    BREAKING: Appeal Court okays judgment nullifying passage of Rivers 2024 budget

    The Court of Appeal in Abuja has affirmed the January 22 judgment by Justice James Omotosho of the Federal High Court in Abuja nullifying the passage of Rivers State’s N800 billion 2024 budget by four members of the House of Assembly.

    In a judgment on Thursday, a three-member panel of the appellate court, led by Justice Joseph Oyewole, held that the appeal filed by the River State Governor against the January 22 judgment was unmeritorious.

    Justice Oyewole, who authored and read the lead judgment, held that, having failed to challenge the case at the trial court, by withdrawing all the processes (documents) he filed against the suit, cannot turn around to now seek to appeal the judgment.

    He held that by withdrawing all his processes earlier filed against the suit at the trial court, he conceded to all the allegations made against him and all the facts as stated by the plaintiffs.

    Justice Omotosho had, in the January 22 judgment,  described the passage of the Rivers State’s 2024 Appropriation Bill by the five lawmakers,  led by Ehie Edison, as an aberration and illegality.

    He consequently ordered Governor Fubara to represent the budget to the  Martins  Amaewhule-led Assembly.

    Fubara’s donation of 10 vans has nothing to do with Rivers LG poll, says NSCDC

    The Nigeria Security and Civil Defence Corps (NSCDC), Rivers State command, has debunked viral claims that the 10 Hilux vans donated to the corps by the Rivers State Governor, Siminialayi Fubara, were in connection with the just concluded controversial local government elections in the state.

    NSCDC made the clarifications following a trending video and narrative that Fubara presented the vehicles to NSCDC to enable the corps provide security for the poll after the police relied on a federal High Court’s judgement to boycott the election.

    In the video personnel of the NSCDC were seen in jubilation when the Hilux vans were driven into their command’s office in Port Harcourt. 

    But the corps on Thursday condemned the misleading narratives that accompanied the video saying they were far from the truth.

    Speaking on behalf of the State Commandant, Joachin Okafor,  in Port Harcourt; the command’s Spokesman, Superintendent Olufemi Ayodele, explained that the new commandant upon assumption of office adhered to the tradition and visited Fubara.

    Ayodele said Okafor reeled out his achievements within the seven days he arrived the state adding that moved by the tenacity and doggedness displayed by the commandant in the war against crude oil theft, the governor donated the 10 Hilux vans.

    He said the vans were designed to enhance the operational efficiency of the NSCDC Rivers State Command and that the event took place before the conduct of the local government elections. 

    Ayodele recalled that the governor had donated 100 vehicles to some security agencies in the state before gifting the vans to the NSCDC.

    But he said: “However, the command got flabbergasted by various unfounded and denigrating reports currently circulating on the social media arrogating the donation of operational vehicles as gratification and compensation for participating in the just concluded local government elections. 

    “To set the record straight, as seen in the video circulating on the internet, the operatives of the Rivers State Command were overwhelmed with great excitement and jubilation as the command is of course fortunate to have a commandant whose assumption of office brought a long awaited transformation, progress and remarkable achievements within a period less than one month.

    “The Rivers State Command is here by stating unequivocally that the vehicles were not donated for elections neither were they compensations for participating in the local government elections but to enhance the command’s land operational patrol like every other security agencies.

    “Our role in the last local government election centered on routine patrol and the protection of critical national assets and infrastructure across the state based on the Intelligence report at our disposal even before the election was conducted.

     “These infrastructure and amenities were provided as succour to the good people of Rivers State and should not be vandalized by hoodlums because of its negative effects on the economy of the nation and the state as well.

    “We therefore urge the media from various quarters to desist from biased, unfounded and libelous statements targeted against the integrity of the Rivers State Commandant and by extension the NSCDC but rather imbibe the acceptable professional ethical standards and guiding rules of international media best practices in their social media publications and news reportage”.

    “The NSCDC remains neutral, apolitical and nonpartisan in matters of elections but sincerely committed to actualizing its core mandate by combating vandalism of public utilities and swift response to rescue victims during emergency. 

    “The newly deployed Rivers State Commandant is an outstanding achiever, a crime fighter, a trail blazer and a Security Service Commander of repute who is fully committed to the safety and security of the good people Rivers State, projection of the Corps’ positive image and effective delivery of the NSCDC statutory mandat.

    “In furtherance, our collaborations with sisters security agencies  in ensuring adequate  protection of the lives and property of the good people of Rivers State remains firm.”

    You are cause of anarchy in Rivers, Wike replies Fubara

    Following the political crisis in Rivers State, Minister of the Federal Capital Territory (FCT), Nyesom Wike on Tuesday night asked Governor Siminalayi Fubara to “obey the rule of law”.

    This, Wike said, is the only thing that can bring peace to Rivers State.

    Wike stated this while speaking in an interview on Channels Television’s ‘Politics Today’, monitored by The Nation..

    He insisted neither he nor the Federal Government led by President Bola Tinubu is fighting Governor Fubara.

    He said: “The moment you (Fubara) don’t obey a court judgement, you are inviting anarchy, you are inviting violence. Allow the rule of law to prevail. It is the only thing that can bring peace. It is up to Fubara. Fubara accused the Judiciary of a fraudulent judgment. Fubara did not follow due process by law. When you do not have good lawyers doing your work you blame the judges.

    “No person who believes in the peace and stability of any nation would say that you want to support violence or destruction. What is important is that when there is violence and instability, it is for you to ask questions about what led to the violence and instability and destruction. The only thing that can bring peace in Rivers State is for the Governor to obey the Rule of law.

    “I was a Governor and I have always obeyed the rule of law. You had the Governor say our state is turning to a state of anarchy where people do not obey the rule of law. What is obeying the rule of law? You must respect and obey court judgments. You must not take the law into your hands. It does matter how you take the judgment. The moment you do not obey court judgments you are inviting anarchy; you are inviting violence. A governor came out on national television to tell the world that he will not obey court judgment, what does that mean?”.

    On July 19, a Federal High Court in Abuja issued a restraining order preventing the Nigeria Police Force (NPF) and other security agencies from providing security during the Rivers State local government elections.

    On September 30, the Federal High Court, Abuja, delivered a judgment that again prohibited the police and other security agencies from participating in the Local Government Election.

    Despite the rulings, Governor Fubara insisted that the election will be held though police authorities in the State did not participate in the exercise.

    Wike also accused his Fubara of sponsoring the Action Peoples Party (APP) in the just-concluded local government election in the oil-rich state.

    The APP won 22 of the 23 chairmanship positions in the election. The chairman of the Peoples Democratic Party (PDP) Governors’ Forum Bala Mohammed of Bauchi State also attended swearing in of the elected chairmen..

    In the lead-up to the poll, Fubara who is a member of the PDP, said he is the “greatest loser” since his party was not on the ballot.

    But Wike claimed Fubara sponsored the APP for the election.

    “Today, people say ‘Discipline Wike, he did anti-party’. I did not do anti-party; I said we must stand for equity, fairness, and justice’,” he said.

    He also stood his ground over his support for President Bola Tinubu of the All Progressives Congress (APC) in the 2023 election.

    Wike said: “Today, what happened? The Governor (Fubara) is the one who sponsored the APP. The chairman of the (PDP) governors’ forum was the one who attended the swearing-in”.

    Wike was Rivers Governor under the PDP from 2015 to 2023.

    He contested the party’s presidential primary but lost to former Vice President Atiku Abubakar.

    He accused the party of injustice, insisting that the PDP should zone its presidential ticket to the south and not leave it open for people like Atiku to contest.

    Efforts to reconcile Atiku and Wike failed.

    That led him to work for Tinubu of the APC, resulting in the PDP’s loss in the presidential election in Rivers State. The president thereafter appointed him as a Minister.

    Although they have been clamouring for Wike’s suspension from the PDP, the Minister insisted that he did not violate the party’s laws and does not regret backing the APC.

    “I have no regret at all,” Wike said when asked about his support for Tinubu in the 2023 presidential election.

    Fubara sets up panel to probe killings, destruction of LG secretariats

    Rivers Governor Siminalayi Fubara has inaugurated a seven-man Judicial Commission of Inquiry to investigate the arson, killings, and destruction of property at various local government councils’ secretariats in the State.

    Fubara inaugurated the commission at the Executive Chambers of Government House in Port Harcourt on Tuesday.

    The commission, which was given one month to conclude its assignment, has Justice Ibiwengi Roseline Minakiri as Chairman; Mrs. Inyingi Brown as the Secretary; and Uzor Ikenga as the Counsel.

    Other members are Felicia Nwoke; Prof. Blessing Didia; Sir Samuel Egbe and Venerable Alex Usifor.

    The Governor said the recent attacks and burning of councils’ secretariats seemed like a repeat of what was experienced in 2014, months to the general elections of 2015 when courts were set ablaze, residences bombed and people killed, leading to the closure of courts in Rivers State.

    Fubara said his administration would not look away while ill-guided youths and sponsored political thugs turn the State into a theatre of violence without being made to pay for such crimes against the state.

    He said: “So, I have decided to take this action to find out the immediate and remote causes of this arson, most importantly, no matter the personalities involved, we must bring them to book.

    “So, this assignment is very important. It is an assignment that, if it is not done rightly, would give the enemies of this State opportunity to continue.

    “And if we are right, it is going to be the end of further destruction of public property in the State. I know it is going to be very tasking. I can assure you that there will be threats, but you have to be strong”.

    Fubara said.that it was long overdue to inaugurate the commission of inquiry owing to incidences that had been witnessed since his administration came on board.

    He explained that sometime in the past, about October, 2023, a similar incidence was experienced, and because he had thought that everybody was of the same political family, he decided to let go.

    He added that the persistence of the violence and differences between people who once had worked together had seemingly destroyed chances of settling any misgivings internally.

    Fubara said: “It has become very clear that rather than getting close to the path of peace, this State is gradually turning into a kingdom where law and order is no longer the order of the day. And we cannot fold our hands and allow such thing to happen.

    “On the 5th of October, 2024, about four days ago, we had an election in this State. Before the election, we also heard from a lot of quarters, songs of war, (and) threats but we never took them seriously because we believed that a local government election is a prerogative of the State Government. It has nothing to do with anybody anywhere that is outside the confinement of our State.

    “And for that reason, we believed strongly that whatever it is, we could manage it to produce the purpose of that election.

    “But, it is very unfortunate that after the election, even while the election was going on, several things happened, which we managed, thinking it was going to end there.

    “The day after the election, there were also more threats from people, and we also thought it was just a normal threat, believing that it was not going to be out of hand but it did.”

    Fubara told members of the commission that God had not made any mistake to find them suitable for the assignment given to them.

    He urged them to work with the mind of actualising the purpose of the assignment, and noted that history will not forget this responsibility given to them.

    Fubara outlined the terms of reference of the assignment given, saying that they must “determine the underlying causes of the violence and identify the individuals or groups responsible for the attacks on some local government council headquarters and the harm caused to citizens.

    “Evaluate the extent of damage to property, infrastructure, and human lives and estimate the financial losses incurred.

    “Examine whether the violence was politically motivated, and if so, identify the key players and their roles in instigating the violence.

    “Assess the effectiveness of the security agencies’ response to the violence and identify areas for improvement.

    “Investigate the actions of individuals and groups involved in the violence in the face of the relevant laws, including the Violence Against Persons (Prohibition) Act, 2015, etc.

    “Advise on adequate compensation and support for victims and their families, as well as measures to prevent future occurrences.

    “Make recommendations on long-term strategies to prevent similar incidents in the future, including recommendations for policy reforms, community engagement, and conflict resolution mechanisms.

    “Recommend appropriate sanctions for individuals and groups found culpable.

    “Make other relevant recommendations in light of its findings which the commission may consider appropriate,” and also mandated the commission to submit its report within “one month”.

    Rivers crisis: Fubara vows to go after arsonists 

    Rivers state governor, Siminalayi Fubara, has vowed that his administration will not sit aloof and watch sponsored political thugs run berserk, committing arson in the atate.

    The governor assured that working with the Nigerian Police Force and the Directorate of State Services (DSS), he would take measures to umask persons behind the recent burning of council Secretariats at Ikwerre, Emohua and Eleme local government areas.

    Fubara gave the assurance while inaugurating four new commissioners at the Government House in Port Harcourt on Tuesday.

    Those sworn-in are Dr. Israel Lebura Ngbuelu, Evans Bapakaye Bipi; Otamiri John Ngubo and Benibo Anabraba.

    Fubara recalled that during the inauguration of the newly elected local government council chairmen on October 6, 2024, he had alerted security agencies about intelligence reports of a planned disruption by certain individuals who threatened to prevent the elected officials from assuming office.

    Fubara said the sponsored political thugs hatched their plans and burnt buildings at some council secretariats.

    He said: “I said it before it happened. I knew because they were unhappy, they would go extra miles to create disaffection in the minds and hearts of the good people of Rivers State.

    “We want to also let the people know that what has happened (arson) after the election, we are not going to allow it to go uninvestigated. 

    “A similar event had happened in this manner before, and after some weeks, some of our supporters were declared wanted in order to turn the story around. 

    “But this time around, I strongly believe, with the support and cooperation of the Nigerian Police and the Directorate of State Services (DSS), we will unravel those behind the assault and make sure that they account for their atrocities.”

    Fubara commended Rivers people for their patience and calmness by majority despite their anger with the reckless acts of the misguided miscreants.

    The governor said he had continued to show leadership, provided the climate that had engendered productive endeavours, and would not mislead the people.

    He said: “As your leader, the one steering the ship, I assure you I will not mislead anyone of you. I still stand on the path of peace. We have cases of arson in some local government areas. 

    “But, I appreciate your calmness. I have always maintained that we are going to be the greatest losers, if we meet them force-for-force. We need to go with peace. 

    “So, I will encourage everyone of you not to follow them with violence. We are carrying a basket of precious eggs in our hands. So, we need to follow them with carefulness and wisdom.”

    Fubara reiterated that the sustained progress of Nigeria mattered most to Rivers insisting that if oil theft was not checked, the country’s economy would be badly impacted, and there would not be funds to address critical issues.

    He said: “We are in a situation where the fund that is being generated from oil production is not sufficient to tackle the challenges of Nigeria, and every hand has to be on deck to make sure that there is increase in production.

    “Our focus here, not minding the distractions, will be how to provide support. You have to work with us to make sure that we curb this issue of oil theft and pipeline vandalisation.

    “This is the only way that the allowances (revenue) will increase and more will also come to our State, and more progress will also be achieved in this State.”

    Fubara explained that his administration was doing a lot for the good people of the state, but were not visible enough  because of the political drama in the state.

    He, however, said that his administration was working out modalities, and would  soon choose a day, which could probably be before the end of October, 2024, to showcase a few projects and services that had positively impacted lives in the state.

    Fubara congratulated the newly sworn-in commissioners for making it into the Rivers State Executive Council. 

    He explained that more persons whose loyalty were for Rivers people and the administration needed to be admitted into the Rivers State Executive Council to help drive the policy of government.

     Fubara said: “We want to be sure, at this point, who we are adding into the Council, so that we will not wake up one morning and see resignation letter. So, we are taking our time.

    “And usually, after a normal political period, there used to be what we call balancing. So, I can also say that the new commissioners that are coming in are coming from their zones to also balance the political equation.”

    Fubara charged them to be dedicated, forthright, diligent and productive while rendering quality services to the State.

    The governor said he believed in their capacity to deliver because of their exposure to the workings of government, and expressed the hope that they would contribute positively to the success of the administration.

    He said: “So, let me thank everyone of you. Let me also use this opportunuty to thank the good people of Rivers State for their support, and to assure them that we will continue to defend, protect the interest of Rivers people.

    “I want to thank everyone of you for you support, more especially before, during and after the elections. I appreciate your doggedness, your belief in our course to salvage this State, to protect the integrity of this state.”

    Despite the controversy surrounding the  Local Government poll in Rivers State, Governor Siminalayi Fubara inaugurated the 23 elected chairmen and their deputies yesterday.

    Fubara boldly declared that with the conclusion of the exercise, his administration had salvaged the state’s local government system.

    He also announced that a new Rivers State had been birthed based on the ‘success’ of the exercise.

    The inauguration  took place at the  Executive Council Chamber of the Government House in Port Harcourt. This was after the state Independent Electoral Commission (RSIEC), Chairman Adolphus Enebeli,   issued the winners of the election certificates of return.  

    Enebeli had before the ceremony also announced Uzodinma Nwafor of the   Action Alliance (AA) as the winner of the exercise in  Etche Local Government Council.

    The collation of results from the council was initially stood down on Saturday but was eventually completed early yesterday.

    A hitherto unknown party in the state, the Action Peoples Party (APP), swept 22 of the 23 chairmanship seats in the state, leaving even Fubara’s Peoples Democratic Party(PDP)  and main opposition All Progressives Congress(APC) without any.

    The APP also cleared 314 councillorship positions in the 319 wards in the state. APC won a ward; Social Democratic Party(SDP), one; Boot Party, one; Labour Party(LP), one; and Young Progress Party(YPP), one.

    Results of similar elections in Akwa Ibom and Benue states showed candidates of the ruling parties—PDP and APC—respectively coasting to victory.

    In Akwa Ibom, the PDP won in all the councils except Essien Udim where victory went to the APC. Senate President Godswill Akpabio hails from Essien Udim LGA.

    All the chairmen-elect and their deputies will be sworn in today by   Governor Umo Eno.

    Results of the poll in Benue showed  APC producing all the chairmen of the 23 councils. The party also won  276 councillorship positions in the state.

    Inaugurating the winners of the poll in Port Harcourt, Governor Fubara argued that the local government system in the state was at the precipice of doom because some distractive political forces wanted to keep their grip on it.

    The governor said he acted alongside the people by conducting the election to salvage the system.

    He said henceforth, democracy would not only thrive but the people would witness the delivery of democratic dividends.

    Fubara added that the pressure to destroy the system became intense three days before election day when an attempt was made to invade the headquarters of RSIEC.

    His words: “But the truth remains, desperate situations require desperate measures. We were confronted with a situation where the local government of this State was heading to doom.

    “And the truth about it is, because of the genuine love that we have for this State, we must salvage the local government election.

    “And what we did, with the support of Rivers people, was to salvage the local government council. And to the glory of God, that has been done and dusted.”

    Fubara said with the elections over, his administration would not deploy any form of undemocratic ways to confront or fight anybody.

    He said: “We will assure the Federal Government that we are not going to be a party to anything leading to breakdown of law and order in this state.

    “This is because we know quite alright that if there is a breakdown of law and order in this state, Nigeria will suffer, and we are not going to be a party to it. That is the reason why our standard, in terms of maturity, was high.”

    Fubara charged the newly sworn-in chairmen to ensure that they remained connected with the people in their council areas.

    He urged them to emulate his approach to peace so that they could be more patient with people and the situation without being violent.

    He said:  “For the newly sworn-in Chairmen, I want you to see yourselves as servants. Once you see yourself as emperor, that is where the problem begins. Once you see yourself as the one who knows it all because of the power of the fund available to you, that is where you will start seeing crisis.

    “But see this opportunity as a call to service. It is an opportunity for you to bring people together and to deliver to the people of Rivers State. We need development in the 23 local government areas.

    “Represent them well. Work for the betterment of your local government. Ensure that you are a servant leader. Open your doors, embrace everyone, and I assure you, that nothing is bigger and greater than that.

    “That is the structure. When you work for the people, when you bring them in, when you help them, there is nothing bigger than that. So, that will be the ingredient of this administration.”

    Fubara said he was aware that his detractors were mobilising 20 people per political unit to attack the new council chiefs when they report at their various council secretariats to resume duties.

    The governor, however, advised the chairmen not to confront the situation, should it happen or fight anybody.

    He said:  “Please if they are coming with violence, avoid them. The peace of this State is too important to us. It is public knowledge, everybody knows what they are planning. But please, I want to beg every one of you, to follow my approach. At the right time, you will always win, if you are patient and calculative.”

    Fubara warned them against greed and the urge to amass wealth indiscreetly, adding that their tendency to get everything would make them lose everything.

    He added: “You must ensure that this opportunity God has given you at this critical time is protected. Don’t fail Him. Don’t fail these elders that have come here to witness this ceremony.

    “We want this to be a landmark. This is the beginning of a new Rivers State, and I am going to make sure that I supervise it with all that I have.

    “I will follow up with whatever is happening in the 23 local governments with everything because I believe this is not a time for me to make any mistake.

     “You must live above board. But I know with what you have done your past responsibilities, and a few of you that I know personally, you are not going to disappoint us.’’

    While expressing gratitude to God,   Fubara appreciated President Bola Tinubu for his democratic approach. 

    He said: “On behalf of the good people of Rivers State, I want to thank him (President Tinubu).

    “I am so glad that the Chairman of the Governor’s Forum of PDP, and Governor of Bauchi State, Senator Bala Mohammed,  are here with us to witness the ceremony. I want to assure you that I remain a member of the PDP.”

    In Eket,  Governor  Eno of Akwa Ibom State told worshippers at All Nations Christian Ministry International, that the chairmen-elect and their deputies would be inaugurated today for rapid development.

    He said: “Election was concluded yesterday(Saturday).   We are swearing in new chairmen tomorrow(today) by 8 am. We want to thank those that have served. They have done well.

    “The window we negotiated with the Federal Government was till October, and this is October. So we need to quickly swear in those Chairmen so that they will start receiving their allocation and work for their people.”

    The  APC, however, rejected the election in the state,  alleging that it was characterised by massive rigging, violence, and snatching of materials by agents of the ruling PDP.

    The opposition party said in a statement by its spokesman    Udo that AKISIEC compromised the integrity and credibility of the election in favour of the PDP.

    The statement partly reads:‘’What we also saw and experienced yesterday(Saturday) was a manifestation of such influence beginning with acute shortages of election materials which disenfranchised quite a number of accredited voters and actions of financial inducements on voters by the ruling   PDP in the state. 

    “AKISIEC just like any other SIEC in Nigeria is controlled and managed by the State Government. To that extent, there is a perceived and real influence of the electoral umpire by the State Government.

    “And to that extent, the obvious result would be tilted in favour of the ruling party in the state.’’

    The party, however,  appealed to its supporters to remain calm because there is hope.

    Eno’s counterpart in Benue State  Hyacinth Alia and Labour Party(LP) Chairman in the state Ibrahim Idoko lauded the peaceful conduct of the poll and its outcomes.

    But a Peoples Democratic Party(PDP) Senator from the state  Abba Moro described the election on Saturday as a rape of democracy.

      Alia, in a statement by his  Chief Press Secretary (CPS)  Tersoo Kula,   commended the Benue people for their peaceful conduct and support for all the APC  candidates.

    The governor described the outcome of the poll as a reflection of the maturity of the people to engage in a democratic process with respect and dignity.

     He said: “The successful conduct of these elections, free from violence, is a testament to our collective resolve to uphold the values of peace and unity that are fundamental to our progress as a state.

    “I am proud to see our citizens trooping out to make their voices heard, demonstrating that we can engage in the democratic process with respect and dignity.” 

     Alia congratulated the winners and urged those who lost to join hands with his administration to move the state forward. 

    However, Moro, who is the Senate minority leader,  said reports from polling units across his senatorial district indicated that the election did not hold.

    He claimed that election materials and officials of BSIEC were not seen anywhere in the area.

    Moro added that he was disappointed in Governor  Alia for not standing by the truth and due process as promised during his electioneering.

    He said: “I expected the governor, as a priest, to push for a paradigm shift by doing what is right and not referencing and copying what was wrongly done in the past.

    “Democracy is fiercely fought for, with some people paying the supreme price. Anti-democratic forces will not be allowed to destroy the system.” 

    He enjoined PDP  members to remain calm, as everything legally possible would be done to challenge the election in court.

    Former Vice President  Atiku Abubakar said yesterday that   Governor Fubara’s determination ensured the successful conduct of the election. 

     In a statement on his X (formerly Twitter) handle, the former PDP presidential candidate for the 2023 general election, said the outcome of the Rivers poll was a victory over retrogressive forces.

    “With the conclusion of the local government election in Rivers State, the shadows of political intimidation and judicial chicanery have dissipated, paving the way for the noble pursuit of governance to commence in the State,” Atiku wrote on X. 

    He lauded the governor and people of Rivers State for upholding the democratic process during the election.  

    The former Vice-President noted the resilience of the people in resisting political oppression and hailed their determination to safeguard the sanctity of the election.

    Atiku congratulated newly elected local government leaders, urging them to prioritise the welfare of the people and avoid the pitfalls of tyranny and over-ambition.

    “In the grand tapestry of this election, it is ultimately the people who emerge victorious, their sacred right to choose their leaders firmly upheld within the framework of our democratic process,” he stated.

    Rivers state governor, Siminalayi Fubara, has said that with the local government councilelection over, a new Rivers has started.

    The governor said he acted alongside the people to salvage local government administration in the state.

    Fubara spoke after inaugurating the 23 chairmen that emerged from the just-concluded Rivers state local government election, at the Executive Chambers of Government House in Port Harcourt on Sunday.

    He said henceforth, democracy would not only thrive but the people would witness delivery of democratic dividends to satisfy their aspirations.

    Fubara acknowledged that the local government  was at the precipice of doom because of the activities of some distractive political forces that  wanted a grip on it.

    He said that the pressure to destroy the local government system in Rivers State became intense three days before election day when an attempt was made to invade the Headquarters of the Rivers State Independent Electoral Commission (RSIEC).

    The governor said: “But the truth remains, desperate situations require desperate measures. We were confronted with a situation where the local government of this State was heading to doom. 

    “And the truth about it is, because of the genuine love that we have for this State, we must salvage the local government election. 

    “And what we did, with the support of Rivers people, was to salvage the local government council. And to the glory of God, that has been done and dusted.”

    Fubara said with the elections over, his administration would not deploy any form of undemocratic ways to confront or fight anybody.

    He said: “We will assure the Federal Government that we are going to be party to anything leading to breakdown of law and order in this State.

    “This is because we know quite alright that if there is breakdown of law and order in this state, Nigeria will suffer, and we are not going to be party to it. That is the reason why our standard, in terms of maturity, was high.”

    Fubara charged the newly sworn-in chairmen to ensure that they remained connected with the people in their council areas.

    He urged them to emulate his approach to peace so that they could be more patient with people and the situation without being violent.

    He said: “For the newly sworn-in Chairmen, I want you to see yourselves as servants. Once you see yourself as emperor, that is where the problem begins. Once you see yourself as the one who knows it all because of the power of the fund available to you, that is where you will start seeing crisis. 

    “But see this opportunity as a call to service. It is an opportunity for you to bring people together and to deliver to the people of Rivers State. We need development in the 23 local government areas.” 

    Fubara added: “Represent them well. Work for the betterment of your local government. Ensure that you are a servant leader. Open your doors, embrace everyone, and I assure you, that nothing is bigger and greater than that. 

    “That is the structure. When you work for the people, when you bring them in, when you help them, there is nothing bigger than that. So, that will be the ingredient of this administration.”

    Fubara said he was aware that his detractors were mobilising 20 people per political unit to attack them when they report to their various council secretariats to resume duties.

    The governor, however, advised the chairmen not to confront the situation, should it happen or fight anybody.

    He said: “Please, if they are coming with violence, avoid them. The peace of this State is too important to us. It is public knowledge, everybody knows what they are planning. But please, I want to beg everyone of you, follow my approach. At the right time, you will always win, if you are patient and calculative.”

    Fubara warned them against greed and the urge to amass wealth indiscreetly adding that their tendency to get everything would make them lose everything. 

    He added: “You must ensure that this opportunity God has given you at this critical time is protected. Don’t fail Him. Don’t fail these elders that have come here to witness this ceremony. 

    “We want this to be a landmark. This is the beginning of a new Rivers State, and I am going to make sure that I supervise it with all that I have. 

    “I will follow up with whatever is happening in the 23 local governments with everything because I believe this is not a time for me to make any mistake.

     “You must live above board. But I know with what you have done, your past responsibilities, and a few of you that I know personally, you are not going to disappoint us.

    “We are doing this today for the world, and for Nigerians to know that the issue of local government election, swearing in, and resumption of office in Rivers State is over. 

    “So, maybe from tomorrow, the story may be different, not anymore: it can’t happen or it will be stopped. What we are talking about now is a different story.”

    While expressing gratitude to God who had remained as an abiding strength, courage and sustainer,  Fubara appreciated President Bola Tinubu for his democratic approach while giving the government support. 

    He sais: “So, on behalf of the good people of Rivers State, I want to thank him (President Tinubu).

    “I am so glad that the Chairman of the Governor’s Forum of PDP, and Governor of Bauchi State, Senator Bala Mohammed, is here with us to witness the ceremony. I want to assure you that I still remain a member of PDP.”

    The Rivers State Governor, Siminialayi Fubara, will swear-in chairmen of local government areas elected on Saturday’s controversial poll.

    A government special announcement signed by the Secretary to the State Government, Dr. Tammy Danagogo, said the governor would inaugurate the chairmen at 4pm today, Sunday October 6.

    “The newly elected chairmen, along with one guest each, are expected to be seated by 3:30pm”, the statement said.

    According to the announcement by the Rivers State Independent Electoral Commission (RISIEC), 22 out of the 23 council chairmen were elected on the platform of the Actions Peoples Party (APP), an alternative political party of Fubara’s camp.

    RISIEC said the Etche Local council’s results were being awaited and would be announced alongside councilorship results.

    The problem in Rivers State is not whether former governor Nyesom Wike or Governor Siminalayi Fubara is right or wrong, particularly as shown by the controversial local government poll. The problem is not even Mr Wike’s obtruding personality and his sometimes flawed arguments and abrasive remarks. The real problem is the infantilism of Mr Fubara. The former governor imposes himself needlessly on his subordinates and mentees, including, sadly, the governor. But the governor is tragically a dictator of the meanest variety without the competence of a dictator of modest capacity.

    The Electoral Act spells out how the LG poll should be conducted, a fact rightly reinforced by the Federal High Court in Abuja. But having been wrong-footed, Mr Fubara has reframed the narrative away from what the constitution provides to what his fight with the former governor entails, a polarisation that unnecessarily veers into utter and disreputable leadership failing. The governor abuses the Inspector General of Police, curses his opponents, threatens everyone and any institution except perhaps the president, at least publicly, and just because he is governor, blithely pronounces every property, including the parliament and judiciary buildings as well as legislative and judicial quarters, in Rivers as his own. This is not sophistry; it is ignorance par excellence.

    It is unlikely the Rivers LG poll will stand, regardless of the constitutional alibi Mr Fubara pounces on consequent upon the Supreme Court decision on LG autonomy. The law is the law, and it must be followed to the letter, especially in the absence of ambiguities. Yet, Mr Fubara is the product of Mr Wike’s incompetent leadership recruitment process. The former governor birthed a Frankenstein out of his disparate thoughts; it is his duty, assuming he can control his hubris, to manage the catastrophe he helped unleash on the state.

    Preparation for today’s Rivers State local government election almost degenerated into chaos yesterday after an angry Governor Siminialayi Fubara stormed the premises of the State Independent Electoral Commission (RISIEC) in Port Harcourt at 1am, alleging plot by the police to scuttle the poll.

    He lashed out at the police authority, labeled the plot nonsense and said the state had had enough of it.

    His supporters had their turn later. They turned back a detachment of policemen drafted to the premises.

    The police, citing a court order stopping the poll, said they would not be available to provide security during the election.

    The national leadership of the Action Peoples Party (APP) on whose platform Fubara’s candidates are contesting the election, expressed support for the election and disowned a factional group in the state.

    The local chapter of the party had disowned the Fubara men, saying they are not members of the APP.

    The local chapter of the Peoples Democratic Party (PDP), which is loyal to Federal Capital Territory Minister Nyesom Wike, is not contesting the election while the party’s national leadership threw its weight behind the governor, saying the election must proceed as scheduled.

    Fubara, who was accompanied by some government officials and security aides during his midnight visit to RISIEC, took an umbrage at the Police Inspector General Kayode Egbetokun for allegedly taking sides in the face-off between him (Fubara) and Wike.

    He said: “We came here this morning when we heard that, according to what they called themselves, the Nigerian Police, were coming to take over the premises of the Rivers State Independent Electoral Commission, and I had to come myself to find out why such a thing would happen.

    “What I heard is that one DC Operation brought them here. He withdrew the policemen that were already here protecting this place so that his officers will take over the place.

    “But I have to say this on a very strong note: we have been taking enough nonsense from this institution. Everybody is aware of the court judgement. Did the ruling specify anywhere that election should not hold?

    “It said don’t give voter register. What are we doing with it? Police don’t provide security. Is it the same thing as blocking the election? I don’t know what the relationship is between the IGP and one person who claims he has so much power in the state.

    “I don’t know the relationship because it is beginning to go beyond the normal professional relationship. I said the government wrote a letter with the judgement that we have to him and what he is acting on is what he called the judgement he got from the Federal High Court.

    “Even if we go by the Federal High Court judgement, did it say election should be banned? Did Lifu, that judge that gave that fraudulent judgement, say no election? Rather he technically said don’t provide, don’t provide security.

    “We don’t need your security. We will provide our own security. After all it happened in Anambra. This election must hold. If you like whatever you want to do, do it. The election must hold, results will be declared and people will be sworn in.

    “What kind of country is this?  And when it comes to the issue of Rivers State it becomes different.

    “You have to be ashamed of yourself. You call yourself IGP. Enough is enough. If I go back and hear anything, I will come here. This is my property and you don’t have any power whatsoever to bar me from entering it.

    “Just try it and part of your history will include shooting Fubara. I think I have given you enough respect.

    “Well, let me say it to all Rivers indigenes, everyone residing in Rivers, election will hold. Anything that wants to happen, let it happen.”

    The Governor’s Chief Press Secretary (CPS) Nelson Chukwudi followed up with a statement claiming that his boss foiled an attempt by some policemen to scale the gates and the strong room of the commission.

    The aim, he said, was to cart away sensitive electoral materials meant for the conduct of the election.

    He accused the Inspector-General of Police of ordering the deployment of policemen to the RISIEC premises with a view to taking it over.

    He said the attempt to surreptitiously withdraw policemen already protecting the facility and replace them with a detachment from a neighbouring state was unacceptable.

    He said the local government election is the internal affairs of states.

    We’ll enforce court judgment, Force insists

    The Police appear undaunted by the governor’s action as the force has directed its commanders in the state to enforce the Federal High Court’s judgement against the conduct of the elections.

    The Police Public Relations Officer (PPRO), Grace Iringe-Koko, citing a July 19, 2024 restraining order of a Federal High Court Abuja, said the police and other security agencies would not be providing security during the poll.

    The force, she said, had also been advised by its Legal Department to comply with a judgment of the Federal High Court dated September 30, 2024, which barred the police from allowing, participating in, providing security for, or taking part in the Rivers State Local Government Election.

    She said: “Given these circumstances, the Nigeria Police Force has been advised by the Force Legal Department that the ruling from the Federal High Court on September 30, 2024, takes precedence.

    “Recently, an opposition party protested, calling for adherence to the court orders and expressing their determination to prevent any disregard for the law.

    “The Nigeria Police Force encourages all parties to seek appropriate legal redress if they feel aggrieved by any decisions or actions related to the election process.

    “The Nigeria Police Force is dedicated to maintaining law and order and will not stand idly by in the face of potential disturbances.

    “Necessary actions will be taken to enforce the court’s orders. All Area Commanders, Divisional Police Officers and Tactical Commanders have been directed to ensure full compliance with the judgment of the Federal High Court.”

    The statement called on all other security agencies to comply with the Federal High Court judgment.

    “In the light of these developments, the Nigeria Police Force calls on all citizens to remain peaceful and orderly and to cooperate with law enforcement in upholding the rule of law during this crucial period,” the statement said.

    Why we deployed fresh personnel to RSIEC – Police

    The Rivers State Police Command denied allegation that its personnel deployed to RISIEC wanted to cart away sensitive electoral materials.

    It said: ‘It should be noted that Policemen from the Rivers State Government House were initially deployed to the River State Independent Electoral Commission (RSIEC) but were withdrawn in response to the Federal High Court ruling of September 30, 2024, barring the Police from participating in the scheduled elections.

    “Conversely, in reaction to credible and actionable intelligence received about plans by hoodlums to carry out an arson attack on the RSIEC office, police personnel were deployed to secure the premises.

    “The Rivers State Police Command remains committed to our duty to maintain the peace and ask residents of Rivers State to act within the confines of the law. The Police will do everything to maintain law and order.”

    Police reject Fubara over ‘weighty allegations’ against IGP, insist they’re neutral

    The Force Headquarters last night denied allegation of partiality leveled against the Inspector General by the Rivers State governor.

    The Force Public Relations Officer, Olumuyiwa Adejobi, dismissed the allegations as weighty and unfounded.

    He said: “The Nigeria Police Force has noted with concern the recent statements made by the Governor of Rivers State, His Excellency Siminalayi Fubara, in which several unfounded allegations were leveled against the Office of the Inspector-General of Police and the Nigeria Police Force. In light of these claims, it has become necessary to set the record straight.

    “Firstly, it is important to clarify that there is a subsisting Federal High Court order barring the Nigeria Police Force from participating in the Rivers State elections. This order was duly served on both the NPF and the Rivers State Government.

    “As a law-abiding institution, the IGP instructed the Commissioner of Police in Rivers State to strictly adhere to this court order by refraining from any direct involvement in the election process.

    “However, in the evening of 3rd October, 2024, the Commissioner of Police in Rivers State received reports that policemen from Rivers State Government House have been deployed to the office of Rivers State Independent Electoral Commission (RIEC) to aid the conduct of the election.

    “This report was also relayed to the Inspector-General of Police who gave clearance to the Commissioner of Police to withdraw the policemen from the Government house and replace with policemen from the Command Operations Department. The mandate of the men from the Operations Department was to provide overnight security for the RIEC to prevent any attack on the facility.

     “It is also important to note that prior to this, there had been series of security breaches in the state following the spate of court orders and counter orders and reactions to them by supporters of the different political parties involved. The response of the Command to secure RIEC overnight was therefore professional and supported by the Inspector-General of Police.

    “For emphasis sake, the policemen deployed to RIEC from the operations department of Rivers State Command on the night of 3rd October, 2024 were with the sole mandate to protect the RIEC office from attack overnight. This action was proactive and responsive to intelligence at the disposal of the State Command.

    “It is therefore shocking to see the state governor storming the RIEC office at night, wrongly accusing the police on lawful duties, deriding the Police institution and using unprintable words to describe the Inspector-General of Police.

    “The Nigeria Police takes exception to the unwarranted outburst of the Governor and particularly the weighty accusations which he falsely leveled against the Inspector-General of Police and the entire Nigeria Police Force and advise caution and decency in the pursuit of individual political goals.

    “Threatening to shed blood and to burn down the State because of a Local Government election is not acceptable to us. The Nigeria Police Force is committed to protection of lives and properties and will work with other security agencies in Rivers State to ensure that there is no breakdown of law and order in the State.

    “To this end, the Inspector-General of Police has ordered increased deployment into Rivers State to beef up security throughout the state. Citizens of Rivers State are advised to go about their lawful businesses.”

    ‘Police presence inconsequential to our election, says Gov

    The governor responded to the police statement during a press conference at the Government House later in the day.

    He said it was clear that the police had decided to serve the interest of an Abuja-based politician to scuttle the Local Government election.

    But he vowed that nothing would stop the election.

    He said everything that needed to be done about the election had been finalised and voters sentisitised because of their high confidence levels.

    Fubara said even the police had been informed and were expected to discharge their statutory professional security duties, particularly because the court also directed so in its judgement on the election.

    His words: “In the early hours of this morning (Friday), I got a security report that the Rivers State Independent Electoral Commission (RSIEC) office has been invaded by the Nigerian Police.

    “I was really surprised because before that time, I got a copy of a signal withdrawing the police officers that were guarding the premises. So, I had to drive to the place myself since the facility belongs to Rivers State Government.

    “Getting to the scene, and to the shock of everyone who accompanied me there, I met some fierce looking policemen in one truck and three other empty Hilux vans trying to force their way into the premises, and, I had to stop them.

    “In the process, we discovered that that movement (operation) was a deliberate attempt by the Nigerian Police Force, both the Rivers State Command and the Headquarters (Abuja), to steal the electoral materials. But by the special grace of God, that act was foiled.”

    Fubara said the Nigeria Police had stooped so low that they allowed their officers to engage in such illegal acts that clearly suggested that they had become enemies of Rivers State.

     Fubara wondered why the Nigeria Police would attempt to take over control of RSIEC or be used to stop a democratic process that was ongoing, which would lead to the emergence of elected political leadership at the local government councils.

    Fubara said: “Here are the questions: first, the Rivers State Independent Electoral Commission, is it not an agency and a process that is being controlled by the State Government? Is it not a system that is governed by the law of the state? Why is Rivers State’s case different?

    “The second part of it is: what is the special thing about this issue of taking over the premises by the police? If we should go by what they claim that they had a court order, the court ruling said don’t give RSIEC voter register, don’t give RSIEC police protection. Did the judgment say they should seal the premises? Or don’t allow them conduct election?”

    Continuing, he said: “However, the Rivers State Government and RSIEC itself also had a judgment that states clearly: conduct the election with the voters’ register of 2023; and police, DSS, Nigeria Army and other sister agencies should provide security.

    “I might not be a lawyer, but I understand clearly that when it comes to the issue of judgment, there is something they call first- in-time.”

    Fubara asked if there was any other court unknown to him that was bigger than the Supreme Court of Nigeria, whose judgment concerning a proper constitution of elected Local Government Councils was being obeyed in Rivers State.

    The governor said that among all the security agencies, it was only the Nigeria Police that was acting so strangely and had become a threat to the nation’s democracy.

    He said:  “Why are they looking for a way to stampede this state? The Supreme Court gave a judgment that all local government activities must be conducted by elected officers.

    “The President of the Federal Republic of Nigeria, in agreement with the state governors, directed compliance to this judgment within 90 days with effect from the judgment date.

    “And all other states are conducting election to ensure that they comply with the directive, not just the Supreme Court ruling but also going by the understanding that we have with Mr. President.

    “And what Rivers State is also doing is not different from others. And the big question is: is any other court bigger than the Supreme Court?”

    He said: “Is it not better if you feel aggrieved, if you feel you don’t want to participate in the election that you should go to court?

    “Why do you want to stop the process of election, to create problem, to create anarchy in the state? We are already complaining of suffering, people are hungry, and you want to stampede the local government civil servants in the state.

    “On the issue of security, if the police feel they don’t want to be part of the election, they should withdraw.

    “I am saying this here so that the Inspector General of Police will be aware, and also know that any act against the peace of this state, anything that will bring a situation of lawlessness in this state, if it happens, I think at the end of the day, he should be prepared to take responsibility.

    “Why is the case of Rivers State different? Is it that the law or the Constitution of the Federal Republic of Nigeria, when it comes Rivers State, it is to be interpreted in a different way?

    “This press briefing, if you listen to me, I am not crying. I am not also calling the international community (for help). When they have their own press briefings, they call on the international community (for help). I am not calling international community.

    “But from here, I just want you to know that we are prepared. Once in the lifetime of every man, you need to stand on the side of truth, and even if it will take your life, history will not forget you.

    “Great Martin Luther King, today we talk about him. We talk about him because he stood for what was the truth, and his life went in. And if I am going to be that Martin Luther King of Rivers State, so be it!”

    Fubara said the Rivers State Government sent a copy of the judgment of court mandating that the election should hold to the National Security Adviser (NSA), Inspector-General of Police (IGP), Director, Directorate of State Security (DSS), and other security agencies, which he believed had been communicated to Mr President.

    He said: “On the aspect of the Police withdrawing their services, I don’t think police (are) supposed to be part of the election process.

    “What police should do is to protect lives and property, ensure that nobody comes to cause a fight or burn people’s property.

    “In fact, police don’t need to be close to the polling units or the voting centres. What is important is for them to ensure that the lives of the people of Rivers State are protected, and their properties are protected.

    “On the issue of the election, I don’t think if they withdraw their services, it is going to mar the process. Not at all!

    “So, if the police are not providing (security), I strongly believe that some other agencies will provide security for the election.”

    Rivers PDP to Fubara: obey court order; announcing results invitation to violence

    The local chapter of the PDP warned the governor of the consequences of disobeying the Federal High Court judgment on the conduct of the local government elections.

    The PDP State Chairman Chukwuemeka Aaron said that participating in or conducting elections contrary to the court’s judgment would be unlawful.

    He said: “The PDP, having reviewed all the cases relating to the local government elections, concludes as follows:

    “We cannot support or promote lawlessness or impunity in any from whatsoever even though we are the ruling party in Rivers State.

    “The proper court judgment must be obeyed as we cannot choose which order of the court to obey and not to obey. 

    “We, therefore call on the Rivers State Governor who incidentally is a member of our great party, the PDP, to obey and comply wholly and strictly with the judgment of the Federal High Court in line with our character and ethics of our party, the PDP and suspend the planned October 5 Local Government elections in Rivers State.”

    Aaron commended the Independent National Electoral Commission (INEC) for standing by the truth and complying with the court’s judgment.

    He said INEC had clarified that it did not release the Voters Register to the Rivers State Independent Electoral Commission (RSIEC), a critical requirement for the elections.

    He added: “We also call on our members and indeed the law-abiding residents of Rivers State to defend the rule of law ensuring full compliance with the judgment from the Federal High Court.

    “Nobody should participate in or allow the conduct of any local government elections in deviance from the judgement of the Federal High Court.

    “We want to thank the INEC for standing on the part of the truth, clearing the air on the non-release of Voters Register to RSIEC and for complying with the Federal High Court judgment.

    “We also commend the Nigerian Police for standing up to the Federal High judgment being the latest on the Rivers State Local government elections.

    “We want to caution that any attempt to announce any results whatsoever will be an invitation to violence and will be properly revisited as no election will be held in Rivers State on the 5th of October as ordered by the court.

    “We enjoin the general public to disregard any announcements calling for the October 5 local government elections, for the same is a call for crisis and which will not be in the interest of Rivers People.

    PDP national disagrees, says state ready for poll

    However, the national leadership of the PDP expressed support for Fubara on the election.

    The party’s national publicity secretary, Debo Ologunagba, said in Abuja yesterday that since RSIEC has confirmed its readiness and possession of the necessary materials to conduct the election, no court under the Electoral Act 2022 can halt the process.

    He asked the people of the state to firmly assert their sovereignty and constitutional right by coming out en masse to vote today.

    He said: “The PDP insists that the right to civil control of democratic activities in Rivers State as a federating unit belongs to the generality of the people of the state, and such right, including participation in local government election cannot be abridged or appropriated by any person, group or organisation under any guise whatsoever.

    “The party maintains that the people of Rivers State are ready for election; the Rivers State Independent Electoral Commission (RSIEC) had also announced its readiness, preparedness and possession of necessary operational materials to conduct the election in line with the pronouncement of the Supreme Court and NO COURT under the Electoral Act 2022 (as amended) has the power to stop elections.

    “For the avoidance of doubt, Section 84(15) of the Electoral Act, 2022 provides that nothing in this section shall empower the courts to stop the holding of primaries or general elections, under the Act pending the determination of a suit.

     “The reported invasion of RSIEC facilities by police operatives allegedly to frustrate the conduct of the election is a direct affront to our democracy and the Rule of Law; an attempt which was firmly resisted by the people of Rivers State who are resolute to express their Will at the poll.

    “The Inspector General of Police should note that he is duty bound under the Constitution to provide the enabling and secure environment for the smooth conduct of the Rivers State Local Government Area election irrespective of where he stands as an individual.

    “Duty calls on him to act professionally in the overall interest of our hard-earned democracy and the stability of our nation, Nigeria.”

    APP recognises Nwokekoro, disowns factional group

    Support for the LG poll also came from the national leadership of the APP with the party’s National Chairman Chief Uche Nnadi, declaring Chief Sunny Nwokekoro as authentic Chairman of APP in Rivers.

    He disowned the faction that had opposed the Fubara candidates, describing them as mere impostors who have never been party officials and should be arrested and prosecuted.

    The chairman in a statement in Abuja on Friday said Nwokekoro replaced Hon Kenneth Atata, the former state chairman.

    Nnadi claimed that the decision of RISIEC to go ahead with the election is backed by a court judgement.

    He asked the Inspector General of Police to “be mindful and not allow the police institution to be further ridiculed by taking partisan positions. The RSIEC is under the command of a judgment of a court of competent jurisdiction to conduct the said election, and the Police cannot interfere with that order.”
