  • Army confirms loss of personnel, equipment in Yobe Attacks

    The Nigerian Army on Saturday confirmed that it lost vehicles, personnel and equipment to the recent Boko Haram terrorists’ attacks in Geidam, Yobe State.

    It however asserted that troops of 159 Battalion responded to the attacks with a show of gallantry leading to the routing of the insurgents in the area.

    The insurgents, according to a statement by the Assistant Director, Army Public Relations in charge of Sector Two, Lt. Njoka Irabor, took advantage of the market day in Geidam to loot foodstuffs.

    Lt Irabor said the troops handled the situation with professional acumen to prevent civilian casualties for which they were commended by the Acting Commander of the sector, Brig General Mohammed Dala.

    Lt Irabor said :”Troops of 159 Battalion deployed in Sector 2 of Operation LAFIYA DOLE in Geidam , Yobe state, have been lauded for their display of gallantry at containing Boko Haram Terrorists (BHT), who infiltrated the serene  town of  Geidam on Wednesday, 23rd  January 2019, at about 5:30pm, shooting sporadically, thereby creating panic and causing unnecessary apprehension.

    ” The Acting Commander Sector 2, Operation LAFIYA DOLE, Brigadier General Mohammed Dala, gave the commendation today, during an on the spot assessment visit to Geidam.

    “He commended the troops for their gallantry and deliberate effort in protecting the civil populace in the town, particularly at the Geidam market.

    “He directed the immediate replenishment of the troops’ supplies, assuring them that issues of their welfare will always be a top priority.

    “The BHTs, who came to loot foodstuffs and other items, took advantage of the market day in Geidam to infiltrate the town and attacked the military base.

    “The troops displayed a high sense of professionalism by discretely engaging the terrorists with less sophisticated weapons in order to minimize collateral damage with the attendant civilian casualties.

    “Sadly however, the troops, in the process suffered some casualties in vehicles, equipment and personnel.

    “The Sector Commander seized the opportunity to pay a visit to the Emir of Geidam and afterwards had a meeting with officials of other security agencies, where he sued for their cooperation and synergy in sharing timely information that would enhance the pro-activeness of  troops.

    “He further reassured them, that troops will continue to carry out aggressive patrols and offensives to deny Boko Haram and other criminal elements freedom of action.

    “He further urged the good people of Geidam and Yobe state in general, to go about their lawful businesses, as the troops are committed to the protection of lives and property, as well as working round the clock to forestall any attempt by groups or individuals to cause breakdown of law and order in the state.

    “The Commander however warned that anyone identified as a BHT collaborator will be arrested and made to face the full wrath of the law.   “

    The Chief of Army Staff (COAS), Lieutenant General Tukur Buratai has condemned the attitude of troops deployed to Geidam in the fight against Boko Haram terrorists group.
    He spoke in Lagos during his maiden tour of units and commands under the 81 Division of the army.
    Referring to the poor performance of the troops, Buratai emphasised the need for serious review, the attitude of the troops towards the ongoing war.
    He noted that despite having the necessary weapons, equipment that will enable them protect themselves, civilians and properties, they did not attack the insurgents.
    “Two, three days back, I was in Geidam and the attitude of our troops call for serious review because they have the equipment, weapons, everything they require to protect themselves and indeed citizens that are there, the whole community and villages around.
    “But, they just went and sat down without adopting the proper battle procedures. These are the attitudes we have been suffering all these while.
    “I have given them very strong warning. And some of you may find yourselves around that area, if you go there, you must behave very professionally.
    “You must apply all the battle principles that you have been thought, deploy the weapons and equipment properly,” he said.
    While fielding questions from reporters after addressing his soldiers, Buratai said he had to go to Geidam to see things for himself, assuring that the loopholes are being addressed.
    “Immediately after my visit, the following day (Friday) they (terrorists) attempted to move into Geidam but the soldiers stood up and conquered that attack. They pursued them and the terrorists have been on the run.
    “So, that issue has been addressed and we want to maintain that capability to ensure we repeal and equally pursue them to wherever they go to.
    Buratai also warned army personnel to remain apolitical, stressing that their moves were being monitored and anyone found romancing politicians will be dealt with accordingly.
    He said: “I want you to remain professional, apolitical. Any officer or soldier seen hibernating with politicians or getting involved in politics of whatever nature will not be tolerated. If he is caught, he will be dealt with accordingly.”
    The army chief also insisted that the December deadline given by President Muhammadu Buhari for the military to end Boko Haram was achievable.
    “Fighting I s urgency require alot of resources, initiative. The renewed commitment of the government of President Muhammadu Buhari,  increased equipments that we have been providing to the troops; increased troops with the deployment  Special forces in key and critical areas have contributed in motivating the troops.
    “We are addressing their welfare needs as at when due, so all these contributed and it is changing the tide against the terrorists. We will definitely meet the target,” said Buratai.
    According to him, priority was given to the various operations the army is involved in with the northeast and Niger Delta areas coming first and second respectively.

    Report reaching The Nation in Damaturu indicates that some Boko haram terrorists are currently engaged in a fierce fighting with security agencies in Geidam town north-east  of Yobe State, residents and security sources have said.

    Geidam is one of the major commercial towns of the state and is located 183 kilometers north of Damaturu the state capital. It also one of Nigeria’s border towns with Niger Republic.

    Residents Modu who ran to the bush told our correspondent on phone that the insurgents are currently exchanging gun fire with security agencies with many residents fleeing to the bush.

    Modu said sporadic shooting and explosives were being detonated across the town causing fear and panic in residents.

    The Police Public Relations Officer in the state ASP Toyin Gbadegesin who confirm the attack said he cannot categorically explain what is happening at Geidam but that the combined security on ground are in control of the situation.

    He also calls on the people “to continue to partner with security agents towards the restoration of peace in the state and the country at large.

    Geidam town was last attacked by Boko Haram in March this year  with residents fleeing into Meine-Soroa in Niger republic.

    Details of the casualty was not  clear.

    Geidam: A governor’s many legal hurdles

    As all newly elected officials settle down for business having survived the challenges of electoral contest, Eric Ikhilae examines the case of the Yobe State Governor, Ibrahim Geidam, who is faced with multiple court cases.

    Along with other governors, who were victorious at the last governorship election, Ibrahim Geidam of Yobe State took his oath of office on May 29, heralding the commencement of another four years in the saddle.

    But, unlike some lucky ones, whose elections are not contested, Ibrahim’s renewed mandate is being attacked on many fronts by his adversaries.

    At the last count, not less than three cases have been instituted against his re-election; two pending at the Federal High Court, Abuja, while the others are before the state’s Governorship Election Petition Tribunal, also sitting in Abuja.

    While the two before the Federal High Court are challenging his eligibility to contest the last election, the one before the tribunal is querying the outcome of the election.

    Geidam was deputy governor to the late Mamman Ali, but assumed the governorship position following the governor’s death in January 2009. He won the 2011 governorship election. Again, he emerged victorious in the April 11, 2015 election as the candidate of the All Progressives Congress (APC).

    One of the cases before the election tribunal was instituted by the Peoples Democratic Party (PDP) candidate in the April 11 election, Alhaji Adamu Maina Waziri. He hinged his challenge on the outcome of the election primarily, on allegation of electoral malpractices.

    Waziri, a former Minister of Police Affairs, who reportedly told a crowd of supporters after the election results were announced that: “I have not conceded defeat or congratulated Governor Ibrahim Geidam for the simple reason that I have some disputes to settle with the result of the election.” He  claimed in his petition, that the INEC’s Resident Electoral Commissioner (REC) in the state was induced three days to the election.

    Pending before Justice Ademola Adeniyi of the Federal High Court, Abuja is a suit by Mustapha Yunusa Maihaja, in which he claims that Geidam was also not qualified to have stood for election, having allegedly presented forged academic certificate.

    He contended in part, that Geidam presented a school certificate dated December 1969 whereas there was no Borno State Government of Nigeria in existence in 1969 because the Borno state was created February 3, 1976 as Yobe State was created out of Borno State August 27, 1991.

    Maihaja further contended that there was no Local Government Education Authority (LEA) in existence as at December 22, 1969 under the North- eastern region, which was the legal entity at that time that purportedly issued the certificate.

    He wants the court to declare, among others, that Geidam was not qualified to have contested the 2015 Governorship Election in Yobe State either under the All Progressives Congress (APC) or any other political party.

    The plaintiff equally urged the court to nullify and void the nomination of Geidam as the “APC governorship candidate in Yobe State for the 2015 governorship election in the event it agrees with his submissions.

    Justice Ademola reserved ruling, last month, in an ex-parte application filed by the plaintiff for leave to serve the governor court processes in the suit, through substituted means.

    Maihaja hinged his application on the ground that he had encountered difficulties in his attempt to serve Geidam, as security personnel attached to the governor allegedly made it practically impossible to effect personal service on him.

    Two politicians, Ayuba Sabo and Ahmed Abubakar, who were governorship aspirants and members of the All Progressives Congress (APC), like the governor said they have also filed a petition before the tribunal, aside the pre-election case they filed against him before the Federal High Court, Abuja.

    The plaintiffs are by the suit, challenging Geidam’s eligibility to contest the April 11 governorship election.

    They argued that if Geidam was allowed to contest in the election and declared winner, he would be spending the third term in office, contrary to the provisions of the constitution.

    The plaintiffs relied on the provisions of Sections 180(2)(b) and 182(1)(b) 191(1) of the constitution, arguing that Geidam, having taken the oath of office on two occasions, was no longer eligible to contest the April 11 election.

    In a supporting affidavit, they averred that with Geidam’s re-election he “will end up spending three terms of a period of 10 years and four months, against the provision of the 1999 Constitution which allows for two terms of a period of eight years, with each term being just four years”.

    The plaintiffs, through their counsel, Chief Adeniyi Akintola (SAN), submitted 10 issues for determination.

    Their prayers read: “A declaration that having regard to the provisions of the Constitution of the Federal Republic of Nigeria 1999 (as amended) it is not unconstitutional, unlawful, illegal and not permissible for any person to occupy the office of a governor of a state of Nigeria for more than a cumulative and or aggregate period of eight years when it is practicable to hold election into the office of the governor of Yobe State.”

    “A declaration that by virtue of section 180(2)(b) of the 1999 Constitution of the Federal Republic of Nigeria (as amended), the tenure of office of Alhaji Ibrahim Gaidam, the 1st defendant herein, as the governor of Yobe State, began on May 29, 2007 when he took the oath of office as the deputy governor alongside the last holder of the office, the late Mamman Ali, thus making his two terms terminable on May, 29, 2015, having won the second term in May 2011.

    “An order of injunction restraining the first defendant from contesting or attempting to vie for the office of the governor of Yobe State, or occupying same after 28 May, 2015, when his tenure, compromising two terms of eight years shall by the constitution would have come to an end.

    “An order directing the second defendant not to countenance the name of the 1st defendant submitted to it as a candidate in the forthcoming governorship election of Yobe State slated for April 11, 2015.

    “An order of perpetual injunction, restraining the first and second defendants, their servants, agents, privies whatsoever or howsoever called, from presenting or accepting as a candidate, for the elections to the office of the governor of Yobe State, the first defendant as an aspirant, having been caught by extant provision of the Constitution with regard to the ‘two previous elections’ limit and two terms of eight years.”

    On May 11, Justice Ahmed Mohammed, while ruling on the plaintiff’s ex-parte application for leave for substituted service, ordered that the governor and the Independent National Electoral Commission (defendants) be served through newspaper publication.

    The judge also ordered that Geidam and INEC to respond to the suit within seven days after the publication.

    There is also a similar suit by a researcher and public affairs analyst, Nkemjika Nkemjika and a politician from Yobe State, Sheik Musa. They argued, in an originating summons, that Geidam exhausted the two-term limit allowed by the Constitution on May 29, 2015 having assumed office in 2009 when the then governor died before the completion of his tenure.

    Nkemjika and Musa want the court to declare, among others, that Geidam was not qualified to stand for election under any political party “having regards to the provisions of Section 180 (1) (b) and 180 (2) of the 1999 Constitution as amended to stand for the 2015 Governorship Election in Yobe State either under the platform of the APC or any other political party.”

    Geidam and other defendants in the cases were yet to respond as  and  when filing this report. Time however, will tell if the governor will successfully navigate these legal hurdles.

    Large turn-out as Yobe holds LG elections amid security challenges

    After several postponements, local government elections in Yobe State took place yesterday across the 17 local government areas of the state amid security challenges.

    Turnout was unexpectedly high with Governor Ibrahim Gaidam who cast his vote in his village at the Bukarti Primary School Polling Unit amidst cheers from the crowd describing the turn-out as “impressive and encouraging.”

    Our correspondent who monitored the elections in some villages of Damaturu, Tarmuwa, Bursari, Bade, Geidam and Yunusari observed that voting began as early as 8am.

    The election was generally peaceful and the logistics fair.

    There was, however, heavy security presence in all the polling booths as well as major streets in Damaturu with soldiers, police, civil defence corps and immigration officers on alert.

    Shops and other businesses were closed while restriction on movement was imposed throughout the state from 8 a.m. to 3 p.m.

    Reports from other parts of the state also spoke of security build up to forestall any unforeseen circumstances.

    The Peoples Democratic Party (PDP) in the state opted out of the election, citing security challenges and the state of emergency in the state.

    However, the State Independent Electoral Commission decided to go ahead with it because the emergency rule excludes democratic structures in the state.

    Gov. Gaidam after casting his vote expressed happiness that the day went without any reported case of violence in any part of the state.

    He, however, told his detractors whom he described as ‘Abuja politicians’ to hide their faces in shame, adding that the successful election has rubbished the impression about insecurity in the Yobe State being created by the Independent National Electoral Commission (INEC) ahead of 2015 general elections.

    Some of the election observers who spoke to our correspondent commended the State Government and the State Electoral Commission for their courage to conduct the election.

    Dr. Hanatu Binyat, Executive Chairman of Kaduna State Independent Electoral Commission, noted YSIEC has demonstrated that SIECs are capable of holding elections at all levels in the country.

    Mr. Femi Bafunsho, Chairman Justice and Equity for All, an NGO, who observed the conduct of the polls, said the turn out in most polling units was commendable.

    The Chairman of the State Independent Electoral Commission, Hajiya Hannatu Binyat, told NAN that reports received from across the state spoke of a peaceful conduct of the election and congratulated the people for a successful exercise.

    Coordinator of NGOs monitoring the election in the state, Ali Abatcha noted that the election is a litmus test for people who believe that elections cannot be held in the state in 2015.

    Member representing Geidam, Yunusari, Bursari Federal Constituency, Goni Bukar described the election as a triumph for democracy.

    According to him, the successful conduct of the election is a testimony that peace has returned to the state and no political activity in the state can be subverted.

    Ten parties participated in the polls.

    The governors of Adamawa, Borno and Yobe states may go to court to challenge plan by President Goodluck Jonathan to use their states’ monthly allocations to fund the military operations in the states under the emergency rule.

    Governors Murtala Nyako (Adamawa), Kashim Shettima (Borno) and Ibrahim Geidam (Yobe) are said to have sought legal advice on the issue.

    They believe that since Defence is on the exclusive list in the 1999 Constitution, the Federal Government should solely fund the Special Forces deployed in the states.

    The governors are likely to seek judicial interpretation of Section 217 of the 1999 Constitution.

    The governors are unhappy with a section of the emergency rule proclamation which seeks to confer on the President power to manage funds meant for states and local governments under emergency rule.

    The section says: “Any Order made under sub-regulation (1) of this Regulation may in particular, if it appears to the President to be necessary or expedient for the purpose mentioned in the sub-regulation – make provision for the detention of any person either within the emergency area or elsewhere, removal and exclusion of any person from the emergency area; authorise the taking of possession or control of any property or undertaking in the emergency area; authorise the entry and search of any premises; provide for the application of any law (with or without modification), in relation to that area; provide for the utilisation of the funds of any State or Local Government in the emergency area; provide for the payment of compensation and remuneration to persons affected by the Order; provide for the apprehension, trials and punishment of persons offending against the Order; and provide for the maintenance of such applies and services as the President considers essential to the lives of persons in the emergency area.”

    Investigation revealed that the legal advisors had on Friday started consultations with the Attorneys-General of the three states, who will report to the governor.

    Sources in Borno State said: “The three governors are already weighing legal options. The three states are taking the legal measure as they are not prepared to take chances which is why they are trying to work well ahead so that they are not caught unawares.

    “The three state governments believe that controlling their funds would amount to a clear breach of the constitution because the emergency Proclamation Bill, 2013 that gave the President powers to spend funds meant for states or local governments in areas of emergency rule is in conflict with the constitution and the legal effect of declaration of emergency in an area simply means that citizens are deprived of certain fundamental human rights because of the security issues involved.

    “All laws no matter how important they may be to the governance of the country cannot supersede the provisions of the constitution because of the supremacy of the constitution which the President and every sworn public officer has an obligation to preserve and protect.

    “The constitution does not in any section remove the executives or dissolve democratic structures and relief them of their functions.

    “Power to spend funds meant for states and local governments is constitutionally vested on the chief executives of the state and local governments being second and third tiers of government directly benefiting from the statutory allocation of the federation.

    “So, any attempt by the President or any other person appointed to act in that behalf is unconstitutional, illegal, null and void and of no lawful effect whatsoever. In addition, it will be a fragrant abuse of the constitution to tamper with funds accruable to these tiers of government and in this case, Borno, Yobe and Adamawa states which are all federating units like the federal government.

    “Moreover, the provision of security is squarely within the Exclusive Legislative list of the constitution which is purely the responsibility of the federal government to protect the lives and property of its citizenry through security agencies.

    ” Basic social amenities like water, healthcare, education, welfare of the citizens fall within the concurrent legislative list of the constitution which both the federal and state governments are to provide.

    “This clearly means it is the exclusive duty of the federal government in the first instance to fund security services, so why should the President now deprive states of their funds to provide the concurrent legislative list to citizens.

    “This is purely unconstitutional and even a part two law student will deliver judgment against the President and the federal government.

    “Moreover, the states of Borno and Yobe have been the ones funding security operations since the deployment of troops under the JTF to the States, the federal government didn’t give them a dime, why should the President now even consider holding on their funds whereas they have been discharging his own functions?”

    President Goodluck Jonathan will on Thursday embark on a two-day state visit to Equatorial Guinea, the Presidency has said.

    A statement signed by the Special Adviser to the President on Media and Publicity, Dr. Reuben Abati, said the visit was in continuation of Federal Government’s efforts to boost economic and trade relations between Nigeria and neighbouring countries.

    Abati said the president would, in the course of the visit, hold talks in Malabo with President Obiang Nguema Mbasogo on various issues of mutual interest to both countries.

    He said the issues included the enhancement of maritime security in the Gulf of Guinea, exploitation of oil and gas resources and the enhancement of developmental cooperation between both countries.

    “It is expected that new agreements on strengthening of economic relations and developmental cooperation between both countries will be concluded and signed before the end of the visit on Friday,’’ the News Agency of Nigeria quoted Abati as saying in the statement.

    The presidential spokesperson also noted that the president would meet with Nigerians resident in Equatorial Guinea before returning to Abuja.

    He said Governors Emmanuel Uduaghan and Ibrahim Geidam of Delta and Yobe States as well as Sen. Ibrahim Gobir and Mr. Cyril Egwuatu would be on the president’s entourage.

    Also on the entourage will be the ministers of petroleum resources, Mrs. Deziani Alison-Madueke, trade and investment, Dr. Olusegun Aganga, aviation, Princess Stella Oduah and culture and tourism, Dr. Edem Duke.

    The Minister of State for Defence, Mrs. Olusola Obada and the Minister of State, Foreign Affairs, Dr. Nurudeen Mohammed, are also on the trip.
