    Confrontation breaks out between Fubara, lawmakers

    • House gives governor 48 hours to submit 2025 Appropriation BIll

    A confrontation broke out yesterday in Rivers State as lawmakers gave Governor Siminalayi Fubara a 48-hour deadline to submit the 2025 Appropriation Bill for their consideration.

    The lawmakers said unless this is done, the state might be plunged into a financial crisis because they (lawmakers) will proceed on a 12-week recess from Friday.

    They made this position known during plenary.

    On the other hand, Governor Fubara vowed to fight on, saying he was not scared of impeachment.

    Yesterday was the first working day after Friday’s  Supreme Court judgment which restored the state legislature and ordered the governor to submit the 2025 Appropriation Bill to them for scrutiny.

    The Supreme Court ordered the stoppage of federation accounts allocation to Rivers until the lawmakers passed the Appropriation Bill.

    Although the governor in a broadcast on Sunday promised to implement the judgment without reservation, his speech at the inauguration of Government Staff House Quarters yesterday showed his combativeness.

    Fubara said: “People should know that because no matter how we have been fooled in this state, it has gotten to a point where this state has decided to take their destiny in their hands.

    “In as much as I don’t subscribe to violence, when the time comes for us to take a decision, I will lead the cause for that decision.

    “Let me say it again, I am not scared of anything. The worst that will happen is for me to leave the office. It is not that I am leaving the earth.

    “Is it going to stop me from existing? So, I am not bothered about that. But the right thing must be done and said when the opportunity is given to us.

    “Let me thank everyone, especially our youths, be strong, please don’t be perturbed. I assure you that at the right time, you will get the instructions.”

    Fubara said he was prepared to pay the supreme price in the course of defending Rivers’ interest.

    Urging the people to take their destiny into their hands, the governor enjoined the youths to remain resolute.

    The governor lamented that each time his administration tried to stabilise, a spanner would be thrown in its wheel of progress, thereby forcing it to start from the beginning.

    Turning to the leaders backing his government, he said: “Our leaders, I do not have anything to give to you. We have not given you anything right from the time we started.

    “We have been running a system where every time when we tried to stabilise, one spanner would be thrown our way.

    “So, for that reason, it is like bringing us to ground zero and we start afresh. But I will continue to thank you for supporting us without getting anything; supporting us because you believe that it is the right thing to do for Rivers State.

    “Let anybody not be deceived; there are faces today that will carry the symbol of some persons and it will be a curse in this state.”

    Fubara urged the people to remain strong and fight gallantly to the end, stressing that the focus is not about winning, but about standing for the right cause.

    He said: “I want you to be in your highest spirit. It is not about who wins, it is about the glory and the honour of fighting gallantly. Being on the side of truth, not on the side of lies, because of cheap favour.

    “I want to assure all our supporters, I know that the news that broke out on Friday must have dampened your spirit. Brace up. What is ahead is more than what has just passed.

    “As humans, I know you feel somehow. But just relax. God has our back. We are not resting on anybody but God only.

    “I want to thank you for your support and assure you that if there is one person on the planet Earth who will continue to stand by you, I will be that person.

    “I assure you that I will lead you with honour, respect and integrity, knowing that when I leave here  I will have questions to answer.

    “If I am called upon years from today, I want to be proud to defend my position.”

    Supreme Court said that there is absolute lack of governance in Rivers.

    But yesterday, Fubara inisted there is.

    He said despite the antics of foes who believe there is no governance in Rivers, “there is legitimate and purpose-driven governance in Rivers State”.

    He said his government, which is not driven by selfish interest, would continue to do the right thing.

    On the staff quarters, he said: “We decided that our staff members can’t be living in uncomfortable places while I live in comfort.

    “Why would I get efficiency from my workers if they are not happy? The government decided to embark on this project. And I am happy that the contractor delivered it within the time limit.”

    ‘Re-present budget estimates within 48 hours’

    The House of Assembly, which sat for the second time after the judgment, gave the governor a 48-hour ultimatum to re-present this year’s budget estimates.

    The Assembly also unfolded plans to amend the Rivers State Local Government Law, Number 5 of 2018  and the Rivers State Independent Electoral Commission Law, Number 2 of 2018.

    The resolutions of the House were contained in a letter dated March 3,  2025, addressed to the governor.

    Copies of the letter signed by Amaewhule were also sent to the Deputy Governor, Prof. Ngozi Odu; Accountant-General of the State and the Chairman of Rivers State Independent Electoral Commission (RISIEC).

    The lawmakers explained that their resolutions were based on the Supreme Court judgment that stopped the statutory federal allocations to the state government and halted spending from the Consolidated Revenue Fund, pending the passage of the Appropriation Bill.

    The lawmakers asked Fubara to present the 2025 Appropriation Bill in line with the provisions of the 1999 Constitution as amended.

    On its plan to amend the local government and RISIEC laws, the lawmakers said the Supreme Court judgment nullified the purported Rivers State Local Government Election of October 5 due to its non-compliance with the Electoral Act.

    According to the lawmakers, the amendment was necessary to make the laws comply with the Electoral Act and pave the way for fresh local government elections.

    The lawmakers rejected the governor’s directive that the sacked chairmen should hand over to the heads of personnel.

    They referred the governor to the provisions of the 1999 Constitution as amended, the Rivers State Local Government (Amendment) Law, 2023 and the judgment of the Supreme Court which affirmed the primacy of democratically elected local governments.

    The letter added: “The House expects you to present the 2025 Appropriation Bill within 48 hours.

    “The House would proceed on a 12-week recess as from Friday, March 7. 2025, but the statutory committee would be expected to continue statutory functions.

    “Please, be informed that our resolutions are geared towards a quick fix to the current financial quagmire occasioned by the absence of an Appropriation Law for Rivers State.

    “We do not want Rivers State people to suffer. We, therefore, urge you to act fast and do the needful in the best interest of the good people of Rivers State.”

    Rivers State Governor, Siminalayi Fubara, has declared his commitment to protecting the state’s interests, stating he is willing to make the “supreme sacrifice” following the Supreme Court’s judgment. 

    Speaking at the inauguration of the Government House Staff Quarters on Monday, Fubara emphasised that it was time for Rivers State to take its destiny into its own hands.

    He urged youths supporting his administration to remain steadfast and await further directives from the government. 

    While rejecting violence, the governor maintained that his administration would make the necessary decisions at the right time, adding that he was ready to lead the cause. 

    Fubara further stated that he had no fear of any consequences, noting that, at worst, he could only be removed from office.

    Fubara said that, contrary to the lies that there was no governance in the state, there “is legitimate and purpose-driven governance in Rivers State”.

    He said his government was genuine and was not driven by selfish interest, adding that his government would continue to do the right things in the state.

    He recalled that the staff quarters were in a dilapidated state and completely unhabitable when his government came on board, but he decided to add value in line with the mantra of his government.

    He said: “We decided that our staff members can’t be living in uncomfortable places while I live in comfort. Will I get efficiency from my workers if they are not happy and the government decided to embark on this project? And I am happy that the contractor delivered it within the time limit.

    “So, let me thank the contractor. The contractor has been doing a lot of jobs for us, and they have been doing it diligently with so much commitment, knowing that we have a lot of people there trying to keep records of our activities, not on the good side but on the bad side.

    “So, we need to be proving them wrong, showing them that we are a government of transparency, a government that is not hiding anything.  It is in the future that everybody here will know that it was a challenge to the previous administration, but we did it with ease because we don’t have anything to hide.

    “We are not after our stomach, we are after the joy of our people, that at the end of the day, what will count for us is the lives we have touched genuinely, the legacy we leave that will speak for us that can open doors for our children, our generations yet unborn.

    “Having that in mind spurs us and forces me as a person to stand on the side of right, to do good and stand on the side that even if I am called up tomorrow, I should be bold to defend my actions. I am happy that we conceived this project, executed it, and by the grace of God, we are dedicating it today to the glory of God.”

    The governor commended leaders and food people of the state for their support and told them that his administration had lined up a list of projects for inauguration before the Friday judgment.

    “We are not going back on it. We must complete what we have already planned, and we will add if need be to what we have already decided to do for our people. Let it be on record that the interest of Rivers State remains my priority, and it is above every other thing, even if it means to pay the supreme sacrifice for it, I will not hesitate to do it”, he said.

    Quoting from the Bible’s book of Philippians 3:18-19, Fubara said: “For as I have often told you before and now I tell you again, even with tears many live as enemies of the cross of Christ. Their destiny is destruction, their god is in their stomach, and their glory is in their shame. Their mind is set on earthly things only.”

    He added: “I want to say here today, and to assure everyone that has stood with us that our strength is not on earthly things, our strength is in the supreme being, that even when we fail here, assuming as being contemplated, our victory is assured.”

    ACJHR hails Fubara’s resolve on Supreme Court Judgement

    The African Centre for Justice and Human Rights(ACJHR) has lauded Rivers Governor, Siminalayi Fubara’s resolve on the recent Supreme Court judgement which he accepted to implement after carefully reviewing its Certified True Copy (CTC).

    ACJHR in a statement by its coordinator commended the impressive state broadcast delivered by Governor Fubara on Sunday, which proved the qualities of a statesman and mature leader committed to the rule of law as well as democratic principles.

    The centre said by allowing the rule of law to prevail and starting implementation of the judgement of the apex court has distinguished the governor as the kind of leaders Nigeria needs at this stage of its democratic journey.

    It said when the Governor’s legal team finally obtained the CTC by Friday, March 7, 2025 the people of Rivers and Nigerians entirely would be further intimated of the next positive steps of Fubura with regards to the judgement for the overall interest of the people he is leading as well as upholding the sanctity of the Constitution to which he had sworn to protect.

    According to the centre, if all leaders have the deposition of Fubara, the country would have been a better place where the law is supreme and not personal ambitious, idiosyncrasies as well egocentrism.

    The group stated: “The African Centre for Justice and Human Rights(ACJHR) having listened and watched the state broadcast by the Executive Governor of Rivers State, His Excellency, Sir Siminalayi Fubara, GSSRS, we elect to commend him for his statesmanship and commitment to legality which is uncommon amongst the ruling class.

    “We stand with the Governor in this trying moment which brought out his leadership qualities of upholding Nigeria’s Constitution which he swore to protect despite outright provocation and frustration by assumed ‘powers that be’. His gentlemanly and statemanly disposition has earned him our respect and all men of conscience and goodwill.

    “What would happened if other leaders were in his shoes can be best imagined! But, on the contrary, Fubara rather than desecrating the law and highest court in the land which many who are now celebrating the Supreme Court judgement would have done, he expressed commitment to implementing the judgement.

    “Even before waiting for the CTC to be obtained on Friday, March 7, 2025, the governor has taken a step further by directing the Heads of Local Government Administration to immediately take over the administration of the 23 local government councils pending the conduct of fresh elections by the Rivers State Independent Electoral Commission.

    “The Governor further directed the outgoing local government chairmen to formally hand over the levers of power to the Heads of Local Government Administration by Monday, 3rd March 2025.

    “For those who may not be aware, the Friday judgment of the apex court declared the Local Government election conducted in the state on October 5, 2024, as invalid.

    “The Court equally another barred the Central Bank of Nigeria (CBN), the Accountant General of the Federation and other agencies from releasing funds to the government of Rivers State.

    “All these, the Governor said although the State Government disagree with the judgments, it is bound to obey the orders made therein as a law-abiding government, adding that since inception, his administration  conducted the affairs of government within the framework of the Constitution, due process and the rule of law.”

    Fubara: I’ll obey Supreme Court judgment

    Forty-eight hours after the Supreme Court handed down two judgments that threaten the soul of the Siminalayi Fubara Rivers State government, the governor yesterday announced his intention to fully obey the orders.

    In a twist, described by observers of the Rivers State politics as unexpected, Fubara told Rivers residents that he expected to get the Certified True Copy (CTC) of the judgment by Friday to enable him to take the necessary action.

    He ordered the 23 local government chairmen, whose election was voided by the judgment, to quit today after handing over to heads of personnel.

    The apex court on Friday gave two judgments – one by Justice Akomaye Agim, which recognises the Martins Amaewhule-led 26 members of the state House of Assembly, and the second by Justice Jamilu Tukur, which declared as invalid the election conducted on October 5, 2024, that led to the emergence of 23 chairmen and 319 councillors.

    The apex court further invalidated the state budget and ordered the Central Bank and the Accountant-General of the Federation to stop releasing funds to the state government pending when Fubara would re-present the budget to the authentic House of Assembly led by Speaker Amaewhule.

    In a broadcast yesterday, Governor Fubara said: “I have had a meeting with my team of lawyers and they have assured me that the certified true copy of the judgments may be available to them by Friday 7th March 2025.

    “I assure you that upon the receipt of certified judgments, we shall study their ramifications and implement them without reservations to move the state forward.

    “Furthermore, given the outlawing of caretaker arrangements in the local government system, I hereby direct the heads of personnel management to immediately take over the administration of the 23 local government councils pending the conduct of fresh elections by the Rivers State Independent Electoral Commission.

    “I further direct the outgoing local government chairmen to formally hand over the levers of power to the heads of personnel management by Monday, 3rd March 2025.”

    Fubara said since its inception, his administration conducted the affairs of government within the framework of the constitution, due process and the rule of law.

    The governor noted with regret the trying times the state had been plunged but urged everyone to remain calm and peacefully go about their legitimate daily activities and be sure that his administration would continue to do everything in meeting their aspirations.

    Fubara said: “We are all aware of the recent Supreme Court judgments and pronouncements regarding aspects of the lingering political disputes in our dear state.

    “Although we disagree with the judgments, we are bound to obey the orders made therein as a law-abiding government.

    “Since inception, we have conducted the affairs of government within the framework of our Constitution, due process and the rule of law.

    “While we are not above mistakes because we are humans, we believe that we have not, as a government, done anything deliberately to trample on the rule of law or the hallowed principles of constitutional governance.”

    Fubara, Amaewhule should work together, say elders

    The Rivers State Elders Council (RSEC) called on Fubara and Speaker Amaewhule, to prioritise the interest of the state and work together in line with the Supreme Court judgment.

    Referring to Fubara and the lawmakers as one political family, the elders in a statement signed by its Chairman, Chief Ferdinand Alabraba, said there was no more case standing between the both parties.

    The elders congratulated the people of Rivers State on what they described as the well-rounded pronouncements of the Supreme Court oon the political crises.

    The statement said: “The Elders Council further commends the people of the state for their resilience, patience and peaceful disposition throughout the period of the crises in the state while awaiting the final verdict of the apex court of the land on all the matters.

    “Now that the Supreme Court has spoken unequivocally on all the matters, we believe strongly that nothing now stands in the way of His Excellency, Sir Siminalayi Fubara, Governor of Rivers State and Rt Hon Martin Amaewhule, Speaker of the Rivers State House of Assembly, working together in the best interest of the state and her people.

    “We are, therefore, calling on the Governor of Rivers State and the Speaker of the Rivers State House of Assembly, who both emerged from the same political family in the state, to put Rivers State above all other considerations, personal or otherwise, and ensure urgently that all necessary steps are taken in conformity with their constitutional responsibilities.

    “We give God Almighty all the glory for granting Rivers State this unique opening for peace to return to our dear state.”

    Fubara lines up 10 projects for inauguration 

    Unperturbed by the Friday’s Supreme Court judgement, Rivers Governor Siminalayi Fubara has listed 10 completed projects for inauguration beginning from Monday.

    Fubara, in a statement on Saturday, by his Commissioner for Information and Communications, Warisenibo Joe Johnson, said the projects would be inaugurated in 10 days beginning from March 3.

    The statement said: “Over the course of ten days, critical infrastructural projects spanning multiple sectors will be inaugurated, reflecting the administration’s unwavering commitment to development, security, and improved service delivery.

    *This commissioning schedule encompasses key projects in housing, firefighting and emergency response, security, healthcare, education, and judiciary welfare across Port Harcourt City, Obio/Akpor, Khana, Okrika LGAs and Bayelsa State”.

    The statement listed the projects to be inaugurated as the Government House Staff Quarters; state fire service headquarters and firefighting vehicles; 

    handing over of helicopter to the Nigerian Air Force; Borokiri Fire Service Station and firefighting vehicles and Rumuodonmaya Fire Service Station and Firefighting Vehicles (Obio/Akpor LGA).

    Others are construction and furnishing of the Palace and Residence of Akpor Monarch, Judges’ Quarters, Bori General Hospital, Okrika Grammar School, Okrika and furnishing, equipping & electrification of the Nigerian Law School, Yenagoa Campus.

    The statement said: “This is in line with our administration’s avowed commitment to Sustainable Development. These projects align with the government’s commitment to infrastructure development, security, education, and improved public service delivery. 

    “The commissioning will see the active participation of key government officials, community leaders, and stakeholders in various sectors. The public is therefore encouraged to join in celebrating these significant milestones as the government continues to work towards sustainable development, growth and improved quality of life for all citizens and residents of our cherished Rivers State”.

    A jubilant Federal Capital Territory (FCT) Minister Nyesom Wike flew to his political base Port Harcourt last night a few hours after the Supreme Court restored the control of the River State House of Assembly to his supporters.

    At the Port Harcourt Airport to receive him were scores of his associates.

    The celebration was a continuation of the ‘Worship, Praises and Prayers’ held in Abuja by Wike and his associates moments after the apex court gave Speaker Martin Amaewhule and the other 26 pro-Wike lawmakers the green light to return to the House.

    And the legislators wasted no time in resuming sitting.

    They hailed the apex court for the ruling and hoped that Governor Siminalayi Fubara, who had sidelined them over the months and worked with his own four supporters in the House, would repent from his ‘sins’.

    Wike, Fubara’s estranged godfather and immediate past governor, described the Supreme Court’s verdict as the end of the era of impunity in the state.

    An apparently disappointed Rivers State Government urged calm among the people of the state, saying it was yet to get the full details of the judgment.

    It said it would carefully evaluate the situation and determine the best steps to take in due course.

    The Supreme Court, in a unanimous judgment, restrained the Central Bank of Nigeria (CBN) and the Attorney General of the Federation (AG-F) from further releasing funds to the Rivers State Government until a valid Appropriation Act is passed by a lawfully constituted House of Assembly, with Amaewhule as Speaker.

    A five-member panel of the apex court also ordered that Amaewhule and other 26 members of the State House of Assembly, who were alleged to have defected, should be allowed to resume legislative duties unhindered.

    The Supreme Court also ordered that all members of the Assembly should resume normal legislative businesses without any hindrance to any member.

    Justice Emmanuel Agim, in the lead judgment, agreed with the arguments made by lawyer to the Amaewhule-led members of the Assembly, Dr. Ogwu James Onoja (SAN).

    Justice Agim condemned the conduct of Governor Fubara for choosing to destroy the government of Rivers State and resort to acting unlawfully by pulling down the House of Assembly building owing to his fear that there were moves to impeach him.

    He said: “It must be stated loud and clear that the crisis in Rivers State is as a result of non-adherence to the rule of law as well as the fragrant disregard of court orders.”

    Justice Agim faulted the Court of Appeal for holding that the Federal High Court lacked the jurisdiction to hear the suit, marked: FHC/ABJ/CS/984/2024 which sought to restrain the CBN and AG-F from releasing funds to the Rivers State Government owing to its failure to obtain a valid Appropriation Act in compliance with the January 22, 2024 judgment by Justice James Omotosho in suit number FHC/ABJ/CS/1613/2023.

    He also faulted the consequential order made by the Appeal Court in the December 13 judgment, voiding the October 30, 2024 judgment by Justice Joyce Abdulmalik in suit number FHC/ABJ/CS/984/2024.

    Justice Agim said: “The view of the Court of Appeal that suit number FHC/ABJ/CS/984/2024 is over the consolidated revenue fund of Rivers State is wrong as it is not supported by the reliefs claimed for in the originating summons.

    “This wrong view influenced it to hold that the subject matter of this suit is not within the scope of the justification of the Federal High Court.

    “It is glaring that the objective of suit number FHC/ABJ/CS/984/2024 is to stop the release of funds to the first and second respondents herein – the Government of Rivers State and Simi Fubara – so as to compel them to comply with the judgment in suit number: FHC/ABJ/CS/1613/2023 by causing the passage of the appropriation law by the Rivers State House of Assembly properly constituted as prescribed by the Constitution.

    “Suit number FHC/ABJ/CS/984/2024 is not a fresh action with the subject matter independent of the subject matter of suit number FHC/ABJ/CS/1613/2023. It is sequel to the judgment in suit number FHC/ABJ/CS/1613/2023,” the judge said.

    Justice Agim consequently set aside the December 13 judgment of the Court of Appeal in which the appellate court held that the Federal High Court lacked jurisdiction to hear and determine cases relating to funds belonging to Rivers State.

    He restored the October 30 judgment by Justice Abdulmalik and all the consequential orders made thereto.

    The judge said: “In the light of the foregoing, I hold that the decision of the Court of Appeal that the Federal High Court lacked the jurisdiction to entertain and determine suit number FHC/ABJ/CS/984/2024 is wrong.

    “The trial court validly exercised its jurisdiction to hear and determine suit number FHC/ABJ/CS/984/2024

    “So appeal number SC/CV/1174/2024 is resolved in favour of the appellants. On the whole, this appeal succeeds as it has merit. It is accordingly allowed.

    “The order of the Court of Appeal made on the 13th of December 2024 in appeal number CA/ABJ/CV/1287/2024, striking out suit number FHC/ABJ/CS/984/2024 for lack of jurisdiction is hereby set aside.”

    Justice Agim said there was no merit in the decision of the Rivers State Governor to deploy the doctrine of necessity and the provisions of Sections 102 and 109 of the Constitution to justify his decision to relate with only four members of a 32-member Rivers State House of Assembly.

    He held that having created an environment that made it impossible for the state assembly to lawfully function, Fubara could not rely on the provisions of Sections 102 and 109 and the doctrine of necessity to give validity to the proceedings of the Rivers State House of Assembly constituted by less than 1/3 of the members and his actions, which included presenting the state’s appropriate bill before a four-member Assembly.

    Justice Agim noted that Fubara had started preventing the House from conducting its businesses even before the issue of alleged defection of the pro-Wike legislators occurred.

    He held that having prevented the 27 members from conducting their legislative businesses by pulling down the Assembly complex, Fubara’s claim that the lawmakers were no longer members of the state Assembly, on the ground that they had defected, was incorrect.

    “The claim that the 27 members are no longer members is a perpetuation of his attempt to prevent them from participating in the House business. The 27 members are still valid members of the House of Assembly,” Justice Agima said.

    He added that Fubara’s fear of impeachment was not a justification for his attack on the House of Assembly.

    “What he has done is to destroy the government because of his fear that he wants to be impeached,” he said, expressing concern that this practice was becoming a culture among politicians.

    Justice Agim awarded a cost of N5 million against Fubara and the Government of Rivers State, to be paid to the Rivers State House of Assembly and Amaewhule.

    Other members of the panel – Justices Uwani Abba-Aji (who presided), Ibrahim Saulawa, Chioma Nwosu-Iheme and Jamilu Tukur – agreed with the lead judgment.

    In another judgment yesterday by the same panel, the Supreme Court voided the October 5, 2024 local government election conducted in the state.

    All members of the panel unanimously held that the election was conducted in violation of Section 150 of the Electoral Act 2024.

    Justice Jamilu Tukur, in the lead judgment, agreed with the appellant, the All Progressives Congress (APC), that conditions precedent were not complied with before the Rivers State Independent Electoral Commission held the election.

    Justice Tukur held that there was no evidence that voters’ registration continued until 90 days before the election and that the requisite notices were issued as required by law.

    Amaewhule-led assembly: We believe Fubara will repent of his sins

    Soon after the Supreme Court delivered its judgment yesterday, the Martin Amaewhule-led assembly applauded the apex court for its “well considered judgment”.

    Special Assistant on Media to the Speaker, Martins Wachukwu, said in a statement that the legislators reconvened yesterday during which House Leader, Major Jack, informed members of the judgment, affirming their legitimacy and the green light to resume sitting immediately.

    Speaker Amaewhule described the judgment as victory for democracy and the rule of law, saying that the Supreme Court proved him and other members right when the House asserted that Fubara was “running a criminal government with persons not screened by the House and without an Appropriation Law.

    “We believe that now that the Supreme Court has spoken, Governor Siminialayi Fubara would repent from his legion of sins, and those impostors who are parading themselves as appointees of this government without the constitutional imprimatur of this House would desist forthwith.”

    The Speaker thanked the justices of the Supreme Court, Wike, members of the Assembly and all those who contributed in fighting for the entrenchment of democratic principles and ethos in the state.

    Wike in ‘Time for Worship, Praises and Prayers’

    A jubilant Wike was seen on video which he posted on his X handle Nyesom Ezenwo Wike@GovWike singing and dancing along with his friends and associates.

    He simply wrote: ‘Time for Worship, Praises and Prayers’.

    In his formal reaction to the Supreme Court judgment, Wike described it as the end of impunity in Rivers State.

    He mocked former Vice President Atiku Abubakar and the Chairman of the Peoples Democratic Party (PDP) Governors’ Forum, Bauchi State Governor Bala Mohammed, both of whom he accused of hailing Fubara for ‘lawlessness’ in the state.

    He wondered if they would now hail Fubara in the aftermath of yesterday’s judgment.

    He said Fubara has no choice but to fully comply with the Supreme Court’s verdict, as it represents the final legal authority on the matter.

    His words: “There is nothing like the Amaewhule faction. What the Supreme Court said is that the budget should be presented to the properly constituted Assembly, which is the authentic leadership of the Assembly led by Martin Chike Amaewhule.

    “But first of all, let’s give God the glory, let’s give God the honour, that today, the 28th of February, 2025, God has done it all for the interest of everybody, for the interest of the people of the state.

    “I have always said that the wheel of Justice is sluggish, but it will come when it will come. More than 15 months, 16 months, this matter has been laid to rest by the highest court of the land.

    “The Supreme Court has made it very clear that you cannot have democracy without a legislature. The Supreme Court has made it very clear that you cannot have a government without a legislature.

    “It is unheard of where anybody will say three people will constitute an assembly to make laws for the entire state. It is unheard of.

    “It has nothing to do with any individual, whether you like this person’s face or not. But what is important is that three people cannot make laws for a state, not to even talk about appropriation.

    “If the Federal High Court said you cannot do this, you cannot do it, and therefore set aside everything they’ve done.

    “Three people will screen commissioners, three people will do all kinds of things, a governor will go and bring down the house of legislature and will do as if nothing happened.

    “An arm of government, independent arm of government, and people pretend as if nothing has gone wrong.

    “You are talking about Wike, it’s not about Wike. What we are saying is” can you, for whatever it is, go and demolish the building of another arm of government? No consequences?

    “Then you carry the legislature to your own house, not even carrying the proper legislature, three people to sit inside the Government House? Begin to make laws? Begin to pass appropriation bills? And you are spending money, and you say nothing will happen?

    “You went on appeal, the Court of Appeal said this is wrong, you can’t continue with this. Petitions were written against the justices of the Federal High Court.  

    “For me, it’s happiness for Rivers State and for Nigerians that yes, this impunity must stop.

    “Enough is enough. We can’t continue with this. You are aware, when the issue of local governments came up, a governor elected, who had taken an oath to abide by the constitution, came up to say that is a corrupt judgment, castigating the judiciary.

    “But thank God, today, the court has said it all: go back, you have no budget.

    “Central Bank, accountant general, you cannot continue to lose money when there’s no government.

    “Until you present your budget to the appropriate assembly which is the 27 members, no money should be released.

    “You refused to follow the electoral act in terms of conducting local government elections.

    “What was the issue? If you don’t comply, you will not obey. I’m not saying we are clapping.

    “People like Atiku were hailing him. That yes, you’ve done well. I hope they will also hail him today.

    “I hope the chairman of PDP Governors Forum will also hail him today.

    “We must not truncate our democracy. If you had allowed this, one day, one member would constitute an assembly, and there is nothing you can do. One member.

    “You can imagine three people, one sitting as speaker. So, two people are allowed to vote.

    “We must commend the judiciary for being bold and firm to say no, this should not be allowed; this impunity must not be allowed.

    “I’ve told people that Rivers State is not like any other state. We are not prisoners of war. We will challenge anything we know is illegal. We will not allow it.

    “You can do that in any other state, but as far as River State is concerned, we will not allow it; it doesn’t matter what time it takes us.

    “So, for us, it is just happiness. We’re happy that the right thing has been done.

    “All we have to say, nobody should go into violence. No fighting. Allow the law to take its course. I knew that the law would take its course.”

    The minister later flew to Port Harcourt last night, according to his spokesman, Lere Olayinka.

    Olayinka posted on X a video of the minister being received at the airport by supporters.

    We will act in Rivers best interest, says govt

    In its own reaction to the development yesterday, the Rivers State Government said Governor Fubara would act in the best interest of the state and its people while it awaits full details of the judgment.

    Information and Communications Commissioner Warisenibo Joe Johnson, in a statement in Port Harcourt, said government would carefully evaluate the situation and determine the best steps to take.

    He advised the people to remain calm.

    He said the main issue of alleged defection of Speaker Amaewhule and 26 other members of the State Assembly was still pending at the Federal High Court and was not part of the matter decided yesterday by the Supreme Court.

    He said: “We have taken note of reports in the media regarding the recent judgment of the Supreme Court concerning the funds of Rivers State and the administration of local governments in the state.

    “At this time, we are awaiting a detailed briefing on the implications of the judgment. We will carefully evaluate the situation and determine the next steps to take in the best interest of Rivers State and its people.

    “Though we have not gotten the details of the judgment from our legal team, we enjoin Rivers people to remain calm, law abiding and go about our legitimate businesses as we seek clarity on the judgment.

    “We believe that the determination of the main issue of defection of the 27 lawmakers is a matter not before the Supreme Court as it is pending at the Federal High Court in Port Harcourt.

    “Since the issue of defection wasn’t on the table before the learned Justices, in their eyes, Amaewhule and the 26 others are still operating as lawmakers until that matter of defection comes before them.

    “We assure you that we remain committed to upholding our mandate to protect the best interest and the rule of law in all matters affecting our dear State.”

    PANDEF pleads for reconsideration of ruling on LGs allocation

    The Pan Niger Delta Forum (PANDEF) expressed concern over the aspect of the Supreme Court’s judgment on suspension of revenue allocation to local governments in Rivers State until certain conditions are met by the State Government.

    The group said this decision could cause financial strangulation for the LGs.

    “Withholding funds essential for economic growth, social welfare and infrastructure development would disproportionately impact the people of Rivers State,” PANDEF said in a statement signed by its National Publicity Secretary, Chief Dr. Obiuwevbi Ominimini.

    The group said while it remained committed to  peace, reconciliation, and conflict resolution, the Supreme Court should “reconsider its decision”, stressing that “fairness, equity and national unity must guide judicial and political decisions, particularly those affecting the South-South region, which remains crucial to Nigeria’s economic stability.”

    It claimed further that the ruling “could derail ongoing peace-building efforts, including the Obong Victor Attah-led Peace and Reconciliation Committee, which has made significant progress in fostering stability in Rivers State.

    The forum urged the Federal Government, political actors, and the judiciary to ensure that governance and economic development take precedence over political rivalries.”

    It likened the situation to the withholding of local government funds from Lagos State by the Obasanjo administration and argued that a similar scenario in Rivers State could have even more dire consequences for peace and security in the Niger Delta.

    Why we can’t conduct by-elections in Rivers now — INEC

    The Independent National Electoral Commission (INEC) said yesterday that it would not conduct any by-election into the Rivers State House of Assembly until the cases before the court are finalised.

    Reacting to a statement credited to Governor Fubara in which he accused the commission of  selectively choosing and conducting by-elections into vacant positions, INEC said while it was  aware of the situation in Rivers State, it would  not comment on it because it is sub judice.

    Chief Press Secretary to INEC Chairman, Rotimi Oyekanmi, appealed to people occupying high public offices to be circumspect in their public statements to avoid misleading the general public and casting aspersion on public institutions.

    Oyekanmi said: “Our attention has been drawn to a statement credited to the Governor of Rivers State, Siminalayi Fubara, in which the Commission was accused of selective implementation of elections to fill vacancies arising from the defection of serving members of the National and State Assembly from one political party to another.

    “While no specific instances of the alleged selective action were presented, the statement specifically accused the Commission of deliberate failure to fill the vacancies resulting from the protracted crisis in the Rivers State House of Assembly where two factions are jostling for control.

    “In the midst of the crisis, three or so lawmakers have declared the seats of 27 members vacant and vice versa.

    “While the Commission is aware of the situation in the Rivers State House of Assembly, the matter is pending in court and, therefore, sub judice.

    “For the avoidance of doubt, the Commission has been joined in several suits filed by litigants at various courts, including the Supreme Court.

    “Under the circumstances, the Commission must await the final judicial pronouncement on the matter before it embarks on a puerile exercise that may eventually amount to a nullity and a waste of public funds.

    “We urge people occupying high public offices to be circumspect in their public statements before they mislead the public and cast aspersion on public institutions, particularly where they are aware of the pendancy of cases in court.”

    Rivers State Governor, Sir Siminalayi Fubara, has approved the release of the Rivers State University (RSU) Campus in Kira, Tai Local Government Area, to the Federal Government for the commencement of the newly established Federal University of Environment and Technology (FUET).

    The institution was formally established after President Bola Ahmed Tinubu signed the bill into law on February 3, 2025.

    During an inspection of the Kira campus on Thursday, Fubara, accompanied by RSU Vice-Chancellor Prof. Nlerum Okogbule, revealed that the National Security Adviser had requested the state government to provide the facility to facilitate FUET’s take-off.

    The governor said: “We are here to assess the place, as it is the government property belonging to the Rivers State University. And we are here for the University to update us with the status of the property. 

    “They have already given us a written information, but I felt that it is proper for us to come and do physical assessment and that is what we just did. From what we have seen , it is a well planned out place and I strongly believe that it is suitable for the take-off of this University.”

    Fubara clarified that the Kira campus belongs to the Rivers State University and that only the Rivers State Government possessed the right through the university to release it.

    He assured President Tinubu, who he said approved the federal university out of his goodwill, and the National Security Adviser, that the facility would be released for FUET to take-off.

    Highlighting the importance of the university, Fubara said: “We are doing this because at the end of the day what the University is going to do for us here is three major things. It will bring development, it will bring increased educational attainment of the Ogoni people especially on this issue of environmental impacts. 

    “You know we have a lot of problems along this region on issues of environment. This university is, therefore, going to provide study platform. Finally, it is a honour that it is in our own time that this noble initiative is established. So we are thanking all the parties who initiated it and made it to come to pass. 

    “We are also grateful to the university for still keeping this place because you can see from our assessment that most of the facilities were just recently renovated. They wanted to use it but as it stands now since I have the final power, we will build another one for the RSU, but this campus should be released for the new Federal University”.

    Rivers crisis paved way for my freedom, says Fubara

    Governor  Siminalayi Fubara says he enjoys ‘’freedom’’ in governing Rivers State because  God allowed the political crisis in the state to happen.

    Recalling the efforts of Primate of the Anglican Communion Church of Nigeria  Henry Ndukauba to end the crisis, Fubara said: ‘’God has a way of doing his things. Maybe if we had  got   peace, I wouldn’t be enjoying the freedom that I am enjoying today.’’ 

    He spoke on Tuesday night when Ndukauba led bishops of the Anglican Communion to pay him a visit in Government House, Port Harcourt.

    But hours after the governor’s comment, the Martins Amaewhule-led 27-member House of Assembly reconvened and restated that all Fubara’s appointments were contemptuous of courts’ judgments and extant laws of the state.

    It went a step further to direct the Clerk of the House, Emeka Amadi,  to disclaim the appointees through a publication.

    While addressing the Primate, Fubara said: “I start first in a very unusual way to say thank you. This appreciation would have come much earlier.  Many of you here may not understand why I am thanking him.

    “When the crisis started, as a man of God who believes that the two main parties(Fubara and his immediate predecessor, Nyesom Wike)  are people from his communion, he made several phone calls and booked several appointments but none of them was granted to him.

      ‘’I want to thank him for what he did even though it didn’t yield the required result, but you see God has a way of doing his things.

    “Maybe if we had got peace then, I wouldn’t be enjoying the freedom that I am enjoying today.

    ‘’So at times, God will be saying let the trouble be there so that there will be peace. But that is not to say that we encourage trouble.

    ‘’ Peace remains the best thing, both internally and externally because it  attracts development.”

    The governor expressed happiness that the Diocese was holding its  Standing Committee Meeting in Rivers State at a time when his government needed prayers to keep functioning.

    He said Bond of Peace which is the theme of the meeting, was apt as daily events and occurrences indicated that peace was urgently needed in the country.

    Fubara said God was directing the activities of his government and that he would not take the glory and power.

    His words “  I thank the church for standing with us. Your prayers are greater than the noise-making or the protest that we are engaging in. 

    “ You all are seeing the kind of governance we are providing. It is the governance of peace and freedom for people to operate. Ours is a government that listens and admits at any point we are at fault and makes amends.  

     ‘’We are  not  seeking for attention.’’ 

      Primate Ndukauba explained to the governor that they appreciated his achievements in the state.

     He said:  “Despite the challenges that you are facing, we thank God that you have kept focus and you are executing the things that you needed to do as the executive governor of this state.

    “ God has the power to raise and to remove, but it has pleased Him that you are there today.

    “Though the situation may be challenging, we have seen the enormous work that you are doing and we thank God for you. We  will continue to pray for you.”
