    Counsel to Fayemi, who is the third respondent, Mr Abayomi Aliyu (SAN), listed eight grounds upon which the motion ex parte should be granted.

    The lawyer argued that such would enable his client to prepare for necessary defence in the course of the matter.

    Tribunal Chairman Justice Sulaiman Belgore, who reviewed the reliefs sought by Fayemi, held that the tribunal found merit in the application and granted them in the interest of fair hearing.

    The tribunal also granted the respondent’s prayer to allow forensic experts to inspect, by electronic scanning, the ballot papers, voters’ registers and other materials.

    It also granted Fayemi leave to use handwriting experts to inspect statutory forms used for the election.

    Last Friday, the PDP candidate, Prof. Kolapo Olusola, filed over 700 pages of petition challenging Fayemi’s victory.

    He claimed to have scored the highest number of lawful votes cast in the election.

    Fayemi’s application, dated July 31, was anchored on six grounds.

    In his application, the APC candidate said:

    • “That the counsel is seeking the order of the tribunal to see the documents of the election materials.
    • “To make photocopies of the documents of the election materials.
    • “To use forensic equipment to view the handwriting of the election result, and the fingerprint of the election materials.
    • “Request, on the order of the court, to obtain and photocopy all the election materials held on July 14, which is also in custody of the first respondent (PDP).
    • “To seek forensic experts, to access both machine and other materials used in the conduct of the election in order to defend the petition of the first respondent (PDP).
    • “To have all the materials used in all the polling units of the election.”

    •’He can’t get backdoor victory’

    Ekiti State Governor-elect, Dr Kayode Fayemi, has hailed the candidate of the People’s Democratic Party (PDP)’s candidate in the July 14, 2018 governorship election, Prof Kolapo Olusola, for ventilating his grievances at the Election Petition Tribunal.

    Olusola on Friday filed a petition of over 700 pages at the registry, urging the Tribunal to declare him winner of the governorship poll claiming to have scored the highest number of lawful votes cast.

    But Fayemi in a statement yesterday by Director of Media and Publicity of his Campaign Office, Wole Olujobi, said the action was a welcome development to strengthen democratic practice.

    It noted it is a constitutional right of the petitioner as enshrined in the Electoral Act to do so.

    “Even though it is the petitioner’s right to seek legal redress in his complaint, it is a fact that the July 14 governorship election that returned Dr Kayode Fayemi is one of the best elections conducted by INEC in this country in which the will of the people was freely expressed through the ballot box.

    “For this reason, Fayemi won one of the best, freest and fairest elections in Nigeria as attested to by the elite election monitoring group, Transition Monitoring Group (TMG), which rattled Governor Ayodele Fayose, who thereafter assembled fake observers group populated by PDP members who tried to discredit the exercise.

    “We won the election in a very free and fair manner and we have no doubt that the tribunal will find this to be the case too in theirfinal judgment.

    “Judgment on the petition will be in accordance to the law and not to the terms of the petitioner, and so Eleka cannot be a judge in this case as he sought to do in his petition.

    “Now that he has filed his petition, he should leave the tribunal to decide if he won or not and not to prejudge, as the petitioner tried to do in his complaint to the tribunal.”

    The Deputy Director General of the Kayode Fayemi Campaign Council, Hon. Bamidele Faparusi, has described Olusola’s filing of petition against Fayemi’s victory as an “exercise in futility.”

    Faparusi maintained that the election of Fayemi reflected the will of Ekiti people and that not even the petition filed by Olusola or any other party can upturn the verdict.

    The former House of Representatives member added that the party will assemble highly experienced legal team that would confront the PDP and its candidate and prevent them from getting victory through the backdoor.

     

  • Fayose’s deputy files 700-page petition against Fayemi

    .URGES TRIBUNAL TO DECLARE HIM WINNER OF GOV POLL

     

    Ekiti State Deputy Governor, Prof. Kolapo Olusola, has dragged the governor-elect, Dr. Kayode Fayemi, before the Election Petition Tribunal.

    Olusola, who was the People’s Democratic Party (PDP) candidate in the July 14 governorship election, urged the court to declare him winner of the poll claiming that he scored the highest number of lawful votes cast.

    He urged the jury to set aside the victory of Fayemi, the candidate of the All Progressives Congress (APC), who was declared winner by the
    Independent National Electoral Commission (INEC).

    According to the result declared by INEC, Fayemi polled a total of 197, 459 to defeat Olusola, who received 178, 121 votes.

    Olusola, who was accompanied by his running mate, Mr. Ayodeji Ogunsakin, submitted a 700-page petition at the tribunal registry within the State High Court premises at about 5.30 pm.

    The statutory 21-day grace allowed by the Electoral Act 2010 (as amended) to file a petition by any candidate aggrieved with the outcome expired on Friday.

    Olusola explained that the team of lawyers that will defend his petition will be led by an Ilorin, Kwara State-based Senior Advocate of Nigeria, Malam Yusuf Ali.

    Speaking with reporters after filing the petition, Olusola said he was motivated to go to court because of what he described as the “brazen robbery” allegedly carried out by INEC in collaboration with federal security forces.

    He alleged that the poll was manipulated by people he described as “political desperadoes using the instruments of the Federal Government.

    The PDP flag bearer also alleged ballot snatching, ballot stuffing, gross falsification of results and the use of security forces to subvert the electoral wishes of Ekiti people.

    He urged his supporters to keep hope alive noting that he has absolute trust in God and the judiciary to retrieve the alleged stolen mandate.

    Olusola said: “Today, I formally filed the much expected petition against the results of the July 14, 2018 governorship election, which was openly manipulated by political desperadoes, using instruments of the federal government.

    “Like I have maintained, I am challenging the election results not out of desperation to be governor, but for reasons of future and posterity, and largely on behalf of the people of Ekiti, who were taken aback by the outcome of the election.

    “Without doubt, the will of the people was subverted by those who have chosen to take Nigeria back to the dark days of ballot stuffing, ballot boxes snatching and outright falsification of election results and I believe they deserve to get justice.

    “I am challenging the election results not out of desperation to be governor, but for reasons of future and posterity, and largely on behalf of the people of Ekiti, who were taken aback by the outcome of the election.

    “Without doubt, the will of the people was subverted by those who have chosen to take Nigeria back to the dark days of ballot stuffing, ballot boxes snatching and outright falsification of election results and I believe they deserve to get justice.

    “As law abiding citizens of our country, the only path of honour to take in a situation like this is the process that we have initiated today, to seek redress against the use of security forces and other instruments of the federal government to suppress the will of our people.

    “Sadly, the desperation of the APC to take over all States in the country, especially those under governors like Dr. Ayodele Fayose perceived as uncompromising has destroyed all the gains made by the PDP government regarding free, fair and credible elections.

    “The mood of Ekiti people when the beneficiary of the electoral robbery was declared winner and up till today is a pointer to the resolve of the people not to accept the subversion of their will and we have answered their calls to use the judiciary to get back their mandate.

    “In doing this, we have presented overwhelming discrepancies in the results declared by INEC to the tribunal to adjudicate upon and I am confident that the popular mandate of the people of Ekiti will not go unrestored. I therefore want Ekiti people to keep hope alive, remain strong and resolute in their belief in God.

    “While we go through this judicial walk to exposing the electoral thievery of July 14, 2018, we urge the good people of Ekiti State, especially my teeming supporters to remain calm, peaceful and prayerful, bearing in mind that those who stole their mandate will not enjoy the benefits for long.

    “I also want to use this opportunity to condemn the indefinite closure of the State Radio and Television stations. No doubt, the closure of the radio and television stations was part of the grand plan to sustain the inglorious use of naked force to rob Ekiti people of their democratic rights, but the people will triumph ultimately”.

    A member of Olusola’s legal team to the petitioner, Mr. Ola Olanipekun, a Senior Advocate, said what the petitioner was asking for is outright nullification of the election that produced Fayemi and declare their client winner of the poll.

    Olanipekun said: “By the time the hearing begins, we are going to prove cases of falsification of results, ballot snatching, ballot stuffing and use of powers to subvert the will of the people.

    “By the time we do this, the whole world can judge whose was the actual winner. We are confident that justice will be done in this case, we are sure that our client shall get justice.

  • The return of Fayemi

    If you describe Dr Kayode Fayemi as a cat with nine lives, you may not be wrong. He first contested for the Ekiti gubernatorial seat on April 14, 2007 and he was reported to be leading in 12 out of the 16 local governments as at 10 pm on that fateful Saturday night before the Independent National Electoral Commission (INEC), under Prof. Maurice Iwu came with its magic and declared his rival, Engineer Segun Oni, as the winner.

    Fayemi was in court for 36 months before he reclaimed his mandate at the Court of Appeal, Ilorin, and was sworn in as governor on October 16, 2010.

    Expectations of Ekiti people were very high having supported him for 36 months in reclaiming his mandate. Fayemi didn’t disappoint them as he fulfilled his promise to make poverty history in the state through his 8-point agenda. He enjoyed the support of the people and was very popular but all this changed after his second year in office when the incumbent, Governor Ayodele Fayose, in his comeback bid, launched a vicious campaign of lies against his person and government.

    First, he lied that Fayemi stole Ekiti money to build a university in Ghana. We didn’t take this serious at first because we thought nobody would believe that trash. But we were wrong, as this lie gained ground and was unbelievably believed by those who we thought should know better, because there is no such university anywhere. By the end of Fayemi’s third year in office in 2013, the damage had been done.

    Coupled with the lie from the opposition was internal discontentment within the APC by its members who were aggrieved by many reasons, principal among which was that Fayemi concentrated on physical infrastructure while neglecting stomach infrastructure. This simply means Fayemi ought to have spent the money he expended in constructing roads, building civic centres and palaces in Ekiti communities on party members. This was the opportunity Fayose was waiting for to complete his vicious campaign against Fayemi.

    The concept of stomach infrastructure was hijacked by Fayose and he made this the kernel of his campaign. He twisted the thinking and orientation of Ekiti people into believing that Fayemi was selfish, aloof, arrogant and self-centred. By the time Ekiti people went to the polls on June 21 2014, despite his good works in all 131 towns in the state, Fayemi had lost so much goodwill such that APC members who even benefitted a lot from the regime complained bitterly of marginalisation.

    The invasion of Ekiti State during the June 21, 2014 elections by federal forces who arrested more than 600 APC leaders on the eve of that election and on election day completed the routing of Fayemi in the election. Fayemi lost the election to Fayose who was disgraced out of office in 2006.

    When Fayose assumed office, his main agenda was to destroy Fayemi politically and rubbish all his achievements through propaganda using the state media to reinforce the vicious campaign he started before he assumed office. He lied that Fayemi bought a N50m bed in the new Government House, had a university in Ghana and left Ekiti State in debts that the state will continue to pay till 2036. This was his excuse for not paying salaries and allowances of workers and pensioners. It was so bad that Fayose and his aides went on live television to call Fayemi a rogue and all unprintable names.

    Due to the systematic character assassination of Fayemi by Fayose and his aides, Fayemi almost became a persona-non-grata in Ekiti State and only a tiny group of loyalists stood with him. Within the APC, many of his appointees turned against him and formed a pressure group that derided the few still left with him.

    The victory of Governor Fayemi in the recently concluded election in Ekiti State taught me many lessons about life and the long and short of this is that only God is wise. The same way his profile nosedived in 2014 when he lost his re-election bid was the same way his profile rose when he defeated the Fayose-backed PDP candidate, Professor Olusola Eleka.

    Fayemi did not just emerge from the blues to clinch the gubernatorial ticket of the APC against all odds and obstacles placed on his way by Fayose and even from his own party and going ahead to win the gubernatorial election on July 14, 2018; it was a result of scientific planning and high level strategic delivery with precision which is almost error-free. Above all, there is the God factor in all of these.

    The strategy team of Fayemi did a fantastic job of constant self- assessment based on many field surveys and this always gave the direction to go. While Fayose was busy making noise about a White Paper barring Fayemi from holding office for 10 years, going on air to call him a rogue, Fayemi’s team was busy strategising and consulting critical stakeholders in Ekiti on the need to reclaim our land and restore our values. This campaign slogan jelled with Ekiti people who were tired of Fayose’s chicanery and demagoguery.

    Fayose was deconstructed as a pathological liar and stunt master who despite receiving billions of naira from the federation’s account in four years, bailouts, Paris Club refund, budget support facility and other intervention funds, refused to pay workers for about 10 months running.

    What also worked for Fayemi was his track records. The wool with which Fayose covered the eyes of Ekiti people was removed when they were able to compare over three years of Fayose’s administration to that of Fayemi. Apart from the state capital, Ado Ekiti, where Fayose built a needless bridge, and Ikere, there is no government’s presence in the remaining 129 towns compared to Fayemi’s administration where his projects are still visible in all 131 towns in the state apart from beneficiaries of his welfare programmes in all the towns.

    Even in Ikere-Ekiti, more than half of the money spent to construct the town’s road was raised through private companies’ corporate social responsibility cash, even though Fayose would not disclose this to Ekiti people.

    Ekiti people especially civil servants, teachers and pensioners became nostalgic about the Fayemi years because their salaries and allowances were regular unlike now that Fayose is owing them 10 months’ salary arrears.

    As a result of this, Fayemi’s popularity rating soared from less than 40 percent in February to about 75 percent by May. The tag of Fayose’s lapdog given to the candidate of the PDP, Prof. Eleka, became his major undoing as Fayose took over the campaign and it was difficult to know who was contesting between Fayose and Eleka, more so, when Eleka has no manifesto of his own other than his continuity slogan, meaning that he has adopted Fayose’s programmes that have impoverished Ekiti people in the last four years. It was so bad that Fayose lost his Irepodun Ifelodun Local Government while the PDP only won in four local governments against APC’s 12.

    The lesson in Fayemi’s second coming and Fayose’s fall is that only God is wise and the moment any mortal plays God like Fayose did, the fall of such mortal is imminent. Ekiti people shall be rewarded with good governance as promised by the governor-elect because he is a man of his words and has learnt useful lessons both as a former governor and minister.

  • Fayemi visits Bamidele in London

    Ekiti State Governor-elect, Dr. Kayode Fayemi, has visited the Director-General of his Campaign Council, Mr. Opeyemi Bamidele in London, United Kingdom.

    Bamidele was shot on June 1 by a trigger-happy policeman at the premises of the All Progress Congress (APC) during a welcome rally organised for Fayemi after stepping down from the Federal Executive Council  (FEC) as Minister of Mines and Steel Development.

    The former House of Representatives member was rushed to the Ekiti State University Teaching Hospital where he was operated upon and stabilised before being flown abroad.

    Bamidele, who has been discharged from the hospital is still in London as an outpatient.

    In a statement last night by his media aide, Ahmed Salami, Fayemi, who left Ado-Ekiti for Lagos immediately after inaugurating his Transition Committee arrived in London.

    The statement said Fayemi spent quality time with Bamidele, his wife, Yemisi  and other members of the family, Mr. Abiodun Bamidele and Mrs. Folasade Bamidele.

    Fayemi and Bamidele also reviewed issues regarding the  July 14 governorship election.

    The reunion sparked up celebration of victory and praise and worship  sessions from the two eminent Ekiti leaders.
